SAN JUAN COUNTY COMMISSION MEETING MINUTES November 18, 1991 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Edward Tapaha, Process Facilatator Dena Hunter, Deputy Clerk Excused: Rick Bailey, Administrative Assistant A motion to approve the minutes of the November 4, 1991 minutes as amended was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. CURRENT BUSINESS Tax Sale Property Dick Knapp met with the Commission to request purchasing Lot #4 in the Woodruff Subdivision in La Sal. Mr. Knapp said this parcel of land was deeded tot he County after the 1990 Tax Sale. It was the decision of the Commission to advertise for bids on this parcel. The minimum bid will be the taxes and interest owing in the amount of $189.99 at the time the County was deeded the property. The sealed bids will be opened at the December 9, 1991 commission meeting. Beer License Ruben Carson met with the Commission to discuss the survey that was conducted of the adjacent property owners about his receiving a packaged beer license. Mr. Carson said he did not feel the first survey that was conducted was fair and he had asked that Sheriff Lacy have a Deputy that does not live in the area conduct the survey. This survey came back with about 50% for the license and 50% against the license. Mr. Carson present signatures from three other persons in favor of issuing a beer license to Mr. Carson. A motion to approve a carry-out beer license for Mr. Carson contingent on meeting all of the requirements and having the Sheriff's Department keep a watch over the business was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. Bus Driver/Aging Aging Director Frank Morrell presented a request to hire for Mack Smith as a part-time bus driver for the Monticello Senior Citizens. Mr. Smith will be delivering home delivered meals and will replace Doyle Rowley. Mr. Smith will be hired at Grade 1 Step 1, $5.12 per hour; effective 11/18/91. A motion to approve this hiring was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. Aneth Chapter/Coal Haul Aneth Chapter Delegate Andrew Tso met with the commission to request that coal be hauled from Peabody Coal to the Aneth Chapter so that the residents can have coal for heating. The Commission discussed using some of the $185,000 appropriated to the County for the Chapter to hire a private hauler to haul the coal. After a discussion of possible funding sources for hauling coal to each of the Utah Chapters it was the decision of the Commission to prepare a request to the Utah Dine` Committee for funding for this project. Mr. Tso expressed the appreciation of the Aneth Chapter Senior Citizens for the help from the County for the Senior Citizens Center. Executive Session A motion to convene into executive session to discuss legal matters was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. Those present at the executive session were: Andrew Tso, Clarence Benn, Engineer Doug Pehrson, County Attorney Craig Halls, Commissioners Maryboy, Lewis and Redd, Process Facilatator Edward Tapaha and Deputy Clerk Dena Hunter. A motion to reconvene into regular session was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. City of Monticello Diane and Rye Nielson representing the City of Monticello met with the Commission to discuss proposal for a Community Center and Combined Visitors Center and Museum. Mrs. Nielson said the project is being proposed on the lot on the west corner on Main and Second South Streets. There is a barn on the lot that has historic value and it will be incorporated into the plan. The plan calls for a Community Center with a gymnasium, a conference room and a Senior Citizens Center in one building and a Visitors Center and Museum in a separate building. Mrs. Nielson said the City would like the support of the County in making their proposal to the Community Impact Board for funding. The Commission expressed their support for the proposal. Mr. Nielson said the City will be using funds from the Community Development Block Grant for the purchase of the land. Mrs. Nielson asked if funding is available from the County for help in preparing the applications for the Grants. The Commission told Mrs. Nielson that Administrative Assistant Rick Bailey has experience in preparing these Grants and the Commission would be willing to have Mr. Bailey help the City with these applications. Livestock Problem Esther N. Yazzie met with the Commission to discuss a problem with livestock trespassing on her allotment on McKracken Mesa. Mrs. Yazzie said her husband has been repairing the fences but the cattle keep coming onto her allotment. Mrs. Yazzie said she had received a letter from the BLM stating her horses were on BLM land and were in trespass. This letter upset Mrs. Yazzie because she and her husband have been trying to get the fencing fixed but felt that the BLM permittee should have some responsibility to fix the fences. The Commission explained to Mrs. Yazzie that the BLM sends letters to anyone who has animals that trespass on BLM property. This is the BLM's way of notifying the owners that there is a problem. Mrs. Yazzie said the cattleguard that is on the road is bent and full of sand so the cattle are walking across the cattleguard. The Commission told Mrs. Yazzie they would write a letter to the BLM asking that the permittee help maintain the fences in this area. The Commission will talk with Engineer Doug Pehrson about the cattleguard. Mrs. Yazzie asked for assistance to