SAN JUAN COUNTY COMMISSION MEETING MINUTES September 4, 1990 The regular meeting of the San Juan County Commission was held in the commission chamber at 10:00 A.M. in Monticello, Utah. Present:Ty Lewis, Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk Excused:Mark Maryboy, Vice Chairman A motion to approve the minutes of the August 27, 1990 meeting as written was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. CURRENT BUSINESS Halls Crossing Calvin Black Airport At the request of Calvin Black's widow, other family members and interested persons a motion was made by Commissioner Redd to amend the name given to the Halls Crossing Airport to Cal Black Memorial Airport. The motion was seconded by Commissioner Lewis. UNANIMOUS. Building Permit A building permit application was presented for Steve Deeter of LaSal. Mr. Deeter is proposing to move a double wide mobile home on his land in LaSal. This permit is for electrical inspection only. A motion to approve the permit was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. A building permit application was presented for Joe Barton. Mr. Barton proposes to build a cabin in the Blue Mountain Dude Ranch subdivision. A motion to approve the permit was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Western Association of Land Users Gail Johnson, chairman of the Western Association of Land Users, met with the Commission to discuss wilderness. Mrs. Johnson said she had received a letter stating the Utah Public Lands Coalition was willing to negotiate on the wilderness proposals. WALU has advocated zero additional wilderness and feel that the stand by the Coalition and Boothe Wallentine should be zero additional wilderness. The Commission will send a letter in support of zero additional wilderness to the Utah Public Lands Coalition. Four Corner Regional Care Center/Land Trade The Request for land trade with the County and Four Corners Regional Care Center was discussed. Commissioner Redd said he had researched this matter and felt the trade would be beneficial to both parties. A motion to approve the land trade with the Four Corner Regional Care Center and San Juan County was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Independent Truckers Contracts A request was made from some of the independent truckers for an increase in the hourly rate the County is paying them for operator, truck and trailer. The Independent Contractors are currently receiving $38.50 per hour. It was requested this amount be raised to $40.00 per hour. This matter was tabled until the Commission could discuss this matter with Road Superintendent Tony Brandt and Engineer Doug Pehrson. A discussion was held concerning the independent truckers filling out the time and haul sheets correctly so their time and material that is hauled can be billed to the right road. It was the decision of the Commission to allow the road department to return the time sheets that are filled out incorrectly to the independent truckers. Communications Problems Communications Specialist Bill Bayles met with the Commission to discuss the problems the Sheriff's Department has been having with the radios. Mr. Bayles said the problem is in the duplex. The duplex will have to be sent off for repair which would probably take as long as a month. Mr. Bayles said a new duplex would cost approximately $1,000. It was the decision of the Commission to have Mr. Bayles purchase a new duplex and have the old duplex repaired for a spare. Mr. Bayles said the radio problem with the road department is an antenna problem and he is working on this. Most of the radios at the road department have been gone over and repaired. The Commission discussed with Mr. Bayles the possibility of a translator site for television at Navajo Mountain. Administrative Assistant Rick Bailey will write a letter to the Navajo Mountain Chapter requesting that the Chapter find a suitable site for the translator and request permission from the Navajo Tribe to place the translator on this site. If a suitable site is found and approved by the Navajo Tribe it may be budgeted for in 1991. Mr. Bayles said he has been looking at a translator site for Oljato and has found a site that may work. The site would service the area by the Chapter House but may not service the whole area. Mr. Bayles said there are dead sites all over the County and not all residents will be able to pick up the television signal. The Commission requested that Mr. Bayles write a letter to the Oljato Chapter and let the Chapter know when he will be in the area to look at the television problems. Hunting Problems John and Mary Tso and Julis Claw met with the Commission to request the help of the Commission to get Mr. Tso's rifle back. Mr. Tso's son received a ticket for killing a doe during the 1989 deer hunt. A 30-30 Winchester rifle