SAN JUAN COUNTY COMMISSION MEETING MINUTES August 6, 1990 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present:Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk A motion to approve the minutes of the July 30, 1990 meeting as written was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. CURRENT BUSINESS Underground Storage Tanks/Blanding Airport The City of Blanding has requested information on the underground fuel storage tanks at the Blanding Airport. San Juan County has had the tanks assessed and will have a report sent to the County. Wanda Franklin will contact Ron Fredrickson for this information. Administrative Assistant Rick Bailey will contact Blanding City and advise them the county will make a decision on the underground tanks after reviewing the report. Civil Rights/Community Relations Basilica Hansen and Art Montoya of the Civil Rights/Community Relations office in Denver, Colorado, met with the Commission to discuss the function of their office. Administrative Assistant Rick Bailey had contacted the office for information on what services are provided by this office. Community Relations is a division of the Civil Rights Office of the United States Department of Justice. Mrs. Hansen said the purpose of this office is to provide consolation and mediation with the minority people to assure they are not being denied rights because of race, color or national origin. The Community Relations office works with the local community and serves as neutral third party interveners. The Community Relations is covered by the confidentiality clause and anything discussed in the mediation process would be handled under this clause. The mediators would not be able to be called as witness if a case was brought to the Courts. This issue has been challenged in Court and the Court has ruled that mediation must remain confidential. Commissioner Maryboy asked what kind of cost to the County was involved in having the Community Relations office mediate. Mrs. Hansen said that there is no cost to the County that these services are provided by taxes. Mrs. Hansen said the only way the that the Civil Rights office can have the power to implement changes is if an agreement is signed. The Civil Rights Office will not force anyone to sign an agreement. The assessment and mediation process will probably involve Mrs. Hansen nd Mr. Montoya and the length of time is dependant on how cooperative the people they talk with are. Commissioner Redd asked if the Commission was to outline the friction areas. Mr. Montoya said that would possibly help but they would find the problem areas from their work. Mr. Montoya said the Civil Rights office can come to a community and mediate without a formal request. The Community Relations office will at times do an assessment just from a newspaper article about troubles that communities are having. Commissioner Maryboy asked how the Community Relations Office deals with discrimination. Mr. Montoya said they will work with both parties. The job of the Community Relations office is not to make a legal decision. The Office tries to resolve the matters to a "win-win" situation so everyone comes out a winner. Mr. Montoya said he was aware that peoples personalities come into play when mediation are going on. Part of the function of the mediation are finding what different alternatives there are available to help solve the problems. Commissioner Redd asked how much experience the Community Relations Office had in working with the difference in culture and the Reservation lands. Mr. Montoya said the office has worked a great deal with different Indian Tribes but not in this area. Commissioner Lewis asked if there were some cases that the Community Relation Office had worked on that the Commission would be able to review. Mrs. Hansen said she could probably get some copies of agreements that were signed after the mediation process was completed. Agreements are not always a signed document. Mrs. Hansen will talk to some of the parties involved with mediation agreements and see if they will give their permission for the Commission to review the agreements. A motion to endorse the efforts of the Civil Rights Office to talk with others and discuss the conflicts between the Anglos and the Navajo people was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. Mr. Montoya and Mrs. Hansen expressed their appreciation to the Commission for letting them visit with them this morning. Mr. Montoya said they would be in the area until Thursday and would appreciate any referrals of people to talk with. The Commission suggested that Mr. Montoya and Mrs. Hansen work with Administrative Assistant Rick Bailey for assistance. Forest Service Road Agreement A motion to approve the revised Schedule A Forest Service Road Agreement and the signing was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Oljato Chapter Oljato Chapter Navajo Tribal Council Delegate Walter Atene met with the Commission concerning the Oljato and Piute Creek bridge. The Commission has been trying to get permission from the Navajo Tribe to survey so the work can begin on the bridges. The Navajo Tribe has requested $500 for the permission to do the survey and the work. The Commission felt that these projects are beneficial to the Navajo Tribe and the County should not pay the $500. Mr. Atene said the Piute Creek Bridge was on the