SAN JUAN COUNTY COMMISSION MEETING MINUTES JUNE 4, 1990 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present:Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk A motion to approve the minutes of the May 29, 1990 meeting as amended was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. Audit Report/Kay Kimball Kay Kimball of Kimball and Roberts Certified Public Account's, Clerk/Auditor Gail Johnson and Deputy Auditor John Fellmeth met with the commission to discuss the recently completed audit of San Juan County. Mr. Kimball presented an audit report and the management letter to each of the commissioners. Mr.Kimball reviewed each section of the audit report and answered questions concerning the report. Mr. Kimball discussed a few areas that he felt needed to be improved. Mr. Kimball said he appreciated the way the county employees are doing their work and the cooperation he and Mr. Roberts received when doing the audit. Commissioner Redd thanked Mr. Kimball for the appreciation and said it is nice for county personnel to receive outside appreciation. South Road Foreman Road Superintendent Tony Brandt presented a request to hire for Lou Calvert for the south road foreman. The present foreman Stanley Hawkins has requested to return to heavy equipment operator. Mr. Brandt stated he had requested applications for the vacancy in-house and had received three applicants. Mr. Brandt said he had interviewed each applicant and is recommending Lou Calvert be hired as south road foreman at Grade 20 Step 1; effective 6-4-90. A discussion was held on the interview process and procedure. A motion to approve the recommendation of Mr. Brandt was made by Commissioner Redd and seconded by Commissioner Maryboy. Commissioner Maryboy stated he felt David Yanito was more qualified than Lou Calvert to be the road foreman and felt the county needed more Navajos in higher positions. UNANIMOUS. Mr. Brandt presented a request for a salary increase for David Yanito who will be assistant south road foreman. Mr. Yanito will be Grade 14 Step 5, 10.24 per hour; effective 6-4-90. A motion to approve the change was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. Mr. Brandt presented a request for reduction in salary for Stanley Hawkins. Mr. Hawkins will be reduced to Grade 14 Step 8, $11.63 per hour;effective 6-4-90. A motion to approve this change was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. Mr. Brandt requested permission to advertise in-house to replace Howard Rogers who has terminated. Mr. Brandt said he felt there were personnel who would be interested in moving to heavy equipment operator. Commissioner Maryboy requested that a minority be assigned to set on the interview panel. A motion to approve the appointment of Harold Williams to set on the interview panel and the request to advertize in-house was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. Aneth to Ismay Road/Scoping Meeting Administrative Assistant Rick Bailey reported a scoping meeting on the Aneth to Ismay road project will be held on June 5, 1990 at 10:00 a.m. in the Blanding library. A motion to appoint Commissioner Redd who will be attending the meeting to sign the agreements for the county was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Drought Proclamation Administrative Assistant Rick Bailey presented the drought proclamation to the Commission for renewal. The proclamation need to be renewed for the period of May 10th through June 10th and June 10th through July 10th. A motion to approve this renewal was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Right-of-Way Easement/Mexican Hat Special Services District Administrative Assistant Rick Bailey presented a request for a right-of-way easement for the Water and Sewer Districts. A motion to approve the request was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Aging Plan 1990 Fiscal Year Administrative Assistant Rick Bailey presented the aging plan for the fiscal year 1990 to the commission for their approval and signature. A motion to approve the plan and the signing was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Utah Summer Games Administrative Assistant Rick Bailey discussed with the Commission the Utah Summer Games that will be held in Cedar City on June 25, 1990 at 7:00 P.M. San Juan County is being honored at the event and the Commission has been invited to participate in the opening ceremonies. It was the decision of the commission to fly over to Cedar City for the opening ceremonies and fly home again that evening. Emergency Number 911 Administrative Assistant Rick Bailey reported he met with Contel representatives Colleen Johnson and John Bergstrom to discuss the emergency number 911 for the county. Most places that are served by the 911 number have a 50 cent charge on the customer billing each month to cover the costs. Because of the size and dispersity of the population in San Juan County this 50 cent per month fee would not cover the costs for maintaining the service. The proposals that are being discussed are 1) the cities request funding from the Community Impact Board 2) Contel meet with Navajo Communications and request their assistance in setting up this service. Mrs. Johnson and Mr. Bergstrom discussed with Mr. Bailey the following proposals for the signing and numbering the county roads 1) contact Utah Power and Light and Empire Electric for their assistance in the project 2) Contel would purchase the signs if the county would furnish the labor to have them installed. Independent Employees/Contracts Commissioner Redd expressed his concerns over the contracts the county presently has with independent employees. Commissioner Redd said he is concerned about these people not being licensed in this type of a business. This will be discussed with County Attorney Craig