SAN JUAN COUNTY COMMISSION MEETING MINUTES December 17, 1990 The regular meeting of the San Juan County Commission was held at 10:00 A.M.in the commission chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk A motion to approve the minutes of the December 10, 1990 meeting and the December 10, 1990 Budget Hearing as written was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. CURRENT BUSINESS Transient Room Tax A discussion was held concerning the request for an increase in the transient room tax. A motion to adopt an ordinance to increase the transient room tax to 2% was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. The Commission will have County Attorney Craig Halls draft an ordinance to be adopted in the meeting of January 7, 1991. This raise in the transient room tax will become effective on April 1, 1991. Tax Exemption Request Assessor Bruce Bunker discussed with the Commission a request from the San Juan County Health Services District for a tax exemption from August 9, 1990 through December 31, 1990 on the Monticello Clinic building and property. After a discussion about the Commission having the authority to grant this exemption it was decided that Mr. Bunker would contact the State Tax Commission and come back later in the meeting with his findings. Mr. Bunker reported later in the meeting that he had contacted the State Tax Commission and had been advised that the property must be allowed to be exempt if the District was the owner on January 1st. If the District was not the property owner on January 1st the Commission can require an exemption certificate to be filed. A motion to approve the request made by the San Juan Health Services District for exemption on the Monticello Clinic property from August 9, 1990 to December 31, 1990 was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. A discussion was held concerning the County requiring all persons wishing a tax exempt status on property to file a request for exemption with the County Assessor by March 1st of each year. A motion to require this filing was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Procurement Assessor Bruce Bunker presented bids for three office chairs for the Assessor's office. Bids were received from Price Office Equipment Company for $154.00 each, Tri-State Office Supply bid $169.00 each and Office Outpost bid $161.00 each. A motion to accept the bid from Price Office Equipment Company was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. A discussion was held about the current procurement policy. The Commission will draft new guide lines for the Department Heads to follow when obtaining bids on merchandise. A procurement was presented for a Printer for the road department. Bids were received from Petra Computer for a Panasonic KX-1624 for $649.00 and a Alps Allegro 500 XT for $799.00. Office Equipment Company bid $478.00 for an Epson LQ-1010 and $768.00 for an Epson LQ-1050. A motion to accept the bid on the Epson LQ1-010 was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Bids were presented for five hand held radios. Three of these radios will be used in the Survey Department and two will be used in the Road Department. Bids were received from Motorola for $438.00 for a six channel radio and Maxon for $395.00 for a two channel radio. Communications Specialist Bill Bayles recommended purchasing the six channel units from Motorola because they are the type already being used in the County and Mr. Bayles has the equipment to program these units. A motion to accept the bid from Motorola on the recommendation of Mr. Bayles was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Road Concern Richard Reece from Ucolo met with the Commission to discuss a bus stop on the Ucolo road. Mr. Reece asked that the curve before the stop at the Fred Skidmore residence be signed for lower speed. Mr. Reece said this is a blind corner and people traveling this road do not see the stopped bus until they are right on the corner. Mr. Reece also asked that this corner be sanded as the bus has difficulty pulling out onto the road after this stop when it snows. Mr. Reece said he had talked to someone at the road department about this problem and had been told to send the bus driver back to driving school. Commissioner Maryboy said he felt the road department needed to be instructed to work better with the public when they have a concern. Mr. Reece asked that an old section of the Ucolo road be graded when it snows. The Commission told Mr. Reece they would check with the Road department to see if this section was still a county road. If this section is not a County road the County will not be able to grade it. Road Department Bids Road Superintendent Tony Brandt and Wanda Franklin presented bids received for the road department for oil , grease, antifreeze, tires, tubes, batteries, filters and culverts. The bids on filters were received from Caun-Co and Monticello Napa. Caun-Co. was the low bidder on all of the filter except for two. A motion to award the bid on filters to Caun-Co. was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Bids were received on batteries from Intermountain, Monticello NAPA and Grand Tire. Mr. Brandt recommending splitting the bid for the batteries between Intermountain and Monticello Napa. A motion to approve this recommendation was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Bids on tires and tubes were received from Parkway/Grand Tire and Redburn Tire. A bid was received the day after the deadline for bids from Basin Coop. Mr. Brandt recommended splitting the bid on the tires between Redburn Tire Company and Parkway/Grand Tire. A motion to award the bid on tires size 195 to size 920 to Grand Tire and tires size 920 to size 10020 to Redburn Tire was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. A motion to award the bid on tubes to Parkway/Grand Tire was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Bids