SAN JUAN COUNTY COMMISSION MEETING MINUTES July 22, 1991 The regular meeting of the San Juan County Commission commenced at 10:00 A.M. in the commission chambers at Monticello, Utah. Present:Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Merna Johnson, Deputy Clerk A motion to approve the minutes of the July 1, 1991 meeting as amended was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. CURRENT BUSINESS Bus Driver - Aging Department Frank Morrell, Area Aging Administrator, requested approval to hire Donald Kilgrow as part-time bus driver for the Monticello Senior Citizens program at grade 1 step 1, $5.12 per hour. Mr. Morrell reported that the position had been advertised and the five applicants had been interviewed. A motion to approve the hiring of Mr. Kilgrow was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Fire Control - Out-Of-State Travel Request Frank Morrell requested permission to attend the Western States Arson Conference to be held on September 23-25 in Las Vegas, Nevada. A motion to approve the request was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Monticello Museum Vee Carroll, a member of the Monticello Museum board, met with the commission in regards to a previous request to have the museum moved from the basement of the library to the multipurpose room. Commissioner Lewis mentioned that several individuals had indicated that the room should still be available for public use. Mrs. Carroll said the board had been checking on other possibilities but they didn't have any funding to consider purchasing a building. She asked if there was anyone who could help them write a grant application or knew of other sources of funding they could check into. Commissioner Lewis indicated that the College of Eastern Utah San Juan Center had people that were experts in the field of grant writing. He also said the commission would be glad to write a letter of support asking CEU to help the museum with this project. Mr. Lewis also recommended that the museum board meet with the San Juan Historical Commission to see what programs might be available through their programs. Clerk/Auditor The San Juan Republican Central Committee presented the names of Dena Hunter, Gail Northern and Maureen Olsen to the commission to be considered for the position of San Juan County Clerk/Auditor. The commission interviewed the candidates and found all three to be well-qualified for the position. After a brief discussion the commissioners voted for the candidates. Administrative Assistant Rick Bailey tallied the ballots and presented the name of Gail Northern to be appointed as San Juan County Clerk/Auditor. A motion to approve the appointment was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Utah Department of Corrections Contract The contract between the State of Utah and San Juan County as it relates to the facility being used by the state to house prisoners was presented for signature. The contract has been review by the County Attorney and some of the wording was revised. The changes did not affect the amount the state would pay the county for housing the prisoners; $30 per day per prisoner. A motion to approve the contract was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Bilingual Election Coordinator/Process Facilitator The Bilingual Election Coordinator/Process Facilitator position is a new one being created in the county as a result of recommendations from the U.S. Justice Department for help in the election process. Such a person would only be needed on election years therefore the commission felt that the individual could also be of help as a liaison between San Juan County and the Navajo Nation. The position was advertised and seven applications were submitted. The commission interviewed five of the candidates and found them to be well-qualified for the position. One candidate did not show up for the interview and the other one called and indicated he was accepting another job offer. After a brief discussion a motion to approve the name of Edward Tapaha as the Bilingual Election Coordinator/Process Facilitator was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Mr. Maryboy indicated that he would make a request from the Navajo Tribe for possible help with the salary for this position as it would benefit the Tribe as well as the county. Chairman Lewis noted that the county would probably need to provide a vehicle for this position as it would require considerable travel. A decision still needs to be made on the salary for the position. 