SAN JUAN COUNTY COMMISSION MEETING MINUTES MAY 6, 1991 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk A motion to approve the minutes of the April 22, 1991 meeting as written was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. CURRENT BUSINESS Grand County Prisoners Sheriff Claude Lacy met with the Commission to discuss a request made by Grand County to house all of their prisoners at the San Juan County jail while the Grand County jail is being remodeled. Sheriff Lacy recommended an agreement similar to the one San Juan County currently has with Grand County to house female prisoners. Grand County is currently paying $30.00 per day to have female prisoners housed in the San Juan County jail. A motion to approve a contract with Grand County for $30.00 per day to house prisoners was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Request to Hire/Sheriff's Department Sheriff Claude Lacy discussed with the Commission some changes that need to be made in the Sheriff's Department. Steve Stovall will be terminating his employment with San Juan County. Mr. Stovall has accepted employment with Washington County. Sheriff Lacy presented a request to hire Alan Freestone to be a full-time Corrections Officers. Sheriff Lacy said he is proposing to move Jaren Adams to Corrections Officer until the time that Mark Ewart and Alan Freestone have completed corrections training. After this Sheriff Lacy will be moving Mr. Adams out on the road as a deputy. Mr. Adams is not certified as a law enforcement officer and will need to attend POST. Sheriff Lacy said he has filled a hiring roster for dispatchers. Deb Davis and Martha Johnson are on the top of the roster and Sheriff Lacy would like to hire and train both as part-time dispatchers. Sheriff Lacy said he felt with these hirings and changes in the corrections department the jail will be staffed to handle the time while Mr. Adams attend corrections school. Deb Davis will be hired as a part-time dispatcher at Grade 6 Step 1, $6.26 per hour; effective 5-6-91. Martha Johnson will be hired as a part-time dispatcher at Grade 6 Step 1, $6.26 per hour, effective 5-6-91. Alan Freestone will be hired as a corrections officer at Grade 15 Step 1, $1504 per month; effective 5-6-91. Jaren Adams will be a corrections officer at Grade 14 Step 1, $1504 per month; effective 5-6-91. A motion to approve these hirings and changes was made by Commissioner Redd. After a discussion on why the Navajo applicants are not placed higher on the roster the motion was seconded by Commissioner Maryboy. UNANIMOUS. Vehicle/Sheriff's Department Sheriff Claude Lacy discussed with the Commission the purchase of a new vehicle for the Sheriff's Department. Sheriff Lacy said there are six old vehicles that need to be sold. The Commission asked about the possibility of assigning one of these vehicles to Commissioner Maryboy for a shuttled car when he needs to conduct county business. Sheriff Lacy said he would like to purchase a Jeep Cherokee or a four door Chevy Blazer. Administrative Assistant Rick Bailey said that this late in the model year a new vehicle could be ordered but wouldn't be delivered until the next model year. Mr. Bailey said he could send out specifications and see what is available on car dealers lots. The Commission asked Mr. Bailey to put out the specifications to some dealers and they will discuss this purchase after it is determined what is available. Sheriff's Department/Personnel Policy Sheriff Lacy presented a copy of the Personnel Policy that the Sheriff would like to adopt for his department. This manual would be used in conjunction with the County Personnel policy and would not supersede this policy. A motion to approve adopting this policy was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Halls Crossing/Deputy Request Sheriff Claude Lacy discussed with the Commission a request he has received for a deputy to be stationed at Halls Crossing. The Commission told Sheriff Lacy that they would be meeting with the Park Service and Kane and Garfield Counties and that this matter would be discussed. Fuel Meters/Road Department A motion to approve the purchase of fuel meters for the above ground tanks at the La Sal and Montezuma Creek road yards was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. San Juan Special Service District #1 A motion the appoint Mark Sword to the board of the San Juan Special Service District #1 for a four year term to expire 5-6-95, was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Historical Society A motion to appoint Steve Simpson and LaVern Tate to the Historical Society Board