SAN JUAN COUNTY COMMISSION MEETING MINUTES February 3, 1992 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present:Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk A motion to approve the minutes of the February 3, 1992 meeting as written was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. CURRENT BUSINESS County Boards A discussion was held concerning the Commission being members of County Boards. The Commission felt that they should be ex-officio members of these Boards since they have budgetary control. The Commission has a seat on the following Boards: Library, Weed and Rodent, Economic Development, Aging and Fair. A motion to make the Commissioners on County Boards as ex-officio members and allow the Boards to fill these vacancies was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. A letter will be sent to the Board advising them of this action. Westwater Property Dan Nakai, Blue Mountain Dine`, discussed with the commission a boundary problem on the Westwater property owned by the Navajo Tribe. Mr. Nakai said water and sewer system surveys have been done on the property and some of the land may not belong to the Tribe. The Commission told Mr. Nakai to check with the Recorder's office and see if the land is deeded to the Navajo Tribe or if it still belongs to the Bureau of Land Management. Courthouse Space Maintenance Supervisor Dell Hunter told the Commission that the estimate for a wall in the downstairs conference room would be between $280 and $760. Mr. Hunter said he felt the Directors of the Social Services and Southeastern Utah Health District should be contacted to see what the projected growth for the departments would be in the next few years. Adding a room to the conference room may not serve future needs. Administrative Assistant Rick Bailey will write to these entities about their long range plans for office space in the Courthouse. Request to Hire Sheriff Claude Lacy, Jail Administrator Bill Christensen, and Deputy Kelly Bradford presented two requests to hire for the Sheriff's Department. James Meyer will be a full-time Corrections Officer at Grade 15 Step 1, $1568.00 per month; effective 02-03-92. Elizabeth King will be a part-time Dispatcher at Grade 7 Step 1, $6.51 per hour; effective 02-03-92. A motion to approve the hirings was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Personnel Policy A request was received from Helen Valdez to allow the transfer of long term sick leave from her husband, John Valdez, to her. The personnel policy states that a husband and wife can use transfer vacation hours only. It was the decision of the Commission to leave the Personnel Policy as it is and deny this request. The dismissal and discipline section of the Personnel Policy was discussed. The Commission asked Administrative Assistant Rick Bailey to draft some changes in the current policy for the Commission to review and discuss at next weeks meeting. Road Department The road department construction crew has the need for additional flaggers and additional help to install culverts at certain times. Workers must be taken off other jobs to travel with the construction crew. Administrative Assistant Rick Bailey said when the County hires flaggers for a short period of time the County is responsible for unemployment claims should the flagger apply for unemployment. Mr. Bailey said there is a private company that does flagging. Using the private company would be more efficient for the County. A discussion was held about hiring a private contractor to install the culverts on an as needed basis. Administrative Assistant Rick Bailey will send proposals to local contractors to see if they would be interested in short time work for the County. Mr. Bailey will also contact the private flagging firm to find out the rates and availability of flaggers in the area. A policy to require all road department employees to have a Class A CDL license was discussed. The possibility of offering tutoring to those employees who will need help with the required testing for the CDL testing was discussed. The Commission asked Road Department Office Manager Wanda Franklin to see if the College of Eastern Utah-San Juan Campus could get a Grant to help with the courses on CDL licenses. Front End Loader Bob Kaelberer from Wheeler Machinery presented a bid for a CAT front end loader for $128,940. Mr. Kaelberer said that there is a three year warranty of the machine or 5,000 hours on the powertrain. Five years after purchase Wheeler Machinery will buy back the loader for $ 59,585. Kevin Kershaw from Scott