get a solar panel that was installed at her residence fixed and working. Mrs. Yazzie said the panels were installed but no instruction on the servicing and upkeep was given. Process Facilatator Edward Tapaha said that Indian Health Services installed the solar panels. Mr. Tapaha will contact Indian Health Services about this matter. Request to Hire Sheriff Claude Lacy and Jail Administrator Bill Christensen told the Commission that a corrections officer has terminated and will need to be replaced. Sheriff Lacy said he would like to move Richard Eldredge from dispatch to corrections at Grade 14 Step 1, $1504 per month ; effective 11/20/91 and change Karaleah Lee from part-time to full-time dispatcher at Grade 7 Step 1, $1,130 per month; effective 11/18/91. A motion to approve the requested changes was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. Sheriff Lacy said he will be rotating Kevin Rhoades and Troy Butler to take the Deputy position in Bluff that was vacated by Charles Bowles' termination. Jaren Adams will be working three nights per week in the Halls Crossing area in the summer months. Sheriff Lacy said a part-time dispatcher will need to be hired as soon as the current testing and hiring roster is completed. Sheriff Lacy said the tape recordings for dispatch for the time period the homicide case against Hierd and Gomez as happening have been subpoenaed. Sheriff Lacy said he will need some help copying these tapes. The tapes have to be watched at all times while the copying is being done. The Commission asked Clerk-Auditor Gail Northern if one of the court clerks would have time to help with this project. Mrs. Northern contacted the court clerks and Julie Bailey will be able to help with this project. San Juan Water Conservancy District The 1992 budget for the San Juan Water Conservancy District was received. A motion to approve reviewing the budget was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Budget Clerk-Auditor Gail Northern and Deputy Auditor John Fellmeth presented copies of the tentative 1992 budget to the Commission. Mr. Fellemth and Mrs. Northern reviewed each section of the budget with the Commission. The Commission will meet with each department head before the Budget Hearing on December 9, 1991. Building Permit A building permit was presented for a bathhouse at the Pack Creek Ranch. A motion to approve the permit was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Procurement Bids were presented for a desk and chair for the Extension office. Office Outpost bid $369.99 for the desk and $239.99 for the chair. Boss Discount Office Products bid $389.00 for the desk and $ 225.00 for the chair. Shipping charges are extra. After a discussion Commissioner Redd made a motion to approve the purchase of only the chair. The motion was seconded by Commissioner Lewis. UNANIMOUS. Utah State Tax Commission/Board of Equalization Clerk-Auditor Gail Northern discussed with the Commission the rough draft of a report on the Board of Equalization that was done by James Teton. The Commission responded favorably to the report. WATTS Line The usage of the WATTS line at the Courthouse has dropped to minimum charges since the County has been using Access Long Distance calling. A motion to discontinue the WATTS line was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. PROCESS FACILATATOR EDWARD TAPAHA'S REPORT Montezuma Creek Police Station Process Facilatator Edward Tapaha said he had located a copy of the lease agreement on the Montezuma Creek Police Station. The Commission requested that Mr. Tapaha give the lease to Administrative Assistant Rick Bailey to determine what needs to be done about the building. Westwater Process Facilatator Edward Tapaha met with Steve Klass, State Planning and Budget, and Blanding City to discuss the land tract at Westwater for water and power expansion. The Blue Mountain Dine` Chapter will need to apply to Indian Health Services for funding. The Utah Dine` Committee recommended that Mr. Klass look into the funding that is supposed to be used for these types of projects. Navajo Police Process Facilatator Edward Tapaha attended a meeting with the Navajo Police Department on November 6, 1991 at the Aneth Chapter. Captain Morris said it was up to the Aneth Chapter to find housing for the police officers. There are two officers currently ready to work in the Aneth area if there is available housing. Oljato Bridge Dedication Process Facilatator Edward Tapaha attended the dedication ceremony for the Oljato Bridge on November 7, 1991. The Blessing Ceremony began at 10:00 a.m. followed by the ribbon cutting. Navajo Nation President Peterson Zah spoke at the ceremonies and gave thanks to San Juan County for all of the work they had done to get the bridge completed. Shiprock Agency Road Meeting Process Facilatator Edward Tapaha attended a Shiprock Agency Road Committee meeting on November 12, 1991 at Two Grey Hills. A resolution was passed in support of the Aneth to Ismay road project. The funding that has been promised from the Navajo Tribe will not be available until their next budget year. Interagency Meeting Process Facilatator Edward Tapaha attended an Interagency meeting on November 13, 1991. The needs of the Navajo Communities were discussed. Travel Process Facilatator Edward Tapaha will travel to Navajo Mountain on November 19, 1991. The Commission requested that Mr. Tapaha get the grader operator that the Navajo Mountain Chapter will