SAN JUAN COUNTY COMMISSION MEETING MINUTES October 15, 1990 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present:Ty Lewis, Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk Excused:Mark Maryboy, Commissioner A motion to approve the minutes of the October 9, 1990 meeting as amended wa made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. CURRENT BUSINESS Request for Payment/Halls Crossing Airport An application for request for payment for the original site of the Halls Crossing Airport was presented by Administrative Assistant Rick Bailey. This request is in the amount of $453.70 and will be made from the County to the Federal Aviation Administration. This will clear up the expenses on the original Halls Crossing Airport site. A motion to approve the application and the signing was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Piute Creek Bridge The replacement contract for the Piute Creek bridge was presented by Administrative Assistant Rick Bailey. This project will be funded by $240,000 federal money and $60,000 of matching County funds. A motion to approve the contract and the signing was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Engineer Doug Pehrson said that the advertising for bids for the Piute Creek Bridge has started. The bids will be opened on October 20, 1990. Procurement Administrative Assistant Rick Bailey presented a procurement for three letter size filing cabinets for use in the Commissioner's Office. Sears in Monticello submitted a bid of $178.84 plus freight of $22.05, Palmers Office Supply bid $210.00 freight included. State of Utah contract is $199.50 plus shipping costs. Office Equipment Company bid $170.00 with free delivery. A motion to approve the bid from Office Equipment Company was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. A procurement was presented for a radio packet to be used by the Emergency Management Systems. The system will be purchased from Office Equipment for $1774. A motion to approve the purchase was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. State Lands Grazing Permit Thomas Billie met with the Commission to discuss a request he has made to fence a section of State Land that runs next to his Tribal Grazing allotment. Commissioner Lewis told Mr. Billie he had talked with the State Lands office in Moab and had been told that the fence Mr. Billie is requesting permission to install would run on State Land and he needs to apply for grazing rights on this section. Doug Fullmer of the State Lands office will send Mr. Billie the necessary paper work to apply for the grazing rights on this State section. After Mr. Billie has obtained the grazing rights he can apply for a range improvement project to get help from the State Lands to fence the section. Federal Aviation Administration /Cal Black Memorial Airport A letter was received from Barbara Johnson stating that the FAA had received a copy of the Land Patent for the Cal Black Memorial Airport. The FAA has reviewed the contract that was sent by Alpine Archeology for the Archeological Mitigation and made some additions to it. San Juan County can now continue with the airport. Bluff Library A letter was received from the Bluff Library Committee. The letter said the Committee has received a release for the building from the Sheriff. The Committee requested permission to sell the old jail cell in the building to a salvage company. The Committee also asked for the proceeds of this sale to go to the library committee for use in setting up the library. Administrative Assistant Rick Bailey has written a letter to the Historical Society to see if they are interested in the jail cell. It was the decision of the Commission to table a decision on this matter until the Historical Society has a chance to respond to Mr. Bailey's letter. Engineering Contract/Cal Black Memorial Airport The engineering contract with Creamer and Noble for the Cal Black Memorial airport was present for the approval and signature of the Commission. The amount of the contract is $22,600.00 The County will pay 4.5% of this amount. A motion to approve the contract and the funding was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Community Development Block Grants There will be an application process workshop on Community Development Block Grants on November 12, 1990 at 7:00 P.M. in the commission chambers. A discussion will be held on the public hearing process. Utah Navajo Fair A thank you card was received from the Utah Navajo Fair Committee for the Commission's help and donation to the fair. Probationary Payroll Increases Jerald Perkins of the Sheriff's department presented requests for probationary increases for the following Corrections Officers: Douglas C. Pehrson, Nelson Shumway, Kelly B. Bradford, Troy J. Butler and Terrill Slade to be increased to Grade 14 Step 2, $1568 per month; effective 10/1/90. Dispatcher Roger Low to be increased to Grade 7 Step 2, $1177 per month, effective 10/1/90. A motion to approve the probationary increases was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Alpine Archeology Contract Alan D. Reed, Alpine Archeology, met with the Commission to present the contract for the archeology mitigation for the Cal Black Memorial Airport. The contract has been approved by the Federal Aviation Administration. A motion to approve the contract and the signing was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Alpine Archeology will begin today. Lowell Bennion Community Service Center A letter was received from Todd Mitchell of the Lowell Bennion Community Service Center. The letter stated that the Center had received requests from several Navajo candidates for help with the up-coming November election. The Commission sent the following letter to Mr. Mitchell: October 15, 1990 Mr. Todd Mitchell Lowell Bennion Community Service Center 101 University Union Salt Lake City, Utah 84112 Dear Mr. Mitchell: We appreciate and compliment you and the Lowell Bennion Service Center on your interest in the voting participation of San Juan County. It is not our position as a County governing body to either encourage of discourage special interest groups in their desired activities, but wish them well so long as they don't promote social unrest, comply with state statutes, and are able to provide for their own expenses. We appreciate your