SAN JUAN COUNTY COMMISSION MEETING MINUTES December 24, 1990 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk A motion to approve the minutes of the December 17, 1990 meeting as amended was made by Commissioner Redd and seconded by Commissioner Maryboy. CURRENT BUSINESS Tax Sale Property Terry Carlson representing Sterling Energy Corporation met with the Commission to request the purchase of a parcel of land that had been transferred to the County at the May Tax Sale. This property had belonged to Black Dahlia Oil Company. The Commission will advertise for sealed bids on this parcel after the first of the year. The minimum bid will be the back taxes, penalty and interest. Piute Creek Bridge County Engineer Doug Pehrson met with the Commission to discuss a problem with the bid on the Piute Creek Bridge. The contractor with the low bid wants to withdraw the bid because an error was made in his calculations and felt the bid was not right. The State will retain the bond of $15,000 if the bid is withdrawn. If the State keeps the bond the contractor may want to go ahead with the project. The State would like to return the bond and re-bid the project. When the project was bid the bid did not specify that the Navajo Labor Relations Laws must be followed. Mr. Pehrson will be meeting with the Navajo Compliance Officer in Shiprock on January 2, 1990. Mr. Pehrson will schedule a meeting with the Navajo Compliance office, the State and the Commission as early as possible. Mr. Pehrson said he would like to see the Oljato and Piute Creek Bridges bid as separate projects and again as a combined projects to see if there would be a price difference in combining the projects. Budget 1990/General Fund Deputy Auditor John Fellmeth discussed with the Commission the adjustment that needs to be made to the 1990 General Fund Budget. A motion to amend the 1990 General Fund Budget and approve the following resolution was made by Commissioner Redd and seconded by Commissioner Maryboy. RESOLUTION 1990-9 Budget/1991 A discussion was held concerning employee raises that have been included in some department budgets. These monies are being transferred to the employee compensation line in the budget. This will allow the Commission to adopt the budget without approving any pay raises until they are considered on an individual basis as has been the practice in the past. A motion to adopt Resolution 1990-10 as printed for the 1991 budget was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. RESOLUTION 1990-10 Bid Concern Kay Randall owner of Monticello NAPA met with the Commission to discuss the bids for purchases at the road department. Mr. Randall said that Monticello NAPA was awarded the bid for the batteries for 1990. In researching Mr. Randall found that $3,300 worth of batteries were purchased from other vendors. Mr. Randall said he never received notification that his bid was not going to be honored. Mr. Randall said there seemed to be a problem with trading in the old cores when the batteries were purchased. Mr. Randall said he did not specify on the bid that he needed the old cores. Blanding NAPA required a core trade in and batteries were purchased at this business. The Commission asked Mr. Randall if the road department had indicated why they would keep the old cores. Mr. Randall said he hadn't asked what they did with the old cores. Mr. Randall discussed the bids that were awarded for 1991. Mr. Randall said he had bid on batteries and filters this year. When the bids were awarded the battery bids had been split. Mr. Randall said he didn't feel that splitting the bids were acceptable . In order to honor the bid prices that were bid Mr. Randall said he would need the full battery bid. Mr. Randall said he was only a few cents higher on the filter bid. Mr. Randall said he felt when the bids are awarded the amount of time it takes to get an item that is not in stock should be considered. Mr. Randall said he felt service was another thing that should be considered when the bids are awarded. Mr. Randall said he had called Grand and Garfield Counties and had been told that they give a 10% local preference on bids to keep the business in the County. The Commission told Mr. Randall that County Attorney Craig Halls had advised the Commission that a local preference was illegal. The Commission will discuss this matter at the January 7, 1991 road meeting Building Inspections Assessor Bruce Bunker presented the Commission a draft of an agreement with the City of Monticello for doing building inspections. Possible additions to this agreement were discussed. This agreement will be given to County Attorney Craig Halls for his review before it is sent to the City of Monticello for approval. Mr. Bunker requested that he be paid for his position as County Building Inspector. Mr. Bunker said when he was appointed assessor that he was asked to assume the responsibility as building inspector because of his building background. The Commission told him at that time they would discuss the pay at a later time. Mr. Bunker said he felt $200 per month was a fair amount to be paid as the building inspector and asked that this pay be retroactive to November 1989. A motion to table this matter until Mr. Bunker could check with County Attorney Craig Halls about increasing Mr. Bunker's pay without a public hearing was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Mr. Bunker returned later in the meeting and reported that Mr. Halls had said that a raise could not be given to Mr. Bunker in his capacity as County Assessor without a public hearing. The County could contract with Mr. Bunker to do the building inspections without a public hearing. A motion was made by Commissioner Redd to pay Mr. Bunker $200 per month effective January 1, 1991. This motion died from a lack of a second. The Chair was passed to Commissioner Redd. A motion to compensate Mr. Bunker for the building inspections since November 1989 was made by Commissioner Lewis. This motion died for lack of a second. The Chair was passed back to Commissioner Lewis. A motion to table this discussion until