SAN JUAN COUNTY COMMISSION MEETING MINUTES February 25, 1991 The regular meeting of the San Juan County Commission was held at 10:00 A.M.in the commission chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk A motion to approve the minutes of the February 19, 1991 meeting as amended was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. CURRENT BUSINESS Four Corners Governors Council Ken Francis met with the Commission to discuss the Four Corners Governors Council that was held at the Escalante Ruins Visitor Center last fall. Mr. Francis said he is currently working part-time for the Four Corners Heritage Council. This council is working on establishing a permanent Council to work on the management of the cultural resources in the Four Corners area. Mr. Francis felt this should not only include the archeological resources in the area but also the western heritage of the area. The proposed Council would be composed of sixteen members. It is hoped that members to the board would be appointed from the four corners area. The council will be composed of an appointment from each of the four states in private industry, a member of an Indian tribe, and a person appointed by the Governor, two representatives from the Department of Interior and two appointments from the Department of Agriculture. The funding for this committee will be provided by the four corners states, Secretary of the Interior and the Secretary of Agriculture. The amount requested for the first year to get the committee set up and projects started is $80,000. Mr. Francis discussed the proposed signs that will be used in the area to point out the points of interest to the traveler. The committee will try to establish something to go along with the Trail of the Ancients in Utah and a trail system that is established in New Mexico. The Council will develop a comprehensive plan nd then ask for public comments on the plan. The committee that has been doing the planning on this project will be meeting in Blanding, Utah at the Science Building at the San Juan Center on March 7, 1991. The Commission was invited to attend. Commissioner Maryboy said there are several archeological sites on the Navajo Reservation that need to be developed because they are deteriorating. Mexican Water Chapter Mexican Water Chapter representative Margaret Buck met with the commission to discuss three resolutions that have been passed by the Mexican Water Chapter. The first resolution asked for installation of cattleguards and bus signs on Highway 191. The Commission told Ms. Buck that the responsibility for these items is with the State Department of Transportation because Highway 191 is a State highway. The Commission will send this resolution to the Utah Department of Transportation. The second resolution was concerning the Mexican Water Road priority list. Ms. Buck said a copy had been mailed to the County. Commissioner Lewis explained to Ms. Buck why the road project that Chapter was concerned about in the Mexican Water Chapter area was not completed. The amount allowed by law has been spent on this road. The remainder of the project will have to be finished in another year. The third resolution concerned the need for a landfill in the Mexican Water area. The Commission advised Ms. Buck that the problem is in getting someone to give the land for the landfill. Ms. Buck said that Tom Boy has agreed that his land by the Todahaidekani pre-school could be used for the landfill. Ms. Buck thanked the Commission for getting the funds to grade the roads after the last big snow storm. Commissioner Maryboy said the Navajo Tribe has appropriated $100,000 for the grading of roads to the residences on the Utah portion of the Reservation. Commissioner Maryboy requested a map of the residences in the Mexican Water Chapter be sent to the Navajo Tribe. The Navajo Tribe also needs support from the Utah Chapters to get additional funding for the road work from the Bureau of Indian Affairs. Tax Problem Peter Benally told the Commission he had came to Monticello to get his license plates and was told that where he lives in Montezuma Creek is not on Tribal land and he would have to pay property taxes on his vehicle. Mr. Benally lives to the east of the Church of Jesus Christ of Latter-Day Saint and has been told the past ten years he lived on Tribal land. Cleal Bradford was present at the meeting and stated that all land east of the Church was tribal land. Administrative Assistant Rick Bailey was asked to check where Mr. Benally lives on the map and see if Mr. Benally does in fact live on Tribal land. After a check on the map it was determined that Mr. Benally does in fact live on Tribal land. The County Assessor was contacted about this matter. Service District/Water Cleal Bradford met with the Commission to discuss getting a Service District for water to White Mesa established. Mr. Bradford said the White Mesa Ute Council has been trying to get a line for water from Recapture Reservoir. Administrative Assistant Rick Bailey told Mr. Bradford that the Aneth Chapter is in the process of establishing a Water Service District. The Bond Attorney's are presently working on this matter. Mr. Bailey requested that White Mesa Ute Council wait until the