number one priority list with the Navajo Tribe. The money for these projects are available. The projects cannot be bid until the survey work is completed. Mr. Atene said he would see if he could get the permission from the Navajo Tribe and have the Tribe waive the $500 fee. Mr. Atene expressed his concern over the roads used for bus routes on the Reservation. Mr. Atene said that 75% of the Navajo people don't have running water and electricity and he felt that a joint effort needed to be made to run power lines and water to these people. Mr. Atene said that a water line is being installed from the San Juan River at Mexican Hat to Monument Valley. Mr. Atene said he is soliciting funding to get the project done. The project has $3 million funded and the project is expected to cost $5-$6 million. Commission Lewis asked if the treatment facility at Mexican Hat would be able to handle this project or would it need to be expanded. Mr. Atene said he the facility would have to be expanded. Commission Maryboy said he has met with the Utah Drinking Water Committee and had discussed this project with the committee. The committee was very interested in this project. The Commission will ask Administrative Assistant Rick Bailey to look at this project and see if there are some sources of possible funding. Mr. Atene asked about the County doing some repair work at the Oljato Airport. The Commission told Mr. Atene the County is in the process of having the Federal Aviation Administration accept the Montezuma Creek, Oljato and Navajo Mountain airports. The Commission will have the road department do some repairs at the Oljato airport. Recreation Trust Agreement A motion was made by Commissioner Redd to authorize Commissioner Lewis to sign the agreement for the Recreation Trust Fund that Treasurer Marian Bayles has set up. The motion was seconded by Commissioner Maryboy. UNANIMOUS. Quit-Claim Deed Attorney Bennion Redd requested a quit-claim deed from the County for two parcels of property. These two parcels were deeded to the County at a tax sale approximately 42 years ago. Burl E. McAninch and C. Edward Logsdon have been paying the taxes on these parcels. The error was discovered in a title search. A motion to approve the quit-claim deed and authorizing Clerk/Auditor Gail Johnson to sign the deed was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. San Juan County Fair The opening ceremonies of the San Juan County Fair will be August 9, 1990 at 1:00 P.M. Agreements/City of Blanding Mayor Jim Shumway and City Manager Norman Johnson met with the Commission to present the road and airport agreements between the City of Blanding and the County. A motion to approve the agreements and the signing was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. The fire protection agreement within a five-mile radius of the city and an extension to UMETCO Minerals was discussed. A motion to table this matter until County Attorney Craig Halls has reviewed the agreement was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Mayor Shumway and Mr. Johnson told the Commission the City of Blanding is continuing to work on the annexation. After a discussion concerning the date the City of Blanding submits their road priority list to the county it was decided that the road priority list would be submitted to the County by December 1st of each year. This date will help the County budget the money that is needed for these repairs. Monument Valley Visitors Center A letter of support for the visitors center at Monument Valley was received from Grand County. Payroll Change A payroll change request was presented for Paula Butler who works in the road department office. It was recommended that Mrs. Butler be changed to a Grade 4 Step 18; $6.85 per hour. A motion to approve this change was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Blanding Birthing Center Chester Johnson said the people in the Aneth area had heard of the Blanding Birthing Center. The residents were concerned that the Indian statistics were used to plan the facility. Mr. Johnson said he liked the idea of a facility but felt the Navajo people should have input into the facility as well as Indian Health Services people. The Commission told Mr. Johnson that these concerns need to be addressed with the Health District Board as they have control over this matter and the Commission does not. Commissioner Lewis suggested that Mr. Johnson contact Edward Tapaha about this concern. Mr. Tapaha is a Health District Board member. Water Needs/Aneth Area Chester Johnson said the residents in the Aneth area have been hauling water for livestock and drinking. Mr. Johnson requested help from the Commission in hauling the water. Mr. Johnson said this matter was discussed at a previous meeting and he wanted to know what had been done about the request. The Commission told Mr. Johnson that the County cannot assist in hauling water for private use. Mr. Johnson said he understood that the Community Impact Board has funds to help with water development. Commissioner Maryboy said he had worked with the Military last year to see if they could help with hauling water. The military in this area has no facilities to haul water. Commissioner Maryboy said this is the first time anyone has asked for help with livestock watering this year. Commissioner Maryboy said the Navajo Tribe is hauling water