SAN JUAN COUNTY COMMISSION MEETING MINUTES March 16, 1992 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present: Ty Lewis, Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk Excused: Mark Maryboy, Vice Chairman A motion to approve the minutes of the March 9, 1992 meeting as amended was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. CURRENT BUSINESS Bureau of Land Management Robert Turri, Jeri Kroskup and Dale Davidson of the Bureau of Land Management met with the Commission to discuss the Cedar Mesa Conference that will be held on April 23-24, 1992. The Commission was asked to be involved in the program. Mr. Davidson said he felt the Conference was a good forum in which to raise questions about the management of Cedar Mesa and the Grand Gulch area. The allocation of commercial permits for Grand Gulch will also be discussed. The Hovenweep and Nancy Patterson projects and the proposed visitors center at Salvation Knoll were discussed. A discussion was held on the Administrative Law Hearing on the White Mesa Ute Council Comb Wash allotment that has been changed from Monticello the week of March 17th to Grand Junction, Colorado for sometime in May. Mr. Turri said that the change in the hearing was requested by the attorneys. The Commission said that they felt the hearings should be held in San Juan County since the hearing deals with San Juan County. The Commission will contact Administrative Law Judge John R. Rampton at the Office of Hearings and Appeals in Salt Lake City to protest the moving of the hearing to Grand Junction, Colorado. Tax Sale Property Mary Lou Kosanke told the commission that there is a problem with the piece of property that she requested to purchase. The property was sold to Steve Deeter in 1990. Mr. Deeter has never had his deed recorded. Mrs. Kosanke said she had recorded her deed this morning. The Commission will ask County Attorney Craig Halls for an opinion on this matter. Mr. Halls will be asked to write a letter to Mr. Deeter and Mrs. Kosanke with his findings. The Commission discussed with County Attorney Craig Halls establishing a procedure to handle tax sale property to assure that the deeds are recorded and the property is back on the tax rolls. Youth Opportunity Unlimited Harold Lyman, Job Service, and Lynn Lee, College of Eastern Utah-San Juan Center, met with the Commission to discuss a program under the Department of Labor entitled "Youth Opportunity Unlimited". The program provides opportunities in education for youth throughout the school year and the summer months. Rural applications must be made through the State. One requirement for the program is to have a poverty rate of 30%. San Juan County is the only County in the State that can qualify. Mr. Lee said he must have a Memorandum of Commitment signed by the Commission and other entities to accompany the application for the Grant. This Memorandum states that the programs that are started with the Grant will be ongoing once the Grant is completed. The Grant money will be used to install a Computer Technology center at the Middle School in Blanding and help with the Computer programs in the school in the South part of the County. This will help to establish technology centers in all of the schools. Only four projects nation wide were funded this year. The computer technology project may not receive funding. A motion to approve signing the Memorandum was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Archeology Week Harold Lyman invited the Commission to attend the April 4, 1992 dedication of the Anazai Basket Collection at the Edge of the Cedars State Park. This dedication will be the kick-off for Archeology Week. The Commission was invited to participate in the Dedication. Mr. Lyman said the Jacks Pasture basket collection is ready to be displayed. Mr. Lyman also advised the Commission of the monthly Boar of Regents meeting to be held a the College of Eastern Utah-San Juan Center at 9:00 A.M. on April 17, 1992. The Blanding Chamber of Commerce will hold a lunch meeting at Kenny's Restaurant on March 18, 1992. Marvin Van Dam, State Director of Business Expansion and Retention, will be the guest speaker. A meeting will be held on March 26, 1992 at 2:00 P.M. at the Grist Mill Inn with Ann King, State Economic Development, and the Forest Service to discuss the new plans for Economic Development in the area. Beer License Clerk-Auditor Gail Northern presented a carry-out beer license for Mark and Christine Davis dba Needles Outpost. A motion to approve the license and the signing was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Beer Ordinance Clerk-Auditor Gail Northern discussed with the Commission the current County Beer Ordinance. Mrs. Northern