SAN JUAN COUNTY COMMISSION MEETING MINUTES June 24, 1991 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk A motion to approve the minutes of the June 17, 1991 meeting as written was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. CURRENT BUSINESS Recreation A discussion was held concerning the request from VISTA volunteers for Bluff recreation monies to be used for a Bluff day camp. The money for Bluff recreation has already been given to the Utah Navajo Development Council. One of the VISTA workers told Commissioner Redd that the UNDC did not want to fund the Bluff camp. Commissioner Maryboy spoke with UNDC Executive Director Dick Neztsosie about this matter. Mr. Neztsosie said the funds will be given to the Bluff camp. Administrative Assistant Rick Bailey said he has received other requests for recreation funding. The Commission instructed Mr. Bailey to send a guideline for the use of the money to each entity that receives funding. Shizani's Industries Rose Sloan of Shizani's Industries met with the Commission to request a letter of support to accompany several Grant applications for building renovations. Ms. Sloan said the business has been in operation since October 1990. The business is currently making parkas and trousers for the Army. There are currently sixteen people employed by Shizani's Industries. With the planned renovation the plant expects to employ 60-80 people. The Commission will send a letter of support. Registration Agents Clerk-Auditor Gail Johnson met with the Commission to have two registration agents appointed. Mrs. Johnson said that the two registration agents that have been helping in voting precinct # 10 and #18 will not be able to serve. Mrs. Johnson contacted the Republican Party for names for this appointment. The names given to Mrs. Johnson are Elaine Johnson for #18 and Adell Lovell for #10. A motion to approve these appointments was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Health Insurance Clerk-Auditor Gail Johnson discussed with the Commission the health insurance for elected officials. The County currently pays for the health insurance for elected officials. The elected officials can then pay for their families coverage. The other County employees get half of the family coverage paid by the County after three years. After five years the County pays for the family coverage. This encourages County employees to stay with the County. Ms. Johnson said that elected officials do not have the opportunity to have their family coverage paid unless they are elected to two terms. Mrs. Johnson said she would like to see the elected officials be given the family coverage. The Commission said they would consider this proposal along with the salaries for elected officials. Andrew Tso/Aneth Chapter Andrew Tso Navajo Tribal Council delegate for the Aneth Chapter met with the Commission to discuss three concerns of the Aneth Chapter. Mr. Tso said with the drought situation the people need help in developing water for livestock. The people are requesting that the County help with this matter. The people also requested that the County help with irrigation projects for people that are trying to get hay fields started on the San Juan River and McElmo Creek. The third concern was about a Navajo oil well worker, Timothy Merit, who was seriously injured in a fire on an oil rig. The family is requesting emergency assistance to help with the expenses of the family to travel to Denver to stay with Mr. Merit. The Commission advised Mr. Tso that the County cannot provide the requested services but could help find the programs that provide these services. Mr. Tso was told to contact the Agricultural Stabilization and Conservation office in Monticello to receive help with livestock water and feed problems. The ASC office also can help with the farming. The Resource Development and Conservation Program can also help to get the farming started. The Commission advised Mr. Tso to contact Albert Marks at UNDC about this program. The Commission told Mr. Tso that OSHA or OSHAW would be the agencies to contact about the oil well fire. Mr. Tso said that Mr. Merit was working for a subcontractor for Mobil Oil at the time of the fire. The Commission advised Mr. Tso to have Mr. Merit's family contact Mobil Oil about money for the family to travel to Denver to be with Mr. Merit. Commissioner Maryboy said that the Navajo people don't understand that the County cannot provide all of the requests that the Navajo people make. But, the County can help the people find the agencies that have responsibility for specific problems. The Commission discussed the Hatch Road project with Navajo Tribal Council delegate Andrew Tso. Mr. Tso serves on the Resource Committee for the Navajo Tribe. The Commission also discussed the Aneth to Ismay Road project. Mr. Tso will see if he can help with the archeological clearance on this project. Commissioner Maryboy requested that Mr. Tso see if he can get right-of-way clearance for the airports at Oljato, Navajo Mountain and Montezuma Creek. Chuska Energy Commissioner Maryboy and Andrew Tso will be meeting with Chuska Energy to discuss the Operating Agreement that Chuska has with the Navajo Tribe on June 26, 1991. Commissioner Maryboy will present a request to Chuska Energy to help with drilling water wells for the Reservation. Trailer Bids/Road Department Southern Road Foreman Lynn Laws presented bids for a trailer for use in the road department. Montella's Repair bid $1890, Metalcraft bid $1847.00 F.O. B. Salt Lake City, and Don's Welding bid $2547.10. Mr. Laws requested the purchase from Montella's Repair because the cost to pickup the trailer from Metalcraft would be greater than the difference buying from Montella's Repair. A motion to