SAN JUAN COUNTY COMMISSION MEETING MINUTES FEBRUARY 5, 1990 The regular meeting of the San Juan County Commission was held at 9:30 A.M. in the Commission Chambers at Monticello, Utah. Present:Calvin Black, Chairman Mark Maryboy, Vice Chairman Tyron Lewis, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk A motion to approve the minutes of the January 22, 1990 meeting as amended was made by Commissioner Lewis and seconded by Commissioner Maryboy. UNANIMOUS. CURRENT BUSINESS Creamer and Noble Representatives of Creamer and Noble met with the Commission to discuss the Aneth to Ismay road project. County Engineer Doug Pehrson said that he estimates that the cost to construct the road would be $200,000 to $400,000 per mile and the project is 10 to 11 miles long. This project could be eligible for Federal Secondary Road Funds. Creamer and Noble will look at the project and come back to commission meeting in two weeks to present a detailed schedule and costs. A discussion was held concerning the Halls Crossing Master Plan for the airport site inside of the recreation area. If the alternate site is not approved then the work is already completed on the original site and it will involve less time to begin construction. Building Permit A building permit was presented for a twenty eight room motel in Bluff, Utah. Vance Nielson is the owner and Tumurru Trades Inc. is the contractor. A motion to approve the building permit was made by Commissioner Maryboy and seconded by Commissioner Lewis. UNANIMOUS. Procurement Bids were presented for assessor's receipt books. Bids were received from The San Juan Record for $260 and Moore Business Forms for $279.54. A motion to approve the bid from The San Juan Record was made by Commissioner Maryboy and seconded by Commissioner Lewis. UNANIMOUS. Louise Jones presented a request to purchase some additional shelving for the recorder's vault. The bids received were from Kelly Company, the only company that has steel shelving. Bids were received for a 16 roller shelf starter unit and two finished end panels for $726.00. The bid for six quarter units and two finished end panels was for $1480. A motion to accept the bids was made by Commissioner Lewis and seconded by Commissioner Maryboy. UNANIMOUS. Mrs. Jones stated that this shelving will enable her to keep all the recorder's books in one vault and she will not need the vault in the old sheriff's office. Mrs. Jones stated that the shelving she had approved for purchase with the 1989 budget did not come in time to come out of the 1989 budget. The Commission said that if her budget needs to be adjusted at the end of the year it can be done. Road Superintendent Tony Brandt informed the Commission that the road department needs to purchase a patrol for the Blanding area. Mr. Brandt contacted Wheeler Machinery and Scott Machinery about the bids they had submitted in November and they are willing to honor those bids. The road department will be trading in a Gallion grader and will have a front mounted blade on the new grader. Scott Machinery bid $94,350 with trade-in and Wheeler Machinery bid &109,711 with trade-in. A motion to approve the bid from Scott Machinery was made by Commissioner Lewis and seconded by Commissioner Black. UNANIMOUS. Arch Canyon Letter The following letter was sent to the BLM concerning the Arch Canyon road. January 25, 1990 Mr. Ed Scherick Bureau of land Management P.O. Box 7 Monticello, Utah 84535 Dear Ed, I first drove up the road in Arch Canyon in 1959. It was a well traveled road the first time I was on it. The road crosses the wash bottom numerous times; sometimes going up the bottom for short distances and other times up either side of the bottom. The road has had a lot of hand work whenever it was first constructed and has had periodic maintenance by hand since then by various people. I have personally used a shovel and picked and rolled rocks out of the way through the years and have removed trees occasionally as they have fallen across the road. I estimate I have used the road a number of times each year since 1959. My Last trip was in November of 1989. I have used the road for sight seeing , hunting, and camping and have taken many friends with me over the years. I have gone alone, with other people in my jeep, and in groups with other vehicles and people. If there is further information I can provide please advise. Sincerely, /s/ Calvin Black San Juan County Commission Louise Liston/San Juan Chapter WALU Garfield County Commissioner Louise Liston will be speaking at the San Juan Chapter of the Western Association of Land Users meeting in Blanding on February 8, 1990. Cemetery District Commissioners Clerk/Auditor Gail Johnson discussed with the Commission the changes in the