SAN JUAN COUNTY COMMISSION MEETING MINUTES August 20, 1990 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present:Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk A motion to approve the minutes of the August 13, 1990 meeting as amended was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. CURRENT BUSINESS Navajo Fair County Engineer Doug Pehrson met with the Commission to discuss a parcel of land that the UNDC has requested the County clear for parking for the Navajo Fair. Commissioner Maryboy said he had talked with UNDC and they had told him they didn't need this parcel cleared that there was adequate parking. Commissioner Maryboy said the UNDC would like the road from the Highway to the mobile home by this parcel graveled. Mr. Pehrson said that not all of this road has a county right-of-way. Part of the road belongs to Ray Perkins. The road cannot be put on the B system until the County has the full right-of-way. Sheriff Claude Lacy met with the Commission to discuss the security for the Navajo Fair. Sheriff Lacy said he has nine certified officers that will be working the three day fair and providing 24 hour coverage. Commissioner Maryboy will check with the Navajo Tribe about the police help that has been requested from the Tribe for this event. Sheriff Lacy said the UNDC is willing to pay time and one-half for the officers work. The UNDC will pay the County directly and the County will pay the officers. A contract will be drawn up with UNDC for the security for the fair. Sheriff Lacy told the Commission he has reserved a room in Bluff for the officers to use while policing the fair. Albert Marks and Dick Neztsosie of the UNDC presented a request to the Commission for some additional work for the Navajo Fair. The UNDC is requesting an emergency exit on the site of the fair grounds and gravel be put on a road used as an entrance to the site. Mr. Marks said he had talked with the property owner for the emergency exit and has permission to use the land. The Commission said they felt an emergency exit was needed to get people out of the site in case of an emergency. The Commission will have Doug Pehrson look at the site so a road can be pushed for an emergency exit. A discussion was held concerning the cost to gravel the road for an entrance. Commissioner Redd asked if the County had met their original promise for the clearing of the land. Mr. Neztsosie said that the County had done more than their original commitment. Commissioner Lewis said the cost of graveling the road is too high and the road would have to be put on the priority list to have this work done. County Engineer Doug Pehrson will look at the site and see if an emergency exit can be built. Mr. Pehrson called later in the meeting and said an exit could not be built at this location because it is nothing but fine sand. Equalization Questions Assessor Bruce Bunker and Treasurer Marian Bayles discussed with the Commission property taxes being adjusted after the Board of Equalization. It was decided that the Commission would ask Attorney Craig Halls to make a recommendation on how to handle requests to change property taxes after the Board of Equalization. Mr. Bunker said the request from UMETCO minerals for a 75% economic obsolescence is based on the cash flow of the operation. If the cash flow goes up in the next year the tax will go back up. Mr. Bunker said a 55% economic obsolescence is all that has been given in the past. It was the decision of the Commission to remain with a 55% economic obsolescence for UMETCO minerals. Forest Service Road Agreement Administrative Assistant Rick Bailey presented a Forest Service road agreement for the signature and approval of the Commission. This agreement allows the County to do work on Forest Service roads. A motion to approve the agreement and the signing was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Transportation Service District The Transportation Service District made a request to lease an office in the Courthouse. Administrative Assistant Rick Bailey said there are two vacant offices in the newly remodeled section of the Courthouse. Mr. Bailey suggested that the Transportation Service District be charged $4.00 per square foot. This is the price Monticello City is paying for office space at the Public Safety Building. A motion to approve the lease at $4.00 per square foot for one year was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Administrative Assistant Rick Bailey presented a request from the Transportation Service District for a $50.00 per meeting payment to board members. It was the decision of the Commission to deny this request. Drought Proclamation A motion to extend the Drought Proclamation from August 10th to September 10, 1990 was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Law Enforcement/Filming Work The Insurance holder for the County has replied to the request concerning Sheriff's Deputies doing security work for film crews. The Utah Local Government's Trust stated that the current insurance would cover deputies for this type of service. A motion was made by Commissioner Redd to allow the County to contract with the film companies to provide security at the film location. The motion was seconded by Commissioner Maryboy. UNANIMOUS. Sheriff's Deputies will be paid time and one-half their regular hourly wage by the County for film work. Aneth to Ismay Road Steve Creamer of Creamer and Noble met with the Commission to discuss the Aneth to Ismay road project. Mr. Creamer said he