Halls. Overtime Administrative Assistant Rick Bailey discussed with the commission the present county policy on overtime. Currently employees who work overtime are required to take the time as comp time at time and one- half the time worked instead of receiving payment. Mr. Bailey stated he felt valuable time on the equipment in the road department was being lost with the present policy. Blanding Senior Citizens Center Administrative Assistant Rick Bailey discussed with the Commission the possibility of the Blanding Senior Citizens cutting some of their funded programs to make a budget adjustment for the money needed for the remodeling project. Mr. Bailey requested permission to meet with the Blanding Senior Citizens to see if they are willing to cut some of their programs and have fund raisers if needed to raise the extra funds needed for the remodeling project. A motion to approve Mr. Bailey meeting with the Blanding Senior Citizens to discuss this proposal and advertising for bids on the center if the Blanding Senior are agreeable to the stipulations was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Telephones Dell Hunter met with the commission to discuss several ten button telephones out of the old sheriff's office that were left out of the auction. Mr. Hunter requested permission to allow Kim Hoggard of Communications Plus to sell these telephones for the county. The commission said they had no objection to this proposal. Television Reception Commissioner Maryboy reported the television reception for channels Two, Four and Five is out in Bluff, Montezuma Creek and Aneth. Administrative Assistant Rick Bailey will report this problem to Communication Specialist Bill Bayles. Interagency Meeting Commissioner Redd reported he attended a Interagency meeting and he and Mark Lyman were the only ones in attendance. UAC Four County Meeting Commissioner Redd will attend the UAC four County meeting to be held in Price, Utah on June 7, 1990. The B road statute and the changes in the B & C roads will be discussed. City of Monticello Monticello City officials met with the Commission to discuss the airport and road proposals. The City reported they have hired Sam Morris as a fixed base operator at the airport. The agreements with the county are being reviewed by the City Attorney. County Attorney Craig Halls will be asked to review these agreements with City Attorney Lyle Anderson. Councilman Winn Westcott has contacted Ron Theobold of the FAA concerning the slurry for the airport. Mr. Theobold instructed the City to get bids on this project and they would consider participating in the costs. Mr. Westcott has contacted Intermountain Slurry and Century Asphalt for bids. The City of Monticello presented a letter requesting to work with the county on building inspections. The city is willing to contribute $1,000 for the training and proposed to pay a fee of $15.00 per building for inspections. This proposal will be given to Building Inspector Bruce Bunker . Mayor Jack Young asked if the Commission had reviewed the proposals the City presented in the last commision meeting to consider for capital improvements for this year. The Commission stated they were in favor of drilling a water well and purchasing of the radio. A motion to approve these expenditures was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. A discussion was held concerning the annexation for the cities and the Port-of-Entry and UMETCO mill. Building Permit An application for a building permit was presented for Danny Flannery of Blanding. Mr. Flannery is proposing to build a log home on lower flour mill road in the Blanding area. A motion to approve the building permit was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. Pecos Conference A notice was received of the 63rd Annual Pecos Conference that will be held at the Edge of the Cedars in Blanding on August 16-19, 1990. Procurements Fair board secretary Nancy Foster presented bids for the PA system at the fairgrounds. Mrs. Foster said she had received two bids and one bidder had withdrawn his bid by a telephone call on May 31, 1990. The bid from Communications Plus was for $2813.65. A motion to approve the bid was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. Human Services Board Funding Requests Commissioner Lewis reported he received letters from Lynn Lee of CEU and Jed Lyman, director of the Human Services Board concerning the funding requests to the Human Services Board. Commissioner Maryboy sent letters to the Oljato and Navajo Mountain Chapters telling them the May 3, 1990 deadline had been extended to May 23, 1990. Commissioner Lewis said that this extension date had not been approved through the commission and Commissioner Maryboy had approved the extension as one commissioner. Commissioner Maryboy said he was thinking of the constituents in Commissioner Lewis' district and thought they should know about the funding they could request. Commissioner Lewis said he had no problem with Commissioner Maryboy writing to the Navajo Mountain and Oljato Chapters, but he did have a problem with Commissioner Maryboy extending the deadline for applications without the approval of the commission as a board. Commissioner Maryboy said he didn't feel he had done anything wrong in this matter. A motion to stand by the original application deadline of May 3, 1990 was made by Commissioner Redd. Commissioner Lewis passed the Chair to Commissioner Maryboy and seconded the motion. Commissioner Maryboy voted NAY. The Chair was passed back to Commissioner Lewis and Commissioner Maryboy was excused for the rest of the meeting. The Commission discussed the make-up of the Human Services Board and the possibility of changing the board members next year. Request to Hire Weed and Rodent Supervisor Paul Weber presented a request to hire