decision is received before they proceed with their request for a service district. Mr. Bailey will send the decision of the Bond Attorney's to Mr. Bradford when he receives it. Montezuma Creek Fire Station Fire Warden Frank Morrell presented bids for the installation of the electrical meter at the Montezuma Creek Fire Station. Four Corners Electric bid $1,600 and Northern Electric bid $1,800. A motion to approve the bid from Four Corners Electric was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Aging Advisory Council Assistant Aging Director Frank Morrell presented the name of Dorothy Tielburg as the San Juan County representative for the State Aging Advisory Council with Verla Marx as the alternate. A motion to approve this recommendation was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Road Construction Concern Gary Crowley of Crowley Construction met with the Commission to discuss the cost of construction on the lower portion of the Hart Draw road. Mr. Crowley compared what he has figured the cost to the County of constructing the road with the cost of Crowley Construction doing the same job. Mr. Crowley asked for the Commission to review these figures with the road department and let Mr. Crowley know what is decided. Computer System/Recorder Recorder Louise Jones and Data Processing Specialist John Fellmeth met with the Commission to present the bids for a computer and program for use in the recorder's office. Mr. Fellmeth explained the advantage of purchasing the proposed equipment. Mr. Fellmeth explained that purchasing this type of a system would allow the system to grow into other departments in the County instead of updating the current computer system. Bids were requested on a four station local area network, laser printer, dot-matrix printer and Network hardware and software. Petra Computer bid $14066 and Office Equipment Co. bid $14315. A motion to approve the bids from Petra Computer was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Summit Helicopter Systems Brad Porter representing Summit Helicopter Systems met the Commission at the fairgrounds for a helicopter ride and to present his proposal for the County to use his helicopter services. Mr. Porter proposed the use of helicopter services for weekly surveillance of the County and use in search and rescue operations. Mr. Porter said a weekly surveillance of the County would be a detirment to crime. Mr. Porter felt he could in one hours time cover 1/3 to 1/2 of the County. Mr. Porter said the Sheriff could point out specific areas where there were problems in the County. Mr. Porter said his current fee is $450 per hour. Summit Helicopter Systems is based in Price, Utah. The flight time to Monticello from Price is one and one-half hours. Mr. Porter said he was trying to establish a use for helicopter service in the counties of Grand, Carbon, Emery and San Juan. Black Daliha Oil Property William C. Hafeman of Black Dahlia Oil met with the Commission to discuss a piece of State assessed property which include an oil well and the equipment. This well was owned by the Company and was put up for tax sale in 1990. Mr. Hafeman said he was not aware this property had gone to tax sale until he had contacted the State Tax Commission. Mr. Hafeman said he has been looking for someone to buy the equipment and close the well. Chuska Energy Corporation has offered to do this. Mr. Hafeman requested that the Commission sell him back his property for back taxes plus penalty and interest with an additional $45.00 for the 1990 taxes. A motion to approve this request was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Bid/Car Pool Car Sealed bids for the purchase of a car for the County car pool were opened. Bids were received from Mike Young Incorporated for a $12935 and Martin's Dove Creek Implement bid $14387. The bid from Martin's Dove Creek Implement had a larger engine than the bid specified and this added an additional $914 to the cost. A motion to accept the bid from Mike Young Incorporated was made by Commissioner redd and seconded by Commissioner Lewis. UNANIMOUS. Division of Wildlife Resources Rudy Musclow, Guy Wallace and Roger Kerstetter of the Division of Wildlife Resources met with the Commission to discuss a newspaper article that appeared in the San Juan Record on February 20, 1991. The article quoted Commissioner Maryboy on hunting rights of the Navajo people. Mr. Musclow said he had four major points he would like to set the record straight on. The statement quoted in the paper concerned the hunting rights given to the Navajo people in the 1868 Treaty. Mr. Musclow said that Utah Reservation lands were not a part of the original Reservation. When the Reservation was expanded into Utah hunting and fishing rights were not addressed. The quote in the paper said people were arrested for hunting in the" Traditional Navajo Way"and guns were confiscated and deer thrown away. Mr. Musclow said all arrests are handled in the same manner. The only time a weapon is confiscated is for hunting at night, no hunting license or over limit on the deer. The Division officers really worked with the Navajo hunters this past year. If there was no evidence of sex the officer would go back to the area to