SAN JUAN COUNTY COMMISSION MEETING MINUTES March 9, 1992 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk A motion to approve the minutes of the February 24, 1992 meeting as written was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. CURRENT BUSINESS Edge of the Seaters Dan Hurst representing the "Edge of the Seaters" theatrical group met with the Commission to request that the County donate two acres of land located in the South end of Blanding to the theater group so that they can apply for a Grant to construct a theater for productions. Mr. Hurst said the group felt that this would be a benefit to the County as it would help draw tourists into the area. The Commission said they would need to know more about the parcel that the two acres are located on. Mr Hurst will bring a proposal to the Commission from the Edge of the Seaters asking for the specific acreage. The Commission told Mr. Hurst that the land may have to be put out for bids. Request-to-Hire Aging Director Frank Morrell requested permission to advertise to hire a bus driver for the Blanding area. Mr. Morrell said that one of the recently hired drivers has terminated. A discussion on the possibility of having a roster of people interested in the bus driving position was held. This would allow vacancies to be filled from the roster instead of waiting to advertise and interview when a driver terminates. It was decided that Mr. Morrell will advertise to fill the vacancy and begin filling a roster. Fire Warden Frank Morrell discussed the part-time seasonal position of assistant fire warden with the Commission. In the past two years the person hired as assistant fire warden he also worked for the fair board. Mr. Morrell said the fair board does not want to share the helper this year. Mr. Morrell said he would like to increase the salary of the assistant fire warden to $6.88 per hour. Part of the wages will be reimbursed by the State. Extension Agent Jim Keyes said the needs of the fair board for the helper is not being met by the person who is able to be assistant fire warden. Mr. Keyes said the fair board would like to hire a helper for three months to work at the fair grounds. The fair board needs someone who can weld and do general carpentry. This worker would work six hours per day, five days per week. A discussion was held on having two separate employees for these part-time seasonal positions. A motion to allow advertising to hire two separate employees and raise the wage of the Assistant Fire Warden to $6.88 per hour was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Fair Board/Stage Fair Board Chairman Jean Lavato, Extension Agent Jim Keyes and Extension Secretary Lillian Taylor presented bids on a portable stage for use at the fairgrounds. Jack Montella bid $27,000 for a 30x40 trailer stage with 2 sets of steps. Miracle Recreation Equipment Company bid $29,936 for a 24x30 trailer stage and $33,195 for a 24x40 trailer stage. Wenger Corporation bid $33,000 for a 24x30 trailer stage and $36,00 for a 24x40 trailer stage. A discussion was held concerning the possibilty of contacting Monticello and Blanding Cities to see if they would be interested in helping purchase the stage. The possibility of the County purchasing the stage and renting it to other entities was also discussed. A motion to approve the purchase of the trailer stage from Jack Montella was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. John Deere Tractor Extension Agent Jim Keyes told the Commission that Bill Wilson is interested in making a trade for the old John Deere tractor that is in the County road yard. Mr. Wilson would like to trade a sprayer unit for this tractor. Mr. Keyes said he would like to have the Allis-Chalmers tractor at the road yard for the fairgrounds. Mr. Keyes proposed trading the John Deere for the sprayer unit and trading the sprayer unit to the road department for the Allis Chalmers tractor. The Commission asked Mr. Keyes to have Max Ksiazkiewicz look at the sprayer unit and determine if this is a good trade. Mr. Keyes will also check with the Blanding road shop to see if they would be interested in the sprayer unit. Later in the meeting it was reported that the Allis Chalmers tractor belongs to Monticello City. Mr. Ksiazkiewicz looked at the sprayer unit and did not feel this was a good trade. It was the decision of the Commission to put the John Deere Tractor in the County Auction. Cow Canyon Trading Company/Liquor License Clerk-Auditor Gail Northern presented an application for a State Liquor license to serve wine with meals. The license has to be approved by the local authority. Mrs. Northern said that she has received approval from the Health Department and the Sheriff. A motion to approve the application and the signing was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Voting Districts/San Juan School Board Clerk-Auditor Gail Northern presented a map of the proposed new districts for the San Juan School District. The new proposal is as follows: #1 Ucolo, La Sal, Spanish Valley, North Monticello, South Monticello, Halls Crossing and Central Monticello. #2 Northwest Blanding, Southwest Blanding and Northeast Blanding. #3 Bluff, Cedar Point, Southeast Blanding and White Mesa. #4 Montezuma Creek, Aneth and Red Mesa. #5 Mexican Hat, Oljato and Navajo Mountain. Mrs. Northern said these changes need to be made because candidates for District #1 #2 and #3 