SAN JUAN COUNTY COMMISSION MEETING MINUTES October 5, 1992 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk A motion to approve the minutes of the September 28, 1992 meeting as amended was made by Commissioner Redd and seconded by COmmissioner Maryboy. UNANIMOUS. CURRENT BUSINESS Monitored Retrievable Storage Facility Lucy Moore, Western Network, met with the Commission to discuss the progress with the public information on the Monitored Retrievable Storage Facility. Phase I of the Grant has been extended to March 1993. This will allow Ms. Moore time to form a citizens committee. A motion to amend the contract with Western Network and extend the contract period to December 31, 1992 for an additional $25,505 was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Sheriff's Department Sheriff Claude Lacy, Jail Administrator Bill Christensen and Assistant Jail Administrator Kelly Bradford met with the Commission to discuss the hiring in the Sheriff's Department. Sheriff Lacy said that the Department is in the process of advertising for applicants and filing the hiring roster. Sheriff Lacy said he was concerned that they were not getting the applicants and the quality of people needed in public safety. Sheriff Lacy asked Commissioner Maryboy and Process Facilatator Edward Tapaha to sit on the oral review board. Commissioner Maryboy said he would help with the recruiting of applicants but felt he should not set on the hiring board where he is part of the grievance committee. Mr. Tapaha will serve on the Board with Deputy Terrence Lee, Mr. Christensen and Mr. Bradford. A discussion was held on the possibility of having two dispatcher on duty during the busy times of the day. Monument Valley Hospital Ray Carney, Monument Valley Hospital Administrator, met with the Commission to request that the area around the community well be asphalted. Mr. Carney said the hospital has provided the water well for a number of years. The concrete pad around the well has deteriorated and the hospital will be pouring a new pad. The well is next to the road but has never been asphalted. South Road Foreman Lynn Laws said the road department will be installing new culverts and widening the road in this area. The Commission told Mr. Carney that they would put some road base in the area and asphalt if they have enough time this season. If there is not time to asphalt in this season it will be asphalted next year. Engineer Doug Pehrson will look at the area to see what work needs to be done. Mr. Carney requested that the retention pond near the hospital be cleaned while the equipment is in the area. The Commission gave their approval to this request. Zoning Lee Cox met with the Commission to request a zoning change in the La Sal Acre area. Mr. Cox has a conditional use permit for a sawdust compost operation. Mr. Cox would like to install a portable saw mill on the property to saw lumber for pallets. Mr. Cox requested the area be zoned agricultural. The agricultural zoning would allow for sawmills and forest products. A motion to extend the conditional use permit for an additional six months to allow time to discuss the zoning change with the County Attorney and go through the zoning change process was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Deputy Bill Pierce was present at the meeting and said the only complaints he has received about the sawdust compost operation was from landowners not living in the La Sal area. The residents next to Mr. Cox have no complaints on the operation. Mr. Cox requested that the use of the portable sawmill be added to his conditional use permit. The sawmill would only be able to run until the weather gets bad. A motion to amend the motion to include the sawmill on the conditional use permit was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. State History Contract Contracts with the State Division of History for the writing of the San Juan County History were presented. A motion to table approving the contracts until the amount of the County match is determined was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. White Mesa Ute Council Cleal Bradford, Ute Mesa Ute Council, invited the Commission to attend a road meeting with the White Mesa Ute Council on October 6, 1992 at 10:00 A.M. The Ute Tribal Chairman will be in attendance at the meeting. Bluff Library A letter was received from Bluff Library Chairman Rosalie Goldman requesting a statement from the Commission in support of the Bluff library. The Commission said the library is included in the Special Service District that is in the process of being established. The Commission requested that Administrative Assistant Rick Bailey draft a letter to Ms. Goldman advising her of this matter. Public Safety Building/Heating System Maintenance Supervisor Dell Hunter discussed with the Commission the billing from Payson Sheet Metal for the work completed on the heating system at the Public Safety Building. The long term work that needs to be done was also discussed. Conference Call The Commission had a conference call from Congressman Bill Orton. They discussed the wilderness bill that is being introduced in Congress. Road Department Bids for the purchase of two radios and tools that have been lost in the road department were presented. It was the decision of the Commission to have Administrative Assistant Rick