prove the sex. More warnings were issued to Navajo people during the hunt instead of giving a sitation. If the officer felt that the offender had made an honest mistake they tried to work with them. Mr. Musclow said that guns are kept only by the courts. All guns are released when fines are paid. Mr. Musclow said that the Division had donated deer and elk to the UNDC for distribution to the Reservation. Mr. Musclow pointed out that the Division officers are bound by the laws of the State of Utah. These laws are designed to protect the herds. Mr. Wallace said he was present at the two meetings that were held with the Navajo Wildlife officials. Mr. Wallace said he saw and read a resolution that was passed concerning hunting and fishing. The main concern of the resolution was the concern of preserving a limited resource. The proposal at the meetings indicated that the Navajo Tribe was not interested in unlimited hunting and fishing rights. The Tribe understands that the resource could not withstand unlimited hunting and fishing. Mr. Wallace said that all fish in Utah are raised at the Division Hatcheries and planted into the lakes. This project is funded through sportmans' dollars. Commissioner Maryboy said the ways of the Navajo and the whites have a big gap. Commissioner Maryboy said he understood on behalf of the Navajo people that they don't want all hunting rights. Hunter education should be an ongoing process not just at hunting season. Commissioner Maryboy said that the Navajo people are being neglected by their own people. Commissioner Maryboy said he appreciated the Division for bringing out these issues. Commissioner Maryboy felt that good things through the media and the litigation will come out of this case. Assessing and Collecting Clerk/Auditor Gail Johnson met with the Commission to discuss a request to pay $49,000 to the Attorney General for 1990 expenditures. Mrs. Johnson said she will be meeting with the State Auditor's office tomorrow on certifying the assessing and collecting budget for this year. If the County pays $49,000 to the Attorney General that would be most of the money budgeted for legal defense for this year. If the Texaco appeal were to start up or if something happened with Chuska Energy there would not be enough money budgeted. Mrs. Johnson said she would like to have a Budget Hearing to reopen the budget to do some adjusting before the assessing and collecting budget is certified. Attorney Lyle Anderson said he felt the State should take a bigger burdern in the oil lawsuit because the State tax Commission has more to lose than San Juan County. A motion to hold a public hearing to amend the budget legal defense fund to $200,000 was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Bluff Cemetery Clerk/Auditor Gail Johnson presented a quit-claim deed for a section of the Bluff Cemetery. This property is being deeded from the County to the Bluff City Historical Association. A motion to approve the quit- claim deed and the signing was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Beer License Clerk/Auditor Gail Johnson presented the beer license for the Needles Outpost. A motion to approve this license was made by Commissioner Redd and seconded by Commissioner maryboy. UNANIMOUS. Natural Bridges National Monument Denise Cooke, Park Ranger for the Natural Bridges National Monument met with the Commission to discuss the fifteen year plan the Park Service is compiling for the Natural Bridges National Monument. Ms. Cooke said March 4, 1991 is the deadline for comments on the proposed plan. The issues that the Park Service is working on in this plan are resource protection, visitor center, campground, roads and trails, utilities and surrounding environment. Ms. Cooke discussed each of these areas with the Commission. The Commission commented to Ms. Cooke that she is the first person from the Park Service to come and meet with the Commission to inform them of changes that may be taking place in the County. Administrative Assistant Rick Bailey also complimented the workers at the Natural Bridges for their help in emergency situations. Ms. Cooke also discussed the landfill with the Commission. The Commission advised Ms. Cooke that the County will be looking at all landfills in the County in the near future. The County will be developing a solid waste plan. Association of Governments The Association of Governments and the Utah Navajo Development Council will be meeting with Frank Talker of Indian Affiliates on February 27, 1991 in Blanding. Administrative Assistant Rick Bailey will attend. Grader Bid Road Superintendent Tony Brandt met with the Commission to discuss the bids on a 16G road grader. Mr. Brandt said he had received two bids. The bid was for a 1978 newly overhauled grader with 40 hours on the engine for $92,500. the bid for a 1979 grader was $79,500. Mr. Brandt said he did not know the hours on this grader. Mr. Brandt said he would like to have permission to go look at these graders before a decision is made. The Commission asked that Mr.Brandt and County Engineer Doug Pehrson meet with them to discuss the road construction on Hart Draw before a decision is made to buy any additional equipment. Requests from Cities Commissioner