the next Commission meeting was made by Commissioner Redd and seconded by Commissioner Maryboy. Commissioner Lewis voted NAY. After further discussion of the past responsibilities of the building inspector a motion was made by Commissioner Redd to compensate Mr. Bunker $200 per month retroactive to November 1989 for the building inspections. The motion was seconded by Commissioner Lewis. UNANIMOUS. Procurement Bids were presented for two typewriters for the Assessors Office. Communications Plus bid $419 each for a Sharp ZX 416. Office Outpost bid $399.00 each for a Panasonic XK-E3000. Parkers Copier Service bid $492 each for a Canon AP110. A motion to accept the bid from Office Outpost was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. The Sheriff's Department presented a request to purchase for a RCA 405 Camcorder for $799 and a Emerson 964 VCR for $239.76. Both of these items were under that amount that was authorized for purchase by the Commission. Both items will be purchased from Wal-Mart. A motion to approve this purchase was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Health Insurance Administrative Assistant Rick Bailey presented a quote on Health Insurance From Intermountain Benefit Administrators. This quote was for a self funded insurance plan with a prescription card. The Commission talked with Insurance Representative Gordon Hilyer on the speaker telephone so that Mr. Hilyer could answer any questions or concerns on the quote from Intermountain Benefits Administrators. Blue Cross/Blue Shield representative John Black met with the Commission to discuss any questions or concerns on Blue/Cross Blue Shield's insurance quote for a self funded health insurance policy. Mr. Bailey told the Commission he should have another insurance quote by next week. This quote will be for a premium plan. The Commission asked Mr. Bailey to check with Emery County on the saving they have experienced with Intermountain Benefit Administrators. Mr. Bailey said there will not be sufficient time to make a decision on the insurance before the first of the year. Blue Cross/Blue Shield will carry the County for January. The rate for this coverage would include the increase. A motion to approve extending the health insurance coverage from Blue Cross/Blue Shield for the month of January was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Aneth to Ismay Road Administrative Assistant Rick Bailey reported a problem that has been encountered at McElmo Creek on the Aneth to Ismay Road. The Corps of Engineers are requesting a notice to change the road at McElmo Creek. After a discussion it was the decision of the Commission to support the corps of engineers on this project. Mr. Bailey will send a letter of support. LaSal Television Commissioner Maryboy said he had been contacted about the television reception in a section of LaSal. Commissioner Lewis said he had talked with Communications specialist Bill Bayles about the LaSal problem. Mr. Bayles had explained the problem why not all people in the LaSal area being able to get the television signal. Snow Removal Commissioner Maryboy reported on the snow needing to be pushed on the Reservation. Heavy snow fall has been reported in the Cahone Mesa area. Aneth Chapter A letter was received from the Aneth Chapter inviting the Commission to attend a meeting on January 6, 1990 with newly elected Navajo Tribal President Peterson Zah at the Aneth Chapter House. This meeting will be held at 1:00 P.M. The Commission is planning to attend. Navajo Nation Presidential Inauguration The Navajo Nation Presidential Inauguration will be held on January 15, 1990. Hospital Loan Commissioner Redd reported he had received a call from hospital accountant Larry Lee requesting the loan to the San Juan Hospital from the County be extended for an additional year. Because of the taxes that were paid in protest the San Juan County Health Services District will have a shortfall in monies for this year. A motion to allow the hospital to extend their loan from the County for an additional year was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. This loan will have the accrued interest added to the note and a new loan agreement will be made up for the Hospital to sign. Travel Request Form The Commission discussed the new travel request form that has been drawn up for the County's use. It was the decision of the Commission to use the new form for travel and reimbursement of expenses for a trial period. The basic rules for its use will be decided after a trial period. Beer Licenses The applications for renewal of all Class A Beer Licenses for 1991 were presented for the approval and signature of the Commission. A motion to approve the license on the stipulation that County Clerk Gail Johnson sees that all of the regulations are met as stipulated in the County Beer Ordinance was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Association of Governments/Board Member A discussion was held concerning a recent letter from the City of Blanding to the Association of Governments requesting a member on the Executive Board. The County Commission is a board member. When Commissioner Black was the board member the City of Monticello had a representative on the Board so both ends of the County were represented. Commissioner Lewis is currently serving on the Board for the Commission. The Commission could see no problem with the other representative on the Board being from the Blanding City so all of the County is represented. Forest Service/Roller Chop A letter was received from the Forest Service Moab office advising the Commission of a rollerchopping project in the Pole Spring Canyon area of the County. The Forest Service is requesting comments on this project. The Commission is in favor of this project. Administrative Assistant Rick Bailey will send a letter in favor of this project tot the Forest Service. Letter of Appreciation/Sheriff's Department A letter of appreciation was received from Paul S. Rey. Mr. Rey complimented Deputies Steve Stovall and Bill King for their assistance in the time of a family emergency.
