SAN JUAN COUNTY COMMISSION MEETING MINUTES June 17, 1991 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Dena Hunter, Deputy Clerk Excused: Rick Bailey, Administrative Assistant A motion to approve the minutes of the June 10, 1991 meeting as amended was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. CURRENT BUSINESS Audit Report/Kay Kimball Kay Kimball of Kimball and Roberts met with the Commission to present the Independent Audit Report for the 1990 audit of the County. Mr. Kimball presented each of the Commissioners with a copy of the audit report and the management letter. Mr. Kimball reviewed the report with the Commission and answered questions concerning the report. Mr. Kimball discussed with the Commission areas he felt need to be improved. Mr. Kimball complimented the County employees and elected officials for their assistance with conducting the audit. Utah Navajo Development Council/Utah Navajo Fair Clarence Kay, Chairman of the Utah Navajo Fair, met with the Commission to request payment of 1/3 of an invoice for fencing for the fair. The Commission advised Mr. Kay that a copy of the invoice would need to be submitted to the Clerk's office for payment. The Commission asked Mr. Kay if the UNDC will be able to purchase the land for the fair site. Mr. Kay said that the UNDC is talking with the land owners. All but one owner seems to be agreeable to sell or obtain a long-term lease on the land. The Commission suggested that the UNDC get an appraisal of the land and make an offer to the land owners. Mr. Kay said the fair this year is expected to be bigger than the fair last year. There is expected there will be 150 different tribes and dancers present. The fair is scheduled for September 14-16, 1991. Mr. Kay said the fair has received a lot of support from the Bluff community and businesses. Commissioner Maryboy cautioned about the expenditures for the fair. Commissioner Maryboy said that as member of the Budget and Finance Committee for the Navajo Tribe he helped review the audits for several Navajo Nation fair and found abuse and mismanagement of funding. Mr. Kay said that Francis Lyman will be helping the UNDC with the accounting of the fair expenses. Mr. Kay said he is the off-Reservation Chapter representative. Mr. Kay has replaced Wilber Willie. Mr. Kay requested that the road that runs through the Westwater Community be maintained so that the school bus will pick-up the school children. The Commission told Mr. Kay that they will talk with the road department about this matter. Zoning Request Steve Olschewski told the Commission he would like to establish a primitive camping park on his land in the Kane Springs Canyon area. Mr. Olschewski said the facility would provide a camp spot and showers for the campers. The Commission asked Mr. Olschewski to send them a copy of his plan for the area. The Commission said any building would require a building permit and approval of the Health Department. Mr. Olschewski will send his plans to the Commission for their approval. Procurement Bids were presented for a television set for the fair board. This television set will be used in the raffle for fairground improvements. Sears bid $280.00 and Blue Mountain Music bid $349.000. A motion to approve the bid from Sears was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Building Permit A building permit for an electrical inspection only was presented for Wade Tangreen. Mr. Tangreen is proposing to move a mobile home onto his property in La Sal, Utah. A motion to approve this permit was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Salary Request Maintenance Supervisor Dell Hunter met with the Commission to discuss the salary currently being paid Rufina Romero. Ms. Romero was a contract worker at the Monticello Library until January when the County made her a County employee. Ms. Romero is currently being paid $275 per month for 20 hours per week work. Ms. Romero will be terminating her employment effective June 17, 1991. Mr. Hunter said he would like to adjust Ms. Romero pay to minimum wage for the time Ms. Romero has been a County employee. A motion to approve this request was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Executive Session A motion to adjourn into executive session to discuss personnel matters with the road and survey department was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. A motion to reconvene into regular session was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Utah Association of Counties/Insurance Trust County Attorney Craig Halls met with the Commission to discuss the By-laws for the UAC Insurance Trust Mutual. Mr. Halls said he had reviewed the by-laws and recommended that the Commissioners approve and sign them. A motion to approve the by-laws of the UAC Insurance Trust Mutual and approve the signing was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Request to Hire Request to hire forms were presented for temporary summer help for the Road Department. Sammy Warren will be hired for a laborer for the northern road department at Grade 5 Step 1, $6.02 per hour, effective 6-18-91. The following names were presented for temporary help at Navajo Mountain. Walter Montoya, Alex Little, Clyde Little and Wilson King. These workers will only be used while the construction crew is in the Navajo Mountain area. These workers will be Grade 5 Step 1, $6.02 per hour. A motion to approve the temporary hirings for the road department was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. A request to hire was presented for the survey department. John Evans will be hired as a seasonal temporary employee at Grade 5 Step 1, $6.02 per hour, effective 6-20-91. A motion to approve this hiring was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Tax Rate Clerk-Auditor Gail Johnson met with the Commission to set the tax rates for 1991. Mrs. Johnson said that state assessed property is up significantly. If the current 13 mill levy is kept the increased growth in assessed property will bring in $300,00 more in revenue that what was anticipated at the time the budget was set. Mrs. Johnson said in order