on culvert and bands were received from Amcor, Geneva, Wheeling and Contech. The price of the connecting bands were added to Contech, Amcor and Geneva's price because Wheeling's bid included the price of the bands. A motion to accept the bid from Amcor on culvert and connecting bands was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. The low bidder on end section was Wheeling. A motion to approve the bid from Wheeling on end sections was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Black Oil Company was the only bid received for oil, grease and antifreeze. The prices bid will fluctuate the same percentage as bid with the market price. A motion to approve the bid from Black Oil was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Justice Court Resolution The following resolution for maintaining a San Juan County Justice Court was presented for the approval of the Commission . RESOLUTION No. 1990-8 Be it resolved that the Board of County Commissioners of San Juan County is desirous of maintaining a County Justice Court pursuant to Utah Code Annotated, Section 78-5-101 et seq., and WHEREAS, the Board of County Commissioners and the san Juan County Justice Court is willing to comply with all certification standards for the Court, NOW THEREFORE, the Board of County Commissioners does hereby resolve as follows: That the Court presently designated as the San Juan County Justice Court does meet all requirements of the operation of a County Justice Court according to the Statute and willing to continue to do each and every thing necessary to maintain certification, to wit: from February 4, 1991 to February 1995. This current court does currently meet of exceed all certification requirements and it is the intention of San Juan County Board of Commissioners to maintain the Court at the present level meeting all certification requirements and does hereby request that the Court be certified. We have reviewed the Justice Court standards for recertification dated August 19, 1990, have answered all questions proposed in conjunction with that certification and have signed and enclosed with this Resolution the request for recertification. This resolution was duly considered pursuant to the regular agenda of the San Juan County Commission Meeting on the 10th day of December, 1990. A motion was made to adopt the Resolution and the Resolution passed unanimously. UNANIMOUS. A discussion was held on the letter that needs to accompany this Resolution to the Court Administrators Office asking for a waiver of the number of clerks and a separate office for the judge and clerk. Budget The Commission went through each budget request to make the necessary cuts to balance the budget for 1991. The request from the Aneth Chapter for $15,000 for surveying to provide power lines in the Aneth area was discussed. It was the decision of the Commission that it is not the obligation of the County to provide money to do surveying so a private enterprise could establish a utility. The request from the Monument Valley Hospital for $9,850 for sewer equipment and a handicap ramp at the post office was denied because the Commission did not feel that this type of an expenditure had historically been recognized as an obligation of the County. The request from the Aneth Senior Center for $10,000 for repairing deficiency in the construction and other needed supplies was discussed. It was the decision of the Commission that this money will be funded on the condition that the Aneth Senior Center is included in the proposal being prepared for the other Reservation Senior Centers to the Community Impact Board. This proposal will be sponsored by the Utah Division of Indian Affairs. If the proposal before the Community Impact Board fails then the County will consider funding the $10,000 requested to the Aneth Senior Citizens Center . The funding request of $20,000 for the Navajo Fair was discussed. It was the decision of the Commission to fund this request with the following stipulations: 1) The money must have a match from the UDIA. 2) The money must be used for capital expenditures only. 3) The billing must be submitted to the County and the County will pay 50% of the billing up to the $20,000 funded. A motion to approve this expenditure with the mentioned stipulations was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. The funding request for the LaSal Community Building was discussed. It was the decision of the Commission to fund $10,000 as a match in applying for the Community Impact Board grant for the other 90% of funding that is required. The request for operating expenses for the building once it is finished was also discussed. The Commission will recommend to the LaSal Improvement Committee that they apply to the County for a portion of the Recreation Trust Fund for this expenditure. The proposed Health Trust Fund was discussed. This fund in the amount of $250,000 will be placed in a non- expenditure trust fund with a trustee to help fund health care in the County. One-half of the fund will be for the Health Services District and one-half will be for the use of the Utah Division of Indian Affairs for health care of the Utah Navajos. Provided the UDIA will match this fund with $125,000 to be placed in Trust. The interest from this fund is all that will be used the principal will remain in the Trust Fund. The earnings from this fund can only be used for Health Care expenditures for San Juan County residents. A discussion on the budget for the Television and Communications upgrade was discussed. It was the decision of the Commission to phase in these upgrades and improvements on the television system in a three-year period. A request for funding from the San Juan County Soil Conservation District for operating expenses was discussed. It was the decision of the Commission that the County cannot fund the request for operating expenses. This type of funding