Redd discussed the requests made from the cities to the County for equipment use and gravel. The need to have a formal written request from Monticello and Blanding cities. It was the decision of the Commission to request both Monticello and Blanding make all requests, other than items covered in agreements, in written form to be presented to in Commission meeting. Administrative Assistant Rick Bailey will inform the Cities of this change. In an emergency situation a member of the Commission can be contacted. Travel Council Travel Council Director Peggy Humphreys met with the Commission to discuss the fifteen-year plan for the Natural Bridges National Monument. Mrs. Humphreys said several of the Economic Development Board members along with herself traveled to the Bridges to look over the problem areas. Mrs. Humpherys will give the Commission a copy of the Boards response to the fifteen-year plan. Mrs. Humphreys said the producers of Thelma and Louise, a movie that was filmed in San Juan County last year, have sent $300 to the San Juan County Film Commission in appreciation for their help. Mrs. Humphreys discussed with the Commission the need for part-time help for the up-coming tourist season. Mrs. Humphreys said the center was staffed with two volunteers last year and she hopes to have more volunteers this season. Mrs. Humphreys said she will still need someone to work approximately fifteen hours per week to cover the center until 7:00 P.M and on Saturdays. Mrs. Humphreys said her schedule would not allow her to cover the center for these hours. The agencies involved in the Visitor Center will be meeting on February 26, 1991 to do the working schedule for this year. The Commission requested that Mrs. Humphreys give the Commission a copy of this schedule before a decision is made on a part-time worker. The Commission asked Mrs. Humphreys to do a mailing to the members of NaCo that will be traveling to Utah for the National Convention. Administrative Assistant Rick Bailey will get a mailing list for Mrs. Humphreys. Building Permit A building permit was presented for the remodeling of the jail building in Bluff for a library. The Bluff Library Board had requested the waiver of the fee for the permit and mileage for inspection. A motion to approve the permit with the fee and mileage waived was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Cal Black Memorial Airport Administrative Assistant Rick Bailey discussed with the Commission and County Attorney Craig Halls the bid on the Cal Black Memorial Airport. Mr. Bailey said the contractor for the project, Interstate Rock Products, has indicated they would like do the project whenever the project can be started. Mr. Halls said he has given William Lockhart a March 1, 1991 deadline for filing an injunction against the airport. If an injunction is filed and the Federal Aviation Administration is enjoined from funding this project any construction costs would have to be paid by the County. Mr. Halls advised the Commission not to sign a contract for the complete construction of the airport. Mr. Halls said a contract for each phase of the construction could be signed. Mr. Bailey will contact Creamer and Noble Engineers for the airport and have them meet with the contractor to see if the contractor is willing to start this project a phase at a time. Personnel Policy Administrative Assistant Rick Bailey told the Commission that Utah Local Government's Trust has compiled guideline for counties to use in developing and changing personnel policies. The Trust would like a copy of san Juan County's personnel policy. Mr. Bailey suggested that the suggested policy be read by himself and then given to Clerk/Auditor Gail Johnson for her input and then forwarded to County Attorney Craig Halls. After these people have reviewed the policy then Mr. Bailey will present the policy to the Commission for their approval. This will allow the County to update the personnel policy to changes in the laws. The Commission gave their approval to this matter. Aging Contract Administrative Assistant Rick Bailey presented the contracts for aging with the Association of Governments. This contracts is for $22,132. A motion to approve the contracts and the signing was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Probationary Increases Administrative Assistant Rick Bailey discussed with the Commission the amount of a probationary increase. On the old grade and step chart a probationary increase was about 3%. On the new chart one step is about 1%. This matter will be decided after all departments have submitted their job descriptions and entry level grade and step. Request for 800 Number Administrative Assistant Rick Bailey said the Commission had received a request several weeks ago from the Blanding City Council for an 800 number to the County for the people that lived out of Monticello.Mr. Bailey said such a line would run between $35 to $40 per month for the first hour of usage. It was the decision of the Commission not to install a 800 line. Mr. Bailey will advise Blanding City that the cost of an 800 number would be to great with each office having a separate telephone line. Piute Creek Bridge Administrative Assistant Rick Bailey reported