interest in this County Very truly, /s/ Ty Lewis Ty Lewis, Chairman San Juan County Commission Department Head Changes A discussion was held concerning all County Employees who are not elected officials needing a department head to report to regarding leave time and other matters. A motion was made by Commissioner Redd to appoint Administrative Assistant Rick Bailey as the department head for all departments that the Commission is to oversee. Commissioner Redd stated he knew that this responsibility was not to Mr. Bailey liking but was being assigned by the Commission. The Motion was seconded by Commissioner Lewis. UNANIMOUS. The departments that Mr. Bailey will be in charge of are the Travel Council, Road Superintendent, County Engineer, Communications and Justice Court. The Commission said they would relieve Mr. Bailey of some of his present responsibility so he could have time to take on the responsibility of department head for the Commission. Mr. Bailey was asked who he felt could handle to job of aging director. The Commission asked Mr. Bailey to prepare a job description oo this postion and come back with his recommendations for the position of aging director. Public Safety Building /DLR Group Richard McCune of the DLR Group, architect for the Public Safety Building, met with the Commission, County Attorney Craig Halls and Maintenance Supervisor Dell Hunter to discuss the final payment DLR is requesting on the Public Safety Building. Mr. McCune said the current bill owing the DLR Group with interest is $53,752.50. After a discussion on the construction problems. The Commission offered Mr. McCune $25,000 to be paid in ten day for the final settlement with he DLR Group. Mr. McCune said he would have to speak with the other members in the firm before he could accept or reject this offer. After Mr. McCune talked with the group on the telephone he told the Commission he was authorized to accept $26,880 from the County as final payment. A motion to accept the offer of $26,880 from DLR Group was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. The payment will be processed today and the check will be paid in about ten days. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT National Wilderness Conference Administrative Assistant Rick Bailey told the Commission the National Wilderness Conference will be held in Denver, Colorado this year. San Juan County has been a sponsor in past years. A motion for San Juan County to be a sponsor of the National Wilderness Conference was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Transient Room Tax and Sales Tax Administrative Assistant Rick Bailey presented the report on transient room tax and sales tax for the quarter. Mr. Bailey said the figures for Hite Marina and ARA Leisure Services would not be an accurate quarterly figure. The State Tax Commission was crediting taxes collected at Hite by ARA Leisure Services to Kane County. This has been corrected the taxes are credited to San Juan County in this report. Travel Administrative Assistant Rick Bailey reported he will be traveling to Salt Lake City on October 16 and 17. COMMISSIONER BILL REDD'S REPORT Land Use Seminar Commissioner Redd attended a Land Use Seminar in Salt Lake City last week. A discussion was held at the seminar concerning the National Environmental Policy Act. Commissioner Redd said the seminar was very helpful to understand what the National Environmental Policy Act was and how it is used. Commissioner Redd said he found out at the seminar that the endangered species can take precedence over anything done by NEPA. Prairie Dog Problem Commissioner Redd said he has bee contacted by several residents in Blanding about the County helping with the prairie dog problem in this area. This matter will be referred to Extension Agent Jim Keyes. Overtime/Road Department A request was received from the road department for overtime for Wanda Franklin and Paula Butler for the time put in for Lynn Lund of Utah Local Gov't Trust on the Larry and Norman Begay case. A motion to approve the over-time was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. COMMISSIONER TY LEWIS REPORT Economic Development Meeting Commissioner Lewis attended a meeting of the Economic Development Board in Blanding on October 9, 1990. Monument Valley Tribal Park Meeting A meeting will be held at the Monument Valley Tribal Park on October 18, 1990 to discuss economic and commercial development around the Monument Valley. Commissioner Lewis had been invited to speak from 2:00 P.M. to 2:15 P.M. Commissioner Lewis has a Resource Conservation and Development meeting in Green River at 3:00 P.M. on this date. Commissioner Redd will attend the Monument Valley meeting to represent the County. Resource Development and Conservation Commissioner Lewis has volunteered to be a member of the board of the Resource Development and Conservation committee. There are seventeen sponsors of the RC&D program. There will be an office established in Price, Utah. Association of Governments There will be an Association of Governments meeting in Price on October 20. 1990 in Price, Utah. Commissioner Lewis and Commissioner Redd will attend. A discussion was held about the revolving loan fund that the AOG is trying to establish. Monticello City has expressed a concern over using the Community Black Grant Funds for this revolving fund and that the smaller communities would be left out. Commissioner Lewis said the board is comprised of a equal representation from all of the four county areas. The loan fund will be taken from the 1991 funds and will not effect any other years. Clean Air Bill Senator Jake Garn and Senator Orin Hatch are in favor of the Senate Bill on Clean Air. The Senate and House bills are currently in conference. Employee Parking Commissioner Lewis said he has received several complaints from person coming to the Courthouse and Public Safety Building to conduct business and not being able to find a place to park because of the employees parking next to the building. Commissioner Lewis requested that Administrative Assistant Rick Bailey send a memo to all County employees at the Courthouse and Public Safety Building requesting that the employees park in the back parking lots and leave the north entrance of the courthouse and the parking in front of the Public Safety Building for the public.