need to file for the election between March 15 and April 15. The Commission asked the School District review the changes before a decision is made. Superintendent Hal Jensen and Business Manager Kent Tibbetts reviewed the proposed plans and said they felt the changes were fine but would like to have the School Board review the changes at their meeting this evening. A motion to approve the proposed changes in the School Board Districts contingent on the approval of the School Board was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Mr. Jensen called at 11:30 A.M. on March 10 to say the School Board had approved the changes in the School Board Districts. State Retirement Clerk-Auditor Gail Northern discussed with the Commission the State Retirement System. Mrs. Northern said that if an employee has a problem with the way their retirement money is being invested the employee needs to contact the retirement office. The Clerk's office has the necessary forms to make changes but does not handle the changes. The Commission request that Mrs. Northern put a letter with the next payroll to inform the employees how to take care of retirement problems. Procurement Bids for a file cabinet and computer desk for the Monticello Historical Society were presented. Bids for the file cabinet were from Sears for $175.00 and Palmer's Office Equipment for $221.95. Bids for the computer table were from National Business Furniture for $149.00 and Quill Office Products foe $169.00. A motion to approve the purchases from Sears and National Business Furniture was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Bids for a horizontal band saw for the Blanding shop were presented from Snap-On-Tools for $940, Four Corners Welding for $2400 and U.S. Welding for $950. A motion to approve the purchase from Snap-On-Tools was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Bids for a grass seed spreader for use by the Construction crew were presented. Cahart Feed bid $551.87 plus freight and Farm Supply bid $557.00 plus freight. A motion to approve the bid from Carhart Feed was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Bids for a impact wrench and a disc grinder for the Construction Crew were presented. Bids on the impact wrench were received from Blanding Motor Parts for $790.00, Monticello Motor Parts for $586.00, Schafer Auto for $445.00 and Save Way Tire for $420. Bids for the disc grinder were received from Monticello Motor Parts for $66.99 and Blanding Motor Parts for $140.00. A motion to approve the purchase of the impact wrench from Save Way Tire and the disc grinder from Monticello Motor Parts was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Sealed Bids/La Sal Parcels Sealed bids for the two parcels in La Sal were opened. Bids on Lot #3 in the La Sal Acres Subdivision were from Steve Kosanke for $1005.25 and J.S. Brown for $585. A motion to accept the bid from Steve Kosanke was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Bids on Lot #8 in the Woodruff Subdivision were from Ron and Shannon Krist for $728 and J.S. Brown for $700. A motion to approve the bid from Ron and Shannon Krist was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Budget/Financial Statement Clerk-Auditor Gail Northern and Deputy Auditor John Fellmeth discussed with the Commission the County Financial Statement for 1991. Mr. Fellmeth reviewed the current expenditures for each department with the Commission. Building Permit A building permit for a mobile home electrical inspection was presented for Alfred Young. A motion to approve the permit was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. San Juan School District San Juan School District Superintendent Hal Jensen and Business Manager Kent Tibbetts met with the Commission to discuss the Interlocal Agreement for the use of the Federal Payment-In-Lieu-of-Taxes to fund the Mexican Hat Housing project and the Scholarship Fund for the San Juan Foundation. The Attorney for the School District Lyle Anderson was also present at the meeting. County Attorney Craig Halls was out-of- town and unable to attend the meeting. After a discussion on the changes that need to be made in the agreement it was decided that Mr. Anderson nd Mr. Halls would meet to make the necessary changes. Mr. Jensen discussed with the Commission a concept of a library at the Monument Valley High School that could possibly serve as a County library in the evening hours. Commissioner Maryboy said that the Navajo Tribe may be able to help fund this type of a library. Senate Candidate/Ted Stewart Republican Candidate for the United State Senate Ted Stewart met with the Commission to discuss his background and listen to the concerns of the Commission. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Exhaust Systems/Electrical Bids for the electrical wiring for the exhaust systems at the Monticello and Blanding road shops were opened. Bids for the Monticello Road shop were received from Abajo Electric for $685, Lyle Northern Electric for $1390 and Four Corners Electric for $875. Bids for the Blanding road shop were received from Lyle Northern Electric for $1350 and Four Corners Electric for $750. A motion to approve the bid from Abajo Electric for the Monticello Shop and Four Corners Electric for the Blanding Shop was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Personnel Policy Administrative Assistant Rick Bailey discussed with the Commission the suggested changes he had received in the draft personnel policy on smoking, automobile accidents and drivers licenses. The Following drivers license policy was presented for the approval of the Commission. DRIVERS LICENSE Employees or applicants seeking or holding positions requiring a drivers license must as a condition of employment be able to meet the drivers approval standards of this policy at all times. A current valid Utah Drivers License is required for each employee who is required to drive a county vehicle as a condition of his/her employment. Additionally, his/her driving record must be such that the County's liability carrier will provide coverage for the employee. Job descriptions and advertisements for the positions requiring a Commercial Drivers License (CDL) must so clearly state this requirement. The employee or prospective employee shall be responsible for obtaining the required CDL license prior to assuming the responsibility of the position. Supervisors are required to assure that employees meet and maintain these conditions. Employees shall notify his supervisor within 3 working days of the loss or suspension of drivers license or CDL status. The County Commission and the employee's supervisor will review the circumstances of the loss together with the employee's driving history and driving record to determine if suspension or termination is justified. Employees are also responsible for any driving infractions or fines as a result of their driving. Only San Juan County employees and authorized volunteers and board members are authorized to drive county vehicles. Failure to maintain the necessary license required for the position is grounds for termination. A motion to adopt the policy on drivers licenses was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. The following revised policies on smoking and auto accidents were presented to the Commission for their review and approval: SMOKING In accordance with the Utah State Code 76-10-106, Clean Air Act, there will be no smoking allowed within the County Public buildings except where designated areas have been approved by the District Health Department and the County. County vehicles will be designated smoking and non-smoking; however smoking designated vehicles will be non-smoking when any passenger in the vehicle is a non-smoker. Additionally, travel trailers and camp trailers are determined to be public places of employment and are smoking and non-smoking. AUTOMOBILE ACCIDENTS Employees must report any accident, theft or malicious damage involving a County vehicle or a personal vehicle used on County business to their immediate supervisor and/or department head, and to the County Commission office regardless of the extent of damage or lack of injuries or fault. Such reports must be made as soon as possible but no later that forty-eight hours after the incident. Employees are expected to cooperate fully with authorities in the event of an accident. Employees are required to have any accident investigated by an appropriate law enforcement agency if the extent of damage is more than $400.00 or if there are injuries associated with the accident. A copy of the law enforcement agency's accident report should be submitted with the written report of the accident. The department head should review any accident with less than $400.00 in damage and provide a written report to the County Commission. Accidents involving Sheriff's office personnel should be investigated by another law enforcement agency. These policies will be given to the department heads for review and comment. Travel Trailer/Road Department Administrative Assistant Rick Bailey said he had looked for a used travel trailer for the road department while he was in Salt Lake City last week. He was able to locate a 1979 Avion 28 foot travel trailer for $7995 and a 1989 Coachman 24 foot travel trailer for $9995. A motion to approve the purchase of the Avion travel trailer was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Pack Creek Box Culvert Administrative Assistant Rick Bailey presented a change order for the concrete apron on the Pack Creek Box Culvert for the approval of the Commission. A motion to approve the change was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Mr. Bailey said the project has been completed with the exception of the paving. The paving will be completed as soon as the weather permits. La Sal Post Office A letter was received from Steve Kosanke, a La Sal resident, advising the Commission of a Public Hearing to be held on April 1, 1992 at 7:00 P.M. to discuss the possible closure of the La Sal Post Office. The Commission is planning to attend the hearing. The Commission asked Administrative Assistant Rick Bailey to write letters to each of the Congressional Delegation expressing the Commission's opposition to the closure of the La Sal Post Office. Utah National Guard/Alternate Assembly Area A letter was received from the Utah National Guard requesting permission to use the County Fair Grounds as an alternate assembly area. A motion to approve this request was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Utah Department of Transportation Administrative Assistant Rick Bailey reported that Steve Noble has been appointed as District Six Director for the Utah Department of Transportation. Dan Nielson has been appointed the Regional Director of the Richfield