an endangered plant had been found in the area of the Piute Creek bridge project. This plant is not on the national list but is a Navajo sponsored plant. This may cause delays in the project. Commissioner Maryboy will discuss this matter with the proper Tribal officials. Custodial Work Maintenance Supervisor Dell Hunter has talked with Administrative Assistant Rick Bailey about the proposal he had made to the Commission on combining the custodial jobs at the Monticello Library, Public Safety Building and the Road office. Mr. Hunter had decided to leave the Monticello Library as it is now and hire someone to work 20 hours per week at the Public Safety Building and the road office. A motion to allow Mr. Hunter to do these jobs in the way he desires as long as he not exceed the allotted money was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Area Plan on Aging Administrative Assistant Rick Bailey presented the Area Plan on Aging for the approval and signature of the Commission. This plan includes the services provided and the number of people served. A motion to approve the plan and the signing was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. COMMISSIONER BILL REDD'S REPORT Utah Association of Counties/Legislative Conference Commissioner Redd attended the UAC Legislative Conference on February 20, 1991 and training for new Commissioners. Southeastern Utah District Health Department Commissioner Redd attended the meeting of the Southeastern Utah District Health Department in Green River on February 23, 1991. Gary M. Angot was named as the new director. Travel Commissioner Redd will be attending a road meeting at the Blanding Library on February 25, 1991. Commissioner Redd will be attending a meeting with Mental Health on February 28, 1991 at the Public Safety Building. Commissioner Redd will attend a Public Administrators Forum at the Grist Mill Inn on February 27, 1991. Commissioner Redd will be traveling to Evanston, Wyoming on March 1, 1991 to a Federal Lands Conference in Randolph, Utah. COMMISSIONER MARK MARYBOY'S REPORT Window Rock Commissioner Maryboy traveled to Window Rock on February 19, 1991. Commissioner Maryboy followed up on the requests that the County made to the Tribe for matching funds for expenditures the County had budgeted on the Reservation. The Tribe has transferred some of the unexpended funds from last years budget to fund some new programs. The 1991 fiscal year for the Navajo Tribe will begin in July. The Budget and Finance Committee is still working on the budget. Utah Legislature Commissioner Maryboy traveled to Salt Lake on February 21-22, 1991 to lobby the legislature on the bill for reorganizing the Utah Division of Indian Affairs. The bill was killed for about one hour. Some amendments were added to the bill and the bill continued through the legislature. Commissioner Maryboy met with Steve Class of the State Planning Office to discuss getting power and water line extensions on the Reservation. They also discussed establishing a way so that the Indian Tribes could have access to the Community Development Block Grant Funds. Resolutions/Navajo Tribe A motion to send Resolutions to the Navajo Tribe to request help in funding several projects for the Navajo Reservation was made by Commissioner Maryboy and Seconded by Commissioner Redd. RESOLUTION 1991-6 A Resolution of the San Juan County Commission requesting the Navajo Nation to provide matching trust funds for recreation programs for the Utah Navajo residents. BE IT RESOLVED WHEREAS, the San Juan County Commission has provided funding in the amount of $600,000.00 to set up a Trust Fund for recreation services for the residents of San Juan County; and WHEREAS, the trust fund monies will generate interest monies which will be used for recreation services; and WHEREAS, it is estimated that there will be over $26,000.00 annually appropriated to the recreational programs for the Utah Navajo reservations from the interest generated from the Trust fund. NOW, THEREFORE, BE IT RESOLVED, that the Commissioners of San Juan County , do hereby unanimously request the Navajo Nation to provide an equal amount of funding in a Trust Fund for Utah Navajo residents, which interest generated from such a Trust Fund will provide funding that will be used for recreation programs for Utah Navajo residents. BE IT RESOLVED WHEREAS, there are currently no Navajo Police Officers stationed in the Montezuma, Aneth,and Red Mesa areas of the Utah Navajo reservation; and WHEREAS, these areas have a high area of crime and the closest officers are stationed at Shiprock;and WHEREAS, the response time of responding officers is often over an hour in duration; and WHEREAS, San Juan County has placed one County Deputy in the Montezuma Creek area, but his power of arrest are limited by law on the Utah Navajo Reservation; and WHEREAS, San Juan County and the Utah Navajo residents had been promised that the Navajo Nation would provide two Navajo Police Officers in the area, if a police substation was provided for the Navajo Officers; and WHEREAS, In 1987, San Juan County did obtain and remodel a building for a police substation and expended $117,965,00 in such an effort to provide a location for the Navajo Police