9-1-1 Agreement/Monticello Based on the agreements that have been provided by the 9-1-1 Task Force, agreements have been sent to Blanding and Monticello which outlines the interlocal agreement between the county and city for the establishment of 9-1-1 emergency telephone services. The County Attorney has reviewed the contract and found it to be in order. The contract has been returned from the City of Monticello and Administrative Assistant Rick Bailey asked that the commission approve such. A motion to approve the request was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Mr. Bailey said it would probably be at least six months before the service will be on line. RESOLUTION 1991-25 INTERLOCAL AGREEMENT BETWEEN SAN JUAN COUNTY AND MONTICELLO CITY (BLANDING CITY) TO PROVIDE FOR THE ESTABLISHMENT OF 9-1-1 EMERGENCY TELEPHONE SYSTEM COMES NOW San Juan County, hereinafter referred to as the "County" and Monticello City (Blanding City), and hereby agrees, pursuant to the Utah Interlocal Cooperation Act as set forth in Utah Code Annotated 11-13-1, et.seq., 1953 as amended, to the establishment by San Juan County of a 9-1-1 emergency telephone system and agrees to the funding mechanism as provided in Utah Code Annotated Title 69 Chapter 2. It is further agreed that: 1. Monticello City (Blanding City) hereby agrees that as the governing authority of a public safety agency providing fire fighting, law enforcement, medical, or other emergency services that the County may provide 9- 1-1 emergency telephone system within its jurisdiction pursuant to this agreement. 2. The parties hereby agree that the duration of this agreement shall be for a period of 49 years, but may be terminated at any earlier time upon mutual written agreement of both parties. 3. The parties hereto agree that San Juan County shall be responsible for establishing 9-1-1 emergency telephone service as provided in Utah Code Annotated Title 69 Chapter 2, and may levy annually an emergency telephone charge in an amount not to exceed $0.50 per month on each basic local exchange access line within Monticello City (Blanding City). 4. There is no new entity being created by this agreement. 5. All money received by the County for the provision of 9-1-1 emergency telephone service shall be paid over to the San Juan County Treasurer and deposited in a special emergency telephone fund. All monies in the emergency telephone service fund shall be expended by the County to pay the costs of establishing, installing, maintaining, and operating a 9-1-1 emergency telephone system or integrating a 9-1-1 system into an established public safety dispatch center, including contracting with the provider or local exchange telephone service and vendors of appropriate terminal equipment as necessary to implement the 9-1-1 emergency telephone service. Revenue derived for the funding of the 9-1-1 emergency telephone services may only be used for that portion of costs related to the operation of the 9-1-1 emergency telephone system if such a system is integrated with any public safety dispatch system. 6. In implementing the 9-1-1 emergency telephone service San Juan County and public safety agencies of Monticello City (Blanding City) and their employees shall cooperate in establishing the service and its day to day provision. 7. San Juan County shall be the governing authority of the 9-1-1 emergency telephone service and Monticello City (Blanding City) hereby agrees that the County may provide 9-1-1 emergency telephone service within the public safety agency jurisdiction of Monticello City (Blanding City) which city is the governing authority of such public safety agency. 8. The parties hereto agree that any word, sentence or paragraph is severable and that in the event of any controversy or the determination that any word, sentence or paragraph is unlawful, unenforceable or unconstitutional, that balance of the agreement shall be valid and construed in a manner which will make it lawful and in compliance with the spirit and intent set forth in this agreement. All such constructions shall also be designed to promote the establishment and operation of a 9-1-1 emergency telephone system by San Juan County within Monticello City (Blanding City). 9. Each party hereto agrees that it shall adopt this agreement to be filed by resolution and cause the resolution and agreement to be filed with the keeper of its records and shall further cause an authorized attorney to approve the agreement and determine the agreement is in proper form and compatible with the laws of the State of Utah. Johnson San Juan County Clerk 9-1-1 Agreement/Blanding Administrative Assistant Rick Bailey stated that he would be receiving the 9-1-1 Agreement from Blanding tomorrow and ask that Commissioner Lewis be authorized to sign that agreement when it was received. Commissioner Redd made a motion to approve the request. Commissioner Lewis passed the chair to Commissioner Maryboy (on the phone) and seconded the motion. UNANIMOUS. The agreement is identical to the foregoing document with Monticello City with the exception of the name of the cities. Service Truck Bids - The commission received one bid for the service truck for the road department from Mike Young Chevrolet. The commission tabled a decision on the