SAN JUAN COUNTY COMMISSION MEETING MINUTES September 9, 1991 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Gail Northern, Clerk A motion to approve the minutes of the September 3, 1991 meeting as amended was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. CURRENT BUSINESS Dark Canyon Wilderness Area Mr. Melvin Dalton presented a Dark Canyon Wilderness map showing areas closed to grazing and with grazing restrictions to the Commission. Mr. Dalton will attend the meeting tonight with Congressman Bill Orton on Wilderness Proposals. Procurements A motion was made by Commissioner Redd and seconded by Commissioner Maryboy that the low bid be accepted from Snap On in the amount of $169.70 for a 1/2" Torque Wrench clicker type for the Road Department. UNANIMOUS. A motion was made by Commissioner Maryboy and seconded by Commissioner Lewis that the low bid be accepted from Handlebar Cycle in the amount of $4,200 ($5,800 new machine, $1,600 trade in on old machine) for a Polaris EFI 500 snowmobile for the Communications Department. UNANIMOUS. Sheriff's Office Dispatch Position A motion was made by Commissioner Redd and seconded by Commissioner Maryboy that Richard Eldridge be hired at entry level on a part time, temporary basis in a Dispatch position at the Sheriff's Office. UNANIMOUS. Bail by Credit Card Lt. Bill Christensen, Sheriff's Department, attended a Legal Ethics class and approached the Commission about the possibility of prisoners posting bail with credit cards. He feels that a prisoner should have every opportunity to post bail. There would be a 3 3/4% bank charge to the County to offer that service plus either a $35.00 charge for a manual machine or a $275.00 charge for an automatic machine. After discussion, the Commission asked Administrative Assistant Rick Bailey to write a letter to First Security Bank expressing the need for an automatic teller machine in Monticello. 2nd Annual Utah Navajo Ahoohai Days Mr. Clarence Kay, UNDC, asked the Commission to sign a Utah Navajo Proclamation of the 2nd Annual Utah Navajo Ahoohai Days sponsored by UNDC in Bluff, September 12 - 15. A motion was made by Commissioner Redd and seconded by Commissioner Maryboy to sign the proclamation. UNANIMOUS Mr. Kay extended an invitation to the Commission to attend. Building Permits Building permits were submitted for Commission approval on a house for Taylor Palmer and a storage building for Elton Jones. A motion was made by Commissioner Maryboy and seconded by Commissioner Lewis to approve Building Permits for Taylor Palmer and Elton Jones. UNANIMOUS. Out of State Travel Out-of-state travel was requested for Process Facilatator Edward Tapaha to attend road meetings in Albuquerque, New Mexico September 17, 18 and 19. A motion was made by Commissioner Redd and seconded by Commissioner Maryboy to approve out-of-state travel for Process Facilatator Edward Tapaha. UNANIMOUS. Out-of-state travel was requested for Commissioner Mark Maryboy to attend road meetings in Albuquerque, New Mexico September 18 and 19. A motion was made by Commissioner Redd and seconded by Commissioner Maryboy to approve out of state travel for Commissioner Mark Maryboy. UNANIMOUS County Attorney Craig Halls County Attorney Craig Halls discussed a personnel matter regarding an ex-road employee with the Commission regarding an ex-road department employee. He will get additional reports from the Road Department. County Attorney Craig Halls discussed with the Commission the District Attorney Bill. Business Disclosure Gail Northern, County Clerk disclosed to the Commission her interest in Four Corners Electrical Contracting. Four Corners Electric occasionally does business with the County. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Cal Black Memorial Airport Administrative Assistant Rick Bailey said he had a Notice of Award to Interstate Rock Products Inc. for the paving and building at the Cal Black Memorial Airport. A motion was made by Commissioner Redd and seconded by Commissioner Lewis to sign the agreements upon FAA approval of the award. UNANIMOUS. Utah Association of Counties Commissioners Workshop Administrative Assistant Rick Bailey attended the Utah Association of Counties Commissioners Workshop last week. There was discussion about Jail Reimbursement and a District Attorney Bill. There will be a multi county appraisal and review in November. Redistricting Meeting Administrative Assistant Rick Bailey attended the Redistricting Meeting in Moab last week. There were about 15 in attendance. There were 4 or 5 proposals for redistricting. The Commission needs to decide upon the recommendations they would like to present. PROCESS FACILATATOR EDWARD TAPAHA'S REPORT Oljato Process Facilatator Edward Tapaha met with Oscar Begay to set up an appointment with Tommy Yazzie, Design Engineer, for the proposed multipurpose building. He met with Francis Shorty and discussed the airport resolution. Mr. Shorty thinks it may have been passed at one time. He will look it up and send the Commission a copy. Aneth Process Facilatator Edward Tapaha met with Lorraine Thomas and Margie Dee. They met with Albert Mark about getting the consent forms signed for the right-of-way for the South Hatch road. Aneth to Ismay Road Process Facilatator Edward Tapaha will meet Wednesday in Chinle with Travis John and Freddy Hubbard of the Tribal road dept. to discuss the Aneth to Ismay road. Oljato and Piute Bridge Process Facilatator Edward Tapaha said that the Oljato and Piute Bridge funds have been reallocated to other projects but can be restored because the money was committed. The County is still lacking the agreement. BIA, Gallup Process Facilatator Edward Tapaha said that according to Bill Frazier, BIA Gallup, the County needs to identify matching funds and projects. COMMISSIONER BILL REDD'S REPORT NACO Land Steering Committee Commissioner Bill Redd has been appointed to serve on the NACO Land Steering Committee. Utah Association of Counties Commissioners Workshop Commissioner Bill Redd attended the Utah Association of Counties Commissioners Workshop. Karen Bud, Land Steering Committee and an expert in land use planning, stressed the effectiveness of using economic bases on land use rather than zoning bases to get