SAN JUAN COUNTY COMMISSION JUNE 12, 1989 The regular meeting of the San Juan County Commission was held at the San Juan County Courthouse in Monticello, Utah at 10:15 A.m. Present: Calvin Black Chairman Tyron Lewis Commissioner Rick Bailey Administrative Assistant Dena Hunter Deputy Clerk A motion to approve the minutes of the June 5, 1989, meeting as corrected was made by Commissioner Lewis. Second by Commissioner Black. Unanimous. CURRENT BUSINESS Resolution No. 1989-4 A resolution to deed some county-owned property in Blanding to the City of Blanding for the sum of $25.00, as voted on in the meeting of May 22, 1989, was presented to the commission. The motion to approve the signing of the deed and the adoption of the resolution was made by Commissioner Lewis. Second by Commissioner Black. Unanimous RESOLUTION NO. 1989-4 Be it resolved that the Board of County Commissioners have reviewed the request of Blanding City Municipal Corporation, for the transfer of county property, more particularly described as follows: Beginning at a point that is 155 feet East of the Southwest corner of Block 21 of the BLANDING TOWNSITE SURVEY, running thence North 149 feet, thence East 34 feet, thence South 40 feet, thence West 24 feet, thence South 109 feet, thence West 24 feet, thence South 109 feet, thence West 10 feet to the point of beginning. Containing .06 acres. That it appears County has no use for said building and it being in the best interest of the public that the property be transferred to Blanding City, It is hereby resolved that the County Commission be authorized to execute any and all documents for the transfer of said property on behalf of County. SAN JUAN COUNTY COMMISSIONERS: /s/ Calvin Black Calvin Black, Chairman Those Commissioners voting for adoption: Commissioner Black -- Aye Commissioner Lewis -- Aye Those voting against: none Tax Rate Gail Johnson, Clerk/Auditor, met with the commission to set the tax rate for 1990. Mrs. Johnson recommended that the tax rate be set at .0032 for the General Fund, .000104 for the library, .000086 for the tort, and .000088 for the health district. These rates will put the county at the certified tax rate. These rates will produce $92,000.00 less revenue for the county general fund. A motion to approve this tax rate and the signing of the documents was made by Commissioner Lewis. Second by Commissioner Black. Unanimous. Library Board Appointment The name of Jean Bayles of Blanding, Utah, has been submitted to fill a vacancy on the library board. A motion to approve this appointment was made by Commissioner Lewis. Second by Commissioner Black. Unanimous. Golden Circle Adventure Inc. Von Black has started a corporation called the Golden Circle Adventure Inc. Mr. Black presented his plan to apply for a concessionaire permit with the National Park Service to run tours into Canyonlands National Park. Mr. Black asked the commission for their support in obtaining this permit to run tours out of San Juan County. The commission told Mr. Black that when he was ready to submit his proposal for the permit that they would be willing to do what they could to help him obtain the permit. County Surplus Auction Gail Johnson, Clerk/Auditor, discussed with the commission the sale of the old road shed on the east highway. The property will be auctioned and the commission will determine if the bid is acceptable. There is a problem with the deed to the property. The deed will be given to Doug Pehrson, county surveyor, to see if he can get a better description of the property for the deed. Jim Keyes Award Jim Keyes, USU Extension agent, has been awarded the Outstanding Livestock Extension Agent for the 10 western states. The award will be presented at the National Extension Convention that will be held in New Brunswick, New Jersey on August 1-3, 1989. A motion to authorize out-of-state travel for Mr. Keyes was made by Commissioner Lewis. Second by Commissioner Black. Unanimous. Pony League Tournament Eddie Allred, recreation director, requested a letter from the commission inviting teams from through out the state to attend a Pony League Tournament that will be held in Monticello, July 26-29, 1989. Road Department Welder A wire feed welder for the road department use was bid on at the Belden Auction in Cortez, Colorado. The bid was for $14930.50. A motion to approve this purchase was made by Commissioner Lewis. Second by Commissioner Black. Unanimous. Blue Cross Blue Shield John Black, agent for Blue Cross/Blue Shield of Utah, informed the commission that the Blanding Clinic was not a Blue Cross provider. This matter was referred to the Health Board. Executive Session A motion to adjourn to executive session to discuss the wages for the Sheriff's Department was made by Commissioner Lewis. Second by Commissioner Black. Unanimous. A motion to return to regular session was made by Commissioner Lewis. Second by Commissioner Black. Unanimous. Sheriff's Department Pay Plan Recommendations Claude Lacy, County Sheriff, presented his recommendations to the commission for a new pay plan for his department. These wages will be effective on July 1, 1989. Sheriff Lacy will present the necessary paper work to the commission before this date. A motion to accept the recommendations of Sheriff Lacy was made by Commissioner Lewis. Second by Commissioner Black. Unanimous. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Hill Burton Trust Agreement After a discussion on the Hill Burton Trust Agreement and the waiver agreement it was recommended that the signing of the agreement be postponed until the waiver is signed by Auburn Manor and returned. This will enable both the agreement and the waiver to have the same effective date. Public Safety Building Payments A payment request in the amount of $50,708.52 on the Public Safety Building was presented by Mr. Bailey. General Communications will receive $6,082.00, Office Equipment Inc. will receive $11,756.20, Midwest Office Furniture will receive $7,974.00, and Southern Paving will receive $24, 896.32. A motion to approve these payments was made by Commissioner Lewis. Second by Commissioner Black. Unanimous. UDOT Letter Commissioner Maryboy called Mr. Bailey about a letter he had received from Dyke LaFevre of the UDOT. Mr LaFevere has requested that the county supply cattle guards to be placed on Highway 191 on the public and private accesses. This road was constructed by the BIA and then turned over to the UDOT. The commission stated that if the access road is a county road the county will supply the cattle guard. ORV Committee Meeting A organizational meeting of the ORV committee will be held June 22, 1989 at 7:00 P.M. in the Commission Room. Ed Scherick of the BLM has stated that someone from the BLM will be at the meeting. Mr. Bailey will be at the meeting to help get the group started on recommendations for the county designation of ORV roads and trails. Art Work Committee Rick Bailey has had a few contacts from people interested in the Art Committee. Mr. Bailey recommended that instead of the county purchasing art work they display the work on a consignment basis. This would allow more artists to display and would alleviate the problem of the county buying art work. A motion to approve this recommendation was made by Commissioner Lewis. Second by Commissioner Black. Unanimous. COMMISSIONER TYRON LEWIS' REPORT Weed and Rodent Control Board Meeting A meeting of the Weed and Rodent Control Board was held on June 8, 1989. Commissioner Lewis said that they have gotten good response from most individuals with the weed control problems. There are several cases where the weed control law may have to be inforced. Commissioner Black questioned if the prairie dog control problem had been discussed. Commissioner Lewis stated that this problem had not been brought up at this meeting. COMMISSIONER CALVIN BLACK'S REPORT Road Meeting Change Commissioner Black requested that the Road Meeting that is scheduled for July 3, 1989 be changed to June 27, 1989. Bayles Ranch Road Commissioner Black has received a letter requesting that a D road which runs to the Bayles Ranch and is access to other public lands be put on the B road system. Commissioner Black will meet with Doug Pehrson about this matter and then they will make their recommendations to the commission. Henry Hillson Open House The commission has received an invitation to the open house at the Henry Hillson Manufacturing Plant in Montezuma Creek, Utah on June 19, 1989, at 1:00 P.M. Mining Law Senator Bumpers from Arkansas has introduced a bill to repeal the mining law of 1872. This bill would sharply increase annual proof of labor fees and would put the small miners out of business. If the new law passes it would require that all existing claims be abandoned or relocated within three years. The claims could be retained if there was $5,000.00 per year for labor per claim and a reclaimation plan. An exploration claim of $100.00 recordation fee where now this fee is $10.00 and a exploration plan would have to be filed before any work could be done. If this plan was disapproved the claim would be null and void. It was recommended that the commission adopt a position in opposition of this because of the effect this law would have in the west. A motion to oppose this bill was made by Commissioner Lewis. Second Commissioner Black. Unanimous. A letter will be sent to Senator Bumpers and to the Utah Delegation. Bluff Post Office A notice has been received for the planning of the acquisition of land for the Bluff Post Office. This land and building will be leased from a private individual. UAC Meeting Commissioner Black met with the UAC Committee that is making recommendations with respect to dues. Commissioner Black has sent a letter to the committee and to all commissioners in the state concerning public lands issues and the dues structures. He is asking each commission to identify what they want the UAC to accomplish, what staff is needed to the job, the budget that is required and the fair and equitable dues formula to fund the budget.
