SAN JUAN COUNTY COMMISSION MEETING MINUTES January 7, 1991 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk A motion to approve the minutes of the December 24, 1990 meeting as amended was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. CURRENT BUSINESS Bidding Process Kim Hoggard of Communications Plus, Burton Black, John Black and Roberta King of Black Oil Company & Kay Randall and Harry Randall of Motor Parts met with the Commission to discuss the current county bidding process. Mr. Hoggard said he felt a local preference needed to be given in bidding. The Commission advised Mr. Hoggard that County Attorney Craig Halls had told the Commission that giving a local preference was not legal. Mr. Hoggard said his concern was the number of tax dollars going out-of-state with County purchases. Mr. Hoggard said he didn't want to appear that he felt only local vendors should bid. Mr. Hoggard pointed out the recently bid typewriters could have been purchased locally for a few dollars more than the low bid price. The difference in the bid price will be spent on the price of a service call should the machines need repaired. Mr. Hoggard said he felt other things such as service, availability of replacement parts, etc, should be considered when an item is purchased. Harry Randall, Kay Randall, Burton Black and Roberta King discussed with the Commission the bids for supplies and parts for the road department. They suggested the bid process be changed to include timely repair, replacement service and time necessary to get in parts that are out of stock. They felt if these items were considered with the bids, local preference would be given. A discussion was held concerning the awarding of the bids for 1991 purchases. The Commission will discuss the bidding process with the County Attorney and decide if the 1991 purchases for the road department need to be re-bid. Feed Assistance Tom Jones met with the Commission to discuss getting emergency feed for livestock on the Reservation. The Commission contacted the Agricultural Stabilization and Conservation office and sent Mr. Jones to this office for assistance. Emergency Snow Removal The Commission has received numerous requests to plow roads to private residences on the Reservation. The last storm has made it impossible for some Navajo families to get out of their residences. The Commission made a telephone call to Utah Division of Indian Affairs director John Powless and requested $10,000 to hire a private contractor to push snow to these residences on the Reservation. The Commission also requested $2,000 to pay to a private hauler to deliver coal to each of the Utah Chapters. Mr. Powless said he would contact the member of the Board and see if these funds are available. The Commission requested that several of the Navajo people at the meeting met with the Road Superintendent Tony Brandt to point out where the snow was the deepest so a private contractor could begin pushing the snow as soon as the money is approved. Mr. Powless called back later in the meeting to inform the Commission the funds had been approved and to proceed with the snow removal. The funds for hauling the coal were also approved. The County will administer this funding. Library Responsibilities/Dell Hunter The Commission discussed the change that is being made in the way the buildings for both of the San Juan County Libraries are handled this year. Maintenance Supervisor Dell Hunter will be in charge of both of these buildings. Because of the legal ramifications of having contract workers do the custodial work the present contractors will be made county employees. These employees will be supervised by Mr. Hunter. All of the maintenance and problems with the physical facilities will be handled by Mr. Hunter. All utilities and maintenance items have been budgeted into a separate account that will be handled by Mr. Hunter. A letter will be sent to the librarian's and contractor's advising them of this change in the janitorial and maintenance of the buildings. Road Work Concern Julius Claw discussed with the Commission the possibility of locating road equipment in the Aneth area. The Commission told Mr. Claw that there is a road shed and equipment in Montezuma Creek and there are two county road operators who work out of this area. Travel Request Form The Department Heads met with the Commission to discuss the new travel request and reimbursement form the Commission has adopted. It was the decision of the Commission that all travel in the local area (within a 100 mile radius) will be approved by the department head. All travel out of the local area must be approved by the Commission. A memo will be sent to all departments explaining the new travel request forms. Representative David Adams Representative David Adams met with the Commission to see if there was anything the Commission wanted him to do for the County at the Legislative Session. The Commission discussed the possibility of Chapters being able to apply to Community Impact Board for funding. Representative Adams talked about the proposed change in the UDIA Board. There is a proposal to change the board to oversee the