had been working on the Federal Secondary Funding for the project and was assured if this program was dropped the funds would be available through 1994. If the Federal Aid Secondary program is dropped another program will replace it to help with road projects. Mr. Creamer recommended the County continue to work with the Navajo Tribe on the right-of-way. If this can be accomplished by March 1, 1991 the project could be bid by August 1, 1991 and construction could begin in October of 1991. It may be necessary to bid the project in two sections if the money from the Navajo Tribe is not available at the time the project is ready to be bid. Creamer and Noble will draw up the plans so the project can be bid either way. County Engineer Doug Pehrson and Mr. Creamer said that instead of using a bridge on this project large culverts will be used. A discussion was held concerning the road from Inscription House to Navajo Mountain. Mr. Creamer will talked with Senators Garn and Hatch and the Senators from Arizona to see if a meeting can be set up to discuss the federal funding of this project. Halls Crossing Airport Engineer Steve Creamer said the letter of decision has been issued from the Federal Government on the Halls Crossing Airport. The project is now waiting on a letter of decision from the Bureau of Land Management. Piute Canyon Bridge Engineer Doug Pehrson said that the Piute Canyon Bridge will be ready to be installed. The County is waiting on approval from the Navajo Tribe. If the bridge is not done within thirty days the bridge replacement monies will be lost. Department Heads Meeting Department heads and elected officials met with the Commission to discuss the implementing of the time clocks in the Courthouse and the Public Safety Building. Concerns were expressed over hourly wages versus monthly salary, comp. time and over-time and how leave time would be handled. It was the decision of the Commission to allow from August 25, 1990 to September 25, 1990 as a trial period before a decision is made as to pay on hourly basis or a monthly salary. Election Worker Clerk/Auditor Gail Johnson discussed with the Commission the possibility of hiring Louis Tapaha for help with the elections. Mrs. Johnson said there is not ample time to write a job description and advertise to hire someone to help with the elections this year as was instructed by the Justice Department. Mr. Tapaha has been helping with the elections in the past on a volunteer basis and has worked with the Navajo Tribe on elections. Mrs. Johnson recommended paying Mr. Tapaha $7.00 per hour plus mileage of 21 cent per mile. Mr. Tapaha would provide written reports of his work. Commissioner Maryboy asked about Mr. Tapaha's current involvement with the Navajo Tribe on elections. Mrs. Johnson said she had spoken with Gloria Dennison at the Navajo Elections office and was told that the project Mr. Tapaha was working on is finished. Ms. Dennison said the Navajo elections office will not be using Mr. Tapaha this year. A motion to approve the hiring of Louis Tapaha as a bilingual voting co-ordinator at $7.00 per hour plus mileage for the elections for 1990 was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. County Vehicles/IRS Tax Law Deputy Auditor John Fellmeth discussed with the Commission some changes in the Internal revenue Services tax law concerning employees being assigned a County vehicle. Mr. Fellmeth said he had received a copy of the regulations from Auditor's Kimball and Roberts. Mr. Fellmeth will review the law and make recommendations to the Commission to comply with the law. Custodial Workers/ Libraries Deputy Auditor John Fellmeth asked the Commission if a decision had been made concerning having the custodians at the libraries become county employees instead of contract workers. It is the decision of the Commission to have these workers become County employees under the supervision of Maintenance Supervisor Dell Hunter. This will happen in January 1991. Mr. Hunter will also be in charge of the capital expenditures for the libraries at this time. Monticello Senior Citizens Request Monticello Senior Citizens Director Malva Randsdell, Fern Richey and Verla Marx met with the Commission to request permission for an out-of-state trip. The senior have had fund raising activities to finance the trip. The Seniors are requesting the County let them use the large bus or two vans for transportation. Administrative Assistant Rick Bailey said before the large bus can be used the State would have to give approval. The Senior Citizens will pay for the cost of the fuel for the trip. Frank Morrell will be driving. If two drivers are needed Mrs. Randsdell is licensed and will drive. A motion to approve the trip and using the large bus or the vans depending on the decision of the State was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Eastland Road Request A letter was received from Norma and Dean Wengreen requesting that a county road located in the Eastland area be removed from the county system. A public hearing would need to be held before a road can be removed from the County road system. The Commission will then make the final determination. Civil Rights Silke Hansen with the Community Relations Department of the Department of Justice requested her meeting with the Commission be in executive session. A motion to adjourn to executive session was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. A motion to return to regular session was made by Commissioner Redd and seconded by Commissioner Maryboy. Grievance Hearing A closed grievance hearing was held for Netta McDonald. Commissioner Maryboy was not present. The decision on the hearing was tabled until next week. