SAN JUAN COUNTY COMMISSION MEETING MINUTES November 19, 1990 The regular meeting of the San Juan County commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present:Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Dena Hunter, Deputy Clerk Excused:Rick Bailey, Administrative Assistant A motion to approve the minutes of the November 13, 1990 meeting as written was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. CURRENT BUSINESS Aneth to Ismay Road County Engineer Doug Pehrson met with the Commission to discuss the Aneth to Ismay Road project. Mr. Pehrson said the Navajo Tribe requires a permit fee for field work on archeology. The permit states that the fee can be waived for a single sponsor for unlimited projects. Commissioner Maryboy will contact the Navajo Nation Historic Preservation Department to see if the County qualifies as a single sponsor for unlimited projects. Piute Creek Bridge County Engineer Doug Pehrson said he should be getting a FAX today from the Navajo Tribe Natural Resource Committee stating that San Juan County has the permission to proceed with the Piute Bridge project. Beer Licenses Clerk/Auditor Gail Johnson met with the Commission to discuss the Class B & C Beer Licenses. The State of Utah will be requiring a State beer license for on premise consumption. Mrs. Johnson said this law will go into effect on January 1, 1991. The State will be charging a $400 license fee and will require a $1,000 bond. The County currently charges $400 per license and requires a $2,500 bond. Mrs. Johnson said the State will not recognize the beer bond from the County. After a discussion of the County requiring a Class B Beer License a motion to table this matter until next week so was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Centrally Assessed Appeals Assessor Bruce Bunker met with the Commission to discuss the large number of appeals that are being filed with the State Tax Commission on centrally assessed property. Theses appeals have caused the County valuation to change on a daily basis. Mr. Bunker will request the files on all of the cases that could make a significant difference in the County valuation. The County only has ten day to respond to an appeal. After a discussion it was decided that Mr. Bunker will contact Bill Peters of the Utah Association of Counties and discuss these cases. PEASE Oil Company/Delinquent Taxes Bill Finch of PEASE Oil Company met with the Commission to discuss the delinquent property taxes PEASE Oil owes for the years 1986, 1988 and 1989. Mr. Finch presented the Commission with a copy of a letter PEASE Oil Company had received from the State Tax Commission in 1986 stating that the State was changing the formula for the state assessed properties and the taxes would not change. Mr. Finch presented a copy of the taxes that were assessed for the 1989 year. They were increased by 23%. Mr. Finch said they had not appealed to the State Tax Commission because they are a six man operation and at that time they could not afford to hire a lawyer to represent them on this case. Mr. Finch said he would like to have the taxes reduced so they can pay them and not have to face forclosure on the wells. Mr. Finch said PEASE Oil Company will pay the 1990 taxes as assessed. The Commission will take this matter under advisement until next week. When a decision is made they will contact Mr. Finch. Halls Crossing Airport The Commission received a copy of the First Amended Complaint for Declaratory and Injunctive Relief in a lawsuit that has been filed in the United State District Court by National Parks and Conservation Association; Southern Utah Wilderness Alliance, Sierra Club and Debora L. Threedy against the Federal Aviation Administration, United States Department of Transportation, Board of Commissioner of San Juan County, Utah ; and Bureau of Land Management, United Stated Department of Interior for the Halls Crossing Airport. Community Development Block Grant A discussion was held concerning the Community Development Block Grant and the possibility of having the Utah Navajos become one of the entities that would rotate with the County and the Cities for the grant. A letter will be sent to the Navajo Tribe asking how there Community Development Block Grant funds are rotated and what formula they use to disperse the funding to the Navajo people. Building Permit A building permit application was presented for Burch's Indian Trading Company. This permit is for a laundromat. A motion to approve the permit was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. City of Monticello/Agreements The Interlocal Governmental Agreement, Road Agreement, Fire Protection Agreement and the Airport Agreement with the City of Monticello have been approved by the Monticello City Council. These agreements were presented for the approval and the signature of the Commission. A motion to approve the agreements and the signing was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Forest Service Road and Trail Committee The Forest Service Road and Trail committee will be holding a public review and comment meeting on their recommendations for Forest Service roads and trails. This review and comment session will be held on December 6, 1990 in the commission chambers. Utah Association of Counties Convention Commissioner Redd attended the Utah Association of Counties Convention in St. George on November 14-16, 1990. Senate Bill 255 on Solid Waste Disposal was discussed. This Bill will give money to the Counties to develop solid waste management. The Taxation and Revenue workshop discussed how Counties can widen their revenue base through areas other than taxing. A discussion was held concerning State Assessed property. It was the decision of the discussion group that any legislative action concerning the State Assessed property should not provide for an overall adjustment. A discussion was held on the roads the State would like the Counties to take back into the County road systems. This would affect four roads in San Juan County. The position of the UAC was that the roads couldn't be returned to the Counties unless the Counties were in agreement on accepting the roads back into their systems. A discussion was held about the fees at the Port of Entry stations being put in a fund for Class B and C roads. The UAC opposed this proposal and felt it should be up to the Counties who enforce the fees to decide where they are spent. A discussion was held concerning making Utah an Inland Port Authority. The UAC supports this concept but legislative action would be needed to accomplish this. Health District Meeting Commissioner Redd will attend a meeting of the Southeastern Utah Health District in Green River on November 20, 1990. San Juan County Health Services District Commissioner Redd said the term for two of the Board members on the San Juan County Health Services District will expire in the near future. These two members are Rayburn Jack and Edward Tapaha. A motion to reappoint Rayburn Jack and Edward Tapaha to the Board for a four year term expiring on December 31, 1995 was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Todahaidekani Preschool Commissioner Maryboy said he had been contacted about the road to the Todahaidekani Preschool. This road is about 100 yards off from the main road and is in bad shape and needs to be graded. County Engineer Doug Pehrson said he would have the road department grade this road. Montezuma Creek Trash Dump Commissioner Maryboy asked about the trash dump at Montezuma Creek. Commissioner Maryboy said he had discussed using the site on the BLM land with BLM district manager Ed Scherick. Mr. Scherick has indicated if the mining interests at this site were relinquished the site could be again used as a trash dump site. Low Flying Military Flights Commissioner Maryboy said there is a problem with low flying military flights over the Montezuma Creek area again. The Commission will have Administrative Assistant call the Air Force about this problem. UNDC Board Meeting The Utah Navajo Development Council held a board meeting in Albuquerque, New Mexico on November 16, 1990. A discussion was held concerning some Chapter proposals to be taken to the Community Impact Board for funding. The Utah Division of Indian Affairs would be the sponsor for these proposals. Navajo Mountain Library Commissioner Maryboy said the Navajo Mountain Chapter will be submitting a budget to the Commission for the Navajo Mountain library. This library is in the Navajo Mountain Adult Education Center. Navajo Tribal Election Commissioner Maryboy reported the Navajo Tribal Election for Tribal President and Vice President will be held on November 20, 1990. State Lands and Forestry The Commission will meet with he State Lands and Forestry on November 21, 190 at 10:00 A.M. in the Commission Chambers to have a working session on State Lands exchange on the Navajo Reservation. Aneth Senior Citizens/Building Proposal Thelma Lansing, Aneth Senior Citizens Director, presented the Commission with a proposal from the Aneth Chapter asking that the $10,000 the County had budgeted for the past two years for an Aneth Community Building be used for the Aneth Senior Citizens Center. There has been $60,000 committed to this project by the Navajo Tribe. Mrs. Lansing will present a Resolution from the Chapter at a later date.
