SAN JUAN COUNTY COMMISSION MEETING MINUTES OCTOBER 23, 1989 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present: Calvin Black, Chairman Mark Maryboy, Vice Chairman Tyron Lewis, Commissioner Dena Hunter, Deputy Clerk A motion to approve the amended minutes of the October 16, 1989 meeting was made by Commissioner Lewis and Commissioner Maryboy. UNANIMOUS. CURRENT BUSINESS Halls Crossing Airport- Ed Scherick and Bob Turri of the BLM met with the commission to discuss the Halls Crossing Airport Site that is on BLM land. Mr. Scherick and Mr. Turri informed the commission that the archeological survey has been completed on 280 acres. The BLM requested that they be informed as soon as possible if this site will be used so that the BLM can get started on the work needed to be completed on the Section 106 of the Natural Preservation Act which will take up to sixty days to complete. Mancos Mesa Road Final Environmental Assessment- A discussion was held on the Final Assessment for the proposed road restoration within the Mancos Mesa Wilderness Study Area. The comment period is until November 15, 1989. The final decision will then be made and then the appeal process will take place. Rick Bailey will prepare a draft response on the Environmental Assessment. County Road Concerns- Ed Scherick of the BLM discussed some problems that have arisen during the deer hunt concerning county roads to public and private lands. Mr. Scherick would like to arrange a consolidated meeting to discuss theses concerns. Water Conservancy District Appointment- The appointment to the Water Conservancy District Board was tabled until the next meeting so that Commissioner Black can talk with each of the candidates. Drought Proclomation- A motion to extend Resolution 1989-3 on the drought for an additional 30 days was made by Commissioner Lewis and seconded by Commissioner Maryboy. UNANIMOUS. Procurement- Bids were received for three typewriters for the Sheriff's department. Office Outpost bid on two Panasconic Brands at $449.00 and $485.00 each. Office Equipment Co. bid $360.00 each for an Adler Satellite IV. A motion to accept the low bid from Office Equipment was made by Commissioner Lewis and seconded by Commissioner Maryboy. UNANIMOUS. Bids were presented from the road department on a journeyman welding kit for use in the Blanding shop. United States Welding bid $259.95 and Snap-On Tools bid $347.60. A motion to accept the bid from United States Welding was made by Commissioner Lewis and seconded by Commissioner Maryboy. UNANIMOUS. Assessing and Collecting Meeting- Gail Johnson, Clerk/Auditor, reported on the Assessing and Collecting meeting that she attended on October 20, 1989. The proposed legislation will be presented to the county commissioners at the UAC convention in St. George, Utah. The proposed plan will allow the counties to do levy their own assessing and collecting tax. This would eliminate the state levying the assessing and collecting tax and then dispersing the monies to the counties. AOG Community Services Block Grant- Rick Bailey, Administrative Assistant, presented the Community Services Block Grant for the Aging program in the amount of $16,959.54. A motion to approve the signing was made by Commissioner Lewis and seconded by Commissioner Maryboy. UNANIMOUS. Amendment to Ordinance 1989-3- An amendment to the Uniform Building Code was presented by Rick Bailey. This amendment will adopt the Uniform Fire Code. A motion to adopt the amendment was made by Commissioner Lewis and seconded by Commissioner Maryboy. UNANIMOUS. AMENDMENT TO ORDINANCE 89-3 An amendment to the recently adopted Uniform Building Code, Mechanical Code, Plumbing Code, and Electrical code to include the Uniform Fire Code, pursuant to Utah Code Annotated, 58-65-1, 1958 as amended. The Board of County Commissioners of San Juan County Utah does hereby resolve as following : Section 1: ADOPTION OF UNIFORM CODES is hereby amended to adopt the Uniform Fire Code (UFC) in addition to those other Uniform Codes which have previously been adopted in that Ordinance dated the 18th day of September, 1989. All of the other parts of this Section shall remain unchanged and all of the other parts of the Ordinance shall remain unchanged and all of the other parts of the Ordinance shall remain unchanged and shall force and effect with regard to the Fire Code. The amendment of this ordinance was adopted at a regular meeting of the Board of County Commissioners of San Juan County Utah, held this 23rd day of October, 1989 and shall be in full force and effect from and after December 1, 1989. Certificate of Substantial Completion/Public Safety Building- Rick Bailey, Administrative Assistant, presented the Certificate of Substantial Completion for the Public Safety Building this certificate is for fire purposes and states that the county occupied the building on June 9, 1989. A motion to approve the signing of