SAN JUAN COUNTY COMMISSION MEETING MINUTES September 15, 1992 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk A motion to approve the minutes of the September 8, 1992 meeting as written was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. CURRENT BUSINESS Road Department South Road Foreman Lynn Laws presented bids for a cutting torch for the Montezuma Creek road shed. Bids were received from U.S. Welding for $394.94, Four Corners Welding for $364.20 and J.M. Custom Welding for $392.00. A motion to approve the bid from Four Corners Welding was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Mr. Laws discussed with the Commission replacing the overhead doors at the road shops. Mr. Laws would like to solicit bids for five doors installed at the location. The Commission told Mr. Laws to proceed with the bids. A discussion was held concerning the overhauling and repairing of older equipment. The Commission told Mr. Laws to proceed with the needed repairs on the CAT loader. Mr. Laws said that he and Harold Williams had met with John Todachennie concerning the County using the gravel source on his allotment. Mr. Todachennie said there is no archeology on the site and gave his permission for the County to use the gravel. A discussion was held on a request to purchase two chain saws for the construction crew. There are two chain saws that have had the motor burned up. The Commission feels a safety meeting in the proper use and care of a chain saw may by needed. Bids were received from Monticello Motor Parts for $571 for a Stihl 038 and $541 for a Stihl 036. W B Refrigeration bid $506.95 for a Stihl 034S, $536.90 for a Sthil 036 and $626.90 for a Stihl 038. Speed Lawn and Garden bid $430.71 for a Stihl 036 and $430.71 for a Stihl 038. G & K Enterprises bid $550 for a Stihl 038. The Stihl dealer in Blanding was not contacted. The Commission requested that bids be received from the Blanding dealer. A motion to approve the bid from Speed Lawn and Garden if it is the low bid with the proviso that the users receive good instruction on the care and use of the saws was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. The Commission requested the use and care of equipment be put on the next road meeting agenda. Cultural Resources Plan The Cultural Resources Plan was presented for the approval and signature of the Commission. The Commission inserted a statement into the plan that reads: " Approval of this plan by San Juan County supersedes all prior or previous agreements and plans dealing with cultural resources and archaeological issues. A motion to approve the plan and the signing was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Oil and Gas Conference The Utah State Tax Commission will be holding a Oil and Gas Evaluation Conference in Price, Utah on October 14, 1992. Commissioner Redd will be attending. Conference Call The Commission held a conference call with Attorney Kathy Bowman of the office of the Navajo Nation Attorney General. The cross-deputization agreement with San Juan County and the Navajo Tribe was discussed. Ms. Bowman told the Commission that with the changes made in the Navajo Attorney General's office when the previous Attorney General resigned the cross-deputization agreement has been misplaced. Ms. Bowman said she is still searching for the agreement. When the agreement is found if it lacks the proper signatures it will be sent directly to the Navajo Justice Department for review and sent to Navajo Nation President Peterson Zah for his signature. Public Defender Complaint Cliftene Gutierrez Ortega told the Commission she had been sent to talk with them by the Judge. Ms. Ortega said she had been arrested and was in the hospital the day she was to appear in court. Ms. Ortega said she was taken to court heavily sedated. The Court appointed a public defender for her. On the next court day Ms. Ortega said sh went to court and when her name was called an attorney went with her to the podium and began stating what she would plead. Ms. Ortega said she had never seen the man before and was astounded. The Judge continued her case. Ms. Ortega said she tried to talk with the Attorney, Keith Chiara. Mr. Chiara slammed the door in her face and refused to talk with her. Ms. Ortega said she felt Mr. Chiara should not be paid for his services. Ms. Ortega will be representing herself at the next court appearance. Ms. Ortega said she has some mental problems and does not recollect ever meeting Mr. Chiara. The Commission told Ms. Ortega that they would inform Mr. Chiara of her complaint and give Mr. Chiara a chance to respond to the compliant. Once Mr. Chiara responds to the complaint the Commission will determine what action will be taken. Repeater Site Wilderness Conquest will be going out of business and has offered their repeater site and equipment to San Juan County for $11,000. Administrative Assistant Rick Bailey will discuss this site and equipment with Communications Specialist Bill Bayles. A decision