SAN JUAN COUNTY COMMISSION MEETING MINUTES JULY 2, 1990 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present:Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Dena Hunter, Deputy Clerk Excused:Rick Bailey, Administrative Assistant A motion to approve the minutes of the June 25, 1990 meeting as written was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. CURRENT BUSINESS Recreation Request Eddie Allred met with the Commission to discuss the possibility of Monticello recreation purchasing gas and oil from the County. After a discussion the Commission told Mr. Allred they would discuss this request with County Attorney Craig Halls and would let him know the decision. Building Permit An application for a building permit was presented from Greg Henning. Mr. Henning proposes to build a 28'x34' home in the Pack Creek subdivision. A motion to approve the permit was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS Procurement Bids were presented from the Extension Service for a VCR. This VCR will be raffled off for a fund raiser for the fair. Bids were received from Sears-Monticello Agency for $204.97 and Blue Mountain Music for $280.00. A motion to accept the bid from Sears was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Bids were presented for an oil distributor for use int the road department. Bids were received from Dick Walton for $28,000.00 and Western Road Machinery for $36,800.00. A motion to approve the bid from Dick Walton was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Bids were presented for air conditioning units for the Road Department heavy equipment. Wheeler Machinery bid $6,375 each for parts only and ARA bid $795 for each unit and $715 each if ten or more were purchased. A motion to approve the bid from ARA was made buy Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. Court Contracts Clerk/Auditor Gail Johnson presented the contracts with the State Court Administrators Office for the courts for the fiscal year. The contracts are for $64,442. A motion to approve the contracts and the signing was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. Board Of Equalization Clerk/Auditor Gail Johnson told the Commission the tentative dates for the County Board of Equalization are August 6th & 13th from 1:00 P.M. to 5:00 P.M. Congressman Wayne Owens Visit Congressman Wayne Owens will be in San Juan County on July 7, 1990. The Commission has been invited to meet with Congressman Owens and tour Cedar Mesa and the Montezuma Creek area with him. Commissioner Lewis said he will be out of town. Commissioner Redd and Commissioner Maryboy will meet with Congressman Owens. Halls Crossing Airport-Final Environmental Impact Statement The final Environmental Impact Statement for the Halls Crossing Airport was received by the Commission. Montezuma Creek to Aneth Road Project A letter was received from the Utah Department of Transportation regarding the highway from Montezuma Creek to the Colorado state line. Phase I of the project is from Montezuma Creek to Aneth and is being planned for the 1991 fiscal year. The Utah Department of Transportation requested a letter of support for this project from the Commission. A motion to approve a letter of support from the Commission was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. The Commission will request letters of support from the Navajo Chapters and the Navajo Tribe. U.S. Forest Service Aaron Howe, Lee Bennett and Brent Barney of the U.S. Forest Service met with the Commission to present draft copies and plats for seven roads for which the Commission has requested an easement from the Forest Service. Mr. Howe said after the easements and plats have been reviewed the Commission should send resolution of acceptance of the easements to the Forest Service. The County will be able to get State road funds for these roads once the easements are given to the County. The easements will be renewable annually and are not long term easements. A new Forest Service road agreement was presented to the Commission for their review. The Forest Service requested an annual meeting to discuss Forest Service roads with the County be set up in February so that any budget items can de identified. Mr. Howe told the Commission of the Forest Service Timber Bridge program. There is a Grant set up to help with funding for the construction of Timber Bridges on Forest Service lands. This Grant will pay $30,000 or up to 50% of the cost of construction of the bridges. Mr. Barney expressed a concern over the timber hauling on the South Cottonwood road. A discussion was held concerning an easement