SAN JUAN COUNTY COMMISSION MEETING MINUTES DECEMBER 4, 1989 The regular meeting of the San Juan County Commission was held at 10:15 A.M. in the commission chambers at Monticello, Utah. Present:Calvin Black, Chairman Mark Maryboy, Vice Chairman Dena Hunter, Deputy Clerk Excused:Tyron Lewis, Commissioner Rick Bailey, Administrative Assistant A motion to approve the minutes of the November 27, 1989 meeting as amended was made by Commissioner Maryboy and seconded by Commissioner Black. UNANIMOUS. CURRENT BUSINESS Jail Removal Dell Hunter, Maintenance Supervisor, discussed the removal of the old jail cells from the courthouse. Mr. Hunter reported that the removal was now complete but the contractor has some repair work to do. The contractor has requested some payment. Mr. Hunter suggested that a 10% retainage be kept until the repair work is completed. The commission approved paying J.W. Nelson Contracting and withholding the 10% until all repair work is completed. Mr. Hunter requested permission to advertise for bids for the remodeling of this section of the courthouse. Rick Bailey, Administrative Assistant, will work with Mr. Hunter to prepare the specifications for the remodeling. The commission gave their permission for Mr. Hunter and Mr. Bailey work on this project and then to advertise for bids. Sheriff Claude Lacy Letter A letter was received from the Sheriff Claude Lacy in response to a request on the sheriff's department vehicles. After a review of the information the commission stated that the information supplied may indicate a need for new vehicles in the Sheriff's Department. Commissioner Black commented that the sheriff's department should accept and answer requests without such a negative attitude. UDOT Five Year Plan Commissioner Maryboy reported that he has been in contact with the UDOT in regards to the environmental restoration and waste management five year plan. The UDOT wanted Commissioner Maryboy comments on the Halchita clean-up. Commissioner Maryboy stated that he has not received any complaints on this project on the clean-up itself. He has had complaints about the communications problems between the Navajo workers and the contractor. Commissioner Maryboy is working with the contractor to improve the communication problems. Aneth Chapter Letter A letter was received from the Aneth Chapter requesting that a road to a private residence be graded. The commission stated that if the road is a county road it can be maintained. Commissioner Maryboy will follow through on this matter. Indian Task Force Commissioner Maryboy reported that the last meeting of the Governor's Indian Task Force will be held on December 12, 1989. The seventeen member advisory council should be finalized at this meeting. Procurement A request to purchase was presented from the Sheriff's office for 60 bulletin strips for use in the jail cells. The only place that supplies these strips is Quill Inc. at $5.48 each. A motion to accept the bid was made by Commissioner Maryboy and seconded by Commissioner Black. UNANIMOUS. FAA Letter A letter dated November 22, 1989 was received from Barbara Johnson of the FAA concerning the airspace analysis of the proposed Halls Crossing Airport alternative site. Based on this study the FAA has no objection to the proposal from an airspace standpoint. Enclosed was the FFA form 55105 for filing after the completion of the airport. If this airport is not operational in a 24 month period after date of this letter this airport determination report will expire. and the airspace application returned in a 20 month period the application will expire. Oil Company Property Valuation A copy of a letter was read from Lyle Anderson has sent to Bryce Pettey, Assistant Attorney General of the Tax and Business Regulation Division, concerning tax valuations protests of Chuska Energy and Meridian Oil. The letter requested information on where this case stands and informed of the counties concern if these taxes are lowered. National Guard Work Request Commissioner Black reported that in order for the local unit of the National Guard to do work on the Blanding Third Reservoir a state of emergency has to be declared. The office of Emergency Management prefers not to do a project there is any protest by the local contractors. Commissioner Black has contacted some local contractors to see if there was any protest to the local unit doing this work. Commissioner Black stated that there are protests to the Guard doing this work so the Guard will not be able to do this work for the City of Blanding at this time. Health Department Notice Commissioner Black reported that he had received a notice from the Health Department on an old theater in Blanding. The Health Department has given 30 day notice to Blanding City to demolish and remove this building. Edge of the Cedars Expansion Commissioner Black reported that he has contacted Dee Hansen of the Department of Natural Resource concerning the Edge of the Cedars funding. Mr. Hansen told him that he had been advised that the State Building Board had approved the money when in fact they had not. Commissioner Black also spoke with Dale Hatch, State Budget Director, and informed him that he had received a letter on March 10, 1989 from the Governor concerning the Edge of the Cedars. Commissioner Black felt that the Governor was supportive of this project and would budget for it in the 1990 budget. Commissioner Black informed Mr. Hatch that the money from the Community Impact Board Grant is conditional on matching funds. If the $800,000 is not funded in the budget and approved by the legislature, the $850,000 from the Community Impact Grant will be forfeited and the Edge of the Cedars will not be acceptable as a repository and the artifacts will be sent out of state. Copies of the correspondence with the Governor in this matter have been sent to Mr. Hatch. Grazing Land Valuation Change Commissioner Black reported that he had called Mark Walsh with the UAC concerning the information that the State Tax Commission had doubled the assessed value of grazing land which will result in the taxes being doubled. This will impact San Juan County and all of rural Utah greatly. Employee Salaries A discussion was held with Gail D. Johnson, Clerk/Auditor, concerning a salary comparison with Monticello and Blanding Cities that Commissioner Black had asked her to do. Commissioner Black asked Mrs. Johnson to work up a tentative budget with a 3 to 4% salary increase for county employees who have not had their salaries adjusted this year. Commissioner Black stated that changes may have to be made in the budget so that the cities have a fairer cost of expenditures on roads, recreation and other services in the county. Money Transfer Gail Johnson, Clerk/Auditor, informed the commission that there is $10,792.26 left in a special fund that was set up for the Montezuma Creel Jail project. This project is now completed and this money needs to be transferred back into the General Fund. A motion to approve this transfer was made by Commissioner Maryboy and seconded by Commissioner Black. UNANIMOUS. Budget Revision Gail Johnson, Clerk/Auditor, and John Fellmeth, Deputy Auditor presented the commission with copies of the revised budget. Joe Slade Visit Joe Slade of the Monticello City Council informed the commission that Montezuma County, Colorado is trying to get a jail and prison complex in their county. There are sixteen proposed sites. They will hold a breakfast meeting on December 6, 1989 and has asked for the support of San Juan County. Commissioner Black stated that the county would be supportive of this project but, he would be unable to attend the meeting with Mr. Slade.