law that require Cemetery District Commissioners to be elected. If no one files for the office then the County Commission will appoint someone to fill the six year term. There will be one Commissioner on the ballot for each of the Monticello and Blanding Districts. San Juan County Accounts Receivable Clerk/Auditor Gail Johnson reported on the accounts receivable for the year-end 1989. There are some accounts that are several years delinquent and Mrs. Johnson wanted to know if she should write them off. Commissioner Black stated that the amount is owed to the County and the people ought to pay it no matter who the bill is to. Commissioner Black stated that the County should have a system so that the people are billed every month. Mrs. Johnson will send out statements on the delinquent accounts and if no action is received then the account will be turned over to the County Attorney. Commissioner Maryboy suggested that Mrs. Johnson contact Travis Parashonts about the UDIA bills that are delinquent. This amount was for funds the UDIA was to have matched for road construction in 1986. Indemnification Agreement/Monticello City An Indemnification Agreement with the City of Monticello which will allow Monticello City to use off duty deputies to fill in until they have filled a vacancy on their force was presented for the approval and signature of the Commission. A motion to approve the agreement and the signing was made by Commissioner Lewis and seconded by Commissioner Maryboy. UNANIMOUS. Dr. Warren's Loan Clerk Auditor Gail Johnson reported that Dr. Warren has requested that the due date on his note with the County be changed to the fifteenth instead of the first of the month. A motion to approve the changing of the due date on Dr, Warren note to the fifteenth of the month was made by Commissioner Lewis and seconded by Commissioner Maryboy. UNANIMOUS. Commissioner Black said that there has been a lot of public comment concerning the county loaning money to Dr. Warren. Commissioner Black said that Dr. Warren had never been compensated to stay in the county as other physicians have been. The money was loaned to Dr. Warren at a higher interest rate than the County is paying for borrowed money. Commissioner Black stated that if it wasn't for Dr. Warren San Juan County might not have a hospital. Commissioner Black also stated that the hospital finally has some stability with Dr. Jones and Dr. Warren practicing in the county. Blanding Road Shop Road Superintendent Tony Brandt and contractor Stewart Johnston met with the Commission to discuss the problem with the roof insulation at the Blanding road shop. The insulation was applied with glue as the specs required. The roof leaks and causes the insulation to fall. Mr. Johnston proposed that he remove the sheeting and insulation and repair the roof and reapply the insulation and sheeting. Mr. Johnston stated that he accepts partial responsibility for the problem and he will do the repairs for $3,000 which is just over cost for the materials. Mr. Johnston estimated that this job could be completed in one week. The commission gave their approval for Mr. Johnston to do this work. Mr. Johnston presented the final billing on the LaSal and Blanding Shops. Bluff Senior Citizens Letter A letter was received from Bluff Senior Citizens regarding the bus and driver being stationed in Blanding and not coming to Bluff during bad weather. Administrative Assistant Rick Bailey stated that it is better for the County to house the bus in Blanding because of the savings on purchasing the gas from the County road department and the control over private use of the bus. Road Department Bids Bids were presented from the Road Department for oil filters, tires, tubes, oil, grease, anti-freeze, batteries and corrugated steel pipe. Oil Filters The oil filters were all awarded to Caun-Co. Tires and Tubes The bids on the tires and tubes were awarded to Redburn Tire, Parkway Texaco/Grand Tire and Schafer Tire according to lowest pricing on the size specifications. Oil and Grease All bids on the oil and grease were awarded to Woody's Petroleum. Antifreeze/ATF All bids were on antifreeze and ATF Dextron II, 55 gallon drums, were awarded to Black Oil Company. Batteries All bids on batteries were awarded to Monticello Motor Parts. Corrugated Steel Pipe Bids on the corrugated steel pipe was awarded to Wheeling Corrugating. The bids on the end sections and connecting bands was awarded to Contech Construction Products. A motion to approve the road department recommendations on the bids was made by Commissioner Lewis and seconded by Commissioner Black. UNANIMOUS. LaSal Shop Wiring Bids were received for the wiring at the LaSal Shop. Northern Electric bid $1650, A&E Electric