approve the purchase from Montella's repair was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Montezuma Creek Road Shed Southern Road Foreman Lynn Laws discussed getting water at the Montezuma Creek Road Shed. There is a well that is currently pumping three gallons per minute near the shed. The owner of the well will allow the County to tap into the well for $30.00 per month. A discussion was held on the advantages of the County having their own well. A motion to allow the advertising for bids for the drilling of a well at the Montezuma Creek Road Shed was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Road Department/Backhoe Administrative Assistant Rick Bailey discussed with the Commission purchase of the backhoe on the municipal services program. There is a need for a backhoe in the southern end of the County. Southern Road Foreman Lynn Laws said the backhoe could be used for routine maintenance work all year long. A motion to approve the purchase of an additional backhoe on the municipal services program was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Mr. Laws discussed the need to use the gravel that is stock piled in Montezuma Creek. It has been reported that the gravel is being hauled off by pickup loads. This gravel will be used on road projects as soon as possible. Mr. Laws reported to the Commission that Norman Begay has been off work for two days with an injury. Mr. Begay fell from a piece of machinery. Utah State Extension Service Home Economist Extension Agent Jim Keyes and Steve Cox met with the Commission to introduce the new Home Economist for San Juan County to the Commission. Francis Price has been hired and will start to work September 1, 1991. Mrs. Price has been the Home Economist in Piute County. Public Hearing/Emergency 911 Number The Public Hearing for the Emergency 911 number was held at 1:30 P.M. There were two people in attendance. Burton Black of the Monticello Ambulance Association presented a Resolution of support from the Association. Mr. Black said that he personally and as a representative of Black Oil support the Emergency 911 Number and the proposed fifty cent per month customer charge. Audrey Campbell representing the County Emergency Medical Technicians said that she has received good response to the Emergency 911 number and the fifty cent charge. The Commission stated that the County was committed to the system with the Grant monies that have been received from the Community Impact Board and the Community Development Block Grant. A motion to pass an ordinance to adopt a fifty cents per customer per month surcharge to help pay for the maintenance of the Emergency 911 number was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Congressman Bill Orton Sheldon Kendall and John Smith of Congressman Orton's Staff met with the Commission to discuss some of the concerns the Commission has over the Bureau of Land Management wilderness bill that has been introduced into Congress by Wayne Owens. Mr. Smith and Mr. Kendall also discussed the plans for Congressman Orton to visit San Juan County in July. Congressman Orton is planning to tour the proposed wilderness areas. The Commission discussed the Inscription House to Navajo Mountain road and asked for Congressman Orton's help to get this project done. Request to Hire Construction Foreman Lewis Calvert met wit the Commission to present hiring a mechanic/handyman for the construction crew. Mr. Calvert said the road department has interviewed for this position and recommended Dan Shupe be hired at Grade 10 Step 9. $ 7.96 per hour, effective 6-25-91. A motion to approve this hiring was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Cal Black Memorial Airport The Cooperative Agreement with the Utah State Aeronautics for the second grant application for the Cal Black Memorial Airport was presented for the approval and signature of the Commission. A motion to approve the agreement and the signing was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. The bid opening for the second phase of construction on the Cal Black Memorial Airport will be June 25, 1991 at 1:30 P.M. Oljato Wash Bridge Administrative Assistant presented the bids that were received from the construction of the Oljato Wash bridge. Mr. Bailey said all of the bids were over the estimate made by Western Engineering. County Engineer Doug Pehrson will clarify the engineers estimates that were low with what the actual bids were. Mr. Pehrson spoke with Western Engineering about the bid estimates for the Oljato Wash Bridge. Western Engineering said that they had estimated too low on mobilization and the untreated base coat. The changes will bring the low bid in range with the estimate. A motion to approve the low bid from Ralph L. Wadsworth Construction Company was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Piute Creek Bridge Administrative Assistant Rick Bailey asked for authorization to sign the Engineering Contract with the State of Utah and Creamer and Noble for the Piute Creek Bridge. A motion to approve this request was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Moab Valley Fire District A letter was received from the Moab Valley Fire District asking for more money to provide fire protection to homes in the Spanish Valley and Pack Creek areas. It was the decision of the Commission to have Administrative Assistant Rick Bailey write to the Moab Valley Fire District ans ask them to wait until the new appraisals for this area are received before an increase is given. Fair Grounds Rest Rooms A letter was received from Sanitarian Rick Meyers informing the Commission that the rest rooms at the fairgrounds are closed to public use until they are repaired. Extension Agent Jim Keyes said he has been trying