SAN JUAN COUNTY COMMISSION MEETING MINUTES JANUARY 3, 1989 The San Juan County Commission regular session commenced at 10:00 A.M. at the San Juan County Courthouse at Monticello, Utah. Commissioners Present: Calvin Black Mark Maryboy Tyron Lewis A motion to approve the minutes of December 27,2989 was made by Commissioner Maryboy and seconded by Commissioner Lewis. UNANIMOUS. COMMISSIONER CALVIN BLACK'S REPORT Appreciation - Commissioner Black indicated that he'd had the opportunity of serving with some outstanding men in the twenty plus years he has served as a public official. Mr. Black said that Marion Hazleton taught him the importance of serving art the regional, state and national level, especially in western counties where so much of the land is owned and controlled by federal and state governments. In order to have a voice in the control of those lands it is essential to serve on state and federal committees as much as possible. Ralph Bailey taught patience, compassion and consideration for others. Harold Young was a very dedicated commissioner and would let everyone know his position on the various issues. Bill Dunow always insisted on concerned individuals being present when issues were being discussed that pertained to them. Dave Guymon was a very knowledgeable about the County and served with Commissioner Black's father in the road department. Dale Holmes served on the Commission was Commissioner Black was serving as a state representative but was a good friend. Dick Broderick was very knowledgeable about the Count roads and the joint road committee. Mark Maryboy has brought a new dimension to the County with liaison and communication with the tribe that was not possible before he joined the commission. Commissioner Black expressed appreciation for serving with Commissioner Maryboy and Commissioner Lewis and all elected officials he has served with. COMMISSIONER MARK MARYBOY'S REPORT Commissioner Maryboy said he had enjoyed his experiences as a commissioner. Many of the things that had been told to him prior to his becoming a commissioner were of a negative nature and he found that Commissioner Black and Commissioner Bailey were very willing to listen to his opinions and teach him the things that were necessary and he appreciated that. Mr. Maryboy stated that he is looking forward to working with Commissioner Lewis and that he will be willing to work with anybody that will improve the lives of the people in San Juan County. Commissioner Maryboy asked Commissioner Black to write a letter to the Navajo Tribal officials to inform them of Mr. Maryboy's appointment so that they will acknowledge his responsibilities. Commissioner Black will write that letter today. TeecNosPos Chapter Planning Meeting- Commissioner Maryboy will be attending the TeecNosPos Chapter planning meeting tomorrow. Congressman Howard Nielson- Commissioner Maryboy inquired about Congressman Howard Nielson's visit to the County on January 16th as the chapter officials are concerned about the items they should discuss with Mr. Nielson. Specifically they are concerned about English being made the official language in the State of Utah as the State of Arizona did recently. Commissioner Black indicated that issue is not a federal issue but handled on a state basis and he was not aware of any effort being made to do that in Utah at this time. Administrative Assistant Rick Bailey said the Congressman Nielson's schedule would only allow a visit to one of the chapters during this visit. Mr. Bailey has not received a final schedule for the Congressman's visit. The Commissioners and the Blanding and Monticello mayors will meet with Mr. Nielson at 5:00 p.m. for dinner in Blanding. COMMISSIONER TYRON LEWIS' REPORT Commissioner Lewis said that he was looking forward to working with everybody and that he expected to gain a great deal from this experience. Recreation- Commissioner lewis stated that Jim Dandy had contacted him and expressed his willingness to work on a committee with recreation activities in the Monument Valley area but he did not want to take the total responsibility for the programs. ADMINISTRATIVE ASSISTANT RICHARD BAILEY'S REPORT Overtime and Comp Time- Administrative Assistant Richard Bailey said that the Commission needs to review the County Personnel Policy with regards to overtime and comp time. Mr. Bailey indicated that there have been three areas of concern with County employees on this matter. One concerns an individual,two concerns a number of road department employees who were needed to keep the roads open during the recent snow storm and the third one has to do with a concern of road Foreman Tony Brandt. Dale Fuller works int he LaSal Road District by himself and is willing to put in the necessary time to keep the roads opened regardless of the time required. He also put in additional time grading the LaSal Mountain road when it was being graveled in order to keep the contract truckers busy hauling gravel. He has accumulated 275 hours of overtime and the County policy states that there can only be 10 hours of comp time carried over into the year. Mr. Fuller is concerned about losing those accumulated hours. Other road employees have 40 to 80 hours of comp time built up from the effort needed to keep the roads open during the snow storms this year. Commissioner Black stated that the road department needs to let the men take time off during the year when there isn't work for them to do and build up that time for when extra time is needed during storms and on weekends. If there is a crew working on equipment on the weekends when it isn't being used that would keep the equipment going during the four days when the operators are working. Acting Road Superintendent Tony Brandt will be asked to come up with a plan to give the men their monthly wages but have them work when