bid $1905, Four Corners Electric bid $1550 and Abajo Electric bid $3230. A motion to accept the bid from Four Corners Electric was made by Commissioner Lewis and seconded by Commissioner Black. UNANIMOUS. State Department of Transportation A letter was received from the Utah Department of Transportation advising the Commission that the extension of State Route 191 was approved on December 8, 1989. The Federal Highway Administration approval of Federal Aid Primary Route 70 was effective January 19, 1990. Request to Hire/Road Department Road Superintendent Tony Brandt presented the request to hire for three positions in the road department. Mr. Brandt recommended that Francis Laws be hired for the Blanding Construction crew at Grade 12 Step 1, $7.97 per hour ; effective 2-6-90. Larry Sorrell will be a heavy equipment operator at Grade 12 Step 1, $7.97 per hour; effective 2-12-90. Lewis Calvert will be on the construction crew to replace Harold Williams that was transferred to maintenance in Montezuma Creek. Mr. Calvert will be hired at Grade 12 Step 1, $7.97 per hour; effective 2-12-90. A motion to approve these recommendations and the hiring was made by Commissioner Lewis and seconded by Commissioner Black. UNANIMOUS. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Bluff Fire Building Administrative Assistant Rick Bailey stated that the work on the Bluff fire building is completed. Mr. Bailey complimented the Bluff volunteers for their help in completing the water and sewer lines. Because of this help there was no cost to the county for hook-up to these services. The only thing needed now is some fill dirt for the area between the road and the concrete. An agreement was presented to the Commission for their signature and approval for the contract of electrical service at the Bluff Fire Building with Utah Power and Light. A motion to approve the agreement and the signing was made by Commissioner Lewis and seconded by Commissioner Maryboy. UNANIMOUS. Mancos Mesa Decision Administrative Assistant Rick Bailey reported that the BLM is going ahead with the Mancos Mesa Road as soon as possible. Dave Parker of the State BLM office will be contacted to review and possibly reverse the decision. If this process in ineffective then the County will appeal the decision to the IBLA. Senate Bill 80 A discussion was held regarding Senate bill 80. Senator Omar Bunnell introduced a bill to the Senate that would raise residential property taxes 20%. This bill would not raise property taxes on anything but residential. This bill has been killed in committee. UDOT Meeting Administrative Assistant Rick Bailey said that at the meeting held with the UDOT on January 31, 1990 the gas and fuel tank situation was discussed. Mr. Bailey has been in contact with the State Tax Commission to discuss the County's purchase of diesel and motor fuel. It was suggested that for the diesel fuel purchases could be made at local pumps and the County would not be required to pay the state and federal taxes. This method is not allowed for the leaded and unleaded gasoline at this time. This could be changed by a change of policy. Mr. Bailey will send a letter to the State Tax Commission requesting that the present policy be reviewed and changed to help out the small local governments The following suggestions were made: 1) The County would own the tank in a joint venture with the distributor and the gas purchase could be made with a card or a key lock system. 2) The distributor or wholesaler would have a card system that would record purchase amount and vehicle mileage. This type of system would help control the possibility of gas stealing. The moratorium has been lifted on the State accepting roads to their system. A discussion was held concerning the roads that the County will resubmit to the state for their acceptance on the state system. The Red Mesa to Montezuma Creek road and the Aneth to Ismay road will be submitted. Commissioner Maryboy stated that the BIA has agreed to provide the materials to fence the Montezuma Creek to Red Mesa road. Script Cards Administrative Assistant Rick Bailey reported that the San Juan Pharmacy's are doing about $4,000 a month on the scrip cards and if the county chose to pay the 10% that was discussed it would cost the County about $400 per month. After a discussion on the options it was decided that the employee would be required to pay the additional 10% of the prescription costs and the $5.00 script card charge at the San Juan Pharmacy's. A motion to approve this change in the prescription charges was made by Commissioner Lewis and seconded by Commissioner Maryboy. UNANIMOUS. Fund Transfer Administrative Assistant Rick Bailey presented the bills for the Public Safety Building that