to serve a four year term, to expire 5-6-95, was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. If the Historical Society wants to expand their board they will need to come to the Commission with a proposal. The Historical Society has requested to use $1,000 of their budget to help with the publishing of a historical calendar on Bluff. This calendar is being done by the Bluff Historical Preservation Association. A motion to approve this expenditure was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Agreement/ La Sal Arena An agreement with Dale Fuller for the La Sal 4-H group to use his horse arena for a minimum of three years was presented for the approval andf signature of the Commission. A motion to approve the agreement and the signing was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Probationary Increase A probationary increase was presented for Weed and Rodent Supervisor Max Black. Mr. Black will be increased to Grade 11 Step 4, $7.94 per hour; effective 4-29-91. A motion to approve this increase was made by Commissioner Redd and seconded by Commissioner Maryboy UNANIMOUS. Building Permit A building permit was presented for Paul and Diane Kemner to construct an addition to their home. A building permit was presented for Don Sparling to construct a storage shed. A motion to approve these permits was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Human Services Board Commissioner Lewis passed the chair to Commissioner Maryboy and made a motion to appoint Frank Morrell to the Human Services Board. The motion was seconded by Commissioner Redd. UNANIMOUS. The chair was passed back to Commissioner Lewis. La Sal Recreation District Administrative Assistant Rick Bailey discussed with the Commission a request from the La Sal Community Group to become a Recreation Services District. This district would encompass the ball field at La Sal. A motion to approve the public meeting to receive comments on the Recreation District was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Blue Cross/Blue Shield Health Insurance Agreement The agreement for health insurance coverage with Blue Cross/Blue Shield was presented for the approval and signature of the Commission. A motion to approve the agreement and the signing was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Procurement Bids were presented for a file cabinet for the Historical Society. Bids were presented from J. C. Penney for $231.49, Sears for $281.49 and Palmer's bid $245.00. The Historical Society requested to purchase the filing cabinet from Palmer's because of the immediate need and local delivery. A motion to approve the purchase from Palmer's was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Oljato and Piute Creek Bridge Engineer Doug Pehrson said he had talked to the Navajo Tribe and would be receiving a FAX copy of the temporary right-of-way for the Piute Creek and Oljato Bridges. Mr. Pehrson said this right-of-way will allow the projects to be started. Utah Navajo Development Council A request was received from UNDC for the County to clear a section of land in Oljato for a four-day convocation that the Episcopal Church of the Navajoland is having. Commissioner Lewis will send a letter to UNDC advising that the County cannot do this type of work and suggest that they seek a donation from a private contractor. Spanish Valley Right-of-Way A letter was received from Jay and Donna Coates of Moab giving the County a 50 foot right-of-way on County road #195. Interlocal Agreement/Grand County An Interlocal Agreement with Grand County for the construction of two bridges in the Spanish Valley area was presented for the approval and signature of the Commission. A motion to approve the agreement and the signing was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Cal Black Memorial Airport The construction of the Cal Black Memorial Airport is progressing very well. The fencing is almost completed. The road has been realigned and the drilling of the well is about to begin. New County Master Plan A discussion was held on having the County Master Plan updated. Owen Burnham did the last Master Plan. Administrative Assistant Rick Bailey will contact Mr. Burnham to have to him submit a proposal to update the Master Plan. Board Of Equalization/ Tax Exemption Requests A motion to convene into the County Board of Equalization was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Assessor Bruce Bunker presented the requests for tax exempt status. A request from The Church of Jesus Christ of Latter-Day Saints and Jehovah's Witness Church were the only ones received. Mr. Bunker