Officers to work; and WHEREAS, as of this date, no Navajo Police Officers have been placed in the area. NOW, THEREFORE, BE IT RESOLVED, that the Commissioners of San Juan County, do hereby unanimously request the Navajo Nation to provide two Navajo Police Officers in the Montezuma Creek, Aneth and Red Mesa are to provide police protection to the residents of the Utah Navajo Reservation. BE IT RESOLVED WHEREAS, the San Juan County Commission has provided funding in the 1991 Count Budget to upgrade television reception for the Utah Navajo residents; and WHEREAS, the San Juan County Commission has provided technical personnel to provide the needed upgrades of television reception; and WHEREAS, the San Juan County Commission has budgeted $156,000.00 for upgrading the television reception for the Utah Navajo residents. NOW, THEREFORE, BE IT RESOLVED, that the Commissioners of San Juan County, do hereby unanimously request the Navajo Nation to provide an equal amount of funding in the amount of $156,000.00 for the Utah Navajo residents, which funding will go towards funding and personnel provided by San Juan County, Utah. BE IT RESOLVED WHEREAS, in 1980 the Stat of Utah and San Juan County transferred at the request of the Navajo Nation and the Utah Navajo Chapters, the responsibility and funding for senior citizens and aging programs; and WHEREAS, it was planned that the Navajo Nation would build and operate a Senior Citizens Center in the Mexican Water area; and WHEREAS, due to several problems including financial, the center has never been constructed; and WHEREAS, San Juan County has continued to operate some aging programs for these Navajo Seniors since 1980, including transportation, recreation, congregate meal, and shopping services; and WHEREAS, San Juan County's source of funding to provide these services is being reduced on an annual basis to the point of not being able to continue these services. NOW, THEREFORE, BE IT RESOLVED, that the Commissioners of San Juan County, do hereby unanimously request the Navajo Nation to provide funding to provide transportation services in the amount of 50 cents per mile with a maximum of 500 miles per week to assist with the Senior Citizen program in the Bluff and Mexican Water area of the Utah Navajo reservation and that the navajo nation place a priority in constructing a senior center in this area and as soon as possible. This resolution passed by the Board of County Commissioners of san Juan County, Utah, this 25th day of February, 1991. /s/ Ty Lewis Ty Lewis, Chairman /s/ Mark Maryboy Mark Maryboy, Commissioner /s/ Bill Redd Bill Redd, Commissioner Travel Commissioner Maryboy will be meeting with the Utah State University Extension Service on February 26, 1991 to look at a farming project on the San Juan River. Commissioner Maryboy will be in Shiprock, New Mexico on February 27, 1991, to meet with the Shiprock Agency. On February 28, 1991 Commissioner Maryboy will be in the Douglas Mesa area. Road Foreman Position Commissioner Maryboy said he has been asked by several people if a chauffeurs license is necessary to have to apply for the position of Road Foreman. The people were wondering if they could apply and then get a chauffeurs license. Commissioner Lewis said to tell these people to apply for the position. COMMISSIONER TY LEWIS' REPORT Legislative Briefing Commissioner Lewis attended the Utah Association of Counties Legislative Briefing on February 21, 1991. The bill that has been introduced to change the court system was moving fast. The UAC first voted against the bill and after some changes were made voted to take a neutral position. This bill would combine the District and Circuit Courts and give each County a District Court and possibly a District Court Judge. Multi-Line Insurance Commissioner Lewis attending a meeting of the UAC Multi-Line Insurance Committee on February 28, 1991. The Committee met with the Utah Local Governments Trust Board and requested that the Board not interview when the UAC proposal for an Insurance Trust is heard by the Insurance Commissioner. The Board agreed not to intervene. Incubator Program Commissioner Lewis traveled to Pueblo, Colorado on February 22, 1991 with the Association of Governments to tour the Incubator program. Commissioner Lewis said the Incubator Program in Pueblo was established by private enterprise without help from government funding. All businesses are in one building and share telephone and computer services. The businesses are charged the market rate for floor space. Once a business gets well established then they have to move to a different location. Commissioner Lewis said this has worked very well to get private enterprise established in the area. Commissioner Lewis said he talked with a man from Canyon City, Colorado where they have a similar operation. The Canyon City operation was partly government subsidized and is not working as well as the one in Pueblo. National Wilderness Conference Commissioner Lewis said the National Wilderness Conference will be held in Denver, Colorado on March 21-23, 1991. Commissioner Lewis would like to attend. A motion to approve the request for out-of-state travel was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS.