royalty money from the Aneth extension. This board would be made up of seven Native Americans and five Anglos. Representative Adams said he had recommended to the Governor's staff that with reorganizing the UDIA board and a new Executive Director for UNDC now would be a good time to conduct a legislative audit of UNDC and UNI. Representative Adams is in the process of introducing a bill to allocate funding to help the Native American Veterans. Representative Adams requested when this bill goes to committee Commissioner Maryboy and some Native Americans be there to testify. Representative Adams said he will introduce legislation dealing with the Native American population and hunting rights. Testimonies from Native Americans will also need to be heard on this bill. Out-of-State Travel A request for out-of-state travel was presented for Peggy Humphreys to attend a travel show in Chicago on January 14-22, 1991. A motion to approve this request was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. Hospital Concern/Dr. Jones Hospital Administrator Larry Putnam met with the Commission to inform them of the possibility that Dr. Val Jones may be called to active duty in the Air Force to serve in Saudi Arabia. Mr. Putnam requested letters from the Commission be sent to the Senators and Congressman from Utah requesting that Dr. Jones not be called to active duty. The Commission said they would send letter of this request to the Congressman and Senators from Utah. Procurement Bids were presented for a computer for the Extension Service. Bids were received from Utah State University on a Toshiba 1000 LE for $1450.00 and Petra Computer bid $3,000.00 on a Toshiba 1000 LE. A motion to accept the bid from Utah State University was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Health Insurance Pharmacist Lee Nielson met with the Commission to discuss the Script card program. Mr. Nielson told the Commission if they would consider doing away with the prescription card he would be willing to give a print out to an employee on his prescription purchases for any period of time they request. This will help the employees file to the insurance for these purchases. Mr. Nielson said he is also willing on an individual employee basis to charge the prescription for the period of one month so the employee has time to be reimbursed by the insurance company. The Commission listened to quotes on self-funded health insurance plans. John Black and Jack Foremen presented a plan from Blue Cross and Blue Shield. John Black them presented a quote from Alta Insurance. Grant and John Hale presented a quote from Hale and Associates. After a discussion of the different plans it was the decision of the Commission to have all the bids re-bid for the same individual stop loss, with and without preapproved hospital visits and with and without a Script card. Bids will need to be to the Commission by 10:00 A.M. on January 14, 1990. Swearing In Of Elected Officials The newly elected County Officials were sworn into office at 12:00 Noon. Commissioner Ty Lewis administered the Oath of Office to Assessor Bruce Bunker, Attorney Craig Halls, Clerk/Auditor Gail Johnson, Commissioner Mark Maryboy, Commissioner Bill Redd, Recorder Louise Jones, Sheriff Claude Lacy and Treasurer Marian Bayles. San Juan County Water Conservancy District The following names were presented for Board members for the San Juan County Water Conservancy District. Gary Halls, Albert Mark, Norman Nielson and Ann Brabrook. A motion to approve these appointments was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. The term for these members will expire on December 31, 1994. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Economic Development Administrative Assistant Rick Bailey discussed with the Commission the $25,000 requested by the Association of Governments to hire a Economic Development Specialist to work in the County. Mr. Bailey said the AOG has the opportunity to apply for money for this position with the Denver office of the Association of Governments. This money would have to have a match. The possibility of having an economic development person teaching at the San Juan Center was discussed. It was suggested that Dixie Barsdale could come up with some guidelines for this type of position and check with the San Juan Center to see if it would be feasible to offer this course at the college. Commissioner Redd discussed the possibility of having an economic development person help write proposals for the Chapters. If this was a possibility the Utah Division of Indian Affairs, Navajo Tribe and School District could be asked to help fund this position. Commissioner Redd will meet with Bill Howell of the Association of Government about this matter and will report on the outcome next week. Aneth Special Service District Administrative Assistant Rick Bailey said the boundaries for the Aneth Special Services District to provide water has been mapped out. The maps have been copied and are ready for the District to be set up. Mr. Bailey suggested that since this District is being established on the Reservation and the laws for establishing Special Services