SAN JUAN COUNTY COMMISSION MEETING July 7, 2008 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Bruce Adams, Chairman Kenneth Maryboy, Vice Chairman Lynn Stevens, Commissioner Tammy Gallegos, SJC Administrative Assistant Norman L. Johnson, SJC Clerk/Auditor Dawn Shaw, SCJ Deputy Clerk Attendees: John Fellmeth, Paul Barr, Greg Adams, Maxine Deeter, Cody Deeter, Charlie DeLorme, Craig Preston, Walter Bird A motion to approve the minutes of June 23, 2008 was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Greg Adams - SJC Planning/Zoning & Paul Barr SJC Treasurer Greg and Paul reported to the Commissioners that the Brittany Homes Subdivision (A.K.A. Elk Meadows) has not paid their 2007 property taxes. They have consolidated the Subdivision from 126 lots to 86 lots. In order to get them out of the "dead file" they requested Commissioners to levy all taxes, penalties and interest onto the largest lot of land, all of which is owner by one person. A motion to approve the request to levy all taxes in the amount of $792.42, penalties in the amount of $1180 and interest in the amount of $105.22, was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commissioner Kenneth Maryboy was absent for the vote. Greg Adams - SJC Planning/Zoning Greg presented an Amendment to Phase I of the Mountain Homes Subdivision and presented Phase II of the same subdivision, for approval and signature. A motion to approve the amendment to Phase I and approve Phase II of the Mountain Home Subdivision, provided all appropriate signatures are in place, was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commissioner Kenneth Maryboy was absent for the vote. John Fellmeth - SJC IT John presented a request from the City of Monticello asking to use the mast on the Courthouse -1- for radio communications. A motion to approve the request, with the provision that the City provide a description of how they intend to use the mast, was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Walter Bird - SJC Personnel Walter presented a request to change Jim Eberling from Laborer with the North Road Department to County Weed Control Supervisor. With a change in Step from 33 to 114. A motion to approve the request made by Commissioner Kenneth Maryboy. Commissioner Lynn Stevens seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Walter presented a request to hire Sandra Strom as the permanent part time Mail Clerk for the Ec. Development Office, a Grade 1 Step 1 position. A motion to approve the request was made by Commissioner Kenneth Maryboy. Commissioner Lynn Stevens seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Walter presented a request to enter into an independent contract with Evan Lowry, who has recently retired from SJC as the Planner/GPS. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Charlie DeLorme - SJC Ec. Development Charlie presented two out of state travel requests. One is to Fort Myers, FL for the TIA's educational seminar for travel organizations, in the amount of $2051.80, and one to Torrance, CA to meet with Japanese tour operators to discuss new travel products in Utah, in the amount of $1092.30. A motion to approve both travel requests was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Cody Deeter - Lewis, Young, Robertson, & Burningham Financial Firm Cody presented a short report to Commissioners about the Financial Firm he works for stating that they would be interested in helping SJC finance the PSB. Commissioners thanked Cody and asked him to get in touch with Rick Bailey. Norman L. Johnson - SJC Clerk/Auditor Norman presented the Certified Tax Rate for 2008. Following a discussion a motion to adopt the Tax Rates for 2008 was made by Commissioner Kenneth Maryboy. Commissioner Lynn Stevens seconded the motion. None opposed. Norman reported to the Commissioners that he has received a GRAMA appeal from Carla Lyman concerning her sons death. Commissioners agree that she needs to be provided with the information but that she has got to communicate with Sheriff Lacy. Tammy Gallegos - SJC Administrative Assistant Tammy presented one building permit fo approval and signature. Mike Langersmith - Barn - Oak Brush Road, Spanish Valley A motion to approve the building permit, provided all signatures are in place, was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Tammy presented to grants for signature for reimbursement on the La Sal Senior Center. One was from USDA in the amount of $100,000 and one was from the CIB in the amount of $120,000. She also presented grant papers for signature for the Bluff Fire Truck. Bruce Adams - SJC Commissioner Commissioner Adams lead a discussion on the Bookmobile that is here in the County saying that the State is limiting the areas it services. In fact, over the last few years, the area the bookmobile covers has decreased quite a bit. Commissioner Adams plans to attend a Library Board Meeting this Thursday and wants to bring up this issue. Commissioner Stevens said he would attend the meeting as well. Commissioner Maryboy wants to talk to residents on the Reservation and get their comments on it. Open Time and Other Business Craig Preston, SJC Hospital, reported that the SJC Hospital Board is having a hard time finding a person to fill the a board member position from the Oljato Chapter. He presented a request to have an amendment to the resolution drawn up stating that an "At Large Native American" can fill this position to represent those on the reservation. Commissioners agreed that this would be a good solution to this ongoing dilemma. -3- Commissioner Stevens addressed an issue about SUA bringing a lawsuit against Kane County for improper use of signs and roads. UAC has asked for Counties to put up funds for the appeal in this lawsuit. A motion to comply with UAC and donate $10,000 was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commission Reports Commissioner Maryboy attended several meetings over the last week concerning the UNTF issue. There is still a lot of controversy and argument about "Who" should be the trustees of the trust fund. Commissioner Stevens reports that he received a letter from UNHS stating that they are no longer able to afford to keep the Montezuma Creek swimming pool open. They are considering converting the pool area to a floor and using it for basketball, etc., stating that it would cut down significantly the cost of running and maintaining. They requested comments, suggestions, or support to this idea from Commissioners. He attended the UAC pre meeting and CEU Board of Trustees meetings last week. He plans to attend the Library Board Meeting this week. Commissioner Adams reports that he will be in the County all week. Norman L. Johnson - SJC Clerk/Auditor Canvass of 2008 Primary Election 12:30 P.M. Norman presented the individual poll books and documentation on the final totals for the Primary Election. A motion to approve the results was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried.
