SAN JUAN COUNTY COMMISSION MEETING MINUTES February 19, 1991 The regular meeting of the San Juan County Commission was held at 10 A.M. in the commission chambers at Monticello, Utah. Present: Ty Lewis, Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk Excused: Commissioner Mark Maryboy was in Window Rock, Arizona to Navajo Tribal meetings. A motion to approve the minutes of the February 11, 1991 meeting as amended was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. CURRENT BUSINESS State Aging Advisory Council Assistant Aging Director Frank Morrell met with the Commission to discuss an appointment to the State Aging Advisory Council. LaRay Alexander who has bee serving in this position has resigned. The Commission needs to appoint a new council representative and an alternate. Mr. Morrell said notices of this vacancy have been posted at all of the Senior Centers. Mr. Morrell said he had received letters from three interested people. Neldon Cochran, Dorothy Teilbay and Verla Marx. The Commission requested that Mr. Morrell interview all three persons and come to next weeks commission meeting with his recommendation. Fire Control Fire Warden Frank Morrell discussed with the Commission the past fire season. The Bureau of Land Management Fire Control office has billed San Juan County for the BLM's assistance in fire fighting this past fire season. The bill to San Juan County from the BLM for this fire season was $2453.16. The bill from the County for BLM help on County fires for the season is $4945.00. This charged is billed through the State Fire Marshall. Other agencies such as the Forest Service and Park Service just trade the time with the County when they assist on a fire. The State fire marshall is trying to settle this matter on a state level. Commissioner Lewis will makes some contacts to see if there is anything that can be done about this billing. Mr. Morrell told the Commission that the electrical at the Montezuma Creek fire station has been running through Utah Navajo Industries. Mr. Morrell would like to have a meter installed at the fire station. This project would cost between $1,500 to $2,000. A motion to approve advertising for bids to the necessary work to install an electrical meter at the Montezuma Creek fire station was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Custodial Proposal Maintenance Supervisor Dell Hunter met with the Commission to present a proposal to consolidate the custodial work at the Monticello Library, Road office and Public Safety Building into one job. Mr. Hunter said he has talked with County Attorney Craig Halls on this matter and Mr.Halls could see no problem with consolidating these jobs to one person. Mr. Hunter presented a job description for the consolidated job. Mr. Hunter suggested this position should begin at Grade 8 Step 1 because of the travel back and forth between building. A motion to approve Mr. Hunter's proposal and the Grade and Step was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Mr. Hunter will begin advertizing for this position. Bluff Library Pat Cook, Chairman, and Rosalie Goldman, Assistant Chairman, of the Bluff Library Board met with the Commission to update them on the happenings with the Bluff Library. Mrs. Goldman thanked the Commission for the building and the support the Commission has given to the Library. Mrs. Goldman said the library has been receiving book donations from all over the Country. The library has had sheet rock, stationary and carpeting donated. The renovation has begun. the proposed date for opening May. Mrs. Goldman told the Commission a bookkeeping system has been established at First Security Bank in Blanding. Mrs. Goldman requested that the $2760 that was funded by the County be placed in this account. The Commission advised Mrs. Goldman that this money was budgeted through the library fund and she would need to contact the Library Board about this money. District Sanitarian Rick Meyer the new District Sanitarian for Southeastern Utah Health District met with the Commission for a get acquainted visit. Mr. Meyer said he has been doing inspections at restaurants in the County. Mr. Meyer said San Juan County has some of the best restaurants he has seen as to the health code regulations. Mr. Meyer discussed the need for sanitation, water and electricity at the West Water section that is owned by the Navajo Tribe. the Commission will discuss this matter with County Attorney Craig Halls. Mr. Meyer will contact the UNDC to see if there is anything planned for this area. Mr. Meyer said he is willing to help in any area he can. Mr. Meyer can do work on the Reservation by invitation from the Navajo Tribe. The Commission thanked Mr. Meyer for coming to get acquainted and wished him well in his new position. Southeastern Utah Economic Development District A motion to approve a resolution of support for the Southeastern Utah Economic Development District