said she has read through the ordinance and has found some sections that are not clear as to what is required. County Attorney Craig Halls will be asked to review the ordinance with current State liquor laws and see what changes need to be made in the County Beer Ordinance. Communications Communications Specialist Bill Bayles presented bids for a snowmobile and trailer for use by the Communication Department. After a discussion the Commission requested that Mr. Bayles bring these purchase requests back in June. This will allow the County to know how much of taxes paid under protest by the oil companies will have to be paid back and the new assessed value of the County. Mr. Bayles told the Commission he has sent a list of the equipment that has been replaced with the communication upgrade to the National Translator Association for bids. Mr. Bayles said he had only received one bid from a firm in California for $1800. Mr. Bayles asked for permission to accept this bid for this equipment. A motion to approve this request was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Mr. Bayles said he is in the process of finishing the upgrades on the television stations that are licensed. The upgrades are two stations at Navajo Mountain, two stations at Montezuma Creek and one station at Bluff. Mr. Bayles said the increased work with the television and radio upgrades will require more help. Mr. Bayles said he would like to use Steven Bradford full-time instead of part-time. The Commission said Mr. Bradford was hired as a Communications employee and could see no problem with Mr. Bradford being used full- time. The Commission requested that Mr. Bayles inform the road department in advance if Mr. Bradford would be available to work for them. County Buildings/Americans With Disabilities Act Buildings Supervisor Dell Hunter met with the Commission to discuss the changes that need to be made in the County owned buildings to comply with the Americans With Disabilities Act. The first priority is an elevator to get people to the top floor of the Courthouse. The estimated cost is $100,000. Mr. Hunter said that there are other needs such as signing that he would be able to handle. Mr. Hunter said the ramp for access to the Blanding Library was already planned and budgeted for this year. Mr. Hunter said he felt an architect needed to be hired to design the elevator and changes in the restrooms and doors. The Commission requested that Mr. Hunter make a list of the items that he can do and what needs to have a architect design. The Commission requested that Mr. Hunter make an estimate of the cost for the changes that he will be able to do and bring the estimate to the next Commission meeting. A discussion was held concerning the signing that is needed at the buildings. A motion to approve $3,000 to start with the proper signing and the cement work at the Blanding Library was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Mr. Hunter said he would like to hire ADG to do the architectural work for the building. The Commission felt that bids for the work should be solicited. The bids should be a flat percentage of cost or a fixed cost. Commissioner Redd said he felt all items to be changed should be bid by the architect to protect the County liability in the future. Procurement Monticello Shop Supervisor Max Ksiaziewicz presented bids for three tool boxes for the new pickups for the North Road Department. Bids were received from Motor Parts of Blanding for $150, Motor Parts of Monticello for $160, WalMart for $124.99 and Sears for $159.99. A discussion was held concerning the cost tot the County to purchase from WalMart and having to send someone to Cortez to pick up the tool boxes. A motion to approve the bid from Blanding Motor Parts was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Fire Control Fire Warden Frank Morrell told the Commission that thirty-five people had finished the firefighter training held recently in Montezuma Creek. The program to the out- lying areas may not be offered again because of budget cuts at the Utah Valley Community College. A meeting concerning this matter will be held on March 19, 1992 at the Utah Valley Community College. Mr. Morrell requested that the Commission send a letter to Steve Dunaway, Director of the State Fire Training, in support for holding the firefighter training program in the out-lying areas of the State. A motion to approve the letter and the signing was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Public Hearing/Road Closure # 147 A Public Hearing to receive comment for the closure of road #147 was held at 1:00 P.M. No opposition was expressed. Comments if favor of the closure were made by Terry