SAN JUAN COUNTY COMMISSION MEETING February 23, 2009 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Room at Monticello, Utah. Present: Bruce Adams, Chairman Kenneth Maryboy, Vice Chairman Lynn Stevens, Commissioner Rick Bailey, San Juan County Administrator Norman L. Johnson, County Clerk /Auditor Attendees: Marilyn Boynton, Lou Muller, Larry Sorrell, Cyndi Eldredge, Ruth Skouson, Greg Adams, Charlie DeLorme, Marcia Hadenfeldt, Dan Sightler, Justin Keith, Scott Mitchell Lou Muller - USU Extension Office Lou reported to the Commission on the recent conference she attendance in Las Vegas. The Home Energy Community of Practice conference was successful and useful. She presented the county a check reimbursing her mileage. Commissioner Lynn Stevens made a motion to accept the report. The motion was seconded by Commissioner Bruce Adams. Voting was unanimous. Commissioner Kenneth Maryboy was absent for the vote. Cyndi Eldredge- SJC Personnel Office Cyndi presented a salary adjustment request from the Sheriffs office for Marsha Shumway, who has obtained medical certification. The adjustment is from step 114 to 132 and effective March 1, 2009. Commissioner Lynn Stevens made a motion to approve the request. The motion was seconded by Commissioner Bruce Adams. Voting was unanimous. Commissioner Kenneth Maryboy was absent for the vote. Cyndi presented a recommendation from the Sheriff to Hire Jason Torgerson as a full time Deputy at step 141. Jason has been part time, without benefits, at a step 169. Commissioner Lynn Stevens made a motion to approve the request. The motion was seconded by Commissioner Bruce Adams. Voting was unanimous. Commissioner Kenneth Maryboy was absent for the vote. Cyndi presented a salary adjustment request from Walter Bird and approved by Rick Bailey for Bruce Bunker, County Building Official. The adjustment is from step 201 to 238. Following a discussion and an executive session, Commissioner Lynn Stevens made a motion to approve the request, retroactive to January 1, 2009. The motion was seconded by Commissioner Kenneth Maryboy. Voting was unanimous. Norman Johnson - SJC Clerk Auditor Norman made a request for out of state travel to attend the IACREOT national elections conference July 6th thru 9th in Spokane Washington. Considering all of the costs for transportation he requested permission to drive rather than fly. Norman indicated this conference pertains directly to elections and preferred it over attending NACO in Nashville. Commissioner Lynn Stevens made a motion to approve the request. The motion was seconded by Commissioner Bruce Adams. Voting was unanimous. Commissioner Kenneth Maryboy was absent for the vote. Charlie DeLorme - SJC Travel and Economic Development Charlie reported on lobby efforts at the legislature and the State Tourism Office travel budget. He will be involved with and on the Berlin promotional tour for the next few weeks. Charlie is also working on the swinging bridge project and will attend the Weed Board meeting in Bluff this week. Senator Bennett's Business Conference, held in Blanding last week, was highly successful and will be of good value to our area. Open Time and Other Business Larry Sorrell wanted to go on record as opposing, the County or State, taking any of the Federal Stimulus money. He is of the opinion there are too many strings attached and some of the spending only increases the authority and power of the current leaders. He will be in Salt Lake this week working with the legislature on this issue. Rick Bailey - SJC Administrator Rick reminded the commissioners that they would be at NACO on March 9th and therefore needed to cancel Commission Meeting. The Clerks's office was asked to make the proper announcements. Kim Christy and other SITLA staff would like to meet with the commission on La Sal Mountain recreation planning. Rick was asked to set up the meeting. Rick indicated a fiber optics line would run across SITLA land along hwy 191 and they have asked for commission input. The commission did not have any objection to the project. Rick discussed the current Public Defender arrangements and stated he has had a written request from another attorney to be considered for the work. After a discussion the commissioners decided the current attorney should be given 90 day notice that the county services would be placed for an RFP. Rick gave to the commission the corrected "Clean Water Restoration Act of 2007" opposition resolution, previously adopted, for Commissioner Adams to resign, as there were a couple errors. The commission agreed to have him resign the resolution. Commission Reports Commissioner Maryboy - will attend a public hearing in Red Mesa today. Last evening he was at the Aneth Chapter meeting where they approved a resolution on road maintenance, which he will take to the Road Department. On the 28th he has a meeting with the Northern Agency (19 Chapters) concerning their representation with the at the Navajo Nation. He may go to SLC this week to meet with legislators. Commissioner Stevens - spent last week at the Legislature and then Friday went to the meeting in Gallup concerning Reservation Transportation with the other Commissioners and Rick. Commissioner Stevens also attended Senator Bennett's conference. This week he will be at the 4-County Lake Powell meetings and will not go to SLC. Commissioner Adams - attended the same Gallup meeting and was at the Legislature last week. This week he will again be at the Legislature, Wednesday thru Friday. Executive Session - Personnel issues At 11:05 AM Commissioner Lynn Stevens made a motion to go into an Executive Session to discuss personnel issues. The motion was seconded by Commissioner Kenneth Maryboy. Voting was unanimous. At 11:23 AM Commissioner Lynn Stevens made a motion to go out of Executive Session. The motion was seconded by Commissioner Kenneth Maryboy. Voting was unanimous. Public Hearing At 11:30 AM Commissioner Lynn Stevens made a motion to go into a Public Hearing to receive input on the Monticello Airport Overlay Ordinance. The motion was seconded by Commissioner Kenneth Maryboy. Voting was unanimous. Commission Chairman Bruce Adams read the Public Notice and gave brief guidelines, to be followed by those wishing to express opinions or ask questions. Opening comments were heard from Greg Adams, San Juan Planning and Zoning and Ruth Skouson, Asst Monticello City Manager, who explained the processes followed to bring the ordinance to a hearing and what was entailed in the ordinance. Questions and comments were heard form Scott Mitchell, Marcia Hadenfeldt, Justin Keith, Don Sightler and Larry Sorrell. There was no real opposition to the ordinance, as it is proposed, by those in attendance. No written comments have been received or placed into the record. At 11:43 AM Commissioner Lynn Stevens made a motion to close the Public hearing. The motion was seconded by Commissioner Kenneth Maryboy. Voting was unanimous.