Machinery presented a bid for a John Deere front end loader for $104,210. Mr. Kershaw said the loader could be purchased and be trader in for a new loader at the end of the year for a difference in price of $15.00 per hour of use. There is a clause in this contract that if the tires are worn Scott Machinery will take the tires from the new loader and the County will keep the worn tires. A motion to purchase the CAT front-end loader from Wheeler Machinery was made by Commissioner Redd. Commissioner Redd said he felt the CAT brand was worth the price difference. The motion died for lack of a second. Commissioner Maryboy made a motion to purchase the John Deere front-end loader from Scott Machinery with the proposal for trade-in at the end of a one year period. The chair was passed to Commissioner Redd. The motion was seconded by Commissioner Lewis. Commissioner Maryboy and Commissioner Lewis voted AYE. Commissioner Redd voted NAY. "D" Roads The Commission discussed with County Engineer Doug Pehrson how the mapping of County D roads is progressing. Mr. Pehrson said that his department has been working on the mapping. The Commission told Mr. Pehrson to hire a part-time worker if necessary to get the roads mapped. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Road Department Accident Administrative Assistant Rick Bailey said a road employee hit a parked vehicle while pushing snow on January 8, 1992. The damage to the vehicle was estimated at $500. Mr. Bailey asked permission to have the vehicle repaired at County expense and not turn it into the insurance company. After a lengthy discussion a motion to pay the billing for the repairs and require all accidents involving County vehicles to be investigated by an impartial agency was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Bluff Service District Administrative Assistant Rick Bailey asked about the proposed Sewer District in Bluff. The Commission told Mr. Bailey that all the information on the District was given to County Attorney Craig Halls. Mr. Bailey will contact Mr. Halls about this District. State Fire Marshal Administrative Assistant Rick Bailey discussed with the Commission a letter received from the State Fire Marshal regarding a recent inspection at the Public Safety Building. Mr. Bailey said most of the problems identified in the letter have already been corrected. Mr. Bailey said that all of the doors in the building are heavy fire doors and if they are going to be propped open they will need the electric magnet systems so they will close automatically in the event of a fire. Maintenance Supervisor Dell Hunter will be asked to get cost estimates for the magnetic systems. Cal Black Memorial Airport Administrative Assistant Rick Bailey said the National Park Service is trying to coordinate the dedication of the Needles Visitors Center dedication with the dedication of the Cal Black Memorial Airport so the Congressional Delegation can attend both ceremonies. The Needles Visitors Center Dedication will be held on April 25, 1992. The tentative date for the Cal Black Memorial Airport Dedication is set for April 15, 1992. Pack Creek Bridge Administrative Assistant Rick Bailey said the Utah Department of Transportation has mandated that more signing be done on the Pack Creek Road detour and on the job. The County has agreed to do the additional signing. PROCESS FACILATATOR EDWARD TAPAHA'S REPORT Albuquerque Road Meeting Proces Facilatator Edward Tapaha attended the Bureau of Indian Affairs road meeting in Albuquerque, New Mexico. Mr. Tapaha said he felt the meeting was very informative. The Native American Highway Trust Fund will be $159,000,000 for this year. The Navajo ares will receive $35,000,000 of the fund. This is an increase from the previous year. Mr. Tapaha said the Navajo are will receive an increase in funding each year. Mr. Tapaha said he talked with Director of the Transportation Committee, Dick Ayer, about getting additional funding by working with the State, County's and Federal Highway Program. Mr. Tapaha discussed with the Commission road projects on the Navajo Reservation in Utah. Elections Process Facilatator Edward Tapaha said he will begin doing election work this week. Aneth to Isamy Road Process Facilatator Edward Tapaha said the Public Hearing on the Aneth to Ismay Road will be held on February 11, 1992. COMMISSIONER BILL REDD'S REPORT San Juan School District Commissioner Redd attended a meeting of the San Juan School District on January 27, 1992. The Mexican Hat teacher housing and the Scholarship Endowment Fund were discussed. Meetings