from the Ute Tribe for this road. The Commission will contact Cleal Bradford to see if an agreement for easement with the Ute Tribe can be worked out. San Juan Dine`Fair Albert Mark and LaSalle McKenzie met with the Commission to discuss the progress of the San Juan Dine`Fair. The following names were presented as fair board members: Albert Mark; Chairman, George Etsitty, Vice-Chairman; Marlene Dee Ben, Secretary; LaSalle McKenzie, Treasurer, and Wesley Oshley, Wayne Lansing, Melinda Bedoni, Herb Jones, Robert Johnson and Richard Yanito, Coordinators. It was recommended that Commissioner Maryboy be the Commission representative on the board. A motion to approve the fair board members and Commissioner Maryboy as the Commission representative was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. The following letter was presented to the Commission. July 2, 1990 Board of Commissioners San Juan County P.O. Box 9 117 South Main Monticello, Utah 84535 RE: Utah Navajo Fair Dear Gentleman: This is a request to draw-down of the $35,000 appropriated by the San Juan County Board of Commissioners for the Utah Navajo Fair. While we are still awaiting action by the Budget and Finance Committee of the Navajo Tribal Council on the tribal portion, per the attached resolution of the Utah Navajo Development Council at a June 15th Board meeting, the UNDC Board of Trustees approved $40,000 in matching funds. As well, we are hereby formally requesting the following assistance through San Juan County Board of Commissioners in preparation for and the execution of the Utah Navajo Fair. We previously requested these from Commissioner Maryboy, but wanted to make it formal herewith: 1. Inclusion of the Utah Navajo Fair in the County's Liability Insurance. 2. That security be provided by the San Juan County Sheriff's Department. We will request that the Navajo Police assist in this regard. 3. That the San Juan County Roads Department clear that the area designated for the First Annual Utah Navajo Fair and survey areas needed to be cleared. Sincerely, /s/ Dick Neztsosie Dick Neztsosie, Executive Director Utah Navajo Development Council The Commission stated that there were certain conditions to be met before the fair board can obtain the money that San Juan County has budgeted for the fair. These conditions are: 1) a resolution from each of the Utah Chapters supporting the location of the fair 2) other matching monies need to be in-hand. The Commission requested that the Utah Division of Indian Affairs send a letter to the Commission stating they will commit $40,000 to the San Juan Dine`Fair. The Commission said they would have to check on the County liability insurance to see if it would cover this event. Mr. Mark said he had checked into the cost of liability insurance for this three day event and the cost is approximately $1114.00. Commissioner Maryboy said he had talked with Sheriff Claude Lacy and Sheriff Lacy had said his department would provide the security for the fair. The Commission discussed with County Attorney Craig Halls the land to be used for the fair. Mr. Halls said the land belongs to Claude Lacy, Melvin Gaines and Cory Perkins. The land owners have agreed to the use of their land for the fair if the land is cleared and left clean. Mr. Halls will draw up the agreements for the lease from the land owners. A motion was made by Commissioner Redd for the County to give the Fair board the additional money needed to purchase the liability insurance for the fair, have the road department clear the land and let the UNDC be the sponsoring agent of the Fair. The motion was seconded by Commissioner Maryboy. UNANIMOUS. Lawsuit County Attorney Craig Halls informed the Commission of a possible lawsuit against the County and Monticello City by Larry Vigil concerning a drug arrest last year. Correction Officer/Sheriff's Deparment County Attorney Craig Halls reported to the Commission a corrections officer at the San Juan County Jail had been written up twice by the State Department of Corrections and may need to be placed in a different job. Social Services Contracts Social Services Director Mark Lyman presented the contracts with the Department of Corrections to provide mental health treatment for the State inmates at the San Juan County jail. This contract is in the amount of $32,000. A motion to approve the contracts and the signing was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. Mr. Lyman presented a contract with the State Department of Health. This contract will allow billing for the Medicaid patients. A motion to approve the contracts and the signing