the county has paid out of the general fund. Mr. Bailey requested approval to transfer the funds in the amount of $28,727.88 from the Public Safety Account to the General Fund. A motion to sign the request and approve the transfer was made by Commissioner Maryboy and seconded by Commissioner Lewis. UNANIMOUS. Emergency Beepers Administrative Assistant Rick Bailey presented to the Commission a concept that would enable elderly single or widowed people to have a beeper to wear that they could use in an emergency situation. This beeper would then call for emergency help. This would help in the event of a fall or a sudden illness. The unit would cost about $170 to $180 and there would be a monthly service fee of $6.00. Mr. Bailey suggested that the county might be able to purchase a few of the units to rent out to people who could not afford to purchase the unit. Communications Plus has indicated to Mr. Bailey that they would be willing to install and maintain the units as a community service. Commissioner Lewis suggested that others may be interested in this service such as the handicapped. The Commission gave their approval for Mr. Bailey to further pursue this concept. Red Mesa Senior Center Administrative Assistant Rick Bailey reported that he had been to Red Mesa to tour the completed Senior Citizens Center and see what furniture they will need. Louis Tapaha, Chapter President, has requested that the county receive the bids and purchase the furniture for this building. Commissioner Black asked if Mr. Bailey had found out when the funding for the Aging programs on the reservation was sent to the Navajo Tribe. Mr. Bailey stated that he is still researching but that it looks like the funding was sent to the Navajo tribe starting on January 1, 1980. Ambulance Garage/Montezuma Creek Administrative Assistant Rick Bailey stated that the Health Services would like to build a garage for an ambulance in Montezuma Creek and are looking at the possibility of building next to the swimming pool. Mr. Bailey said he has researched the lease that the County has with the Navajo Tribe for the land for the Montezuma Creek swimming pool but has been unable to locate the original lease but the Commission minutes state that the lease was signed on May 22, 1978. Commissioner Maryboy and Mr. Bailey will follow through on this and see if the lease can be located. Creamer and Noble Payment Administrative Assistant Rick Bailey presented the final billing from Creamer and Noble for the work on the original Halls Crossing Airport site. The billing is in the amount of $3,000. A motion to approve the payment was made by Commissioner Lewis and seconded by Commissioner Maryboy. UNANIMOUS. Old Blanding Clinic Administrative Assistant Rick Bailey reported that he had finally received the keys to the Old Blanding Clinic and Blanding Senior Citizens could now determine what remodeling needs to be done. Drought Administrative Assistant Rick Bailey reported that Farmers Home Administration has declared San Juan County as a Drought area. Congressman Howard Neilson/Town Meetings Congressman Howard Nielson will be in Monticello and Blanding on February 10, 1990 to hold town meetings. Public Safety Building/Sewer Administrative Assistant Rick Bailey reported to the Commission that there has been a problem at the jail with the inmates flushing items down the toilet. The sewer backed up about three weeks ago in the city's 12 inch line and flooded a residence. The city claimed that the responsibility for this backup was the county's and called the County insurance company. Mr. Bailey informed the County Attorney Craig Halls about the situation. The items that caused the clog did not all come from the Public Safety Building. It was the opinion of the County Attorney that if the items passed through the county system with no problem that the county would not accept responsibility for the clog. Emergency 911 Number Administrative Assistant Rick Bailey reported that Monticello and Blanding city council's were very receptive to the emergency 911 service proposal from Contel. Both cities have agreed to accept the proposal. There would be a $.50 charge to the telephone customer each month. CDBG Grant Application Administrative Assistant Rick Bailey presented the application to the CDBG for money to be used for rural fire control. A notion to approve the application and the signing was made by Commissioner Lewis and seconded by Commissioner Black. UNANIMOUS. Jail Kitchen Administrative Assistant Rick Bailey reported that he had been contacted by Sheriff Claude Lacy concerning the Commission decision on eating in the kitchen. The standard practice at jail facilities is to feed the correction officers. It was the decision of the