SAN JUAN COUNTY COMMISSION MEETING MINUTES January 27, 1992 The regular meeting of the San Juan County commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk A motion to approve the minutes of the January 6 & 21, 1992 meetings as written was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. CURRENT BUSINESS Southeastern Utah District Health Department Gary Angott, Southeastern Utah District Health Department Director, and Rick Meyer, District Sanitarian, met with the Commission for a get acquainted visit and to discuss office space. Mr. Meyer asked that the employees working for the Health Department remain in their current location. A problem has arisen with the Department of Human Services adding additional staff members to the Monticello office. The intake technician is in need of a private office. After a discussion of the possible alternatives for office space the Commission asked Building Maintenance Supervisor Dell Hunter to determine the costs for dividing the conference room in the basement into additional office space. The Commission felt that all of these offices should remain in the basement. Mr. Angott told the Commission the Southeastern Utah Health Department is willing to assist the County with the solid waste management plan. Mr. Meyer told the Commission that a group would be in Blanding on January 31, 1992 to assess the Westwater property that was purchased by the Navajo Tribe to see if a water and sewer system can be installed. Mr. Meyer said legislation has been passed to address abandoned buildings. This will help resolve the problem with the old Blanding theater. Commissioner Maryboy asked if the Southeastern Utah Health Department participated on any programs on the Navajo Reservation. Mr. Angott said the Department will be providing a Public Health Nurse for a mobile unit that will be operating in the County sometime in April. Employee Payroll Advance Clerk-Auditor Gail M. Northern told the Commission that she has received a request for a payroll advance from an employee. Commissioner Redd said he has experience with handling payroll advances and he said that there is additional paper work involved and he didn't feel the County should start doing payroll advances. Commissioner Maryboy said he has been employed at several places and payroll advances were given. Commissioner Maryboy said he was in favor of offering payroll advances to County employees. A motion to develop a policy to allow payroll advances was made by Commissioner Maryboy. The motion dies for a lack of a second. The Commission said if a policy was written for payroll advances they would look at the policy. Clerk-Auditor Gail Northern advised the Commission later in the meeting that after researching the County Personnel Policy she found where the policy states that no payroll advances will be given. Executive Session A motion to go into executive session to discuss personnel matters was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. A motion to reconvene in regular session was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Governors Council on Disabilities Omnibusman for the Governors Council on People with Disabilities, Tamara Wharton, met with the Commission to discuss the American's with Disabilities Act that went into effect on January 26, 1992. Ms. Wharton explained that this act was designed to incorporate all people into the American way of life. This is the first Human Rights Legislation in the world. The Act provides that all businesses must be accessable if you provide a service. Ms. Wharton explained ways that business could be made accessable to the disabled. Ms. Wharton discussed Title II of ADA with the Commission. Ms. Wharton said that problems of inaccessibility could be handled by a spokesperson and that would help avoid a lawsuit or the involvement of the Justice Department. Ms. Wharton presented copies of guidelines on ADA and literature that explains what the County needs to do. Disability Access/Courthouse Building Maintenance Supervisor Dell Hunter asked the Commission if Architect Gerald Browers could examine the Courthouse and the two libraries and make recommendations on what should be done to make the buildings accessible to the disabled. Mr. Browers would charge $495 for the first five hours and then an hourly rate for the remainder of the time. The Commission gave their approval to this proposal. Department of Human Service Bruce Shumway of the Department of Human Services met with the Commission to request that the County help with purchasing of two homes in Montezuma Creek. The Navajo Tribe is offering these homes for sale for $25,000 and $28,000. Purchasing these homes would allow a Day Treatment facility and office space for the Department in Montezuma Creek. Mr. Shumway asked for the County to purchase the homes and the Department would reimburse the costs when the fiscal year is closed out in July 1992. Mr. Shumway said he is researching if the land is being purchased or if it is a lease. The land may belong to the Navajo Tribe or State Lands. Ownership of the homes will be in the name of San Juan County. A motion to approve the purchase of the homes for $53,000 if the land issue can be resolved or leased for and extended period of time was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. Mr. Shumway asked if the County has obtained fire and casualty insurance on the Day Treatment Center in Blanding. Mr. Shumway said there may be a problem with the State purchasing the insurance when the treatment center belongs to San Juan County. Administrative Assistant Rick Bailey will have the Day Treatment Center added to the Casualty Insurance. Monument Valley/Trash Dump Herbert Cly told the Commission that he