SAN JUAN COUNTY COMMISSION MEETING October 20, 2008 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Bruce Adams, Chairman Kenneth Maryboy, Vice Chairman Lynn Stevens, Commissioner Rick Bailey, SJC Administrator Norman L. Johnson, SJC Clerk/Auditor Dawn Shaw, SCJ Deputy Clerk Attendees: Cyndi Eldredge, Scott Burton, Bill Boyle, Jeff Nielson, John Fellmeth, Steve Bradford, Kris Black, Jim Morrell, Mike Lacy A motion to approve the minutes of October 13, 2008, with corrections, was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commissioner Bruce Adams abstained from the vote. Cyndi Eldredge - SJC Personnel Cyndi presented a request to amend the October 13, 2008 minutes on the John Laws promotion. John was promoted to a Road Sargent at a Step 174. Cyndi stated that this should be a Step 184 position. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. John Fellmeth - SJC IT John presented a procurement request for a HP Laserjet P4015x printer from Tiger Direct in the amount of $1479. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Bruce Adams seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Commissioner Kenneth Maryboy was not present for the vote. Evan Lowry - SJC Planning/GPS Evan reported to the Commission that the US Geologic Survey stated that they can only cover $13,000 of the $29,000 in joint funding for water gauges at the North and Spring Creeks. After discussion, Commissioner Lynn Stevens made a recommendation of Evan exploring other options. Commissioner Kenneth Maryboy seconded the recommendation. None opposed. Commissioner Bruce Adams declared the motion carried. -1- Evan presented a request to come up with a new contract with Earl Hindley, who does photo compare work with the County. A motion to approve the request was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Steve Bradford - SJC Communications Steve presented three procurement requests. One for a 83" x 16' 2008 Diamond T Flatbed Trailer in the amount of $2,695 from Ol' West Trailers. A Top Gun Bumper and Grill Guard Wench in the amount of $2,950 from Davis Classic Detailing. And one for a AFA Technology Inc. 600- 999MHz Graphical Antenna Analyzer with Signal Generator in the amount of $795 from Tessco. A motion to approve the procurement requests was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. John Morrell and Kris Black - Regence Blue Cross Blue Shield John and Kris presented the Regence BC/BS coverage and cost package for 2009. A discussion ensued after Jim notified Commissioners of a 19.9% increase in administrative costs. Cyndi reported that their was a 13% increase last year for administrative costs. Cyndi stated that this is much higher than the 10% increase for health care costs. Commissioners asked Cyndi and Rick Bailey to look into this matter further because it does pose a concern for the County. Rick Bailey - SJC Administrator Rick presented one building permit for approval and signature. M. Vandewater - Residence - Brown's Hole, La Sal A motion to approve the building permit, provided all appropriate signatures are in place, was made by Commissioner Lynn Stevens. Commissioner Kenneth Maryboy seconded the motion. None opposed. Commissioner Bruce Adams declared the motion carried. Rick presented a proposed list, of items to be submitted to CIB, to Commissioners. The list consists of short term and long term items. He stated that if there was anything Commissioners wanted added to the list to let him know. Rick presented Commissioners with a letter that Brandy Tomhave, with the Tomhave Group, drafted to the BIA regarding County maintenance of Reservation Roads with in the County. The contract amount has been $81,000/year for over ten years. The letter is to find out if the contract will be recognized in the future as the County has not been able to ascertain the status of the contract with BIA or the Navajo Nation. Commission Reports Commissioner Lynn Stevens reports that the State Librarian was not able to come down last -2- week but she plans to reschedule sometime in the future. He plans to attend the Canyon Country Partnership meeting at Dead Horse Point this week and will be taking members from the State Parks Board of Directors, by horseback, to Hammond and Arch Canyons Friday and Saturday. Commissioner Maryboy reports he will be in Window Rock the rest of the week for the Navajo Nation Fall Session. Commissioner Adams reports he was out of the County last week and plans to be in the County this week. He will leave Sunday to go to New Orleans, LA for UCIP training all next week. Commission Public Hearing October 20, 2008: Mining Setback At 1:00 PM a Public Hearing was held to allow input on the proposed revision to the County Zoning Ordinance pertaining to mining setbacks. All County Commission were present along with (16) sixteen members of the public. Also present were the following County Staff; Walter Bird, Bruce Bunker, Greg Adams, Rick Bailey and Norman Johnson. Bill Boyle was attending representing the San Juan Record. Commission Chairman Bruce Adams welcomed those present and following a brief introduction of the purpose for this hearing and the appropriate ground rules to be followed opened the floor for input to the record. It was noted that the entire proceedings were being tape recorded. Comments were heard from; Phil Glaze, Bruce Bunker, Manuel Davis, Chris McAnany, Tom Williams, Brenda Glaze, Elizabeth Gore, Sam Lightener (by letter), Nancy Fletcher, Alan Clark and Rick Lamb. Each of the County Commissioners also made comments at various times during the hearing as did several staff members. There being no other comments Commissioner Adams thanked all for coming and the civility of the proceedings. He said the matter would be taken under advisement and that a decision would be made at a future date. Hearing adjourned at 2:05 PM -3-