was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. RESOLUTION 1991-4 At its regularly scheduled meeting of February 19, 1991, the San Juan County Commission did resolve to continue its support of economic development activities of the Southeastern Utah Economic Development District. Signed /s/ Ty Lewis Chairman, Ty Lewis San Juan County Commission Correspondence A letter was sent to Canyonlands National Park Superintendent Harvey Wickware congratulating him on his upcoming retirement. The Commission also thanked him for the working relationship he has had with the Commission. A letter was sent to William D. Howell, Executive Director of the Southeastern Utah Association of Governments thanking him for his attendance to meetings with the State Bureau of Land Management and Garfield County. A letter was sent to BLM Area Manager Ed Scherick thanking him for taking the time to go out in the field with the Commission to look at some areas of concern. A letter was sent to Navajo Tribal President Peterson Zah concerning the road from Navajo Mountain to Inscription House. The Commission asked that this road be put on the Tuba City Agency's number one priority list to be paved. The request also asked that this project be done in one phase in 1992. San Juan County will attempt to obtain the funding for the seven miles of this road that is in Utah. The Commission also requested this highway be named the Harold Drake Highway after its completion. The Commission also requested help on the right-of-way for the airport and a gravel source for these projects. A letter was sent to the Insurance Commission of the State of Utah concerning the application by the Utah Association of Counties to form an insurance pool. A letter was sent to LaRay Alexander thanking him for his service on the State Advisory Council for the Division of Aging. The Commission also thanked Mr. Alexander for his work with the San Juan County Aging Program. A letter was sent to James Parker, State BLM Director, thanking him and his staff for meeting with the Commission. Communications Communication Specialist Bill Bayles met with the Commission to request an executive session to discuss a personnel matter. A motion to convene into an executive session was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. A motion to return to regular session was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Mr. Bayles presented a request to hire for Steve Bradford as a part-time communications helper. A motion to approve this hiring was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Mr. Bradford will start at Grade 12 Step 1, $7.97 per hour; effective February 25, 1991. Mr. Bayles requested permission to expand the communications office that is inside the Blanding road shed. Mr. Bayles would like to move a wall out five feet. This would allow enough room for two people to work in the area. A motion to approve this request was made by Commissioner Redd and seconded by Commissioner Lewis. Cal Black Memorial Airport County Attorney Craig Halls met with the Commission to discuss the construction of the Cal Black Memorial Airport. Mr. Halls said he had given a ten day notification to Attorney William Lockhart that if nothing further was filed in the lawsuit against this project construction would begin. Mr. Lockhart has contacted Mr. Halls and advised him that this case has been moved from the Federal District Court to the Court of Appeals. The ten day notice does not allow enough time to have the lawsuit transferred and have anything new filed in the case. Mr. Halls advised that if any construction was to begin and a legal action was filed the County may be required to reclaim the land. A motion was made to name the Halls Crossing Landfill the Bill Lockhart/Terry Martin Sanitary Landfill, to be known as the Lockhart/Martin Dump. The motion carried unanimously. Southern Navajo Fair Albert Mark and George Ettisity of the Utah Navajo Development Council met with the Commission to discuss the funding for the Southern Navajo Fair. The Commission requested that the UNDC send invoices for purchases to the County for payment. This would allow the county to have on file the items that were purchased with the funds. This would help for auditing purposes. After a discussion it was the decision of the Commission to have UNDC send a copy of the invoice to San Juan County. A check will then be sent to UNDC to the attention of Albert Mark. The County will pay for invoices up to the $20,000 allotted for the fair. This will enable the UNDC and the County to have a copy of the invoices in their files for auditing purposes. Mr. Etsitty said the UNDC is working with the Bureau of Land Management for a permanent site for the fair. The UNDC is meeting with Utah Power& Light to talk about getting electricity to this site. The Commission suggested if they are unable to obtain BLM land for a site the UNDC might consider a long term