has the grazing allotment in Monument Valley where the Gouldings Trash Dump is located. Mr. Cly said that last Tuesday evening he had three cows that wandered into the dump and were shot. Mr. Cly said he notified the Navajo Tribal Officer but nothing has been done about the incident. Mr. Cly asked for the help of the County in investigating this matter with the Navajo Tribal Police. Mr. Cly said there are continuing problems with the trash dump. Mr. Cly said the dump is on his grazing allotment and the Navajo Tribe has never issued a permit for the dump. Mr. Cly said if the problems with the dump continue he would like to see the dump closed. The Commission said if the County installed the cattleguard into the dump and it needs to be maintained the County will take care of this matter. The Commission will have the road department look into this matter. Melinda Bedoni told the Commission that the trash dump at Oljato is in terrible condition and requested that something be done wit the dump. The Commission told Ms. Bedoni that the jurisdiction for the trash dump lies with the Oljato Chapter. The County pushes the dump when requested by the Chapter and will close the dump if the Chapter requests that it be closed. All landfills and dumps that are not certified must be closed by 1993. Administrative Assistant Rick Bailey will write a letter to the Oljato Chapter informing them that the trash dump is under their jurisdiction and any decisions about the dump must be made by the Chapter. Building Permits An application for a building permit for Vance Seely was presented. Mr. Seely has built a home in the Blanding area. No building permit was issued and no inspections were made on the home. Mr. Seely has paid his fees. A building permit was presented for Melvin Gaines and Faye Belle. Faye Belle has constructed two garages in Bluff. Faye Belle has built the garages without a permit or inspections. Faye Belle has paid the building fees. A motion to approve both of the building permits was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. The Commission requested a letter be sent to Faye Belle thanking her for her timely payment of the fees and advising her the penalty has been waived. A discussion was held on the need to have a building permit for all construction in the County. The Commission requested that Building Inspector Bruce Bunker post notices in all of the Post Offices in the County and put an article in the San Juan Record. After the notices are placed failure to obtain a building permit before construction is started will result in a penalty of double the fees for the building permit. A motion to approve this action was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Lot #7 Woodruff Subdivision Sealed bids on lot #7 in the Woodruff Subdivision were opened at the January 21, 1992 meeting. Only one bid was received. Ron and Shannon Krist bid $929.00. A motion to accept this bid was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Bluff Library Request A request was received from the Bluff Library for a draw-down of the 1992 budget request. The Commission asked Administrative Assistant Rick Bailey to write a letter to the Bluff Library for the Commission advising them that the only funding that was approved for the Bluff Library was for liability insurance. This will be the final year for funding from the County. San Juan Economic Development Board A letter was received from Diane Nielson, San Juan Economic Development Board Chairman, requesting that John Evans from Monticello and Chuck Burand be appointed to the Board. A motion to approve these appointments was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Blanding Library Bids for a copy machine for the Blanding Library were received. Commissioner Redd was asked to talk with Blanding Librarian Mildred Palmer to see if this expense is a capital improvement or if it was budgeted as operating expenses. Mrs. Palmer will be asked to contact Communications Plus for the State bid. Grade and Step Adjustments The payroll changes with the Grade and Step adjustments were presented for the signature and approval of the Commission. A motion to approve the changes and reserving the right to alter, modify or adjust if an error is found upon closer examination was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. A motion to approve all payroll changes and reserve the right to alter, modify or correct as necessary was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Car Pool/Ford Taurus Administrative Assistant Rick Bailey said the Ford Taurus ordered for the car pool is in Moab. A motion to make the Ford Taurus exclusively for the use of the Commission or by Commission approval was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. The Commission said this vehicle will be scheduled through Administrative Assistant Rick Bailey's office. Mexican Water Chapter Two Resolutions were received from the Mexican Water Chapter. One resolution asked for a grader for use on non-County roads. The other Resolution asked for $5,000 for supplemental livestock feed and coal and wood hauling for the elderly. The Mexican Water Chapter will be advised about the money coming to the Chapter from the Navajo Tribe, the possibility of a grader from Federal Surplus and the ASCS emergency feed program. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Aneth to Ismay Road Administrative Assistant Rick Bailey said the Bob Dibblee of Senator Garn's office had been researching the possibility of the funding for the Aneth to Ismay road project being transferred at the Washington level. Mr. Dibblee said that the money must be funded at the Bureau of Indian Affairs level not the Washington level. Procurements Administrative Assistant Rick Bailey said he has found a Allis Chalmers forklift at State Surplus for $1,300. A motion to approve this purchase was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Mr. Bailey presented a bid from Industrial Electronics and Communications for two Unicom radios and antennas for the Cal Black Memorial Airport for $2,282 and a weather station including the altimeter and disks for $1845.00. A motion to approve these purchase was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Mr. Bailey said the tentative date for the dedication of the Cal Black Memorial Airport is April 15, 1992. Camp Trailer/Road Department Administrative Assistant Rick Bailey said he had looked for a camp trailer for the Road Crew while in Salt Lake City. The cost for a camp trailer will be between $8,00 and $10,000. Request to Hire A request to hire was presented for Jerry Smallcanyon. Mr. Smallcanyon will be the part- time grader operator at Navajo Mountain. Mr. Smallcanyon will be hired at Grade 13 Step 1, $8.43 per hour; effective 1-21-92. Mr. Smallcanyon will be on probation without a probationary increase. A request to hire for two Senior Citizens bus drivers was presented. Betty S. Yazzie will be hired for the Bluff area at Grade 1 Step 1, $5.20 per hour; effective 1-21-92. George Bradford will be hired for the Blanding area at Grade 1 Step 1, $5.20 per hour; effective 1-21-92. A motion to approve these hirings was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Capital Expenditures Administrative Assistant Rick Bailey asked if the Communication Department could proceed with the capital expenditures for the television upgrades. A motion to approve these expenditures was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Mr. Bailey asked for permission for the Communications Department to proceed with the radio communications installation for the Sheriff's Office. A motion to approve this request was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Aneth Senior Citizens Bus Administrative Assistant Rick Bailey presented a request for the $6,000 that was budgeted for the Aneth Senior Citizens bus. A motion to approve this draw down was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Front End Loader/Road Department Administrative Assistant Rick Bailey said he has the prices for the front end loader for the road department from John Deere and Case Equipment Company. South Road Foreman Lynn Laws will discuss these prices at the next road meeting. Bureau of Land Management/IBLA The Bureau of Land Management Interior Board of Land Appeals has upheld the decision of the District office for issuing drilling permits in the White Canyon area of San Juan County. Amplex Exploration has not decided whether they will resume the drilling in this area. Television Translator Stations Administrative Assistant Rick Bailey presented the applications for Authorization to Construct Television Translator Sites for Navajo Mountain, Bluff, Montezuma Creek and Aneth areas. A motion to approve the application and the signing was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. PROCESS FACILATATOR EDWARD TAPAHA'S REPORT Navajo Tribal Money Process Facilatator Edward Tapaha presented the breakdown for funding the amount of $185,00 for the Chapters from the Navajo Tribe. Mr. Tapaha figured the funding based on the number of Utah residents in the Chapter and the number of road miles. These figures will be presented to the Navajo Nation so that the funding can be transferred to the Chapters. The Navajo Tribe has decided to give the requested money to the Chapters instead of San Juan County. Window Rock Process Facilatator Edward Tapaha traveled to Window Rock, Arizona last week. Mr. Tapaha said he received a cool reception until people realized he was from San Juan County and not the Utah Navajo Development Council. Aneth to Isamy Road Process Facilatator Edward Tapaha said another Public Hearing will need to be held for the Aneth to Ismay Road project. The Aneth Chapter will schedule this hearing. Albuquerque Road Meeting Process Facilatator Edward Tapaha said the funding for federal roads will be discussed at the Albuquerque road meeting on January 28, 1992. The Inscription to Navajo Mountain Road will be discussed at this meeting. Mr. Tapaha requested permission to attend the Albuquerque road meeting. A motion to approve the out-of-state travel was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. The Commission asked Mr. Tapaha to tell the Road Committee that San Juan County is willing to do the archeology on the Utah side of the Navajo Mountain road. Voting The Commission requested that Process Facilatator Edward Tapaha meet with County Attorney Craig Halls and Clerk-Auditor Gail Northern to review the items the Justice Department has mandated that need to be covered for the election this year. COMMISSIONER BILL REDD'S REPORT Wilderness Hearing Commissioner Redd attended a Wilderness Hearing with the sierra Club and the Grand Canyon Trust on January 15, 1992. Oil Task Force Commissioner Redd attended a meeting of the Oil Task Force on January 16, 1992 in Duchesne, Utah. Congressman Orton Town Meeting Commissioner Redd attended Congressman Bill Orton's Town Meeting on Health Care on January 18, 1992. The Commission met with Congressman Orton prior to the meeting to discuss County matters. Governor's Meeting Commissioner Redd attended a meeting with Governor Bangarter, Tim Brown, Tom Hatch and Mark Walch to discuss the Land Use Plan the Utah Association of Counties is doing. The UAC would like the State to adopt the plan once it is completed. The Governor agreed to this concept. Oil Companies/Taxes Paid Under Protest Commissioner Redd attended a