Commission that if the on duty employees in the jail( correction officers and dispatchers)were not allowed to leave during their shift they would be allowed to eat from the kitchen. This is the only people that will be allowed to eat at the kitchen. A motion to approve this change was made by Commissioner Lewis and seconded by Commissioner Black. UNANIMOUS. Courthouse Telephone System Administrative Assistant Rick Bailey discussed with the Commission the changes that would need to be made in the telephone system with the offices moving in the Courthouse. Mr. Bailey presented the following recommendations: 1) Move the present system to the new clerk's office. The cost for this would be around $2,000. Remove the road office so they would have to their own lines. 2) Sell the old system and purchase or lease a new system. (a) PBX system with an operator. (b) Centrax system that would allow all offices to have their own lines. After a discussion of these options the Commission asked Mr. Bailey to get bids on purchasing and leasing the systems and they will further discuss the system after Mr. Bailey gets these bids. COMMISSIONER MARK MARYBOY'S REPORT Montezuma Creek T.V. Commissioner Maryboy reported that Channel Five is not working in Montezuma Creek and asked if Administrative Assistant Rick Bailey would have the problem looked into. Mr. Bailey will advise Bill Bayles of the problem. InterTribal Governmental Relations Commissioner Maryboy reported that he has written to the Navajo Tribe and suggested that they establish an InterTribal Governmental Relations position. Commissioner Maryboy received a response from the Tribe asking for more information on the suggested position and a recommendation to fill the position. Commissioner Black again reminded Commissioner Maryboy that there should be a record in the county files of all Commission correspondence. Commissioner Maryboy stated that this request was not made as a County Commissioner that it was a personal letter and that he was surprised at the Tribes response. COMMISSIONER TYRON LEWIS' REPORT San Juan County Natural Resource Committee The San Juan County Natural Resource Committee met on January 31, 1990. The committee prepared a letter to the Division of Wildlife Resources concerning the depredation hunts on private lands. They are recommending that the Division allow the land owners to sell the permits to people they would like to participate in the hunts. Recreation, Roads and Airports A discussion was held concerning turning over to the cities the recreation, roads and airports. It was the opinion of the Commission that these items should all be one package and not split up. The commission will meet with the cities at a later date to discuss this matter. BLM Drought Commissioner Lewis reported that the BLM will took at the drought and the livestock on a case by case basis. They feel they can work with the livestockmen at least through the calving season. COMMISSIONER CALVIN BLACK'S REPORT State Lands Sale Notice was received of an application for land sale six miles Southwest of Moab in San Juan County. Blanding Rodeo Grounds Lease Commissioner Black reported that he had been contacted by an individual interested in using the Blanding Rodeo grounds for roping clinics. The Blanding 4-H groups are also interested in using the rodeo grounds. The 4-H club has submitted the following proposal: 1) Clean up the grounds. 2) Clear all of the brush. 3) Remove old posts and lumber from the track. 4) Repair bleachers. 5) Level the inside of the arena. 6) Remove the excess sand. 7) Repair the access road. 8) Repair holding pens. 9) Supply power and have sufficient lighting. All of the above improvements will be made and we as a club will supply labor only. Any additions, return alley, trappings chutes, release gates, etc, that person or persons supply , or for the County use, if the County will not pay such will remain the property of said person or persons. The County will supply or help supply sanitation facilities. The County will have the right to appoint as overseer or grounds keeper, of club or clubs. It was the decision of the Commission to look at the lease agreement the County has with the American Legion before any decision is made about the Blanding Rodeo Grounds. This item will be on the agenda for next week. Utah Energy Office Contract A motion to authorize Recreation Director Eddie Allred to sign a contract with the Utah Energy Office on the Monticello Pool was made by Commissioner Lewis and seconded by Commissioner Black. UNANIMOUS. Travel Request Commissioner Black requested travel permission to Salt Lake City to do some lobbying at the legislature concerning the County. The Commission gave approval for this travel.