District. Archie Hamilton has been appointed Director of District Four. State Lands Administrative Assistant Rick Bailey said that the Bill that allows Counties rights-of-way on State Lands was passed with a rider attached. The Counties will have two years to make the changes. Fuel Tanks/Blanding Road Shed Administrative Assistant Rick Bailey said the underground storage tanks at the Blanding road shed need to be removed. Certified Environmental Consulting Inc. has proposed to remove the tanks and do the contamination cleanup for $11,600. This proposal would allow the County to do part of the work. Mr. Bailey said most contamination remediation companies will not allow the County to do part of the work. A motion to approve the proposal from Certified Environmental Consulting Inc. was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Public Safety Building/State Fire Marshal Administrative Assistant Rick Bailey discussed the letter received from the State Fire Marshall concerning an inspection made at the Public Safety Building. Mr. Bailey said that Maintenance Supervisor Dell Hunter has located electric magnetic door closer that can be installed to comply with the fire code. The door magnets are $80 each and Mr. Hunter will need six. A motion to approve this purchase out of the Public Safety Building Capital Expenditures was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. BILINGUAL COORDINATOR EDWARD TAPHA'S REPORT Voter Awareness Bilingual Coordinator Edward Tapaha reported he attended a parents meeting at the Montezuma Creek Preschool to conduct a Voter Awareness session. Mr. Tapaha also attended the Aneth Chapter and Mexican Water Chapter meetings to discuss Voter Awareness. Mr. Tapaha said he had not been given adequate time to cover all that he felt needed to be covered so Mr. Tapaha will request an hour at the next Chapter meeting to explain Voter Awareness. Mr. Tapaha attended an Adult Education Even Start program on March 3, 1992 to conduct a Voter Awareness session. Mr. Tapaha also conducted a Voter Awareness session at a District Nine Grazing Committee meeting on March 4, 1992. Mr. Tapaha is working on a flip chart presentation for Voter Awareness. Mr. Tapaha will present the flip chart to the Commission when it is completed. Funding Proposals/Navajo Tribe Process Facilatator Edward Tapaha reported he has been working on helping the Chapters get their proposals ready for funding from the Navajo Tribe. Mr. Tapaha will attend the Navajo Mountain Chapter meeting on March 21, 1992. Mr. Tapaha will discuss the proposals to the Navajo Tribe and Voter Awareness. COMMISSIONER BILL REDD'S REPORT Five County Association of Governments Commissioner Redd attended a five county AOG meeting with Bill Howell in Bicknell, Utah on February 26, 1992. The National Heritage Compact was discussed. Project 2000 Commissioner Redd attended a Project 2000 Wilderness meeting on February 27, 1992. National Association of Counties Commissioner Redd went to Washington D.C. from February 28 to March 4, 1992. Commissioner Redd attended a NACO Public Lands Steering Committee meeting on February 29, 1992. A resolution was passed that would give county governments principle affected interest on lands in their county. This resolution now goes to the WIR Committee and will be voted on at the NACO Convention in July. At the Public Energy Land and Environment Committee meeting the western counties presented a resolution to change the Endangered Species and Wetlands Act. This resolution was tabled. The Native American Community Relations Subcommittee agreed to have NACO do a study on county residents medical services. This study would help establish a generic rule for medical health. Commissioner Redd requested that Administrative Assistant Rick Bailey write a letter to Rick Kiester commenting on the favorable outcome of the meeting and complimenting NACO for taking the responsibility for this study. Commissioner Redd attended a session of the Unites States Supreme Court while in Washington, D.C. The case Lucas vs. The United States Costal Authority was being heard. This case could have a significant impact on wetlands and property rights. Commissioner Redd requested that Administrative Assistant Rick Bailey send a letter to Daniel N. Lewis, Senator John McKane and the United States Select Committee on Indian Affairs about the neglect of San Juan County Native Americans. The letter needs to suggest the need for a Bureau of Indian Affairs office in Utah and paving of the road from Inscription House to Navajo Mountain. The County Commissioner had breakfast on March 3, 1992 with the Senators and Congressman. That evening Commissioner Redd had dinner with James C. Barker, Minority Counsel for the House of Representatives. They discussed a probable location for a spent fuel repository. Grants are available to help establish this repository. A motion to pursue establishing a spent fuel repository in San Juan County was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. The following resolution was presented. A motion to approve the Resolution and the signingwas made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. RESOLUTION 1992-06 A RESOLUTION AUTHORIZING THE SUBMISSION OF A GRANT APPLICATION TO THE DEPARTMENT OF ENERGY TO ASSESS THE FEASIBILITY OF SITING A MONITORED RETRIEVABLE STORAGE FACILITY IN SAN JUAN COUNTY, UTAH WHEREAS, the Department of Energy is