was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. ASFCME Request A discussion was held concerning the ASFCME Union request for the County to adopt an ordinance concerning union membership. A motion was made by Commissioner Redd to leave the County policy as it is presently and allow employees to join the union if it is their wish. The motion was seconded by Commissioner Maryboy. UNANIMOUS. Clerical Request/Judge Muhlestein A discussion was held with County Attorney Craig Halls concerning the County hiring Judge Muhlestein's wife to be his clerical help and the possibility of hiring a part-time clerk for this office. This matter was tabled until the next meeting to allow time for County Attorney Craig Halls to research the Nepotism Law. Resolution 1990-4 The following resolution was presented concerning wilderness. RESOLUTION 1990-4 WHEREAS, San Juan County, Utah Navajo Development Council, Blanding City, and Monticello City endorse multiple use of all public lands for all races, including but not limited to wood gathering, pine nut gathering ritual herb gathering, oil exploration, mining, grazing, water development, hunting, fishing, tourism, recreation, and other uses; and WHEREAS, San Juan County, Utah Navajo Development Council, Blanding City , and Monticello City believe multiple use of our public lands creates economic development, job opportunities, and preserves existing and historic livelihoods; and WHEREAS, San Juan County, Utah Navajo Development Council, Blanding City, and Monticello City believe that the preservation of our environment should include man, NOW THEREFORE, BE IT RESOLVED by San Juan County, Utah Navajo Development Council, Blanding City, and Monticello City that Wayne Owens be petitioned as follows: 1) to support us in our efforts to be industrious and self-sufficient 2) to support us in our efforts to maintain multiple use of public lands without the restrictive designation of wilderness so that our people may enjoy the economic benefits that other people in the nation enjoy. UTAH NAVAJO DEVELOPMENT COUNCIL SAN JUAN COUNTY /s/ Ty Lewis, Chairman BLANDING CITY MONTICELLO CITY UNDC Recreation Request The UNDC has requested the County Road Department finishing hauling the sand into the baseball field at Halchita that was not completed last year. The UNDC has also requested repair work be done at the Montezuma Creek Swimming Pool. A motion to approve the request to haul the sand and have Administrative Assistant Rick look at the Montezuma Creek Pool was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. COMMISSIONER MARK MARYBOY'S REPORT Chapter Planning Meetings Commissioner Maryboy reported he will be attending the Aneth and Red Mesa Chapter meetings on July 2, 1990. Congressman Owens Visit Commissioner Maryboy reported he will be meeting with the UNDC and Congressman Owens on July 7, 1990. They will meet at the Elk Ridge Cafe at 8:00 A.M.. Travel Commissioner Maryboy reported he will be traveling to Salt Lake on July 5th and 6th on UNDC business. COMMISSIONER BILL REDD'S REPORT Auditor's Meeting Commissioner Redd reported he had traveled to Wendover, Utah to attend the Auditor's meetings on June 26-28, 1990. UAC Assessing and Collecting Commissioner Redd reported he attended the UAC Assessing and Collecting meeting in Salt Lake City on June 29, 1990. All of the formula that were discussed had San Juan County as a contributing county. COMMISSIONER TY LEWIS' REPORT Letter Agreement/City of Blanding A Letter Agreement with the City of Blanding was presented. This agreement is for the placing of a culvert at Main Street from 700 South to 900 South. A motion to approve the agreement was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Canyonlands National Park Commissioner Lewis read a statement concerning the opposition that has been received on the improvements at Canyonlands National Park Needles District. The Commission will send a letter of support for the facilities. Navajo Mountain to Oljato Road A letter of thanks will be sent to Senator Garn for recommending funding for a feasibility study for the Navajo Mountain to Oljato road. Auditor's Letter A letter was received from Kimball & Roberts, the firm that did the County's Audit. The Commission had asked about the private contractors that the county hires. It was the opinion of Kimball & Roberts that Public Defenders are not considered employees for IRS purposes. Contractors for custodial work may need to be looked at to be made County employees. Commissioner Lewis reported he will not be to Commission meeting on July 9, 1990 as he will be out-of-town.