purchase of the truck until the cost factor for a year old truck and the needs for the road department are determined. Fencing - Fairboard Procurement A request has been received from the Fairboard for fencing on the fairgrounds. Bids have been received from American Fence Co. -Orem for $245/roll for Tenax fence and $133/roll for horse fence and American Fence Co. - Farmington for $208/roll for Tenax fence and $118/roll for horse fence. A motion to approve the purchase from American Fence Co. in Farmington was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Pipe - Fairboard Procurement A request has been received from the Fairboard for 1,200 feet of drill pipe to be used on the fairgrounds. Bids have been received from Belt Salvage for $1.25/foot and Don Cave Co. for $.70/foot. A motion to approve the purchase from Don Cave Co. was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Concrete - Fairboard Procurement A request was presented for 10 yards of concrete to be used on the fairgrounds. Bids were received from Sonderegger for $76 per yard and Holliday Construction for $64 per yard with $3.00 per mile delivery. A motion to approve the purchase from Sonderegger Inc. was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Gates - Fairboard Procurement A request was presented for gates to be used on the fairgrounds. Three gates will be needed. Bids have been received from J.B. Grain for $73.00 for an 8'; $53.15 for a 10'; $72.50 for a 16' gate and from Basin Coop for $45.65 for the 8'; $53.15 for the 10'; and $72.50 for the 16'. A motion to approve the purchase from Basin Coop was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Portable toilets - Montezuma Creek Road Shed A request has been made for a portable toilet to be set up at the Montezuma Creek Road Shed. A contract will also go along with this unit to be serviced as needed for $100 per month from Flowers Honey Pots. A motion to approve this request was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Fairgrounds Restroom Repair Billing - Building Maintenance Supervisor Dell Hunter met with the commission to discuss the billing from Whipple Plumbing relating to the restrooms at the Fairgrounds. Mr. Hunter feels that some items on the billing are excessive and that part of the bill should not be the county's responsibility. He was directed to pay what he felt like was proper but notify Mr. Whipple that he would need to justify the county paying for the repairs on the backhoe. Bid: Septic Tank and Drain Field Bluff - Bids have been received for a septic tank and drain field at the Bluff Fire Station and Library from Whipple Plumbing for $2,605 and Smith Plumbing for $2,400. A motion to award the bid to Smith Plumbing was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Snowmobile - Communications - The communications department is in need of a new snowmobile to service communications facilities on Abajo Peak during the winter. Bids have been received from Four Seasons Sports for $5,549 with a trade in of $2,300 and from Colorado Recreation Equipment for $5,399. They would need to see the old machine to determine any trade in value. A motion to accept the bid from Four Seasons Sports was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Drug and Alcohol Policy County Attorney Craig Halls submitted a draft copy of a Drug and Alcohol Policy to the commissioners. Mr. Halls indicated that the sheriff's department requested the policy for that department and he thought that possibly the commission would want to consider it for all county employees. The policy was reviewed and discussed but was tabled until Mr. Halls can finalize the wording. Pay Scale for Full-Time Custodian Dell Hunter, Building Maintenance Supervisor, reported that he had made a survey of business around the area as well as contacting other counties to see what custodians are being paid. As a result of the survey he is recommending that the new custodian for the courthouse, who will also be doing the custodial work at the Monticello Library be hired at $12.75 at grade 10 step 1. The commission asked Mr. Hunter to review this with Administrative Assistant Rick Bailey before making a final recommendation. Probationary Increase/Part-Time Custodian Dell Hunter presented a request for approval of a probational increase for Joe Barton, part-time custodian at the Public Safety Building. This matter will be discussed with Administrative Assistant Rick Bailey to determine the proper grade and step for this position. Recreation Trust Agreement Commissioner Redd reported that he had reviewed the Recreation Trust Agreement and felt that a Clause of Intent needs to be added as follows: Irrespective of whatever language is contained in this agreement, it is the intent of these parties that the corpus of this trust remains invested, unincumbered and that all language pertaining to purchases, sales, interest, ownership, morgage, etc