belonging to Mr. Tso was confiscated. The Commission explained to Mr. Claw that the Division of Wildlife Resources is a State Agency and is not under the jurisdiction of the County. The County has no way to change the law regarding hunting. A call was made to a Division of Wildlife Resources Officer. The Officer informed the Commission the rifle was in Salt Lake City to be auctioned off on September 8, 1990. The only way at this time Mr. Tso could get his rifle back is to go to Salt Lake City and bid on it at the auction. Mr. Claw requested to be put on the agenda at the next Commission meeting to discuss with the Native Americans the hunting laws. The Commission will arrange to have a representative from the State Division of Wildlife Resources present at the meeting to explain the hunting laws and answer questions. Travel Council Report Travel Council Director Peggy Humphreys reported to the Commission the activities of the Travel Council. Mrs. Humphreys is working on information for the Incubator program. A site facility inventory is currently being done. The Incubator program has identified the possibility of two new businesses opening in the County. Mrs. Humphreys reported that the film business in San Juan County is increasing. Mrs. Humphreys presented the Commission with a report of the film work in the area since January 1, 1990. Mrs. Humphreys said the motel owners report an increase in all areas of the County. A discussion was held concerning the targeting of advertising to areas where the visitors are coming to San Juan County from. A hearing on raising the Transient Room Tax will be held on September 10, 1990 at 1:00 P.M. in the Commission chambers. Mrs. Humphreys said she felt the Economic Development Board needed some motel owners on the Board to help with determining how the advertising money is spent. Solid Waste Disposal Southeastern Utah Health Department Sanitarian Jerry Jackson, Leonard Howe and Alan Frost met with the Commission to discuss the solid waste disposal problem with dead animals and by-products. Mr. Jackson said there is no State law that requires the City or the County to provide solid waste disposal sites. Mr. Jackson said he is concerned that these two businesses have no where that is legal to dispose of dead animals and by-products. Mr. Howe is currently burying his carcasses and by-products on a pit on his private property. Mr. Frost is burying his dead animals on his property and selling the by-products to a by-products company from Grand Junction, Colorado. The Commission said they are currently looking at the solid waste disposal problem for the entire county. The County would like to develop a plan before the State develops a plan for the County. The Commission feels the dead animal disposal site should be a concern of Monticello City since both of the businesses are located in Monticello City. Mr. Jackson said he had spoken with Monticello City and they had told him they could not afford to do this type of a project. Mr. Howe said he felt there was not enough room at the present dump site to build a dead animal pit. Mr. Jackson said he had no problem with the private site if the pit was top filled with at least six inches of soil in 24 hours. Mr. Howe will apply with the State to see if he can get a permit for a private disposal site. It was also suggested that Mr. Howe contract the Division of Wildlife Resources to see if they would be interested in using a dead animal pit for disposing of road killed deer. Curb and Gutter Request Clyde Gonzales met with the Commission to ask about having curb and gutter put in front of his father's residence at 300 South and 200 West in Monticello. The Commission told Mr. Gonzales the County only does road work for the city and they are not involved in doing the curb and gutter. Mr.Gonzales was told to contact Monticello City. Circuit Breaker and Indigent Applications Clerk/Auditor Gail Johnson presented the 1990 Circuit Breaker and Indigent applications for the approval of the Commission. A motion to approve the applications and the signing was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Road Culverts Forest Service Ranger Lee Bennett contacted the Commission concerning the County furnishing culverts for some road work a private contractor is doing on the Monticello to Blanding road over the mountain. This road is one of the roads the County has requested easement for from the Forest Service. A motion to approve the County furnishing the culverts if the contractor installs them was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Piute Creek and Oljato Bridges County Engineer Doug Pehrson met with the Commission to discuss the Oljato and Piute Creek Bridges. Mr. Pehrson outlined the correspondence he has had with the Bureau of Indian Affairs and the Navajo Tribe trying