to get bids for these repairs. Mr. Keyes said he has only received one bid for this work. The Commission asked Mr. Keyes to give the other bidder a deadline and if a bid is not submitted bring the one bid to the Commission. Worker's Comp. Premium Administrative Assistant Rick Bailey told the Commission that the premium for Worker's Comp. has raised $700 per month. The Commission asked Mr. Bailey and Clerk-Auditor Gail Johnson to see if they can find a lower rate. Montezuma Creek Swimming Pool Administrative Assistant Rick Bailey asked the Commission what they would like done at the Montezuma Creek Swimming Pool. The Commission asked Mr. Bailey to look at the pool and get some bids on the required work. Forest Service Permit A letter was received from the Forest Service concerning a requested permit for guiding cougar and bear hunting. It was the decision of the Commission to respond in favor of this activity as long as it favorable to the existing rights on the Forest Service. Auto Insurance Administrative Assistant Rick Bailey told the Commission that the Automobile Insurance with Utah Local Governments Trust is due for renewal. Mr. Bailey asked how the Commission would like the insurance paid. The Commission instructed Mr. Bailey to pay the coverage quarterly instead of yearly. Mineral Development Resolution The following Resolution was passed at the June 17, 1991 meeting. A motion to approve the signing was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. 1991-23 RESOLUTION A Resolution of the San Juan County Commission supporting and encouraging the development and exploration of minerals in San Juan County and other areas of the State of Utah. WHEREAS, San Juan County is the largest County in the State of Utah and has over 88% of the total land base in federal of State; and WHEREAS, the development of the sub-surface minerals in the County over the years have had a positive effect on the citizens of the County, provided through the tax base in areas such as schools, communities, roads, etc; and WHEREAS, the total tax base of the County is currently 85% funded from the collection of subsurface mineral production; and WHEREAS, the requirements for service from the County will continue to increase and there will be no other source from which to pay for such services without the mineral production; and WHEREAS, without the mineral production , all governmental entities will suffer a great loss of tax bases, which include the local school district, the County, the State of Utah , Utah Navajo Development Council and others; and WHEREAS, the employment from these mineral productions activities provides a superior employment to other types of employment. NOW THEREFORE BE IT RESOLVED BY THE COUNTY COMMISSIONERS OF SAN JUAN COUNTY, UTAH AS FOLLOWS: 1. The County recognizes the benefits from mineral production to the residents of the County, and therefore encourages the exploration and development of all types of mineral production within the County. 2. The County encourages Federal and State Agencies to prioritize mineral production as high priority for management plans, permits, etc., to encourage the exploration and development of mineral production. 3. The County encourages the President of the United States and The Congress of the United States to develop and implement a National Energy Plan which encourages the development of mineral production within the boundaries of the United States. Passed and approved this 10th day of June 1991, by a vote of three in favor and none against. San Juan County Commission /s/ Ty Lewis Ty Lewis Environmental Award Administrative Assistant Rick Bailey said he has been contacted by Congressman Orton's office about a nomination for an environmental award for an environmentally aware business. The Commission recommended UMETCO Minerals and Rio Algom. Blanding Bus Driver/Aging Administrative Assistant Rick Bailey said that only two applicants applied for the advertised job for Senior Citizens Bus Driver in the Blanding area. Mr. Bailey said there is a need to have two drivers to keep the time down to 20 hours per week. Christine Jones will be Grade 1 Step 1, $5.12 per hour, effective 6-20-91. Stanley M. Kuykendall will be Grade 1 Step 1, $5.12 per hour, effective 6-20-91. A motion to approve these hirings was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. COMMISSIONER MARK MARYBOY'S REPORT Senior Citizens/Navajo Tribe Commissioner Maryboy met with Tully Mann director of the Aging programs for the Navajo Tribe at Window Rock, Arizona. Mr. Mann said that he wasn't sure whether the Navajo Tribe was receiving the Title III funds. Mr. Mann will research this matter and let the County know his findings. Mr. Mann said he would like to match the $10,000 that San Juan County has appropriated for the Aneth multi- purpose building. These funds would be used to upgrade the present Aneth Senior Citizens Center. Monument Valley Water Line Commissioner Maryboy met with the Navajo Tribal officials and Indian Health Services on June 19, 1991, to discuss water line distribution in the Oljato, Douglas Mesa and Monument Valley area. The proposed plan is to drill a well near the San Juan River by Mexican Hat and run the water line to Oljato, Douglas Mesa and the Monument Valley area. The other option is to drill a well by Oljato, set a storage tank and distribute water from this point. The right-of-way and easement for the well by the San Juan River have been given. There has been $1.5 million appropriated from the Navajo Tribe to begin this project. Wilbur Nez of the Navajo Tribal Economic Development office was at the meeting and Mr. Nez said he has been working with the State Economic Development office to develop some economic structure on Section 32. Utah