be using for road maintenance to fill out the necessary paperwork so the County can pay him. Utah Dine` Committee The Utah Dine` Committee will be meeting at Navajo Mountain on November 23, 1991 at 10:00 A.M. COMMISSIONER BILL REDD'S REPORT State Mental Health Board Commissioner Redd attended a meeting of the State Mental Health Board on November 7-8, 1991. A proposal was made to the Board that would allocate beds at the Mental Health Facility in Provo to each County based on population with preference given to urban areas. This proposal was voted down by the Board. A discussion was held on the consumers rights to access their own records and select their own therapist. A discussion was also held on having a report on suicides at the Board meetings. It was decided suicide reports were not necessary as reports are already made to other agencies such as police departments. Utah Association of Counties Convention Commissioner Redd attended the Utah Association of Counties Convention in St. George on November 12-15, 1991. The Public Lands Steering Committee reviewed the proposals for land management plans from the four firms selected by the committee. It was decided to have each of the four firms work on a part of the land plan. Each of the counties will have the choice of joining the UAC planning or of hiring their own firm to do the planning. The UAC agreed that the tax base of the counties is being reduced. The counties will hire a person to work with the centrally assessed property. A discussion was held on establishing a Wildfire Suppression Impact Fund. This would help the counties with the cost of fighting wildfires. The amount assessed to each county would be figured from assessed valuation and prior experience with wildfire. Travel Commissioner Redd will be attending a Senior Citizens meeting in Bluff on November 19, 1991. Commissioner Redd will attend a Public Hearing on oil drilling on State sections at Star Hall in Moab on November 19, 1991. Commissioner Redd will be in Salt Lake City on November 20, 1991 to attend a meeting of the Governor's Committee on Community Impact Board funds. This meeting will deal with the access to funds by the Indian Tribes. Commissioner Redd will also attend a meeting with the State Tax Commission to discuss oil and gas taxation. Commissioner Redd will attend an Association of Governments meeting in Price on November 21, 1991 and a meeting with the San Juan School District and the oil companies on November 22, 1991 to discuss the property taxes paid under protest. COMMISSIONER MARK MARYBOY'S REPORT Patrolling Request Commissioner Maryboy said he has been asked to have the Deputy stationed in Montezuma Creek to do more patrolling east of the Aneth area. Shiprock Agency Road Meeting Commissioner Maryboy attended a Shiprock Agency Road Meeting at Two Grey Hills on November 12, 1991. A resolution was passed supporting the Navajo Tribe spending $1.5 million for the Aneth to Ismay Road project. Legislative Audit/Utah Navajo Trust Fund Commissioner Maryboy traveled to Salt Lake City on November 11, 1991 to attend the meeting where the State Senate released the report from the Legislative Auditor on the Utah Navajo Trust Fund. The report released was not a positive report. Commissioner Maryboy said the Governor has frozen all funding to the Utah Navajo Development Council. Commissioner Maryboy requested that a letter be sent to the Governor asking that funding be continued for the Health Clinics at Montezuma Creek, Halchita and Navajo Mountain. Commissioner Maryboy said it is also very essential for the scholarship program for the Utah Navajos to be continued. Commissioner Maryboy said he felt the Utah Navajo Trust Money should not be given to the Navajo Tribe. The money could possibly be placed in a Community Impact Board type fund and be request for approved projects by the Chapters. Travel Commissioner Maryboy will be in Window Rock, Arizona on November 19, 1991 to attend a Navajo Tribal Budget and Finance meeting and November 21-22, 1991 to attend Navajo Tribal meetings. COMMISSIONER TY LEWIS' REPORT Oljato Bridge Dedication Commissioner Lewis attended the Oljato Bridge dedication on November 7, 1991. Commissioner Lewis talked with Navajo Nation President Peterson Zah. Mr. Zah said the Navajo Tribe would be favorable to funding on the Aneth of Ismay road project and cooperation on matching funds for other projects. Mr. Zah said his office was open to the Commissioners anytime they would like to come to Window Rock to meet with him. Utah Association of Counties Convention Commissioner Lewis attended the Utah Association of Counties Convention in St. George on November 13-15, 1991. Meetings Commissioner Lewis will be attending a meeting with the Monticello Office of the Bureau of Land Management on November 19, 1991 at 2:00 P.M. in the Courthouse. Commissioner Lewis will be attending an Association of Governments meeting in Price, Utah on November 21, 1991. Commissioner Lewis will attend a meeting with the San Juan School District and the oil companies concerning the payment of property taxes under protest on November 22, 1991. Commissioner Lewis will be attended a meeting of the Utah Dine` Committee on November 23, 1991 at Navajo Mountain. Resource Conservation and Development The annual meeting of the Resource Conservation and Development will be held on December 5, 1991 in Green River, Utah at the City Hall. Commissioner Lewis will be attending.