for livestock. Commissioner Maryboy said the Aneth Chapter has passed a resolution to establish a Service District in Montezuma Creek for drinking water. Administrative Assistant Rick Bailey is working on getting this Service District established. Commissioner Maryboy said Mr. Bailey has recommended using UDIA as the sponsor for funding at the Community Impact Board. Jean Melton said she felt the Bennion Center should help with the proposals to the Impact Board. Commissioner Lewis said what the UDIA needs to do is be a sponsoring entity not prepare the proposal. The County will help with drawing up the proposal. If the County is a sponsor it will effect the amount of money the County receives from mineral lease money payments. Commissioner Maryboy said that Mr. Bailey needs to know where the boundaries for the Service District would be drawn. Commissioner Maryboy met with the Land Administration office at Aneth and reviewed the boundaries. The Land Administration Office is in the process of preparing the maps. Commissioner Maryboy said he has been receiving complaints about the Service District. The people are wondering if a Service District needs to be set up. Commissioner Lewis said the Special Service District cannot include areas that already have water. Mr. Johnson said he felt the County should do more to help the Navajo people with hauling water for livestock. Commissioner Lewis said if the County hauled water for any private citizen the County would have to haul water for everyone that needs water hauled. The Commission said they could help find the source to haul water for the people and they are willing to help out in this manner. Administrative Assistant Rick Bailey said the National Guard would be willing to haul water but someone would have to pay for the costs. The National Guard charges for truck and employee time. The National Guard doesn't have anything larger than a 250 gallon water trailer. Administrative Assistant Rick Bailey will call FEMA and see if there is anything is available to help with hauling water. Administrative Assistant said he is waiting on a map to get the Specioal Services District established. A Special Services District for electricity is not possible because Utah Power and Light already provides this service. The only way electric services could be provided would be with a special permit from the Utah Public Service Commission. The law states if another entity is already providing these services a permit will not be issued to another entity. A discussion was held concerning the appointment of persons to serve on the Special Services District Board. It was suggested that the board members be elected. Mr. Bailey said the problems in the past has been getting peopleto run. Commissioner Lewis said before appointments are made there will be a notice run to have interested individuals apply. Hunting Season/Native Americans Harry Johnson said it is getting close to the hunting season again and the Navajo people on the Reservation understand that they have hunting rights. They can hunt on lands adjacent to the Reservation because that right was given to then in a treaty. Mr. Johnson said because there is no game on the Reservation or game in the area, the Navajos have a right to come into this area to hunt. Mr. Johnson requested that the Commission help the Navajo people be able to hunt. Mr. Johnson also asked to have the Utah Division of Wildlife Resources informed to work with the Navajo people. The Indian people that have come to the north part of the County to hunt have been harassed by the DWR officers. Mr. Johnson said the Indians don't understand the law all they understand is the treaty. Mr. Johnson said he is afraid there will be problems if something is not done. Commissioner Lewis said the original treaty is being researched to see if the Reservation lands that were added in later years are included with the treaty. The Commission said they could request that the Division of Wildlife Resources meet with the Chapters to explain the laws to the people. Mr. Johnson expressed his concern over the people gathering herbs to make medicines and having problems with the government agency in doing so. Commissioner Lewis said that there is a Natural Resource Committee in the County and he felt that these types of problem could be addressed at this committee meeting. The Division of Wildlife Resources has a member and Commissioner Lewis could ask him to set up meetings at the Chapters. Commissioner Maryboy said all of the Chapter presidents met last fall after the hunting season. A resolution was passed and sent to the Governor, Representative David Adams and UNDC. This resolution contained the concerns of the people during hunting season. The DWR was also in attendance. The Chapters met with David Adams and asked him to introduce a bill to address these problems. Mr. Adams said he would do this. Commissioner Maryboy said Mr. Adams didn't get around to doing this at the last legislative session. Commissioner Lewis said Mr. Adams had someone researching the treaty and was working on this. Request to Hire Sheriff Claude Lacy presented a request to hire for a dispatcher. Mr. Lacy said the job has been advertised and testing and interviews have been conducted. Out of sixteen applicants three made it through the testing. Mr. Lacy recommended hiring Grayson Redd at Grade 7 