Power and Light Commissioner Maryboy met with Utah Power and Light on June 21, 1991 to discuss the power line extension in the Aneth, McCraken Mesa and Horse Canyon areas. The project will proceed in the near future. Mosquito Problem Commissioner Maryboy said he has been asked about the mosquito problem in the Montezuma Creek area. The residents would like to know if there can be an aerial spray of the area. This matter will be discussed with Extension Agent Jim Keyes. Bluff Library Commissioner Maryboy has received a letter from Rosalie Goldman of the Bluff Library Board. Mrs. Goldman indicated that the Bluff Library would like to be handled under the County library system. Administrative Assistant Rick Bailey will write to the Bluff Library Board telling them what needs to be done to become a County Library. A copy of this letter will be sent to the Library Board. State Roads Commissioner Maryboy asked about having the road from Red Mesa to Montezuma Creek accepted as a State Road. The County will look at applying to the State for the road from the Arizona State line through to the Colorado State line as soon as the Aneth Ismay road is completed. Administrative Assistant Rick Bailey will send a letter to the Chapters asking for a Resolution of support to have this road become a State Road. Telephone Commissioner Maryboy said he now has an office in Montezuma Creek. Commissioner Maryboy requested that the County set up a telephone with an answering machine so that he can be contacted and receive his messages. A motion to approve getting quotes for this purchase was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Travel Commissioner Maryboy will meet with Robert Montoya concerning the Bureau of Indian Affairs increase in appropriations that was requested by the County. Commissioner Maryboy will also discuss the fencing of some of the County roads. Commissioner Maryboy will be in Window Rock, Arizona on June 26, 1991 to meet with Larry Curley, Director of the Health Division. They will be discussing the money that San Juan County has set aside for a Health Care Trust. Commissioner Maryboy will ask for matching funding. COMMISSIONER BILL REDD'S REPORT Historical Society An application was presented Dawn Boyle for appointment to the Historical Society. A motion to approve this appointment based on there being a vacancy on the Board was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Blanding Airport Commissioner Redd and Administrative Assistant Rick Bailey met with the only bidder, Save Way Tire and Oil, on the fuel tanks for the Blanding Airport. The bid was reviewed item by item with the bidder. Commissioner Redd and Mr. Bailey felt that the was in line with the estimated cost.A motion to approve the bid on the Blanding Airport tanks was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Hatch Road Commissioner Redd went to Hatch with Engineer Doug Pehrson on June 18, 1991 to look at a gravel source for the roads in this area. Mr. Pehrson will test the gravel to see if it can be used. It will be bought for twenty-five cents per yard. Southeastern Utah Health Department Commissioner Redd attended a meeting if the Southeastern Utah Health Department in Green River on June 18, 1991. There was a discussion on the possible change in health insurance for employees of the District. Resource Conservation and Development Commissioner Redd attended a meeting of the Resource Conservation and Development Committee on June 20, 1991. A Resource Conservation and Development workshop will be held at Mesa Verde, Colorado on July 22-23, 1992. A workshop on writing grants will be held in the future. No date has been set. Association of Governments Commissioner Redd attended an Association of Governments meeting in Price, Utah on June 21, 1991. A Source Pollution Control report was discussed. Miles Morriety of the Division of Wildlife Resources talked about introducing the black-footed ferret into the area. Emma Kuykendall was named as the new Association Chairman for a six month period. Republican State Convention Commissioner Redd attended the Republican State Convention on June 22, 1991 in Salt Lake City, Utah. Hugh Bloomer was installed as chairman. Congressman Jim Hansen and Lieutenant Governor Val Oveson spoke at the Convention. Centrally Assessed Workshop Commissioner Redd will attend a Centrally Assessed Workshop that the Utah State Tax Commission will be holding in Price, Utah. COMMISSIONER TY LEWIS' REPORT Economic Development Board A letter was received from the Economic Development Board requesting that three appointments be made to the Economic Development Board. It was the decision of the Commission to have the Economic Development Board advertise to fill any vacancies on the Board. This will let people who are interested in serving on this Board know of the vacancy. A request was received from the Economic Development Board to appoint Donald Rogers to be the San Juan County representative on the Moab Film Commission. A motion to approve this appointment was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Litigation The Utah Association of Counties has filed a litigation on the AMAX tax case. There will be a meeting held to discuss this matter in Salt Lake City at the Juvenile Court Building on July 3, 1991. San Juan Transportation Services District Commissioner Lewis will attend a meeting of the San Juan County Transportation Services District on June 25, 1991. Utah Association of Counties Commissioner Lewis will attend a UAC Board of Directors meeting on June 28, 1991 in Price, Utah. La Sal Recreation Public Hearing Commissioner Lewis and Administrative Assistant Rick Bailey will attend the public hearing on the proposed La Sal Recreation District on June 26, 1991.
