SAN JUAN COUNTY COMMISSION MEETING MINUTES FEBRUARY 26, 1990 The regular meeting of the San Juan County Commission was held in the Commission Chamber at Monticello, Utah at 10:00 A.M. Present:Tyron Lewis, Chairman Mark Maryboy, Vice Chairman Calvin Black, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk A motion to approve the minutes of the February 20, 1990 meeting as written was made by Commissioner Black and seconded by Commissioner Maryboy. UNANIMOUS. CURRENT BUSINESS Congressman Candidate/Steve Densley Steve Densley, Republican Congressional candidate for the third district, met with the Commission to introduce himself and let the Commission know that he is concerned with problems of the Commission. Mr. Densley stated that he is zero wilderness oriented and he wasn't aware of the political affiliation of the Commissioners, but he did not agree with Congressman Owens wilderness proposals. The Commission informed Mr. Densley that Commissioner Maryboy was a Democrat. Commissioner Maryboy stated that he totally disagrees with Congressman Owens wilderness concepts. Commissioner Maryboy asked Mr. Densley how familiar he was with the Indian issues. Mr. Densley stated that he has visited with the Indian people in the Vernal area and he is very interested to find out more about the Indian issues state wide. County Attorney Craig Halls/Commission Resignation County Attorney Craig Halls met with the Commission to discuss the resignation of Commissioner Black and how the new Commissioner will be appointed. Mr. Halls stated that; 1) The vacancy has to be made by written resignation, 2) The Republican central committee will submit six names to the two remaining Commissioners, 3) The commission then has 30 days to appoint one of the six central committee candidates to fill the vacancy, 4) If the Commission cannot come to a decision then the names will be submitted to the Governor for his decision. The Governor will have 30 days to make his decision. Courthouse Stairs Maintenance Supervisor Dell Hunter met with the Commission to discuss the carpeting of the stairs in the Courthouse. The metal strips that are currently on the stairs are not secure and are dangerous. The carpet contractor stated that he doesn't feel that the metal strips can be securely glued and should be removed. There is a rubber stairway material that can be purchased to go on all the stairs. It would cost about $1500 to use this material on all of the stairs in the courthouse. The motion to approve this purchase was made by Commissioner Maryboy and seconded by Commissioner Black. UNANIMOUS. Courthouse Office Space County Clerk/Auditor Gail Johnson informed the Commission that she had been contacted by Kelly Green, Social Services Social Worker, about having an office on the main floor of the courthouse. Mr. Green would like to have the office that John Fellmeth is currently using. Mrs. Johnson stated that she was hoping to move the microfilm camera back up from the basement, but if the office currently being used by the recreation department is vacated that office would be ideal for the microfilm camera because there are no windows in this room. A decision on this matter will be made at a later date. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Creamer & Noble/Amendment Administrative Assistant Rick Bailey presented an amendment to the contracts for the Aneth to Ismay road. This amendment will allow the county to do 3,000 feet of the work. This amendment will reduce the contract with Creamer and Noble by $4,000. A motion to approve the contract and the signing was made by Commissioner Maryboy and seconded by Commissioner Black. UNANIMOUS. Charles Henderson, representing the Navajo Tribe, Creamer and Noble and the County representatives will meet on March 14, 1990 at the Aneth Chapter house to discuss the Aneth to Ismay road project. Mancos Mesa Road Administrative Assistant Rick Bailey reported that he had spoken with Jim Parker, State BLM Director, concerning the County's protest on the Mancos Mesa road. Mr. Parker indicated that the letter he had received from the County asking him to review the decision on the Mancos Mesa road would protect the county in the appeal process. The County will still be able to file an appeal to the IBLA. Building Permit/Doyle & Marilyn Rowley A building permit application was received from Doyle and Marilyn Rowley for a 24'x16' recreation cabin. This will be built in the Blue Mountain Acres area by the Blue Mountain Guest Ranch. A motion to approve the application was made by Commissioner Black and seconded by Commissioner Maryboy. UNANIMOUS. Procurement Administrative Assistant Rick Bailey presented a request to purchase four portable radios for use in the Senior Citizens buses. These units will be taken out of the vehicles after each use so the County will not have to purchase as many radio units. Bids were received from Wesley Hunt Company for $2,200 for four units and Motorola bid $3,280 for four units. A motion to accept the bid from Wesley Hunt Company was made by Commissioner Black and seconded by Commissioner Maryboy. UNANIMOUS. Travel Request Administrative Assistant Rick Bailey reported that he will be traveling to Salt Lake City on February 28, 1990 to attend the Community Impact Board concerning ambulances and the Edge of the Cedars Museum. Mr. Bailey will be attending the Solid Waste Workshop on March 1, 1990. Mr. Bailey will also meet with Jerry Miller