pertain only to the earnings of the Trust. County Attorney Craig Halls will be consulted on the changes to be made. Assessing and Collecting Surplus Commissioner Lewis read from a statement that the San Juan County share of the Assessing and Collecting that is owed to the State is $42,511. A motion to approve the request was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Moab BLM Advisory Council Vacancy - Administrative Assistant Rick Bailey reported a vacancy on the Moab BLM Advisory Council for the Renewable Resources position. The Commission will submit the name of Lisle Adams for that position. The name of Heidi Redd will also be submitted for possible appointment to the Wildlife position as submitted by Joyce Martin. Catering Contracts Frank Morrell presented the catering contracts between the county and Christine Laws and San Juan Hospital. Mrs. Laws prepares the congregate meals and the hospital prepares the home delivered meals. A motion to approve the contracts was made by Commissioner Redd and Commissioner Lewis passed the chair to Commissioner Maryboy who was on the phone and seconded the motion. UNANIMOUS. Blanding City - Jim Shumway/Jim Slavens - Mayor Jim Shumway and Councilman Jim Slavens met with the commission to discuss the paving of Center Street to 4th west and the 4th west street in Blanding City. The contract between the county and city calls for matching funds for projects within the city. They indicated that they have $240,000 allocated towards the project. However in talking with Lynn Laws, Southern Road Foreman, he indicated that the road department is limited to only about $100,000 worth of work that they will be able to accomplish this year. Mayor Shumway asked permission, per the agreement, to bid the additional $140,000 out to private companies so that much work can be done. As an additional request, the city has the $100,000 set aside to do that work, however if the weather holds out so that the county road crew can possibly do more than the $100,000 worth of work, the city would like permission to roll over the additional expense into next year's budget. This request was denied by the Commission. After reviewing the project a motion to approve having the project bid out was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. UNDC Executive Director - Dick Neztsosie UNDC Executive Director Dick Neztsosie met with the commission to discuss the ramifications to UNDC as a result of the Chuska lawsuit with the County and State. Even though they have not been named in the suit they feel that the State Attorney General does not always take into consideration the interests of the royalty beneficiaries and they would like to have an attorney represent them and defend their interests. However, the entities funding UNDC do not want their funding used for this purpose and Mr. Neztsosie asked the possibility of getting funding from the county. The commission expressed the opinion that because the county is already putting funding into the case they would have to obtain further legal advice as to whether additional attorneys would be needed. In consulting with the state attorneys it was thought that possibly some individual Navajo people could be added to the suit as plaintiffs to stay abreast of the happenings. The commission will consult with County Attorney Craig Halls, Paula Smith and Lyle Anderson to see which would be the best route to take. In speaking to the County Attorney later in the meeting, Mr. Halls indicated that the State had hired a law firm from Washington to handle this case and that the Attorney Generals office wanted to be closely involved to get the expertise in this field. He said that he would contact the attorneys from Washington to find out what San Juan County's role would be in this case. Amend Pack Creek Subdivision Jane Sleight met with the commission to get approval on changing one lot site and one lot size in the Pack Creek Subdivision. A motion to approve the amended plat as described and the signing by Chairman Lewis was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Public Hearing: Tax Increase/Budget Amendment Commissioner Lewis opened the public hearing for a proposed tax increase and budget amendment at 1:30 p.m. Attending were: Commissioner Lewis, Commissioner Maryboy, Commissioner Redd, Administrative Assistant Rick Bailey, County Clerk Gail Johnson, Assessor Bruce Bunker, Deputy Auditor John Fellmeth, Deputy Clerk Merna Johnson and fifteen individuals. Commissioner Lewis explained that there were actually two hearings; one being the Truth in Taxation hearing and the second being to open the general fund and amend the budget. A Truth in Taxation hearing is required by law if the taxing entity proposes to bring in more property tax revenue than they did the previous year. When the San Juan County Health District was created, the county levied 16 mills