Districts have changed since the last one was set up in San Juan County a bond attorney be hired to handle this matter. Mr. Bailey said a bond attorney will handle all of the paper work and answer all of the legal questions that need to be answered. A motion to approve Mr. Bailey hiring a bond attorney of his choice to work on this matter was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Road Equipment A discussion was held in road meeting concerning the purchase of needed equipment for the road department. A motion to prepare an application to the Community Impact Board for a loan to purchase this equipment was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Procurement Administrative Assistant Rick Bailey told the Commission that the sheriff's department is in need of another desk. The sheriff's department has contacted Mid West Office that supplied the equipment for the Public Safety Building for a price. Mid West Office will furnish an identical desk for $385.87. Mr. Bailey pointed out that this quote is substantially lower than Mid West would usually ask for this desk. A motion to approve this purchase was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. COMMISSIONER BILL REDD'S REPORT Mexican Hat Ice Jam Commissioner Redd was contacted on January 1, 1991 about an ice jam in the San Juan River at Mexican Hat. There was a request to blow up the ice jam. The final decision was to just let the water run. Everything turned out all right. LaSal Improvement Association Commissioner Redd reported the Commission met with the LaSal Improvement Association on January 2, 1991. It was decid ed the County would fund $10,000 to help the Association get a grant from Community Development Block Grant for a community building. The School District has committed $2,000 for operation of the building. Association of Governments Commissioner Redd met with Dixie Barsdale on January 3, 1991 to discuss the AOG Revolving Loan Fund. Aneth Chapter Meeting Commissioner Redd attended a meeting of the Aneth Chapter on January 6, 1991. All of the Commission members attended the meeting. Salary Increases Commissioner Redd Presented the following recommendations for salary increases. Peggy Humphreys to be increased $75.00. Julie Wood to be increased $100.00. Netta McDonald to be increased $50.00. Fay Muhlestien to receive a probationary increase. Jason Shumway to be increased to $7.70 per hour. David Bronson as recommended to $2030.00. Sal Lavato as recommended to $1715.00 Bill Christensen to $1853.00. Jerald Perkins to $1705.00. Monte Dalton, Tom Dyer, Terrance Lee and Bill King a Two Step increase. The recommendations in the Sheriff's Deartment are based on the enacting of the Sheriff not on Commission approval. A motion to approve these recommendations and the stipulation was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. These increase will be effective with January payroll. Commissioner Redd made a motion to adress merit increase in salary one time per year in October. The motion was seconded by Commissioner Maryboy. UNANIMOUS. Commissioner Lewis passed the chair to Commissioner Redd and made a motion to increase all employees this year an additional 1% above the 1% figured to fit the new grade and step chart. The motion was seconded by Commissioner Maryboy. Commissioner Redd voted NAY. The chair was passed back to Commissioner Lewis. COMMISSIONER MARK MARYBOY'S REPORT Aneth Meeting Commissioner Maryboy will be meeting with Utah Power and Light in Aneth on January 9, 1991 to discuss the power line extension in the Aneth area. Navajo Labor Relations The Commission will be meeting with e Navajo Labor Relations at the Blanding Library on January 10, 1990 at 1:00 P.M. to discuss the construction of the Piute Creek and Oljato bridges. UDIA Meeting The Commission will be meeting with Utah Division of Indian Affairs director John Powless at the UNDC offices in Blanding at 6:00 P.M. on January 10, 1991. Community Relations Commissioner Maryboy said he had been contacted about the money that was reimbursed to the County for the Denver trip to the Community Relations office. The peoiple that traveled have questioned him about the difference in the money the County advanced and the actual costs paid by the Justice Department. A motion to refund this amount to the individuals was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. COMMISSIONER TY LEWIS' REPORT Governor Bangarter Letter A copy of a letter sent by Governor Bangarter to Navajo Tribal Chairman Peterson Zah was received. Governor Bangarter recommended Commissioner Maryboy to serve on the Budget and Finance Committee for the Navajo Tribal Council. A motion to send a letter to Navajo Nation President Peterson Zah to recommend the appointment of Commissioner Maryboy to the Budget and Finance, Transportation and Resources Committees was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Library Board Commissioner Lewis requested a letter be sent to the Library Board with the names of the people who have contacted the Commission about being on the Library Board from the Blanding area. These people are Tammy Barton, Mark Shumway and Paul Foreman.