this certificate was made by Commissioner Lewis and seconded by Commissioner Maryboy. UNANIMOUS. Interagency Meeting- Commissioner Lewis reported that he attended the Interagency Meeting on October 18, 1989, and there were only three people present. Fair Board Meeting- The fair board met on October 19, 1989. Commissioner Lewis worked with the board on their budget for next year. Recreation Board Meeting- The Recreation Board will hold a meeting to further discuss the setting up of the recreation entity on October 31, 1989. Commissioner Lewis will be unable to attend so Rick Bailey will attend to represent the county. Navajo Chapters Road Resolution- Commissioner Maryboy reported on a resolution that has been received from the Navajo Chapters concerning road work in the Chapter areas. A discussion was held on the problem that the drought has caused with the roads and the work that can be done on them. The resolution will be given to Tony Brandt, Road Superintendent. Temporary Gate Request- Commissioner Black reported on a letter he has received from Ray Perkins requesting permission to put a temporary gate across a county road at Butler Wash in the Bluff area. Mr. Perkins stated that the BLM has applied for a cattle guard for this location. Until the cattle guard is appropriated and installed Mr. Perkins needs to install a gate because he will be running cattle from January until April. A motion to approve the temporary gate across the Butler Wash road was made by Commissioner Lewis and seconded by Commissioner Maryboy. UNANIMOUS. Wayne Owens/CUP Bill Commissioner Black reported that Wayne Owens has introduced a bill concerning the Central Utah Project. The bill will reserve 44,000 acres feet of water for instream flows. This will directly affect the water level of Lake Powell and water rights. A letter will be sent to Bill Howell concerning this proposed legislation. Revolving Loan Fund- The commission has been contacted by Patty Jo Nielson concerning the revolving loan fund. Miss Nielson is building a motel and restaurant in the Bluff area. Miss Nielson was informed that this loan fund is not available for tourism and recreation and she will need to apply with the small business administration. Oil and Gas Prices- Rick Bailey, Administrative Assistant, reported on the oil and gas prices for June of 1989. The final value of the gas and oil is up 11% compared to one year ago. Edge of the Cedars Signing- A letter was received from the State of Utah concerning the Edge of the Cedars. Commissioner Black discussed the signing to the Edge of the Cedars with Kent Tibbits. The suggestion is to change the signing or the road name on second north to better help the public find the Edge of the Cedars. The City of Blanding is opposed to this type of signing because it takes the people away from the downtown area. Commissioner Black will discuss this with Blanding City manager Norman Johnson. Park Service/ARA Services Meeting- Commissioner Black and Rick Bailey met with the Park Service and ARA Services to discuss the marketing of Lake Powell. Al Early stated that the development of the upper part of Lake Powell will depend on the demand. The projection of a facility being developed in Utah would be at Bullfrog. Mr. Early stated that ARA would not add more lodging facilities on the upper end of the lake until the present lodging facilities have an annualized occupancy of 70%. Another meeting will be scheduled with the counties involved before the end of the year. Commissioner Black commented that ARA Services will not do anything to develop the upper part of Lake Powell unless they are forced to do so by pressure from the Counties, the State and the Park Service. Economic and Development Board Meeting- Commissioner Black attended the budget meeting of the Economic and Development Board on October 19, 1989. A discussion was held on the marketing of highway U-95 with the National Parks connections and marketing of special promotions in the off season. Community Impact Board Contracts/Edge of the Cedars- The Permanent Community Impact Fund Board contract in the amount of $850,000 for the Edge of the Cedars expansion was presented to the commission for their signature. A motion to approve the signing of the contract was made by Commissioner Lewis and seconded by Commissioner Maryboy. UNANIMOUS. Energy Fuels Lease- Rick Bailey will contact Energy Fuels to talk to them about the MiVida mine lease and the royalties that are being paid to the County. Lisbon Valley/UniCal Expansion- Rick Bailey, Administrative Assistant, has been asked by the BLM to attend meeting at the Moab District on October 31, 1989. This meeting will be to discuss the expansion of the UniCal plant in Lisbon Valley. The land that the plant is on is owned by the company, but the expansion will also include the pipelines that are on public lands. The commission has no abjection to this expansion.