would set a precedence and the Commission would be flooded with requests from all other groups. A discussion was held on the requested one-third funding for an Economic Development Specialist for the County. The other two-thirds would be funded by the UNDC and the AOG. This funding of the match for this position would raise the budget from Economic Development to $25,000. The Chair was passed to Commissioner Redd. A motion to approve funding the Economic Development budget in the amount of $25,000 was made by Commissioner Lewis and seconded by Commissioner Maryboy. Commissioner Redd voted NAY. The chair was passed back to Commissioner Lewis. A motion to adopt the following budget was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Community Relations Silke Hansen of the Community Relations Office met with the Commission to discuss the plans of the Commission to get help with funding from the Tribe and Federal Government for the Utah Navajos. Aneth Senior Citizens A discussion was held on the request made from the Aneth Senior Citizens for funding to help with the operation expenses of the van that was award the seniors from Thrifty Car Rental. The Navajo Tribe has indicated there is no funding available for this. UNDC has agreed to match the County $3,000 for this expense. Administrative Assistant Rick Bailey indicated there in enough money in the aging budget to pay this expense. A motion to approve the $3,000 for the operation of the senior citizens van at Aneth was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Bluff Accident Administrative Assistant Rick Bailey received a letter from Vickie Wright of Monticello. Mrs. Wright said Lila Reeves, Senior Citizens bus driver, had arrived at the scene of the pedestrian accident in Bluff, Utah on December 6, 1990 and administered CPR until the ambulance arrived. Mrs. Wright said she had read in the San Juan Record where others that had helped with the accident had been sent letters of thanks and felt Mrs. Reeves should be acknowledged. A letter will be sent to Mrs. Reeves. Mexican Hat Accident Administrative Assistant Rick Bailey reported on a semi-truck accident in Mexican Hat on December 11, 1990. Steve Pehrson had used his 4-wheel drive vehicle to move the wreckage enough to free the trapped driver. This action saved the drivers life. A letter of thanks will be sent to Mr. Pehrson. State Lands Administrative Assistant Rick Bailey has been contacted by Doug Bates of the State Board of Education about the proposed state lands exchange on the Navajo Reservation. The Board of Education would like to hear the Commission's proposal for the land exchange. The Board is interested in obtaining mineral rich land. Commissioner Maryboy said the UNDC and all Chapter officials had met with the Governor last week and requested that the State Lands within the Navajo Reservation in Utah be given to the Navajo Tribe. The Commission will meet on December 18, 1990 for a work session on State Lands. Health Insurance Administrative Assistant Rick Bailey and Blue Cross/Blue Shield Representative John Black discussed a proposal for self-funded health insurance. Mr. Bailey pointed out that a majority of the trauma cases in this area are sent out of state. This may cause a problem with an insurance company that is not recognized by these states. Mr. Black discussed the difference in cost to the county with a prescription card or without a prescription card. Mr. Bailey will present the proposals from other insurance companies at the next commission meeting. COMMISSIONER BILL REDD'S REPORT Economic Development Commissioner Redd attended a meeting of the Economic Development Board on December 11, 1990 in Mexican Hat. Phil Mueller was elected as chairman for the coming year. Association Of Governments Commissioner Redd attended a meeting of the Association of Governments in Price for a Legislative Forum. Scott Johansen, Emery County Attorney, discussed the Amax Oil decision. A representative of Bill Orton discussed the wilderness issue. Incubator Program Commissioner Redd met with Dixie Barsdale to discuss the Bonneville Incubator Study. Road Concern Commissioner Redd received a letter from eight year old Cassie Patterson of Blanding requesting the Reservoir road in Blanding be fixed. The road department has said they are working on widening and resurfacing this road. COMMISSIONER MARK MARYBOY'S REPORT Tribal Council Orientation Commissioner Maryboy spent December 11-12, 1990 in Gallup, New Mexico attending orientation for the newly elected tribal councilmen. Salt Lake Travel Commissioner Maryboy traveled to Salt Lake City on December 13-14, 1990 with the UNDC and Chapter officials to meet with the Governor to discuss the State Lands exchange. The proposed changes in the Utah Division of Indian Affairs board was also discussed. Enid Green is working on proposed legislation for changing the UDIA Board. This proposed legislation would separate the Board so that the Trust Fund for the Utah Navajo is administered by a separate board. Navajo Tribal Government Inauguration Commissioner Maryboy said the Navajo Tribal Government Inauguration will be held in January. The Commission will be invited to attend. COMMISSIONER TY LEWIS' REPORT Association of Governments Commissioner Lewis attended the Association of Governments Legislative Forum in Price on December 14, 1990. A discussion was held concerning the possibility of the Community Impact Board funds being used to work with public lands and minerals that come off from State lands. State Lands A notice requesting input from the County was received from the Division of State Lands and Forestry on the Spanish Valley area of the County. The deadline for input is January 4, 1990. Governors Conference on Tourism The Governor's Conference on tourism will be held on April 15-16-17, 1990 in Salt Lake City, Utah. 1990 Census A packet on the recount of the 1990 census was received.