meeting with the oil companies that have paid taxes under protest on January 22, 1991. A probable resolution to the problem was discussed. The group met again on January 23, 1992 in Price, Utah to further discuss this matter. Utah Association of Counties Commissioner Redd attended the UAC Legislative Briefing January 23, 1992 Utah Department of Transportation Commissioner Redd attended a UDOT meeting in Price, Utah on January 23, 1992. The meeting was to discuss the proposed move of the District UDOT offices to Richfield. Commissioner Redd said he feels that the decision for the move has already been made and no amount of discussion will change the plans. COMMISSIONER MARK MARYBOY'S REPORT Chuska Energy Corporation Commissioner Maryboy attended a meeting of the State Tax Commission and Chuska Energy Corporation in Salt Lake City on January 17, 1992. The attorney's for the State Tax Commission and Chuska Energy Corporation exchanged information. Bureau of Indian Affairs Commissioner Maryboy said that the Bureau of Indian Affairs will be reorganized. The intent of the reorganization is to have more money reach the people. Navajo Tribal Council/Special Session Commissioner Maryboy attended a Special Session of the Navajo Tribal Council on January 24, 1992. The $200,000 that the County has requested for the Chapters was discussed. The Navajo Tribal Council has decided to give the funding to the Chapter instead of the County. The Commission requested that Administrative Assistant Rick Bailey prepare a listing of the County suppliers for culverts, cattleguard and etc for the Chapters. The Utah Navajo Tribal Council submitted a proposal for $600,000 for operational expenses. This funding will be appropriated with the condition that the people mentioned in the Legislative Audit report were removed from the Board. Commissioner Maryboy said all of these people have stepped down. Commissioner Maryboy said $800,000 has been appropriated by the Navajo Tribe for irrigation along the McElmo Creek and the San Juan River for the farmers in Utah. Utah State University Extension Agent Jim Keyes will be working with this project. Travel Commissioner Maryboy will be traveling to Window Rock on January 29-30, 1992. Commissioner Maryboy will travel to Salt lake City on January 31, 1992 to attend the Legislative Session. Navajo Nation Counties Commissioner Maryboy presented a letter from Senator Garn listing the counties within the Navajo Reservation that are being subsidized by the Bureau of Indian Affairs. COMMISSIONER TY LEWIS' REPORT Utah Association of Counties/Insurance\ Pool Commissioner Lewis attended a UAC Insurance Pool meeting. The counties are still in the process of switching insurance companies and getting refunds from the previous carrier. The UAC is helping the counties with this transition. Doug Alexander will be the Insurance person for the UAC Insurance Pool. The Insurance Pool will hold a meeting on January 30, 1991. Three meeting per year will be held. Commissioner Lewis said he felt San Juan County should be in attendance at these meetings. Resource Conservation and Development There will be a workshop of the Resource Conservation and Development Committee on February 19, 1992 at the Marriott Hotel in Salt Lake City. San Juan Transportation Services District Commissioner Lewis attended a meeting of the San Juan Transportation Services District on January 21, 1992. An update of the road projects was presented. Payment of Taxes Under Protest Commissioner Lewis attended a meeting with the oil companies that have paid taxes under protest on January 22, 1992. Utah Association of Counties/ Legislative Briefing Commissioner Lewis attended the UAC Legislative Briefing on January 23, 1992. The following Bills were discussed: HB #17 deals with the membership of the Community Impact Board. This Bill would allow a representative from the Board of Education, Water Quality and the Division of Family Services to be on the Board. Three County Commissioners would also serve two year terms on the Board. HB # 18 This Bill would allow the Community Impact Board to have the final say in how the mineral lease money is spent. A Bill is being introduced that would deny the counties access to the sales tax reports on businesses in the counties from the State Tax Commission. SB# 14 deals with State Highways and County Roads in State Parks. The Utah Department of Transportation could designate roads within the State parks as County roads. SB #71 would consolidate motor vehicle taxes. San Juan County is opposed to this Bill. A Bill is being proposed that would control the regulation of vehicle emission standards to the counties. Speaker of the House Craig Moody spoke about the list compiled by the UAC of State mandated programs. There are seven pieces of Legislation in Committee that deal with State Lands. Wildfire Suppression Fund The Wildfire Suppression Fund will have mineral lease money added to it. Association of Local Governments Commissioner Lewis attended an Association of Governments meeting in Green River on January 24, 1992. The Revolving Loan Fund was discussed. Two new loans were approved for Motel construction in San Juan County. The American Disability Act was discussed. Funding can be received from the Community Development Block Grant but a percentage of the money has to be used for Human Services. $400,000 to $500,000 will be applied to the Grant for this purpose. The Grant will be equally divided between the counties. Travel Commissioner Lewis will be attending a Land and Livestock Workshop being put on by the Utah Farm Bureau in St. George on January 29-31, 1992. Commissioner Lewis will talk about how mining and tourism effect the economic base of the County.