on the site will have to be made by the end of September if the site is to be retained. Bingham Environmental Proposal A proposal was received from Bingham Environmental for evaluating the regulating of storm and other water regulations. Administrative Assistant Rick Bailey will discuss this proposal with Solid Waste Planner Brian Brimner. A discussion was held concerning the decision by Montezuma County, Colorado to prohibit out-of-state solid waste at their landfill. Request to Hire Sheriff Claude Lacy, Jail Administrator Bill Christensen and Assistant Jail Administrator Kelly Bradford told the Commission that part-time dispatcher Todd Moon will be accepting full-time employment at the Port of Entry. A request to proceed with replacing Mr. Moon from the already established roster was granted. Executive Session A motion to approve a request for an executive session to discuss Sheriff Department personnel matters was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. A motion to reconvene into regular session was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Primary Election Canvass Canvassing of the Primary Election was held at 12:00 Noon. Fifteen absentee ballots were counted. A motion to approve the official returns of the election was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. The following are the offical Primary election results: PROCESS FACILATATOR EDWARD TAPAHA'S REPORT Elections Bilingual Coordinator Edward Tapaha reported that he spent September 8, 1992 helping with the Primary Election. There were problems with the telephone lines at Monument Valley and Oljato. Mr. Tapaha had to radio the election results to the Clerk's office for the Oljato and Red Mesa precincts. Mr. Tapaha said the election went very well but voter turn out was very low. Navajo Mountain Process Facilatator Edward Tapaha said that the Navajo Mountain Chapter is requesting matching funds in the amount of $3,000 from San Juan County for establishing a solid waste transfer site. Mr. Tapaha said he has spoken with Julie Orr, Navajo Tribal Solid Waste, concerning this matter. Ms. Orr has indicated she would be willing to discuss this matter with the Navajo Mountain Chapter officials and the Commission in October. Mr. Tapaha said he would schedule the meeting after the new Chapter officials take office on October 15, 1992. Commissioner Lewis will attend this meeting and will also discuss roads and funding available from the Navajo Tribe with the Chapter officials. Commissioner Maryboy said the Navajo Mountain Chapter can apply for funding for the transfer site project from the Navajo Tribal Community Development Block Grant or the Chapter Capital Improvement funds. Meetings Process Facilatator Edward Tapaha will be meeting with the Navajo Tribal Transportation Department on September 16, 1992 in Window Rock. Mr. Tapaha will be attending a meeting of the Southeastern Utah District Health Department on September 15, 1992. Mr. Tapaha will be attending a meeting of the Utah Navajo Commission on September 17, 1992 in Bluff, Utah. Mr. Tapaha will be attending the Utah Navajo Fair on September 18-19, 1992 to hold Voter Awareness Sessions and to register people to vote. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Aneth to Ismay Road Administrative Assistant Rick Bailey reported that the bids for the Bureau of Indian Affairs portion of the Aneth to Ismay road project were opened last week. Three companies bid on the project. JKL Construction bid $1633,594.00, Silverstate Construction bid $2,744,765.00 and Chuska Energy Development Corporation bid $1,482,358.00. The Engineers will verify the bids and submit them to the BIA for approval. The low bid came in under the Engineers estimate for the project of $1,500,000.00. Mr. Bailey will be meeting with Creamer and Noble and the Utah Department of Transportation to discuss the contract agreement of the Aneth to Ismay road on September 17, 1992. Governor's Conference on Emergency Management Administrative Assistant Rick Bailey will be attending the Governor's Conference on Emergency Management on September 16-17, 1992. Senator Garn's Office Administrative Assistant Rick Bailey will be meeting with Bob Dibblee of Senator Jake Garn's office on September 17, 1992 to discuss items that need to be finished before Senator Garn leaves office. San Juan Transportation District Administrative Assistant Rick Bailey presented a contract with the San Juan Transportation District to transfer funds to the County for the paving of county road #355. This road is being financed by San juan County, San Juan Transportation Services District and a private land owner. The chair was passed to Commissioner Redd. Commissioner Lewis made a motion to approve the contract and the signing. The motion was seconded by Commissioner Redd. UNANIMOUS. The chair was passed back to Commissioner Lewis. Emergency 911 System A discussion was held on implementing the Emergency 911 system in the County. The Commission