SAN JUAN COUNTY COMMISSION MEETING MINUTES March 11, 1991 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk A motion to approve the minute of the March 4, 1991 meeting as amended was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. CURRENT BUSINESS Executive Session A motion to adjourn into executive session to discuss personnel matters was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. A motion to reconvene into regular session was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. Blanding and Monticello City Blanding City Manager Norman Johnson, Councilman Jim Slavens and Monticello City Manager Rick Terry, Maintenance Supervisor Clyde Christensen and Councilman Joe Slade met with the Commission to discuss the requests the cities make to the road department. Mr. Johnson said that the recent decision to have all request come before the Commission has caused some problems. Mr. Johnson asked about having the Blanding Dump pushed, the shoulders of the streets need to be graded and five blocks of curb and gutter that were installed this past year need to have road base from the current road to the curb and gutter. Mr. Johnson said that the City does not plan on having this section paved this year. Mr. Johnson said the City needs some gravel to fill in where water lines have been dug and for filling in potholes. Mr. Johnson asked to have a stock pile at the City yard if all requests for gravel need to come before the Commission. The Commission said that their intent was to have the cities come to the Commission for the request to use equipment and any other requests that are not covered in the road agreement. A motion to allow the cities to work with the local road foreman for requests that fall under the existing road agreement was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Mr. Johnson asked if the billings from the road department to the cities could be made in a more timely manner. Mr. Johnson said the difference in the fiscal years between the County and the City causes problem with the bills being paid in the proper year. Mr. Johnson asked that the billings be made quarterly. The Commission said the road department has indicated that they may need additional help to send out quarterly billings. Mr. Christensen said at times it is hard to contact Mr. Brandt with these requests if he is somewhere else in the County. Mr. Christensen asked if they could make the requests to the road office. The commission said they had no objection to this method if the road office has no problem with handling the requests. Mr. Christensen discussed with the Commission the problem the City of Monticello has with the some of the water meters being installed on private property in the old government home in Monticello. Mr. Christensen said that home on Uranium Drive have the water meter installed in the middle of the driveway. The homes on Circle Drive have the water meters in the back yards. The City owns the water meters and must fix them from time to time. This would be a problem with the City supplying the gravel to fill in where the repairs were done. The Commission advised Monticello City that they may have to charge the property owner for the gravel in this instance. Mr. Slade discussed the use of weed spraying equipment that the County has for rent. Mr. Slade said that in previous years the County has sprayed weeds for the City and them billed the City. If the County has not had time to do the spraying then the County has allowed the City to use their equipment. The weed control has been done by verbal agreement. The Commission will have Jim Keyes meet with County Attorney Craig Halls to draw up a written weed agreement. Mr. Slade and Mr. Terry discussed the upgrading of the Monticello airport with the Commission. Mr. Terry said there has been some discussion of realigning the runway to help with the prevailing cross winds. The State will be handling the beacon and the plane controlled runway lights. Sheriff's Department/Computer Data Processing Specialist John Fellmeth, Sheriff Claude Lacy and Mike Meyers from Spillman Data met with the Commission to discuss the solution to the computer problem in the Sheriff's Department. Mr. Fellmeth said he had researched the costs of four different alternatives.to correct the problem with the computer. Alternative One: No change in the current system. This is the least expensive but, may not be the most workable. This will not permit utilizing the computer in any useful manner. This alternative would cost $74,400 for the next five years. Alternative two: Expand the hard disk capacity on the current machine. One 160 Mb upgrade immediately and another upgrade in two years and an another upgrade in four years. This alternative would cost $76,200 over the next five years. Alternative three: Replace the current machine with an upgraded Motorola machine with a 600 Mb hard disk, 16Mb memory and a 68030 25 Mhz processor. This proposal locks the County into a proprietary hardware solution which will result in higher prices in the long run. This alternative would cost the County $78,150 over the next five years. Alternative four: Replace the current system with a Spillman Data Systems software and IBM compatible software with a 600 Mb hard disk, 16Mb memory, 80386 33 Mhz processor and a laser printer. This system is the least expensive over a five year period at a cost of $73,950. It is also