inviting interested applicants to assess the feasibility of siting a Monitored Retrievable Storage Facility in a volunteer host county; and WHEREAS, the Department of Energy will make a Phase 1 grant of up to $100,000.00 to assist San Juan County to understand the waste management system and a monitored retrievable storage system, and determine if San Juan County, given issues of public health and safety, has real interest in pursuing the feasibility assessment process; and WHEREAS, the Department of Energy has agreed that the feasibility process can be terminated at any time by San Juan County or the Governor, with no liability to the County of State; and WHEREAS, the Governor has no objection to San Juan County conducting this Phase 1 process; and WHEREAS, San Juan County is an eligible applicant pursuant to Amendment Number 001, Solicitation Number DE-PS01-91RW000231; NOW, THEREFORE BE IT RESOLVED by the San Juan County Board of County Commissioners that a grant application be submitted to the Department of Energy to assess that feasibility of siting a Monitored Retrievable Storage Facility within San Juan County, Utah. Northern, San Juan County Clerk-Auditor Utah Association of Counties Commissioner Redd attended a UAC Comprehensive County Planning meeting in Salt Lake City on March 5, 1992. The UAC Four County Oil Task Force went to the Community Impact Board to request funds in the amount of $75,000 to hire a person to work on Centrally Assessed property. Funding in the amount of $45,000 was also requested for comprehensive land planning. The Community Impact awarded the funding to the UAC. Blanding City also received $95,000 for their fire department. Travel Commissioner Redd will be attending a Centrally Assessed Committee meeting on March 12, 1992 in Provo. This meeting will be to determine what to do with appeals on Centrally Assessed property. Commissioner Redd will be attending a Utah Association of Counties Comprehensive County Planning meeting in Richfield on March 13, 1992. COMMISSIONER MARK MARYBOY'S REPORT Navajo Tribe Commissioner Maryboy said the Navajo Tribal Budget and Finance Committee has been conducting Public Hearings on the Budget at all Five Agencies on the Navajo Reservation. The budget for the fiscal year is in the amount of $85,000,000. The administration costs for the budget equal 70% of the budget. Comments at the Public Hearings have made about reducing the administration costs and having more funds go the people. $3,000,000 of the total budget will be for the Utah Navajos. National Association of Counties Commissioner Maryboy attended the NACO Convention in Washington, D.C. February 28 to March 4, 1992. Commissioner Maryboy attended a meeting of the Community and Economic Development Committee. Project HOPE that deals with Public and Indian Housing Home Ownership was discussed. Commissioner Maryboy said he has contacted the Bennion Center at the University of Utah to have them work on this program. Project HOPE will be having a workshop in Phoenix, Arizona on March 12-13, 1992. Commissioner Maryboy requested that Process Facilatator Edward Tapaha attend this workshop. A motion to approve the out-of-state travel for Mr. Tapaha to attend the Project HOPE workshop was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. Commissioner Maryboy attended several sessions and workshop that dealt with County issues such as land fills and endangered species. Commissioner Maryboy discussed the Utah Navajo Trust Fund and the Indian Highway program with the Utah Delegation. Commissioner Maryboy talked with members of the Indian Select Committee to discuss the issues concerning the Utah Navajo and the Trust Fund. Roads Commissioner Maryboy said he went to Halchita to inspect the street improvements being done. A request was made to work on the road to the water treatment facility. Commissioner Maryboy said he asked Stan Hawkins to look at this road. Commissioner Maryboy went to Douglas Mesa and Monument Valley to inspect the road work that is being done in these areas. Utah Navajo Trust Fund Commissioner Maryboy said he talked with Association of Governments Director Bill Howell about the Utah Navajo Trust Fund. Mr. Howell indicated that the AOG might be able to become administrator of the fund and will look into the process. Travel Commissioner Maryboy will be in Window Rock working on the Navajo Tribal budget this week. Commissioner Maryboy will be in Salt Lake City on March 13, 1992 to meet with the Bennion Center to discuss Project HOPE. COMMISSIONER TY LEWIS' REPORT Canyonlands National Park A notice was received that the Open House for the Needles District of the Canyonlands National Park will be held on April 22, 1992 at 10:30 A.M. San Juan Natural Resource Committee Commissioner Lewis attended a meeting of the San Juan Natural Resource Committee on February 26, 1992. The Utah Farm Bureau, Division of Wildlife Resources, Bureau of Land Management and Forest Service have urged counties to form natural resource committees. San Juan County has had a committee for over two years. Cal Black Memorial Airport Commissioner Lewis traveled to the Cal Black Memorial Airport on March 3, 1992 to see how the airport work is progressing. Construction Crew Commissioner Lewis went to Oljato on March 4, 1992 to meet with the construction crew. Another meeting is scheduled for March 30, 1992 at 8:00 A.M. at the Banding Library.