Warner. A motion to approve the closure of the road and remove it from the B Road System was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Bluff Community Building Jim Sayers of Bluff met with the Commission to discuss the Bluff Community Building and recreation facilities in Bluff. Mr. Sayers said the building is getting a lot of use and is in need of some repairs. Mr. Sayers presented a list of the needed repairs for the Center and the Tennis Court. A discussion was held with Aging Director Frank Morrell on the Senior Citizens Center and the need to have the place monitored on a regular basis to insure it is clean and that items that should be at the center are there. The Commission discussed with Mr. Sayers the possibility of Bluff establishing a non- taxing Recreation District. Bluff would then have an entity to handle the recreation funds given by the County on a per capita basis. Circuit Court/Trust Fund District Court Clerk Ila Stewart told the Commission that the Trust Fund for the formeer Seventh Circuit Court is being transferred to the State since they have taken over the district Court. This transfer is in the amount of $42,611.68. Building Permit A building permit for Wallace Brice was presented. Mr. Brice is proposing to construct a porch and a barn on his residence in the Blanding area. A motion to approve this permit was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Request to Hire A request to hire was presented for a part-time seasonal employee for the Travel Council. Cordie Arellano will be hired at Grade 1 Step 4, $5.35 per hour; effective 04-10-92. A motion to approve the hiring was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Archeology/Navajo Reservation Administrative Assistant Rick Bailey said that Engineer Doug Pehrson and Archeologist Bill Davis are in Aneth doing the archeology clearance on the identified gravel sources. Transportation Service District/Road Projects Administrative Assistant Rick Bailey said that the Hovenweep project being done by the Transportation Service District is ready for the prime coat. Once the prime coat is finished the road department is to chip seal the road. Mr. Bailey said the weather will not be warm enough for the chip sealing until May. Mr. Bailey suggested asking the Transportation Services District to extend the contract with Brown Brothers so that the prime coat is applied just before the chip sealing is done. The Commission felt that this was the best process as Brown Brothers is currently working on the Perkins Road and could finish this project before going back to the Hovenweep project. The County will request an extension on the Hovenweep project from the Transportation Services District. Peters Point/Fence Administrative Assistant Rick Bailey said that he has received a letter from Mountain West Tree in response to the letter sent about the fencing along the road. The letter indicated the fence will be moved back from the road and any damages would be assumed by Mountain West Trees. Conferences Scheduled Administrative Assistant Rick Bailey told the Commission that the Utah Association for Counties Management Conference will be held in Provo on April 8-10, 1992. The National Wilderness Conference has changed its name to the Land, Water, Ocean and Wildlife Conference. This years conference will be held in St. Louis, Missouri on May 7- 9, 1992. Gravel Request A letter to the Blanding Postmistress concerning a request to gravel around the cluster mailboxes was presented. The letter states the County will gravel the areas around the cluster mailboxes but the gravel must be purchased by the Post Office. Driver License Policy Administrative Assistant Rick Bailey said the road department has received three or four letters concerning the drivers license policy. The concern seems to be with the truck drivers being responsible for the overweight tickets. After a discussion in this matter it was the decision of the Commission that the overweight tickets will be handled by the Commission on a case by case basis. Navajo Mountain/Road Employee Administrative Assistant Rick Bailey discussed with the Commission a problem with the operator hired to grade the road in Navajo Mountain purchasing fuel for his pickup. The operator must drive sixty miles to purchase fuel. A discussion concerning having a tank placed at the Navajo Mountain Boarding School for fuel and paying the operator a reduced rate for mileage was held. It was the decision of the Commission to purchase a 500 gallon metered fuel tank and place it at the Boarding School for the operator to use for fuel. The amount for mileage paid to the operator will be reduced. Newspaper Rock State Park Administrative Assistant Rick