maximum benefit of current Public Domain laws. Kent Powell addressed the format etc. for County histories. They have already met with San Juan County and the County's Historian. Dennis Downs reported on Solid Waste Planning stressing the December 1992 deadline. Discussion was held on Salt Lake County software proposal. The software would be free but there would be a $3,500 license fee per year. The program is a County 5 year cost allocation budget program. This software is capable of cross referencing County departments and performing cost analysis involving items such as assessing and collection and jail reimbursements. Commissioner Bill Redd reported that counties can have a revolving loan for financing their own departments through the capital account in the county. This would have an effect on the budget and certified tax rate. Redistricting Meeting Commissioner Bill Redd attended the Redistricting Meeting in Moab last week. Cultural Resource Planning Seminar The College of Eastern Utah, San Juan Center has invited the County Commission to a Cultural Resource Planning Seminar in October. Halchita Clean Up Commissioner Bill Redd said the Commission has been asked to see what they could do to speed up the clean up at Halchita. Mexican Hat Water and Sewer District Commissioner Bill Redd said that there needs to be a new chairman of the Mexican Hat Water and Sewer District. Administrative Assistant Rick Bailey will send a letter stating that the Board needs to elect a new chairman. COMMISSIONER MARK MARYBOY'S REPORT Bluff Library Commissioner Mark Maryboy will talk further with the people at the Bluff Library. They have signed a contract to be autonomous and not be a part of the County Library Board and therefore must provide their own insurance etc. Rocky Mountain Legal Rights Office Commissioner Mark Maryboy has been asked to serve on the commission on civil rights for the Rocky Mountain Legal Rights Office. UDOT Joint Highway Needs Inventory Discussion was held regarding the UDOT Joint Highway Needs Inventory. Administrative Assistant Rick Bailey placed a call to UDOT inquiring about the priority of #262. The Aneth to the State Line #262 has a #2 priority in the State. McElmo Creek Project Public Notice of the U.S. ARmy Corp of Engineers will accept written comments on the irrigation project at McElmo Creek until September 17, 1991. Bluff Bench Project Commissioner Mark Maryboy asked Administrative Assistant Rick Bailey to find out for Bluff residents the status of the Bluff Bench Project and the company financing it. Road Matter Commissioner Mark Maryboy asked Administrative Assistant Rick Bailey to send a letter to Steve Noble of the Highway Department regarding the need to widen the road between Mussi and the LDS Church in Montezuma Creek. It is very dangerous for the school children. Bluff Fair Commissioner Mark Maryboy extended and invitation to the other Commissioners to attend the Bluff Fair. They are expecting 30,000 people this year. LeRoy Sleepy Commissioner Mark Maryboy asked County Attorney Craig Halls to respond to LeRoy Sleepy's proposal on the property right-of-way for the South Hatch road. Process Facilatator Commissioner Mark Maryboy had two assignments for Process Facilatator Edward Tapaha. 1) Set up a voter registration booth at the Bluff Fair. 2) Contact Bessie Tsosie about census redistricting. TV Reception in Bluff Commissioner Mark Maryboy has had many complaints about poor TV reception in the Bluff area. Communications Technician, Bill Bayles, could not be in attendance at Commission meeting but sent a letter explaining the problems (snow, poor equipment & licensing). Commissioner Maryboy is interested in the possibility of training someone in Bluff to make the necessary equipment adjustments instead of waiting for someone to come from either Blanding or Monticello. Health Care Commissioner Mark Maryboy asked Administrative Assistant Rick Bailey to write a letter to the Governor's office regarding health care needs on the Reservation. Meetings Commissioner Mark Maryboy will attend meetings in Window Rock on Tuesday. He will be in Elko, Nevada on Wednesday, Thursday and Friday. COMMISSIONER TY LEWIS' REPORT Interlocal Right of Way Agreement Commissioner Ty Lewis asked County Attorney Craig Halls to look over the draft of the Interlocal Right of Way Agreement. U.S. Forrest Service Commissioner Ty Lewis asked Administrative Assistant Rick Bailey to write a letter to the Forest Service regarding Heidi Redd's Dug Out Ranch outfitting permit. State Lands and Forestry Commissioner Ty Lewis said there is a State Lands and Forestry Meeting on the second Thursday of each month. The Commission agreed that someone needs to attend these future meetings if they affect San Juan County. Impact Board Commissioner Ty Lewis said that they were successful in getting funding for the Edge of the Cedars. It will be available next spring when construction begins. They have also agreed to change the contract to the Utah State Parks and Recreation. LaSal Recreation Project Commissioner Ty Lewis said they were successful in obtaining the grant money for the LaSal Recreation Project. That will be $50,000 now and $240,000 committed for next spring. BIA Area Office Contract Commissioner Ty Lewis asked County Attorney Craig Halls to look at the BIA Area Office Contract with regard to Road Department appropriations to San Juan County for the road maintenance on the Reservation portion of the County. Centrally Assessed Property Commissioner Ty Lewis said there will be a meeting September 17 at the Courthouse in Price at 10:00 A.M. regarding Centrally Assessed Property. County Assessor Bruce Bunker will attend and one of the Commissioners also should attend. Recreation Land Commissioner Ty Lewis asked County Attorney Craig Halls about transferring deeds and titles of recreation land to the City or the Recreation Service District. County Attorney Craig Halls said that there would need to be some kind of agreement stating that if the land were not to be used for recreation purposes that it would go back to the County. Newspaper Rock Commissioner Ty Lewis asked Administrative Assistant Rick Bailey to write a letter regarding the State Parks taking over Newspaper Rock.