which is the maximum amount that can be levied. In 1988 the county reduced its mill levy to 13 mills and gave the other 3 mills to the Health District. Since that time the county mill levy has remained the same. Over the past few years the tax revenue of the county has gradually gone down. The taxable value this year has gone up mainly because the value of oil and gas has risen plus the production has increased. Because of this the county has two choices; they can either maintain the same revenue and lower the tax rate to meet that or they can keep the mill levy the same which will bring in additional revenue. Because of the AMAX court case the legislature changed the way taxes would assessed. It brought the homeowners assessment up to 67% of value and small businesses up to 95% of value. The county had no recourse but to follow this directive which affected many individuals taxes. The county proposes to leave the tax rate at the same level as last year which will bring in approximately $200,000 more revenue. The question was asked as to why the county needed the additional revenue. Commissioner Lewis said that there were two or three major projects as well as several smaller ones that have exceeded their present budget; the underground tanks at the Blanding Airport and the Cal Black Memorial Airport are the two major projects. Administrative Assistant Rick Bailey also pointed out that solid waste disposal and certified landfills are also going to require considerable revenue. Many of the individuals that attended the meeting expressed their wishes that the commission hold down taxes. The comment was also made that some services should be sacrificed before taxes were raised. Some also felt that the commission should consider drawing some on the surplus for the needed additional funds. Appreciation was also expressed to the commissioners for the good job they are doing with the public's money. Representatives of the oil & gas industry indicated that any consideration of lower taxes would be welcomed by that industry. Phone calls from Tom Redd and Hardy Redd also expressed opposition to a tax increase as did a letter from E. J. Sonderegger. Commissioner Lewis expressed appreciation for everyone's comments and assured them that the comments would be taken into consideration as they made their decision. After additional discussion relating to the pros and cons of reducing the tax rate Commissioner Redd made a motion to leave the tax rate at the present level. Commissioner Maryboy seconded the motion with the comment that he felt people ought to be made aware of the fact that Indians do pay some taxes and are willing to do so. The motion carried with Commissioners Redd and Maryboy voting for the motion and Commissioner Lewis voting no. A motion to amend the general fund budget to reflect that revenue increase was made by Commissioner Maryboy and seconded by Commissioner Lewis. UNANIMOUS After further discussion later in the meeting the commissioners decided to amend the motion to lower the tax rate to .002530. A motion to approve the amendment was made by Commissioner Redd and seconded by Commissioner Lewis. RESOLUTION 1991-24 After a duly noticed public hearing to amend the 1991 General Fund Budget of San Juan County, BE IT HEREBY RESOLVED that the budgeted property tax revenue in the general fund be increased from $1,768,000 to $2,057,975 and a tax rate of .002530 be adopted to fund that amended revenue; it is hereby also RESOLVED that the budgeted property tax revenue in the tort liability fund be increased from $56,440 to $100,000 and a tax rate of .000123 be adopted to fund the amended revenue; it is also hereby RESOLVED that the property tax rate for the library fund be set at .000155 and the property tax rate for the health fund be set at .000071; and the property tax rate for assessing and collecting be .0005000. These rates are set to the budgets adopted in December 1990 for the calendar year 1991. The increase in property tax revenue in the General Fund shall be used as transfers to fund expenditures in other accounts. The increase in the tort liability shall be used to fund the revenue shortfall in the budgeted expense of $100,000. ADOPTED this 22nd day of July, 1991. Johnson, Clerk Commendation to Clerk/Auditor Because this will be the last commission meeting that Gail will be to, the commission presented Clerk/Auditor Gail Johnson with a beautiful Navajo pottery vase. Commissioner Lewis expressed his appreciation for the time he has worked with Gail stating that she has been very professional and very confident and she will be missed in the County. Commissioner Maryboy stated that as a commissioner he has worked with Gail for five years and at times has pushed her to the limits but she has always had a good relationship with the American Indians. Administrative Assistant Rick Bailey said that he had worked with her over six years and pointed out how she has saved the county a lot of money. She has been excellent to work with and will really be missed in the county. Gail's termination date is July 31, 1991. County Gravel Needs The commission discussed the gravel needs of the county with County Engineer Doug Pehrson and asked him to check on what pits are available and the possibility of getting it crushed. The commission would like to have the road between Monticello and Blanding on the back of the mountain graveled. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Disaster Assistance The commission received a letter from Senator Orrin Hatch concerning the disaster assistance update from the SBA Administration. Those who can qualify for financial assistance because of economic losses and the drop of farm income due to the 1990 drougth can apply before July 29th. A notice will be put in the paper to inform the public. State Land Board Trading School Trust Sections Administrative Assistant Rick Bailey informed the commissioners that the State of Utah is trying to trade out a number of sections of school trust lands that are in the U.S. Forest Service. In order to find out more concerning this issue the commission will send a representative to the next State Land Board meeting to be held in Logan on August 14-15. Mr. Bailey will contact the board to have the commission on the agenda for that meeting. Outstanding Liability Claims - Workers' Comp Administrative Assistant Rick Bailey presented a letter from the Utah Local Governments Trust reporting on the outstanding liability claims of the county. Draft Overtime/Compensatory Time Policy A copy of a draft overtime/compensatory time reporting process was prepared by Administrative Assistant Rick Bailey and given to the commissioners. The auditors expressed some concern about the county's liability regarding overtime and compensatory time. The only change in the current policy is that the department heads would have to submit both to the clerk/auditor and to the county commission a copy of the overtime/compensatory time; which employee received that, how much it was and what was the justification for that. That would give the commission an opportunity to review the liability of that with the people. A motion to approve the policy was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Monument Valley Visitors Center In response to a letter from Nolan Hansen of the Division of Parks and Recreation from the Utah Division of Indian Affairs, Administrative Assistant Rick Bailey prepared a letter to Max Jensen, Superintendent of the Southeast Region of the State Parks, asking that a meeting be set up with the State Parks, state and travel council officials and the county commission in order to dispel some of the rumors and misunderstanding among the residents in the area about the scope of the Monument Valley Visitors Center. Glen Canyon Recreation Area A letter has been prepared to John Lancaster, Superintendent at Glen Canyon Recreation Area, requesting a meeting on August 13th between the him and his appropriate staff members and San Juan County Commissioners here at the county courthouse. Agenda issues to be discussed will be RS2477 road right of ways, transportation system, the Cal Black Memorial airport, solid waste management and law enforcement. Community Impact Board A letter has been prepared to Shirl Clark, Administrator of the Community Impact Board, regarding the funding for the Edge of the Cedars State Museum in Blanding. The letter requests the releasing of the funds so that the project can begin and an additional request for $167,467 required to complete the project. The commission would also like the Impact Board to renegotiate the current contract and allow the Division of Parks and Recreation to become the recipient of the contract. They are asking this item to be placed on the September Agenda. Area Aging Director Administrative Assistant Rick Bailey reported that he has reviewed Frank Morrell's performance over the past six months and feels that he has done an excellent job. He still needs some training in some of the programs and in the financial end of the program. He also received a letter from the director of the Division of Aging commending Frank for the excellent job that was done in arranging the visit of the Governor's wife, Colleen Bangerter, to the Blanding Senior Center. In addition, the State Fire Office has evaluated Frank and given outstanding marks in his performance in that department. Mr. Bailey recommended that Mr. Morrell be promoted from Assistant Aging Director to Aging Director, effective July 1, 1991 and that his salary be raised from grade 12 step 4 to grade 12 step 9, $1,500 per month. A motion to approve the request was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Cal Black Memorial Airport Bids A copy of the bid for the Cal Black Memorial Airport was presented to the