and Dee Hansen of the Division of Parks and Recreation concerning the Monument Valley visitors center. Blanding Ambulance Association The Blanding Ambulance Association is applying to go from a Basic to an Intermediate Level of service. The Blanding Ambulance Association has received support from the Health Board. The Association is waiting for the Approval from the Doctors. A letter of support based upon the approval of the doctors will be sent from the Commission. A motion to approve the letter of support was made by Commissioner Maryboy and seconded by Commissioner Black. UNANIMOUS. Blanding Senior Citizen Bus Driver Blanding Senior Citizens bus driver Morris Swenson will be cutting down the number of times he will be driving. Mr. Bailey requested permission to advertise to hire another part-time bus driver. The motion to approve the advertising was made by Commissioner Black and seconded by Commissioner Maryboy. UNANIMOUS. Surplus Property Two surplus camper shells that the County has were advertised for sale by bid. Only one bid was received. Dell Hunter bid $100 for the short wheel base camper shell. A motion to accept the only bid was made by Commissioner Black and seconded by Commissioner Maryboy. UNANIMOUS. COMMISSIONER MARK MARYBOY'S REPORT Bluff Community Building Commissioner Maryboy reported that he had spoken to Susan Herman about the locks at the Bluff Community Building and Ms. Herman stated that the locks were in good repair. Commissioner Maryboy talked with the maintenance man at the UNDC and he stated that the locks were in very bad shape and needed to be replaced. Administrative Assistant Rick Bailey will handle this matter. Aneth and Red Mesa Chapter Meeting Commissioner Maryboy reported that the Aneth and Red Mesa Chapter residents are concerned over the recent death of an oil field worker. The main concern is that the H2S gas has no odor and Navajo sheep herders are unaware of the dangers. Administrative Assistant Rick Bailey will get Commissioner Maryboy the phone numbers to contact the State Division of Oil, Gas and Mining and also OSHA. Legislative Session Commissioner Maryboy stated that he had been a member of the Governor's Indian Task Force. Commissioner Maryboy said that he thought that the purpose of the Task Force was to address Indian problems. At the last meeting that was held in December the Task Force passed ten bills and resolutions. Commissioner Maryboy felt that all of these bills and resolutions were anti-Indian. The Indian tribes marched on Capital Hill and a resolution was presented to the Legislature. Commissioner Maryboy stated that it was very appalling that the legislature didn't respond. Commissioner Maryboy reported that Senate Bill 202 concerning Indians was just left in the House and died there. Commissioner Maryboy said that he felt the Senators and Legislature were short sited. Senator Myran of Duchense had a bill he presented, drafted, and approved in one day. Commissioner Maryboy stated that Representative David Adams introduced House Bill 312 that would waive the soverignty of the Indians in regards to water rights. The Aneth Chapter passed a resolution to recall David Adams for his activities in the State Legislature. Commissioner Maryboy reported that House Bill 312 did pass as far as he knew. Commissioner Black stated that there are no recall provisions in Utah law and asked why Senator Omar Bunnell was not included in the resolution. Commissioner Maryboy said that Senator Bunnell was included in the recall resolution. Administrative Assistant Rick Bailey presented the Legislative report from the Deseret News that showed that House Bill 312 did not pass. COMMISSIONER CALVIN BLACK'S REPORT State Lands Board Meeting Commissioner Black reported that he had attended a State Lands Board meeting in Salt Lake City last week. There was a request to purchase submitted for a School Section near Shirttail Corners. The request was from the Native American Foundation. The Foundation wants to purchase the land at market value to protect the archeological and cultural heritage. Pat Spurgin will be in Blanding in the near future to look over this area. COMMISSIONER TYRON LEWIS' REPORT Halls Crossing Airport The final Airport Master Plan for the site in the recreation area was received from Creamer and Noble. The Airport Master Plan will be available for review in Administrative Assistant Rick Bailey's Office. Forest Service/Drought A notice was received from the Forest Service that they will be working with permitees on a case by case basis. The report for the water year which begins in October and runs through September showed the following; 1988, 17.39 inches of precipitation which was 8% over normal, 1989 9.63 inches of precipitation which is 40% below normal, 1990 (first four months) 1.28 inches of precipitation which is 80% below normal. In 1977 drought year there was 9.56 inches of precipitation which was 39% below normal. These figures are from the Monticello Port of Entry. The Forest Service is working on an Interagency meeting to work on the wildlife forage problems. Public Lands News A notice of renewal was received from the Public Lands News. A motion was made by Commissioner Black and seconded by Commissioner Maryboy to renew this publication. UNANIMOUS. Travel Request Commissioner Lewis stated that he will be traveling to Salt Lake City with Rick Bailey to attend the Community Impact Board Meeting on February 28, 1990.