felt that the system should be phased in a portion at a time. The Commission asked Administrative Assistatn Rick Bailey to work out a schedule and present it at the next meeting. La Sal Road Request Administrative Assistant Rick Bailey said he sent a letter to Jim Blankenagel outlining the requirements that must be met to use his ORV for agricultural purposes on the county road. A discussion was held concerning designating all "B" and "C" roads as open to ORV use. Mr. Bailey will discuss this matter with County Attorney Craig Halls. COMMISSIONER BILL REDD'S REPORT Oil and Gas Evaluation Commissioner Redd attended a meeting of the Oil and Gas Counties. Commissioner Redd presented a proposal from Pricthard and Abbott to do an evaluation of oil and gas wells for $61,000. The counties will contact the school districts to have them participate in this evaluation. A letter will need to be sent to Commissioner Ron Perry, Chairman, if San Juan County is willing to participate. A motion to approve the County participation in the evaluation of oil and gas properties was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. State Fair Commissioner Redd attend the Utah State Fair on September 11, 1992. Commissioner Redd attended the State Fair Queen Pageant and luncheon. San Juan County won first prize on the County booth for the third year in a row. Utah Association of Counties Comprehensive Planning Meeting Commissioner Redd attended a meeting of the UAC Comprehensive Planning Committee on September 11, 1992. A discussion was held with the planning group on the elements of the plans. A meeting with the three counties being planned, Piute, Wayne and Garfield, will be held. State Land Trade Commissioner Redd reported that the Five County Association of Governments in Southwestern Utah has passed a resolution in support of the State Land Trade. The Commission felt that the Five County AOG should not be in support of an action that has nothing to do with their area. A letter will be sent to the AOG president Jerry Lewis protesting the resolution. Travel Commissioner Redd will be attending a noon meeting on September 25, 1992 with a party interested in the 21st Century property in Blanding. Commissioner Redd will be attending a meeting of the Southeastern Utah District Health Department on September 15, 1992 in Green River. Commissioner Redd will be attending an Interagency Meeting on September 16, 1992. Commissioner Redd will attend the Association of Governments meeting in Price on September 18, 1992. COMMISSIONER MARK MARYBOY'S REPORT Complaint Commissioner Maryboy received a letter of complaint from a Blanding resident concerning young children drinking beer at a residence. A copy of the letter will be sent to Social Services for their attention to this matter. Navajo Tribal Council Commissioner Maryboy attended the Navajo Tribal Council Session. More funding was approved for the Chapters. The budget for the Utah Navajo Commission was increased to $1,000,000. Only ten percent of this funding will be allowed for administrative purposes. Ninety percent of the funding will go the Chapter projects. The Navajo Mountain Chapter was awarded $100,00 for immediate project needs. An additional $30,000 will be given to Navajo Mountain Chapter for other needs. Utah Navajo Fair Commissioner Maryboy said the Utah Navajo Fair will be held September 17-20, 1992 in Bluff. Commissioner Maryboy invited the Commission to attend. Montezuma Creek Sewing Plant Commissioner Maryboy said the sewing plant at Montezuma Creek is being renovated so it can reopen. The Navajo Tribe is doing the renovation. The sewing plant has a contract with Schafer Western Apparel to construct Navajo Tribal clothing. State Highway #262 Commissioner Maryboy said he talked with Congressman Bill Orton and State Senator Mike Demetrick concerning the construction of State Road #262. Mr. Demetrick indicated that the project was about to begin. Administrative Assistant Rick Bailey will discuss this matter with the Utah Department of Transportation when he meets with them this week. Travel Commissioner Maryboy will be in Albuquerque, New Mexico on September 16, 1992 to a meeting concerning Chuska Energy and their possible sell out to another oil company. Commissioner Maryboy will be attending a Utah Navajo Commission meeting on September 17, 1992 at the Bluff Learning Center. COMMISSIONER TY LEWIS' REPORT Joint Highway Committee Meeting Commissioner Lewis will be attending a Joint Highway Committee meeting on September 17-18, 1992 in Brigham City, Utah. Commissioner Lewis will attend a meeting with the Utah Department f Transportation on September 17, 1992. Newspaper Rock State Park Commissioner Lewis said he has spoken with the Bureau of Land Management about what would be done with Newspaper Rock State Park if the State Parks turned the park over to the BLM. The BLM said they were not willing to negotiate with the mining claims in the area but they are willing to manage the Park.