Step 1; $1130 per month. A motion to approve the hiring was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Southeastern Utah Association of Local Governments/Incubator Program Economic Development Council Director Peggy Humphreys and President Phil Mueller presented to the Commission an agreement between the County and Southeastern Utah Association of Local Governments for commercial and industrial surveys for the incubator program. A motion to approve the agreement and authorize Peggy Humphreys to sign for the County was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT State Lands and Forestry Administrative Assistant Rick Bailey reported State Lands and Forestry has approved funding $213.36 as a match to purchase backpacks for fire control in the Montezuma Creek, Bluff and LaSal areas. The backpacks are $61.81 each. State Lands and Forestry has approved $1550 of matching money to purchase two hand-held radios, three pagers and a chain saw. Mr. Bailey requested permission to purchase the pagers from Wesley Hunt for the purchase bid on the last pagers. A motion to approve the purchase was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Zoning Variance Request Administrative Assistant Rick Bailey reported he had been contacted by Betty Hastings, North Star School, requesting a zoning variance to establish a school at Lee's Ranch near Mexican Hat. Mr. Bailey said if the Commission wanted to grant the request a notice would have to be published and a public hearing. A motion was made by Commissioner Redd to table this matter until the meeting of August 13, 1990. The motion was seconded by Commissioner maryboy. UNANIMOUS. State Surplus Property Administrative Assistant Rick Bailey presented the application for purchase through State Surplus Property to the Commission for their signatures. Area Agency on Aging/Navajo Tribe Administrative Assistant Rick Bailey reported he met with the Navajo Tribe Area Agency on Aging director Tully Mann on July 31, 1990. Mr. Bailey reported he had received word from Thrifty Car Rental that the Aneth Chapter Senior Citizens have been awarded a van from thrifty. A person was from the Chapter was flown to Tennessee to receive the van. Process Facilitator Administrative Assistant Rick Bailey reported on the research he has conducted for the job of Process Facilitator. Mr. Bailey said he felt the position would need a budget of approximately $25,000 per year for salary a travel allowance, a vehicle and a secretary. Mr. Bailey said he has not had the time to write a job description. The Commission decided to do further research into possible help from the UDIA and Navajo Tribe to fund this position. Commissioner Maryboy said he felt the title of this position needed to be changed. Commissioner Maryboy suggested funding for this position could come from the Community Impact Board. Mr. Bailey said the Community Impact Board will not fund administrative costs. COMMISSIONER MARK MARYBOY'S REPORT Television Problems Commissioner Maryboy reported that channels two and eight are out in the Montezuma Creek area. Administrative Assistant Rick Bailey will contact Bill Bayles about this problem. Navajo Mountain Library Commissioner Maryboy asked Commissioner Lewis if Lorraine Becenti had contacted him concerning the Navajo Mountain library. Commissioner Lewis said he had not been contacted. Commissioner Maryboy told Commissioner Lewis that Ms. Becenti could be contacted at the UNDC education office in Bluff. Administrative Assistant Rick Bailey will contact Ms. Becenti. Native American Coordination and Consultant Commissioner Maryboy received some information from Ken Sleight concerning the Bureau of Land Management coordinating with the Native Americans. Copies were given to the other Commissioners Justice Department/Voting Rights Commissioner Maryboy requested that the next time the Commission discusses the Justice Department Voting recommendations that it be an agenda item. Commissioner Lewis will find out when this matter will be discussed with the Justice Department and the state and have the meeting put on the agenda. Montezuma Creek Ambulance Commissioner Maryboy asked Administrative Assistant Rick Bailey about the plans to move the Montezuma Creek Ambulance. Mr. Bailey said the female ambulance drivers will not park the ambulances in the present location after dark. The Health District will be requesting permission from the UNDC board to move the ambulance garage next to the clinic. COMMISSIONER BILL REDD'S REPORT UAC Assessing and Collecting Commissioner Redd reported he attended a Utah Association of Counties Assessing and Collecting meeting on August 3, 1990. A motion was approved to present to the County Commission Convention in September. The motion was based on an assessing set by the state for uniform assessing and collecting. Commissioner Redd asked for and received okay for this travel. Interagency Meeting An Interagency meeting will be held on August 7, 1990. Commissioner Redd will attend. COMMISSIONER TY LEWIS' REPORT Halls Crossing Airport Meeting A meeting will be held at Halls Crossing on August 8, 1990. Commissioner Lewis and Commissioner Redd will be attending. Resource Conservation and Development Commissioner Lewis attended the meeting of the Resource Conservation Development board. The board is requesting dues of $250 for the County to be a sponsor.