the work needs to be done. Also during the storm Pard Slade, who works for Monticello City, used some County equipment to push snow on monticello streets that wasn't being used by County personnel. Mr. Slade was not paid by the County as he was on his regular city time while using the equipment. There was a question as to the liability insurance in a situation like that. The Commission felt that the County would be responsible when county equipment is being used. Halls Crossing Airport- Administrative Assistant Richard Bailey indicated that the Commission needs to contact Barbara Johnson of the FAA in regards to the status of the Halls Crossing Airport project. CURRENT BUSINESS Oath of Office-Swearing In Ceremony/Tyron Lewis- At 10:30 A.M. on January 3, 1989 county Clerk Gail Johnson administered the oath of office to Tyron Lewis as a Commissioner of San Juan County, Utah. Reorganization of Commission- Commissioner Lewis made a motion to elect Chairman Calvin Black as Chairman of the San Juan County Commission and Commissioner Mark Maryboy as Vice Chairman of the San Juan County Commission. Commissioner Maryboy seconded the motion. UNANIMOUS. Beer Licenses- County Clerk Gail Johnson submitted the beer license applications and certificates for approval for Fry Canyon, San Juan Inn, and the San Juan Bar. A motion to approve the applications and authorize Chairman Black to sign the certificates was made by Commissioner Lewis and seconded by Commissioner Maryboy. UNANIMOUS. County Group Insurance/Family- The change of County group insurance providers has some of the County employees wondering what the premium will be for family members. County Clerk Gail Johnson indicated that the County pays for the employees premium and the employee pays $105.65 for family coverage and $73.85 for two party coverage for the first three years at which time the County will pay half of that amount and after five years the County will pay for the entire coverage. Mrs. Johnson indicated that there was not a significant raise in the premium for family coverage. The biggest increase was in the single coverage. Mrs. Johnson recommended that the employees pay the same amount as they have been paying. The Commission concurred with the recommendation. Sheriff Claude Lacy- The Commission asked Sheriff Lacy to make periodic checks on the beer license holders and the certification cards. Garth Skousen, who is responsible to teach the certification class, indicated that he teaches the laws that govern the sale of beer and he would appreciate the periodic checks being made to insure compliance with the laws. Sheriff Lacy indicated that there were no arrests made for drunk driving over the New Year celebration. The entire sheriffs deputy force was on duty during this crucial time. Executive Session- A motion to go into executive session to discuss matters pertinent to the sheriff's department was made by Commissioner Lewis and seconded by Commissioner Maryboy. UNANIMOUS. Salary Increase/Road Personnel- A request for a change in responsibilities has been =received from Victor Nebeker. He will be moved to Grade 12 Step 2 at $8.31 per hour. Max Ksiaziewicz will be moved to the shop supervisor position at Grade 17 step 1, $1,705 per month, and Max Halls will be the assistant shop supervisor at Grade 11 Step 4, &8.66 per hour. The change will be effective December 28, 2988. A motion to approve the requests was made by Commissioner Lewis and seconded by Commissioner Maryboy. UNANIMOUS. Tax Anticipation Notes/Health District- County Clerk Gail Johnson asked the Commission to approve Resolution No. 88-10 which would allow the San Juan Health District to borrow tax anticipation notes. The Commission indicated that the resolution should be a continuing one that would allow the district to borrow every year as needed. Commissioner Lewis made a motion approving the resolution. Commissioner Maryboy seconded the motion. UNANIMOUS. Independent Audit Bids- County Clerk Gail Johnson indicated she had sent letters to 17 various accounting firms for proposals to do the County audit for the next three years. Five proposals were returned for consideration.The companies submitting bids were: Phil B. Acton/Karren, Hendrix & Associates for $18,500; Kimball & Roberts for $4,900 to $5,200; Beynon, Hart & Riter for $6,400 for 1988, $6,600 for 1989 and $6,900 for 1990; Taylor and Company for $6,000 for 1988, $6,250 for 1989 and $6,500 for 1990; and Smuin, Marsing & Company for $8,500 for 1988, $8,000 for 1989 and $8,000 for 1990. It was the Smuin, Marsing and Company be given the contract. After a discussion the Commission decided to take the recommendation under advisement until next week. Economic Development Board Members- A motion to approve the additiion of Dick Neztsosie and Holly Tatnell to the San Juan Development Board was made by Commissioner Maryboy. UNANIMOUS. Bluff Project/William Simpson- Barry and William Simpson met with the Commission regarding a building permit for a motel project in Bluff. Mr. Simpson has applied for a building permit through Gerald Jackson, the County building inspector. Mr. Jackson had indicated to Mr. Simpson that he would deny the permit as he felt it was located in a hazardous area under the rock cliffs, even though he had not been down to inspect the location. In a Letter to the Commission Mr. Jackson refers to the Utah 1988 Uniform Building Code section 207 (B). Commissioner Black was not aware of what that referred to but stated that the County policy had been to let people do what they want with their own land as long as it doesn't interfere with the rights of their neighbors. The only requirement would be that building coded were conformed to for safety of all concerned. The County Attorney Craig Halls will be asked to give an opinion on the matter before the permit is approved.