to get approval to finish this project. It was decided that Mr. Pehrson and Commissioner Redd will travel to Tuba City to visit with the BIA and then on to Window Rock to get the necessary paper work taken care of before the funding is lost. Road Closure A request for a road closure was received. This would effect a 1/2 mile section of road in the Eastland area. A public hearing will be scheduled. Hatch Trading Post Road Engineer Doug Pehrson said he has the agreements from the Navajo Tribe for the people who have the allotments in the area of road #413 to sign. The agreements will be sent to Commissioner Maryboy to see if he can obtain the required signatures. There are thirty people that need to sign the agreements. Federal Forest Highways Resolution The following Resolution concerning Forest Service Highway roads was presented for the approval of the commission: RESOLUTION 1990-6 WHEREAS, the County of San Juan has been maintaining the following roads under Schedule "A" of the Forest Development Road Cooperative Agreement and from time to time entered into Project Agreements to upgrade segments of following roads under the Forest Development road Cooperative Agreement: The Indian Creek Road #50079 (2.05 miles) The Blue Mountain Ranch Road #50082 (0.92 miles) The Causeway Road #50095 (4.1 miles) The Spring Lake Road #50100 (3.1 miles) The Monticello Loop Road #50105 (4.8 miles) The Upper Two Mile Road #50208 (4.05 miles) The Paradox Road #50371 (0.72 miles); AND, WHEREAS, the County of San Juan is more centrally located to administer and provide the equipment and materials to maintain roads of this construction and standard; AND, WHEREAS, the County of San Juan is more centrally located to administer and enforce the laws and regulation that insure safe and reasonable use of these public roads; AND, WHEREAS, the County Commission of the County of San Juan concur that the roads provide essential access to the watersheds, water storage facilities, private lands, and State of Utah lands important to the well being and economy of San Juan County and its citizens; AND WHEREAS, the County Commission has previously submitted to the U.S. Forest Service a request for public road easement on the roads; NOW THEREFORE, BE IT RESOLVED, that the County Commission of San Juan County requests that the UNITED STATES OF AMERICA, acting by and through the Forest Service, Department of Agriculture, grant to San Juan County a Public Road Easement for the AFOREMENTIONED roads and hereby authorizes its chairperson to submit said notice to the Forest Service and to accept said easements for the County of San Juan. BY: /s/ Ty Lewis Ty Lewis-Commission Chairperson DATE: September 4, 1990 Equalization Request A letter was presented from George and Patricia Jurasich requesting the value of two parcels of land be lowered. It was the decision of the Commission to deny the request because the request was not done at the time of Board of Equalization. Assessor Bruce Bunker will write to George and Patricia Jurasich and inform them of the decision of the Commission. Mr. Bunker will also tell the Jurasich's their request will be heard at the next Board of Equalization in August of 1991. Senior Citizens Bus Driver/Bluff A discussion was held concerning a request for a senior citizens bus driver to be stationed in Bluff. Administrative Assistant Rick Bailey said he is currently working with the Navajo Tribe to get help with the senior citizens busing in this area. Tax Commission Meeting Commissioner Redd reported the meeting that was scheduled with Mike Monson of the State Tax Commission was cancelled because Mr. Monson had a personal emergency and had to travel back to Salt Lake City. Senior Citizens Center/Bluff Commissioner Redd reported he had met with Melvin Gaines in Bluff to inspect the water line to the Senior Citizens Center. The line is rotting out and needs to be replaced. It was the decision of the Commission to have Monticello Plumbing look at this project and see if they might could do this work. Monticello Plumbing is already working in the area. National Association of Counties Commissioner Redd reported he has received a letter from NACo President Mike Stewart appointing him to the Public Lands Steering Committee. Division of Wildlife Resources Tour A notice was received of a Division of Wildlife Resources Tour in Wayne County on September 19, 1990. Commisisoner Lewis will try to attend. Association of Governments A letter was received concerning the annual appropriations to the Community Impact Board for the different regions of the state. The AOG feels the annual appropriations should be based on the amount of production from the counties. If this type of allocation was used there may be enough funding to establish a Public Lads Office in the southeastern part of the state.