the most flexible and easily upgradable hardware solution. Mr. Fellmeth said he felt the Spillman Data system was by far the best approach for the County to take. New equipment can be added without needing a whole new machine. Sheriff Lacy said he has only budgeted $20,000 for a computer system. Clerk/Auditor Gail Johnson said a budget hearing will be held on March 25, 1991 and this $57,000 can be included at that time. A motion to proceed with the purchase of the Spillman Data System and to authorize Commissioner Lewis to sign the necessary papers was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. TelAmerica Proposal TelAmerica representative Jim Forsey presented a telephone service proposal to the Commission. Mr. Forsey said that TelAmerica is just getting established in Contel service areas. The County would be allowed to pick six area for their savings access. These calls would be charged thirteen and one-half cents per minute for in state calls. All calls in any of the other picked areas would cost thirteen cents per minute. Calls would be discounted more if they were made in the evening hours. The billings would be made to each telephone used. Every user could be given an identification number to punch when the call was placed. This would allow calls to be traced to any telephone and person and still be billed to the County. TelAmerica would cost $10.00 per month for the service plus the amount of the long distance calls. Mr. Forsey said that this type of service would be cheaper to the County than the present WATTS line. There is a two to three week set up time and no charge for the installation. The Commission asked Clerk/Auditor Gail Johnson and Deputy Auditor John Fellmeth to contact other counties and cities currently using the TelAmerica system to get their input on the system. The Commission also requested that Mrs. Johnson and Mr. Fellmeth do a cost comparison to give the estimated savings to the County. This matter will be discussed at the March 25, 1991 meeting. Executive Session A motion to adjourn into an executive session to discuss personnel matters was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. Oil Exploration Concern Chester and Fred Johnson met with the Commission to discuss their concern over the number of exploration permits that have been issued on McCracken Mesa by the Bureau of Land Management. Mr. Johnson said the Aneth Chapter at their meeting on March 10, 1991 had a list of 90 leases for exploration that have been issued for McCracken Mesa area. The people that live in this area are concerned that they will have the same thing happened here as happen to them when they lived where the Aneth oil field is. The Aneth Chapter objected to these leases in this area until the concerns of the people are met. The people are concerned over the water and air pollution and destruction of the area. The Commission told Mr. Johnson that they are working on having a meeting with the Bureau of Land Management, Environmental Protection Agency and the Navajo Tribe to get something done about the contamination of water in the Aneth, Montezuma Creek area. The Commission will write letters to the EPA, BLM and the Navajo Nation with the concerns of the Navajo people and the Commission with the cleanup of the Aneth oil fields and the new exploration that is being allowed on McCracken Mesa. A copy of the letters will be sent to the Aneth Chapter. Economic Development Council A letter was received from the Economic Development Council asking that Ted Beach of La Sal be appointed to the board. A motion to approve this appointment was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Travel Council Travel Council Director Peggy Humphreys met with the Commission to discuss the schedule that has been made for the Combined Visitors Center. Mrs. Humphreys said there are times on Friday evenings and on Saturday and Sunday when someone is needed to work at the Center. The Commission asked Mrs. Humphreys to advertise for volunteer help and specify the times they will be needed. If volunteer help cannot be found then the Commission will make a decision on hiring more help. Mr. Humphreys reported on her recent trip to California to attend a film workshop. Mrs. Humphreys said she felt the trip was very educational. There is a big interest in the Western United States. Mrs. Humphreys was able to meet with and talk with location people. Mrs. Humphreys said she felt that San Juan County would be getting more of the filming business. San Juan County Transportation Services District/Monticello City A letter was received from Monticello City Manager Rick Terry advising the Commission that Monticello City had appointed Jack N. Young as their representative on the Transportation Services District. Agricultural Stabilization and Conservation District A letter of thanks will be sent to Richard Holyoak for his thirty plus years of service as the County Executive Director for the Agricultural Stabilization and Conservation District. Out-of-State Travel The National Association of Counties Western Interstate Region will be holding meetings in Hawaii on May 8-11, 1991. Commissioner Redd and Commissioner Maryboy would like to attend. The chair was passed to Commissioner Redd. A motion to approve the out-of-state travel for Commissioner Redd and Commissioner Maryboy to attend the NACO meeting in Hawaii was made by Commissioner Lewis and seconded by Commissioner Maryboy. UNANIMOUS. The chair was passed back to Commissioner Lewis. Aneth to Ismay Road A discussion was held on the funding requested from the Navajo Tribe for the Aneth to Ismay road project. The project will not be able to be done this year if the Navajo Tribe does not supply funding. Administrative Assistant Rick Bailey will write to the Navajo Tribal President Peterson Zah about this matter. Commissioner Maryboy asked that a copy of the letter be sent to Congressman Bill Orton and Charles Henderson of the Department of Transportation. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Edge of the Cedars Administrative Assistant Rick Bailey reported there will be a meeting at the Edge of the Cedars on March 13, 1991 at 7:00 P.M. to discuss the expansion and remodeling with representatives from the State History Association. Commissioner Lewis will attend this meeting. COMMISSIONER BILL REDD'S REPORT Department of Energy Commissioner Redd attended a Department of Energy meeting in Monticello on March 7, 1991. The planned cleanup of the uranium waste in Monticello was discussed. Forest Service Roads and Trails Commissioner Redd attended a Forest Service Roads and Trails meeting on March 7, 1991 at the Courthouse. The County will need to make a decision on county roads that go into the Forest Service area so that all roads will be classified the same. National Association of Counties Commissioner Redd will be traveling to Washington, D.C. to attend the National Association of Counties Legislative Forum on March 14-20, 1991. COMMISSIONER MARK MARYBOY'S REPORT Mexican Hat Town Meeting Commissioner Maryboy attended a Mexican Hat town meeting on March 8, 1991. The residents asked for a pothole to be fixed by the Halchita sewing factory and to have the guard rail that has fallen down removed or fixed because it is dangerous. The Commission will have the road department look into these matters. The Department of Energy is appropriating money to the Navajo Tribe to finish the uranium cleanup in Halchita. Administrative Assistant Rick Bailey will send a letter to the Navajo Tribal Resources asking that this projected be completed as timely as possible. Solid Waste Disposal Commissioner Maryboy reported that Indian Health Services has indicated that they would like to work with the County on solid waste disposal. The legislature has appropriated money to the counties for developing solid waste management plans. Indian Health Services will be contacted when the County is ready to start the planning. Resolutions/Navajo Nation Commissioner Maryboy presented five resolutions to be sent to the Navajo Tribe asking for assistance with airports, additional road maintenance money, fencing, agriculture projects, and money for each of the Utah Chapters for roads. A motion to approve the resolutions and the signing was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. RESOLUTION 1991-12 A Resolution of the San Juan County Commission requesting the Navajo Nation Transportation Committee to provide for the application and process for upgrading airports at Navajo Mountain, Oljato and Montezuma Creek. BE IT RESOLVED WHEREAS, there is a great need to upgrade the existing airports at these locations; and WHEREAS, the Federal Aviation Administration requires the land for each airport be under one ownership and fenced before funding can be appropriated; and WHEREAS, it will be necessary for each Chapter to obtain needed rights of way, permits, etc. for the application of the FAA. NOW, THEREFORE, BE IT RESOLVED, that the Commissioners of San Juan County, do hereby unanimously request the Navajo Nation Transportation Committee to work with the Utah Chapters and Land Offices to provide rights of way and permits and make application to the FAA for funding to upgrade these airports. This resolution passed by the Board of County Commissioners of San Juan County, Utah, this 11th day of March, 1991. /s/ Ty Lewis, rmb Ty Lewis, Chairman RESOLUTION 1991-13 A Resolution of the San Juan County Commission requesting the Navajo Nation Transportation Committee to request the Bureau of Indian Affairs to increase the amount of road maintenance money to San Juan County, Utah from $40,000.00 per year per agency to $200,000.00 per agency per year. BE IT RESOLVED WHEREAS, San Juan County has over the years provided many millions of dollars into roads on the Utah portion of the Navajo Reservation in construction and maintenance projects; and WHEREAS, the Shiprock and Western Agency now provide to San Juan County $40,000.00 per agency per year to do maintenance on the Utah Navajo Reservation; and WHEREAS, the funding has not been significantly increased over the years, even though the cost of fuel, labor and equipment has risen greatly; and WHEREAS, the revenues of the County of San Juan have been declining and the County will not be able to continue to provide the same level of work as has been accomplished in the past. NOW, THEREFORE, BE IT RESOLVED, that the Commissioners of San Juan County, do hereby unanimously request the Navajo Nation Transportation Services Committee request the Bureau of Indian Affairs to increase the yearly amount of funding to San Juan County for the two agencies from $40,000.00 to $200,000.00 per year. BE IT RESOLVED WHEREAS, San Juan County has over the years provided many millions of dollars into roads on the Utah portion of the