Bailey advised the Commission that a meeting will be held at Newspaper Rock State Park on April 4, 1992 to discuss the future of Newspaper Rock State Park. Helicopter Costs/La Sal Mountain Rescue Administrative Assistant Rick Bailey said the helicopter billing from Rocky Mountain Helicopter for the La Sal Mountain avalanche rescue is $8,200. Grand County paid the billing for lodging and explosives for the rescue. A discussion was held on the need to have State law changed to make the Federal Agencies responsible for search and rescue costs on Federal Lands. The possibility of requiring all commercial users on Public Lands to carry liability insurance was also discussed. Mr. Bailey will send a letter requesting that future commercial permits from the Forest Service be required to carry liability insurance. A letter has been sent to Forest Service Supervisor George Morris requesting that the Forest Service help with the costs of the La Sal Mountain rescue. No response to this request had been received. Commissioner Lewis will talk with Mr. Morris about this matter on his way through Price this week. PROCESS FACILATATOR/BILINGUAL COORDINATOR EDWARD TAPAHA'S REPORT Project HOPE Process Facilatator Edward Tapaha reported that he attended the Project HOPE workshop in Phoenix, Arizona on March 12-13, 1992. The three areas of federal funding for Indian Housing were discussed. A discussion was held on the Utah Chapters becoming a Housing Authority to apply for housing. Administrative Assistant Rick Bailey said the Utah Chapters establishing a Housing Authority may be contrary to the Utah Code because the Navajo Tribe is already the Indian Housing Authority. Navajo Mountain Chapter Meeting Bilingual Coordinator Edward Tapaha will be attending the Navajo Mountain Chapter meeting on March 21, 1992. The funding requests from the Navajo Tribe for roads and Senior Citizens Center will be discussed. Meetings Process Facilatator Edward Tapaha will be attending a meeting of the Southeastern Utah Health District in Green River on March 17, 1992. Mr. Tapaha will be holding Voter Awareness session at the Aneth Chapter on March 17, 1992, Monument Valley High School on March 18, 1992 and in Bluff on March 19, 1992. Aneth to Ismay Road The right-of-way application for the Aneth to Ismay Road project has the wrong footage described and will have to be redone. Process Facilatator Edward Tapaha will talk with Engineer Doug Pehrson about this matter. Mr. Tapaha will then contact Commissioner Maryboy in Window Rock, Arizona and see if Commissioner Maryboy can make the necessary corrections on the application so it can be approved. Solid Waste Hearing Process Facilatator Edward Tapaha will attend a Shiprock Agency Solid Waste Public Hearing on March 25, 1992. COMMISSIONER BILL REDD'S REPORT Cedar Mesa/Grand Gulch Management Plan Commissioner Redd discussed some items he felt the Bureau of Land Management should include in developing the Cedar Mesa/Grand Gulch Management Plan. Utah Association for Counties/Centrally Assessed Property Commissioner Redd attended a meeting of the UAC Centrally Assessed Committee. The Committee discussed problems with the Centrally Assessed properties and identified eight problems that they felt need to be addressed. The Committee also decided to send a representative to meet with the State Tax Commission. Commissioner Redd was selected to be the representative. The meeting will be held on March 18, 1992 in the Heber C. Wells Office Building in Salt Lake City. Utah Association of Counties/Comprehensive Planning Meeting Commissioner Redd attended a meeting of the UAC Comprehensive Planning Committee in Richfield on March 13, 1992. A scoping meeting was held with the Forest Service, Bureau of Land management, Cities and Counties in the southern part of the State. The costs for doing a state wide comprehensive plan have increased. A meeting will be held in the Governor's Board Room on March 19, 1992 to discuss the increased costs. Association of Governments Commissioner Redd will attend a Association of Governments meeting in Price on March 20, 1992. COMMISSIONER TY LEWIS' REPORT Clay Hill Crossing A request to have the boat ramp at Clay Hills Crossing cleared of tamarack was received. This request will have to be researched to see if the County can legally clear the boat ramp. Drug Abuse Program Commissioner Lewis participated in a Drug Abuse Awareness panel at Monticello High School on March 10, 1992. Bluff Sewer Service District Commissioner Lewis will attended the Public Hearing on the proposed Bluff Sewer Service District on March 17, 1992. Joint Highway Meeting Commissioner Lewis will attend a Joint Highway Meeting in Vernal, Utah on March 20, 1992.