commission. Administrative Assistant Rick Bailey reviewed the bid and noted that the FAA would not participate in the terminal building in any portion. Therefore, it was decided to combine the generator building and the maintenance building with the terminal building to get as much help with the funding as possible. There will be additional money needed to finish the terminal building. A motion to approve the additional funding was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Indian Civil Rights Bill Administrative Assistant Rick Bailey said he had received a phone call stating that Senator Hatch was introducing an Indian Civil Rights Bill that would allow tribal members to appeal their cases to courts off the reservations if they were not satisfied with the decision made by Indian courts. He further stated that most of the tribal leaders did not support this bill as they felt the tribal legal system adequately takes care of its members. COMMISSIONER BILL REDD'S REPORT Meetings Attended Commissioner Redd reported that he attended the Economic Development Board meeting and the Interagency meeting in behalf of the commission. NACo Conference Commissioner Redd attended the NACo Conference beginning July 12th. He reported the he was appointed to two NACo committees; the Public Lands Steering Committee and the Native American and County Relations Committee. Two resolutions passed in the Public Lands Steering Committee; to raise the PILT payment and keep the grazing fees under the formula of the 1978 Public Lands Act. Commissioner Redd felt that we should write our legislators on the grazing fees and mining law as that is one way that individuals can still go out and stake claims and mine. Otherwise it will only be available to the large companies. In the Native American and County Relations Committee Commissioner Maryboy presented a resolution to support the increase of funding from the BIA for reservation roads. San Juan County Annexation Committee - Commissioner Redd attended the first meeting of the county annexation committee. The chairman of the committee is Patsy Shumway and the vice chairman, Larry Richmond. BLM Grazing Allotment Commissioner Redd will be going with the BLM personnel on a grazing allotment trip. COMMISSIONER MARY MARYBOY'S REPORT Navajo Mountain Road Commissioner Maryboy reported that the Navajo Mountain Chapter has passed a resolution requesting some roads be placed on the B road system. This matter was discussed with County Engineer Doug Pehrson and he will check on it. Halchita Road A request to have a metal rail removed on one of the roads in the Halchita area was discussed with County Engineer Doug Pehrson. Mr. Pehrson will call the Chapter to find out what needs to be done. Bluff Fairgrounds Road Commissioner Maryboy has been in contact with UDOT and said they recommended that the road going to the fairgrounds in Bluff needs to be paved in order to keep the dust and dirt from deteriorating the main highway. Doug Pehrson indicated that there was a chain-link fence that may be placed too close to the road and may have to be moved. Mr. Pehrson said the road would need both base rock and gravel before it can be paved. Commissioner Lewis suggested that maybe the road department could get it up to grade and graveled this year and see how that works. Mr. Pehrson said he will check on the fence. NACo Convention/Indian Select Committee - Commissioner Maryboy reported that he attended the NACo Convention and that all the appointments to the Indian Select Committee have expired and need to be reappointed. The names of Mark Maryboy and Bill Redd will be submitted for that appointment. Commissioner Maryboy's Schedule - Commissioner Maryboy reported that he will be in Window Rock on July 23rd, Teec Nos Pos on July 24th and in Aneth on the 25th and 26th. On the 28th he will attend the governor's and media meeting to be held at Oljato. Commissioner Maryboy wants to meet with County Engineer Doug Pehrson to discuss right of ways and surveys on the reservation. Bilingual Election Coordinator/Process Facilitator Commissioner Maryboy suggested that Edward Tapaha, the new Bilingual Election Coordinator/Process Facilitator may want to share an office with him. Commissioner Lewis said that could be discussed with Mr. Tapaha. Navajo Tribal Funds Commissioner Maryboy reported that the Navajo Tribe would be forwarding the $20,000 that had been committed to San Juan County. COMMISSIONER TY LEWIS' REPORT Annexation Board Meeting Commissioner Lewis reported that he attended the Annexation Hearing in Blanding on the 18th Economic Development Information Specialist Commissioner Lewis made reference to a letter he received from the Economic Development Board indicating the need for an Information Specialist in that office. He requested that the Economic Development people meet with them in commission meeting to further discuss this request.