lease with the land owners at the present site. A discussion was held concerning selling beer at the fair, if one of the distributors became a sponsor for the rodeo. The Commission advised against selling of beer because of the increased liability. The liability insurance would go way up and some insurance carriers will not even cover an event that sells beer. With the change in the State law the UNDC would also be required to have a State and County license. Anyone serving the beer would have to be trained . Private Contractors Gary Crowley and Jerry Holliday met with the Commission on a follow-up of the discussion they had with the Commission two weeks ago. Mr. Crowley said he would like to see the County bid out more of their construction work. Mr. Crowley said he wanted to get the feelings of the Commission about bidding out the construction projects and if they feel the County is saving money by doing these projects. Commissioner Redd said state law governs what size of projects that County must put out to bid. Commissioner Redd said he feels the County should bid projects whenever possible. There was a discussion on the work the County does for the cities and the cities purchasing gravel from the County. Mr. Holliday sid he understood that County policy was not to accept roads from the cities until they were up to a certain standard. County Engineer Doug Pehrson said this practice has never been a written policy. The Commission pointed out that all roads within the cities belong to the cities. The County has no roads in the cities. Mr. Holliday said he felt that any project that doesn't take four or five months to build is considered maintenance. Mr. Holliday said there haven't been any County road projects bid out in three years. Mr. Holliday felt that the lower end of the Hart Draw project should have been bid instead of the County doing this work. Mr. Pehrson said this was the only project where there was water available so the County could work. Commissioner Lewis said the drought has made it impossible to do a lot of projects. Mr. Crowley said he was concerned with the costs on the Hart Draw project. Mr. Crowley didn't feel this was an accurate cost amount because he couldn't see where benefits, workman's compensation and vacation were figured into the wages paid. Mr. Crowley asked if the water costs for this project were figured in the cost. Mr. Pehrson said the water was of no cost to the County. Mr. Holliday asked if the County did not have to build a road for Heidi Redd for the water. Commissioner Lewis said the road being moved from going through the Dugout Ranch had been requested a long time ago. Mr. Pehrson said the road will not be done until the lower part of the Hart Draw project is completed. Mr. Crowley and Mr. Holliday discussed some of the upcoming road work in the County. Mr. Pehrson said there were plans to do the Hart draw road, the realignment of the Perkins road, South Hatch road, Hoovenweep road and the Aneth to Ismay road. Mr. Crowley asked why the County did not break these projects into smaller projects so the local contractors could bid on them. Administrative Assistant Rick Bailey pointed out that the Commission has no control over these planned project. The San Juan County Transportation Services District will be funding these projects. The Commission suggested that the contractors talk with the Transportation District. Mr. Bailey said there is not a full quorum to hold a meeting at the present time. Mr. Bailey said he foresees the County doing more maintenance projects and the Transportation District doing the construction because the Transportation District will have more money. Mr. Crowley said he felt it hurt the private smaller contractor when the County does the smaller project that the local contractor could bid on and do. Mr. Crowley said the contractors would like to see the Commission try to promote some growth in this industry in the County. Utah Legislature/Court Bill Clerk/Auditor Gail Johnson told the Commission that she had been contacted about the bill that is being that is being introduced on the reorganizing of the Court system. The Utah Association of Counties has not seen the latest draft of the bill and was informed that the State Court Administrator had changed the bill and gotten eighteen more sponsors. The Cities are backing this bill. The bill is suppose to be in rules committee this afternoon. The Commission called Representative David Adams to have him find out where this bill is and if it would be voted on in this legislative session. Senior Citizens Bus Driver Assistant Aging Director Frank Morrell requested permission to advertise for a part-time bus driver in the Blanding area. A motion to approve this request was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Southeastern Utah Association of Local Governments Administrative Assistant Rick Bailey, Economic Development Representative Dick