Navajo Reservation in construction and maintenance projects; and WHEREAS, the County has a policy to not fence county roads and it is the responsibility of the land owners to fence such roads; and WHEREAS, Bureau of Indian Affairs does have land responsibility for these roads. NOW, THEREFORE, BE IT RESOLVED, that the Commissioners of San Juan County, do hereby unanimously request the Bureau of Indian Affairs to provide funding for the construction and installation of fencing along San Juan County roads 413 and 406 on the Utah Navajo Reservation. BE IT RESOLVED WHEREAS, these areas of San Juan County have good agriculture possibilities and have been involved in studies with the Federal Agricultural Stabilization and Conservation Service and Utah State University Extension Service; and WHEREAS, the funding for these agricultural projects is very important to provide a stable economy to the residents of the Utah Navajo Reservation; and WHEREAS, Utah State University and the ASCS offices will provide local input, supervision and some funding. NOW, THEREFORE, BE IT RESOLVED, that the Commissioners of San Juan County, do hereby unanimously request the Navajo Nation to provide $100,000.00 for funding these agricultural projects. This resolution passed by the Board of County Commissioners of San Juan County, Utah, this 11th day of March, 1991. /s/ Ty Lewis, rmb Ty Lewis, Chairman RESOLUTION 1991-16 A Resolution of the San Juan County Commission requesting the Navajo Nation to provide $100,000.00 in funding to each Utah Navajo Chapter to allow the chapters to provide road maintenance and snow removal to resident's home. BE IT RESOLVED WHEREAS, the San Juan County Commission has provided road construction and maintenance to the Utah Navajo residents for may years; and WHEREAS, the County has expended funding up to a million dollars per year on Utah Navajo road projects; and WHEREAS, the County is prohibited by law from providing road work to private residents; and WHEREAS' the residents of the Utah Navajo Reservation need road work from the county roads to resident's homes and snow removal services to the residents. NOW, THEREFORE, BE IT RESOLVED, that the Commissioners of San Juan County, do hereby unanimously request the Navajo Nation to provide $100,000.00 to each Utah Chapter to allow the Chapters to purchase a used road grader and provide fuel and labor to accomplish needed road work and snow removal. This resolution passed by the Board of County Commissioners of San Juan County, Utah, this 11th day of March, 1991. /s/ Ty Lewis, rmb Ty Lewis, Chairman COMMISSIONER TY LEWIS' REPORT State Lands Commissioner Lewis traveled to Salt Lake City on March 6, 1991 and met with Dick Mitchell of the Utah State Lands and Forestry. They discussed the proposed State Lands exchange on the Navajo Reservation. Community Impact Board Commissioner Lewis attend the Community Impact Board with the Association of Governments on March 6, 1991. The AOG asked for funding to hire a public lands specialist to work with the counties on public lands issues. This funding was approved by the CIB. Navajo Reservation Funding Commissioner Lewis met with Ron Madsen of Senator Hatch's Office and Robert Dibblee of Senator Garn's office to discuss the funding needed for the Navajo Mountain to Inscription House road. A discussion was held concerning how equitable money is spent on the Navajo Reservation. A discussion was also held about the possibility of getting a Bureau of Indian Affairs office in Utah to serve the Utah Navajo residents. Resource Conservation and Development A Resource Conservation and Development meeting will be held on March 12, 1991. Representatives from the Cities, County and Navajo Tribe will be discussing a county wide plan for resource conservation and development. Forest Service Amendment Notice was received from the Forest Service of proposed amendments to three grazing allotments in the Bears Ears area. Administrative Assistant will make comment on these amendments. Economic Development Meeting There will be a meeting of the Economic Development Council Board on March 12, 1991 at the Blanding City office. Bluff Cemetery A letter of thanks for deeding a portion of the Bluff cemetery to the Bluff City Historical Preservation Association was received from Liza Doran. La Sal Cemetery Commissioner Lewis discussed a problem with the La Sal cemetery that the County owns. Mr. Lewis has been contacted about getting a plot in this cemetery. After a discussion it was the decision of the Commission to have Administrative Assistant Rick Bailey talk with the LaSal Community Group and see if they would be interested in taking over the La Sal cemetery. San Juan County Transportation Services District The San Juan County Transportation Services District will be meeting on March 19, 1991. Joint Highway Committee A meeting of the Joint Highway Committee will be held on March 22, 1991 in Provo, Utah. Association of Governments There will be Association of Governments meeting in Price on March 15, 1991. Commissioner Lewis will attend. Utah Association of Counties The Utah Association of Counties will be meeting on April 10-12, 1991 in Park City, Utah. Piute Creek Bridge Commissioner Lewis received a call from Dan Julio of the Department of Transportation advising the Commission that the Navajo Tribe has appropriated $120,000.00 to participate in the Piute Creek Bridge project.