said the County has not required tax exempt status to be declared every year and people are not aware that this needs to be done yearly. A motion to approve the two requests and all others that had made requests in previous years unless Mr. Bunker finds a problem with any exemption was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. A motion to close the Board of Equalization and reconvene into regular session was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Auditor's Letter Clerk/Auditor Gail Johnson presented the Auditors Letter for the approval and signature of the Commission. This letter will allow the independent auditors to begin the yearly audit of the County. A motion to approve the letter and the signing was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Beer License/El Sombrero Clerk/Auditor Gail Johnson presented a request for a Class C Beer License for the El Sombrero Cafe in Mexican Hat. This license will be issued on a quarterly basis for $115. Sheriff Lacy was present and gave his approval to the issuing of the license. A motion to approve this license was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Delinquent Tax Sale Clerk Auditor Gail Johnson discussed with the Commission the procedures for the delinquent tax sale to be held on May 23, 1991 at 10;00 A.M. Parcel #1 will be sold for minimum bid of the delinquent taxes, penalty and interest. Parcel #2 will be sold for the minimum of the appraised value. Parcel #3 will be sold for a minimum bid of the delinquent taxes, penalty and interest. Parcel #4 will be sold for the minimum bid of the delinquent taxes, penalty and interest. Court Contracts Clerk/Auditor Gail Johnson presented the contracts for Circuit and District Court for the approval and signature of the Commission. A motion to approve the contracts and the signing was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Problem in La Sal Discussed Steve and Mary Lou Kosanke met with the commission to discuss a woodpile William Stocks has on his property that is adjacent to their property. Mr. Stocks received a building permit to construct a fence for fire control on his property. Fire Warden Frank Morrell contacted the State Fire Marshall about this matter last fall. The State Fire Marshall stated that a 12 foot galvanized fence would eliminate the fire hazard and be in compliance with the State Fire Code. Mr. Kosanke said that he felt the best alternative was to move the wood pile. The Commission told Mr. Kosanke that they have no authority over this matter as long as Mr. Kosanke is in compliance with the State Fire Code. Mr. Morrell will inform Mr. Stocks he needs to complete his fence within a 90 day period. Mr. Kosanke discussed with the Commission a site he felt would work for a television translator site. Commissioner Redd will discuss this matter with Communications Specialist Bill Bayles. Navajo Tribal Police Kee Mann of the Navajo Tribal Police met with the Commission, Sheriff Claude Lacy and Deputy Terrence Lee to discuss police protection on the Utah portion of the Navajo Reservation. Sheriff Lacy said he would like to have another Tribal officer stationed at Montezuma Creek. There is currently one officer stationed in Montezuma Creek. This officers works an eight-hour daytime shift and is unavailable for call out in the evening hours. Mr. Lee said he knows a man in Montezuma Creek that is interested in working for the Navajo Tribal Police. Mr. Lee said he feels he would be an excellent officer. Mr. Mann will be arrange a meeting with the Navajo Tribal Police and Sheriff Lacy to discuss this matter. Sheriff Lacy and the Commission will send letter of recommendation for hiring a Montezuma Creek resident for a Tribal deputy. The Cross Deputization Contract with San Juan County and the Navajo Tribe was presented for the approval and signature of the Commission. This contract will allow the officers to make arrests on the other departments jurisdiction. Those arrested under this contract will have to be tried in the proper jurisdictional courts. A motion to approve the contract and the signing was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Mr. Mann will take the contracts to Window Rock for the proper signatures and return them to Sheriff Lacy. Out-of-State Travel/Federal Lands Conference Melvin Dalton met with the Commission to advise them of a Federal Land Conference that is being held in Albuquerque, New Mexico on June 11, 1991. This conference will deal with counties and Mr. Dalton feels the Commission and the County Attorney should attend. Commissioner Redd will plan to attend. The chair was passed to Commissioner Redd. A motion to approve out-of-state travel for Commissioner Redd to attend the Federal Land Conference in Albuquerque, New Mexico on June 11, 1991. The motion was seconded by Commissioner Redd. UNANIMOUS. The chair was passed back to Commissioner Lewis. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Off-Road Filming Administrative Assistant Rick Bailey said Dick Davis who will be filming the off-road vehicle film will be on Highway 95 on May 22 or 23 to talk to people about off-road vehicle use in the county. Out-of-State Travel A request for out-of-state travel was presented for Administrative Assistant Rick Bailey and Commissioner Redd to travel to Window Rock on April 29, 1991. Commissioner Redd and Mr. Bailey went to present a proposal to the Navajo Tribe. A motion to approve the request was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. Southeastern Utah Association of Local Governments Administrative Assistant Rick Bailey said Bill Howell from the AOG will be to commission meeting on May 20, 1991 to discuss Economic Development. Bureau of Indian Affairs Administrative Assistant Rick Bailey said Bob Dibblee of Senator Garn's office had met Bob Weidner to discuss the way BIA funds are allocated. Mr. Weigner said he is pushing to have a formula attatched to all Bureau of Indian Affairs funding from Washington D.C. Bureau of Indian Affairs School/Aneth The land fill at the BIA school in Aneth has been closed by Indian Health Services. Administrative Assistant Rick Bailey said a meeting was held with IHS last fall and IHS indicated that Utah Navajo Development Council would be in charge of all of the landfill problems on the Utah portion of the Reservation. After a discussion on the responsibility of landfills on the Reservation it was decided that Mr. Bailey would send a letter to Indian Health Services advising them that UNDC is not a recognized provider on the Utah portion of the Reservation. COMMISSIONER MARK MARYBOY'S REPORT National Association of Counties Commissioner Maryboy said he has been asked to serve on the National Association of Counties Select Committee of Native Americans. A motion to approve Commissioner Maryboy's appointment was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. The Utah Association of Counties will be advised of this appointment. Bureau Of Indian Affairs/Budget Meeting A BIA budget hearing will be held in Durango, Colorado May 15-16, 1991 to talk about the proposals for the budget. Navajo Tribal Budget Commissioner Maryboy said that the Navajo Tribal Council will be presented the final budget on May 29, 1991. Travel Reimbursement Commissioner Maryboy said he has not billed for reimbursement for travel to commission meetings for this year. A motion to allow Commissioner Maryboy to bill for his back travel on May 20, 1991 was made by Commissioner Redd. The Chair was passed to Commissioner Maryboy and Commissioner Lewis seconded the motion. The chair was passed back to Commissioner Lewis. Administrative Assistant Rick Bailey will do Commissioner Maryboy's travel on a monthly basis. COMMISSIONER BILL REDD'S REPORT Navajo Tribal Budget Proposal Commissioner Redd traveled to Window Rock, Arizona on April 29, 1991 to present a budget proposal to the Navajo Tribe. The proposal was for Chapter funding to maintain private roads to residences on the Utah portion of the Reservation. The meeting was changed to April 30, 1991 so Commissioner Maryboy made the proposal for San Juan County. Congressman Wayne Owens Commissioner Redd met with Congressman Wayne Owens and other elected officials to discuss wilderness on May 2, 1991. COMMISSIONER TY LEWIS' REPORT Park Service Meeting Commissioner Lewis will be attending a meeting a Bullfrog on May 13-14, 1991 with Kane and Garfield Counties and the national Park Service to discuss roads, law enforcement and other issues. Bureau of Land Management The BLM will be holding a meeting at 10:00 A.M. on May 15, 1991 to discuss the Comb Wash allotment. San Juan Natural Resource Committee The San Juan Natural Resource Committee will be going on a tour on May 18, 1991 to determine forage capacity for cattle and wildlife. Southeast Utah Association of Governments Commissioner Lewis met with Southeastern Utah Association of Counties Director Bill Howell. They discussed the $300,000 that was appropriated by the Community Impact Board for a land specialist to work with the AOG. Several members of the CIB were offended by this use of money. San Juan , Grand, Carbon and Emery counties are high contributors to the mineral lease fund that is used by the CIB.