Commissioner Redd attended the Utah Department of Transportation annual county visit on January 28, 1992. Commissioner Redd attended a meeting of the Counties Oil Coalition, State Tax Commission and the Oil Companies on January 29-30, 1992. Travel Commissioner Redd will be attending a Counties Oil Coalition meeting in Salt Lake City on February 6, 1992. Commissioner Redd will be attending a Utah Association of Counties Legislative Briefing on February 6, 1992. State Inmates/Telephone Commissioner Redd said that Sheriff Lacy discussed with him the possibility having a long distance service the jail. The County would receive a portion of the money for the calls made. Sheriff Lacy wanted to know if the revenue from the telephone calls could be used by his department. Administrative Assistant Rick Bailey said there is a pay telephone service on State Contract. The Commission asked Mr. Bailey if he would find out the details on the State Contract. COMMISSIONER MARK MARYBOY'S REPORT Utah Department of Transportation Commissioner Maryboy asked about the UDOT Annual visit. Commissioner Maryboy asked if the State road from Montezuma Creek to the Arizona State Line was going to be accepted by UDOT as a State road. There are sections of this road that need to be brought up to the State standard before UDOT will accept the road. A discussion was held concerning the fencing of the highway from Montezuma Creek to Bluff. UDOT told the Commission at the annual meeting that the Bureau of Land Management would not allow a fence along this road. Administrative Assistant Rick Bailey said he spoke with the BLM about this fence and was told that the fencing would be approved. Mr. Bailey will have the BLM write a letter to the UDOT approving this fencing project. Utah Navajo Development Council Commissioner Maryboy met with the Navajo Tribe to discuss the Utah Navajo Development Council. It has been decided that a division of the Navajo Tribe will administer UNDC. An audit of funds that the Navajo Tribe has given to UNDC will be done. If the audit does not reveal any wrong doing the funds requested by UNDC will be released. Utah State Legislature Commissioner Maryboy traveled to Salt Lake City to attend a session of the Utah Legislature. Commissioner Maryboy met with Senator Leavitt, Senator Demitrick and Representative Adams. Commissioner Maryboy discussed with Senator Leavitt a Bill he has introduced that would give the Utah Navajo Trust Fund to the Navajo Tribe to administer. Senator Leavitt told Commissioner Maryboy he would try to stop the Bill. The Bill was introduced. Commissioner Maryboy said he could support the funding going to the Navajo Tribe the funding was to go to Congress then to the Bureau of Indian Affairs and then earmarked for Utah Navajos. Commissioner Maryboy feels this method would work better for the Utah Navajos than having the money go directly to the Tribe. SB#91 would establish a negotiating team to administer the Navajo Trust Fund. Commissioner Maryboy said the only problem he could foresee was that $200,000 is earmarked to office expense. Navajo Tribal Budget Commissioner Maryboy aid the Navajo Tribe will begin holding Public Hearings on the Budget next week. Travel Commissioner Maryboy will be traveling to Window Rock, Arizona on February 4-6, 1992. Commissioner Maryboy will attend a meeting of the Grand Canyon Trust in Sal Lake City on February 7, 1992. COMMISSIONER TY LEWIS' REPORT Utah Department of Transportation Commissioner Lewis attended the UDOT annual County Visit on January 28, 1992. The Federal Highway program was discussed. San Juan Natural Resource Committee Commissioner Lewis attended a meeting of the San Juan Natural Resource Committee on January 28, 1992. Wildlife was discussed. Utah Farm Bureau Commissioner Lewis attended the Utah Farm Bureau Land and Livestock Workshop in St. George, Utah on January 29-31. Commissioner Lewis gave a presentation on Economic Development on how tourism effects the County. Commissioner Lewis picked up a brochure on National Parks in Utah at the Motel where he was staying in St. George. The brochure was produced in such a way that it appeared the only way to get to Canyonlands from St. George was over I-70 and to Moab. The Natural Bridges is not listed on the map. The Commissioner discussed this brochure with Travel Council Director Peggy Humphreys. Mrs. Humphreys said that a private firm in California produces the brochure and San Juan County does not participate in the cost. The Commission will discuss this brochure with the National Park Service.