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Commissioner's Conference Administrative Assistant Rick Bailey reported the annual Commissioner's Conference will be held September 13-14, 1990, in Logan, Utah. The Conference will begin at 8:00 A.M. on September 13, 1990. The Commission is planning to attend. State Emergency Services Grant Administrative Assistant Rick Bailey presented the State grants for Emergency Services. Mr. Bailey said this Grant will be transferred from the County to the Health Services District next year. A motion to approve the signing of the Grant was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. Blanding Senior Citizens/Range Administrative Assistant Rick Bailey reported he has received a call from Colleen Harvey concerning purchasing a used range for the senior citizens center that is being renovated in Blanding. Mrs. Harvey said the range is large enough to meet the needs for the Center. The cost of the range is $150.00. A motion to approve the purchase was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. COMMISSIONER MARK MARYBOY'S REPORT Economic Development Commissioner Maryboy reported he attended the meeting of the Economic Development Board that was held in Montezuma Creek on August 14, 1990. The potential for business on the Reservation and at Montezuma Creek were discussed. The Board also discussed the possibility of having a Bank in Bluff or Montezuma Creek. The Board discussed the Transient Room Tax and the people present felt it should be raised. The Economic Development Board was in unanimous support of the idea. Administrative Assistant Rick Bailey will check to see if a public hearing needs to be held or what other requirements need to be met and report back to the Commission. Dixie Barsdale will meet with Commissioner Maryboy on August 21, 1990 to discuss the Economic Development Incubator Program. Navajo Tribal Elections Commissioner Maryboy reported the Peterson Zah, candidate for Tribal President, has selected Marshall Plummer as his running mate. Peter McDonald, candidate for Tribal President, has selected George P. Lee as his running mate. Bluff Senior Citizen Request Commissioner Maryboy said he had been contacted by a Bluff Senior Citizen concerning the Bluff Senior Citizens bus driver being from Blanding. The Citizens felt the driver would not be in such a hurry if he was from Bluff and didn't have to return to Blanding. This matter will be discussed with Administrative Assistant Rick Bailey. COMMISSIONER BILL REDD'S REPORT Navajo Mountain Visit Commissioner Redd reported he had traveled to Navajo Mountain last week with Commissioner Lewis. Pecos Conference Commissioner Redd reported he had welcomed participants at the Pecos Conference in Blanding, Utah on August 18, 1990. Historical Society Commissioner Redd reported he had been approached by the San Juan County Historical Society asking the Commission to write a letter to the Edge of the Cedars requesting space in the new building for the Historical Society. The Historical Society felt this will be an ideal location to keep the historical documents and photos from the southern end of county. The Commission will send a letter of request to the Edge of the Cedars. Wayne Owens Letter Commissioner Redd has written a letter to Congressman Wayne Owens concerning wilderness and what his wilderness bill would do to San Juan County. COMMISSIONER TY LEWIS' REPORT Navajo Mountain Commissioner Lewis reported he and Commissioner Redd had traveled to Navajo Mountain last week to discuss roads and television upgrading. Navajo Mountain Chapter will write a letter to the County requesting the television equipment at Navajo Mountain be upgraded. The number of people to use for figuring a monetary figure for the Recreation program was decided. The figure will be 333 people. Navajo Mountain will receive the funds for recreation from the County instead of having UNDC run the recreation program for them. Commissioner Lewis said Navajo Mountain has never received the vaccine for immunization of the school children. Commissioner Lewis contacted Robert Furlow, Southeastern Utah Health Department, and was told that the Health Department furnishes the vaccine to UNDC. UNDC Executive Director said the only vaccine the UNDC receives is for animals. AOG Meeting Commissioner Lewis reported on an Association of Government meeting he attended on August 17, 1990. A discussion was held at the meeting concerning Utah State Rental Rehabilitation program. This program helps individual owners of apartments and rental houses with rehabilitating these units. A consultant would run this program for the counties. The AOG agreed to enter into the Utah State Rental Rehabilitation Program. The AOG will advertise for the position of consultant for this program. This program has been very successful in rural Utah. David Fletcher of the Utah Division of Administrative Services talked at the meeting about underground storage tanks for fuel. Mr. Fletcher presented several proposals of alternative ways for government entities to handle fuel need without having a storage problem. Sam Klemm of Congressman Neilson's office presented an update on the Clean Air Act. The Senate and the House of Representatives have both past a bill concerning clean air. The bills are now in conference committee.