to leave the mill levy at 13 mills the County would have to hold a Truth in Taxation hearing. The Tort liability will need to be increased from $70,000 to $100,000. A motion to set the tax rate in the General Fund at .0026, Tort Liability at .0000123, Library Fund at .000155 and Public Health at .000071 was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Sealed Bids/Blanding Airport The sealed bids for the fuel tanks at the Blanding Airport were opened at 1:00 P.M. Only one bid was received. Save Way Tire and Oil bid $77,945.00. The Commission asked that the bid be reviewed by Administrative Assistant Rick Bailey when he returns to work on June 20, 1991 to see if the bid is within 10% of the estimated amount. A motion to approve the recommendation of Mr. Bailey for the awarding of the bid was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Road Equipment The road department has requested permission to advertise for bids on a 1,000 gallon fuel tank, a welder for the service truck and a flat bed truck for the fuel tank. A motion to approve the advertising for bids for these items was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Natural Gas Problem/Road Department There is a problem with a natural gas leak at the road shed. A motion to allow the road department to investigate the leak was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Utah Navajo Development Council Marlene Valentine, UNDC Recreation Coordinator, met wit the Commission to discuss the recreation programs that will be offered by UNDC this summer. Ms. Valentine said that recreation programs will be provided to seven communities. Ms.Valentine requested $18,000 for Commission District #3 and Oljato to run these programs. Commissioner Lewis said he has received a call from Francis Shorty and the Oljato Chapter wants to run their own recreation programs this summer. The money will be allocated on per capita basis. Ms. Valentine said that Oscar Begay has requested that fifteen truck loads of sand be put on the ball field and volleyball court at Halchita. Doug Pehrson,. County Engineer will be asked to look at the ball field and volleyball court and make arrangements to haul the sand. Ms. Valentine requested an additional $10,000 to help with the repairs at the montezuma Creek Swimming Pool. The Commission told the UNDC last summer that the County would help get the pool in operating shape. Ms. Valentine presented an estimate for the work. The Commission asked Ms. Valentine to ask UNDC if the County helps to fix the pool if the UNDC is willing to take over the ownership of the pool. The cost estimate for repairing the pool will be given to Administrative Assistant Rick Bailey to review. Mr. Bailey will contact Ms. Valentine about the proposal. Monticello Museum Nell Dalton and Vee Carroll of the Monticello Museum Board met with the Commission to discuss moving the museum into the multi-purpose area in the library. Mrs. Carroll presented figures for the use of the multi-purpose room in the last two years. The Commission discussed the need for the museum to carry liability insurance. No decision was reached about moving the museum. COMMISSIONER BILL REDD'S REPORT Interagency Meeting Commissioner Redd attended an Interagency Meeting with the Social Services on June 12, 1991. Utah Association of Counties/County Visit Commissioner Redd attended the UAC County visit on June 12, 1991. The By-laws of the Insurance Trust were presented and discussed. White Mesa Ute Council/Grazing Allotment Commissioner Redd attended a meeting at the Bureau of Land Management on June 13, 1991 to discuss the White Mesa Ute Council's grazing allotment at Comb Wash. State Lands and Forestry Commissioner Redd attended a State Lands and Forestry public hearing in Moab, Utah on June 14, 1991. The hearing concerned the release of with held properties for oil and gas drilling. Association of Governments Commissioner Redd will attend an Association of Governments meeting on June 21, 1991. Resources Conservation and Development Commissioner Redd will attend a RC&D meeting in Green River on June 19, 1991. COMMISSIONER MARK MARYBOY'S REPORT State Land and Forestry Commissioner Maryboy attended a meeting with the State Lands and Forestry to discuss the problem of providing water and electricity to the residents of Cahone Mesa and Hatch. The water and power lines will run across the State lands. The Aneth Chapter has requested that the Navajo Tribe work with the State Lands and Forestry on this matter. Budget and Finance/Navajo Tribe Commissioner Maryboy attended a Navajo Tribal Budget and Finance meeting on June 12, 1991 Navajo Tribal Council Commissioner Maryboy attended a Navajo Tribal Council session on June 14, 1991. It was decided at this session that the election for new Chapter officials will be held in the summer of 1992. Travel Commissioner Maryboy will be traveling to Window Rock, Arizona to attend a Budget and Finance Committee meeting on June 18, 1991. Commissioner Maryboy will be in Monument Valley on June 19, 1991 to attend a meeting on the proposed diversion of the San Juan River from Mexican Hat to Monument Valley. This proposal will be made by the Navajo Tribe and will be for irrigation purposes. Commissioner Maryboy will attend an Aneth Chapter meeting on June 20, 1991 concerning the grazing permits in this area. Commissioner Maryboy will meet with Utah Power and Light on June 21, 1991 to discuss the power line extensions on the Navajo Reservation. COMMISSIONER TY LEWIS' REPORT La Sal Recreation Services District Commissioner Lewis will attend a public meeting in La Sal on June 19, 1991 to hear comments on establishing a La Sal Recreation Services District. San Juan Cultural Resources Commissioner Lewis will welcome the participants at the San Juan Cultural Resource meeting on June 20, 1991 in Blanding, Utah. Utah Association of Counties The Utah Association of Counties Board of Directors meeting will be held in June 28, 1991. Utah State lands and Forestry The Utah State Lands and Forestry Grant application package was received. This grant will be given to plant trees on State or Government Lands.