Neztsosie and Commissioner Redd met with Dixie Barsdale and conducted interviews for the researcher for a Resource/Market Strategy study on the Navajo Reservation in Utah. The group decided rather than hiring an individual that they would hire Indian Affiliates, Inc. This firm has conducted similar studies. Utah Division of Indian Affairs has agreed to financial support if this firm is used for the study. Mrs. Barsdale felt if the UDIA could help with this project the money saved by the AOG could be used for a Navajo Strip Conference with Tribal leaders in the spring. Navajo Tribal Funding Administrative Assistant Rick Bailey reported the Commission has received a letter from the Navajo Tribe concerning the funding requests the County made for matching funds for projects on the Reservation. Mr. Bailey said this is the first letter of acknowledgment the County has received from the Navajo Tribe. the letter stated the Navajo Tribe would take into consideration the funding requests made by the Commission. Mr. Bailey said he had been contacted this past week by the Director of Aging for the Navajo Tribe. The director verbally agreed to pay the County fifty cents per mile for the transportation of the Navajo Senior Citizens to the Bluff Senior Center. Justice Court Administrative Assistant Rick Bailey met with Judge Muhlestein last week to discuss the hiring of the part-time employee for the Justice Court. Mr. Bailey said a desk, telephone and chair are needed for this part-time person. The Justice Court budget did not plan for this expenditure and will need permission to overspend the budget for these purchases. After a lengthy discussion on the need for new equipment it was decided that Commissioner Redd would have the responsibility of locating a used desk and a chair for use in the Justice Court. After the lunch break Commissioner Redd made a motion to authorize Mr. Bailey to solicit bids for a desk, chair and telephone for use in the Justice Court. The motion was seconded by Commissioner Lewis. UNANIMOUS. COMMISSIONER BILL REDD'S REPORT Southeastern Utah Association of Local Governments Commissioner Redd reported that he helped on February 12, 1991 with the AOG interviewing for a researcher for the resource/market strategy study. It was recommended that Frank Talker's firm Indian Affiliates, Inc. be hired to conduct this study. Commissioner Redd attended the AOG Economic Development meeting in Price on February 15, 1991. The proposed Southeast Utah Economic Development program and budget was discussed and approved. The Community Development Project applications were received and approved. San Juan County had the CDBG application for $51,000 for installing the Emergency 911 system. This grant was approved. The hiring of a museum consortium staff person to coordinate with all area museums was discussed. This matter was tabled to allow further study. Economic Development Commissioner Redd met with the Economic Development Board on February 12, 1991. They board heard a report on the San Juan County Fair. Janet Wilcox made a presentation to help fund a Cowboy and Indian poetry symposium. Natural Bridges Ranger Denise Cook presented the fifteen-year plan for the Natural Bridges. Ted Veech of La Sal attended the board meeting. The Board passed action to recommend Mr. Veech as a member of the Board. National Federal Lands Seminar Commissioner Redd said there will be a National Federal Lands Seminar held in Randolph, Utah on March 2, 1991. Commissioner Redd would like to attend. The closest place for lodging is in Evanston, Wyoming. A motion to approve a request for out-of-state travel was made by Commissioner Lewis and seconded by Commissioner Redd. UNANIMOUS. Proposal Commissioner Redd received a proposal for an economic development person to work with the County, the Association of Governments and the College of Eastern Utah/San Juan Center. This proposal was from Lynn Lee of the College of Eastern Utah/San Juan Center. Mr. Lee said the Center has the necessary computers for this type of a program. Travel Commissioner Redd will attend a meeting of the Southeastern Utah Health District in Green River on February 23, 1991. Commissioner Redd will be attending the Legislative Briefing on February 20, 1991 in Salt Lake City. COMMISSIONER TY LEWIS' REPORT Utah Association of Counties Commissioner Lewis will be attending a meeting with the Utah Association of Counties Multi-line insurance committee on February 21, 1991. The Multi-line Insurance committee will be meeting with the Utah Local Governments Insurance Trust Board. Southeastern Utah Association of Local Government Commissioner Lewis will travel to Pueblo, Colorado on February 23, 1991 with the AOG to tour their incubator program. Public Administrator's Forum There will be a Public Administrator's Forum at the Grist Mill Inn in Monticello on February 27, 1991. Commissioner Lewis and Commissioner Redd will attend.