for Shane Barr as a seasonal part-time employee. Mr. Barr has been employed for the previous three years in this position. A motion to approve this hiring was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. San Juan County Mental Health Contracts Social Services Director Mark Lyman presented to the Commission the contracts with the State of Utah for Mental Health Funding. These contracts allow yearly evaluation of local mental health patients. A motion to approve the contracts and the signing was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Out-of-State Travel Road Superintendent Tony Brandt requested permission for out-of-state travel to attend a machinery auction in New Mexico and Colorado. A motion to approve the request was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Watts Line Clerk/Auditor Gail Johnson met with the Commission to discuss the Watts line in the courthouse. Mrs. Johnson said with the new telephone system at the courthouse the road department and the travel council are not hooked up to the call accounting system. These two departments are heavy watts users. After a discussion on possible ways to monitor and bill watts users in these departments the Commission authorized Mrs. Johnson to research ways to resolve this problem with Contel and Communications Plus. Recreation Concern Clerk/Auditor Gail Johnson asked the Commission who was to pay the billing for the Eastland recreation building. After a discussion it was the decision of the Commission to pay the billings for this year. Sheriff Claude Lacy Letter A letter was received from Sheriff Claude Lacy advising the Commission he had discussed the workers comp and sick leave payments with Rudy Cook & Tom Dyer and they had advised the sheriff they will consult with their attorneys on this matter. Request to Purchase Maintenance Supervisor Dell Hunter requested permission to get bids for a riding mower for use to mow the courthouse and the Public Safety Building lawns. A motion to approve Mr. Hunter's request to receive bids for a riding mower was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Bullfrog Marina Employees Association A letter was received from the Bullfrog Marina Employees Association requesting the Commission's help in fixing the television translator on the Henry Mountains that transmits television reception to Bullfrog, Halls Crossing, Hite and Ticaboo. The Association has raised funds and is requesting the counties donate $350.00 to help bring the translator back on line. The Association would like to have the counties include this service in a special services district to maintain the translator site. The Commission felt a special services district could be a possibility if ARA was favorable to the district being established. A motion to support the request if the other counties that are contacted and agree to help was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Michael Murphy Property Michael Murphy has requested a 60 day period to pay the amount of the taxes to purchase a parcel of land from the county he lost because of delinquent taxes. A motion to allow Mr. Murphy to purchase this parcel for the amount of the taxes owing within sixty days was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Administrative Assistant Rick Bailey will send Mr. Murphy a letter informing him of this action. Travel Council/Peggy Humphreys The Commission requested Peggy Humphreys attend the meeting to discuss the travel council. Commissioner Lewis asked Mrs. Humphreys about her out-of-state travel to Oregon in April. Mrs. Humphreys stated the out-of-state travel was approved in September or October of last year. The commission requested Mrs. Humphreys submit her pre-approved request to the Commission. A discussion was held about a letter of complaint the Commission has received from Wanda Franklin at the road department concerning Mrs. Humphreys and the use of county vehicles. Mrs. Humphreys said she did not agree with the complaints being made against her and she requested a copy of the letter so she can make a response to Mrs. Franklin. The Commission discussed with Mrs. Humphreys the request to hire she had made to the Commission on May 21, 1990. Commissioner Lewis said when the combined visitors center was being planned he understood that there would be volunteers and the city would help staff the center in the summer months. Commissioner Lewis said if the volunteer help is not available the center would have to be closed. The County will not hire any more workers. Mrs. Humphreys said she currently has a Project Good Works student working in her office for five weeks at no cost to the county. Carl Eiseman, a volunteer worker, will be back after this time. Commissioner Redd asked Mrs. Humphreys if the Economic Development Council had taken a stand on wilderness. Mrs. Humphreys said they had discussed wilderness and had decided to support the Commission on their stand on wilderness. Mrs. Humphreys provided stationary and envelopes to the members to write letters about wilderness. Commissioner Redd said he would like to see the Council become personally involved in the wilderness issue. Mrs. Humphreys said she hasn't personally attended any meeting because she is too busy. Mrs Humphreys invited the Commission to attend the meeting of the Economic Development Council on June 12, 1990 at the Blanding City building at 7:00 P.M. Hand Held Radios Administrative Assistant Rick Bailey reported the hand held radios the commission had approved for purchase by fire control will not accept the required frequency. Mr. Bailey requested permission to have the radios upgraded for approximately $60 or purchase the next lowest bid that will accept the frequency. A motion to accept the proposal was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS.