Bailey send a memo to the road foreman advising them to establish a policy on repair and replacement cost for lost or broken items. When the policy is established the Commission will consider replacing the lost items. A request to hire was presented for a night watchman for the construction crew. It was the decision of the Commission that with proper management of the employees on the construction crew the time can be covered without hiring an additional employee. PROCESS FACILATATOR EDWARD TAPAHA'S REPORT Elections Process Facilatator Edward Tapaha reported to the Commission that he has been working on the translation tapes for the upcoming General Election. Mr. Tapaha discussed the making of an election video with the Commission. Mr. Tapaha said he may need to hire an older couple to be in the video. The Commission asked Mr. Tapaha to budget for this expense in the 1993 budget. Mr. Tapaha will talk with the College of Eastern Utah/San Juan Center and Whitehorse High School about helping with the video. Mr. Tapaha will be in Window Rock on October 6, 1992 to discuss voter information. Chapter Officials Process Facilatator Edward Tapaha discussed with the Commission an inservice training for the newly elected Chapter officials. Mr. Tapaha suggested that the Commission meet with the Chapter officials and other service providers for the Chapters on a quarterly basis. Mr. Tapaha will arrange a meeting with the Chapter officials on October 26, 1992 in Bluff. The Commission asked Mr. Tapaha to develop the agenda for the meeting. Voter Awareness Bilingual Coordinator Edward Tapaha will be involved in the Voter Awareness Seminar presented at San Juan High School on October 12, 1992 by Utah State University Extension. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Building Permit A building permit for a garage was presented for Stephen Brownell. A motion to approve the permit was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. A building permit was presented for a storage building for Merrill Bunting. Administrative Assistant Rick Bailey said the zoning in the area requires a 10 acre lot for a home or mobile home. The building may not be used for commercial purposes. A motion to approve the permit with the addition of the zoning stipulations was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Subdivision Ordinance Administrative Assistant Rick Bailey said he attended a session dealing with subdivision ordinances at the Utah Association of Counties Commission workshop last week. Mr. Bailey said he has requested copies of subdivision ordinances from several counties. Mr. Bailey said he will review the ordinances and come up with a draft for San Juan County. Patch Truck Administrative Assistant Rick Bailey said the bid for the patch truck that was awarded last week may have some problems. Mr. Bailey said it has been brought to his attention that the bed that was bid by AG Truck Equipment Company is from a Canadian Company that has filed for bankruptcy. Mr. Bailey said he is concerned if the company goes bankrupt that the parts will not be available when they are needed. Mr. Bailey said he has written to AG Truck Equipment concerning this matter. Mr. Bailey said if the response from AG Truck Equipment is that the company is in bankruptcy he would like permission to award the bid to Holland Equipment. The Commission gave their approval to this request. Transient Room Tax Administrative Assistant Rick Bailey presented the Commission with a copy of the transient room tax for the past two quarters. Utah Local Governments Insurance Administrative Assistant Rick Bailey said the settlement agreement with Utah Local Governments Insurance on the exit fees charged to the counties require that the funds to be escrowed by the counties. The funds will not be called for except in the case of extreme losses by Utah Local Governments Insurance. COMMISSIONER BILL REDD'S REPORT Utah Association of Counties/Commission Workshop Commissioner Redd attended the UAC Commission workshop on September 29, 1992 to October 2, 1992. The Oil Counties Committee was disbanded and became part of the Centrally Assessed Committee. The Comprehensive Planning Committee discussed the planning of Piute, Wayne sand Garfield counties and gave the directive to the counties to form comprehensive planning committees. Commissioner Redd will attend Wayne County's Comprehensive Planning Committee meeting. The candidates for Governor and Attorney General spoke at the workshop. A discussion was held concerning the PILT payments to the County. Travel Commissioner Redd will be attending a meeting of the State Lands Board on October 9, 1992. SB179 concerning the right-of-way across State Lands will be discussed. COMMISSIONER MARK MARYBOY'S REPORT Navajo Tribal Council Commissioner Maryboy said he would be absent this afternoon to attend a meeting of the Navajo Tribal Council. Commissioner Maryboy attended a special meeting of the Navajo Tribal Council last week. Bonds for the Navajo Tribal government in the amount of $300,000,000 were discussed. This bonding would be for twenty years and would be used for Chapter projects. Many of the Tribal Delegates were confused about how the bonds would work. If the entire Tribal Council can agree on the Bonding it will be established. Shiprock Agency Commissioner Maryboy attended a meeting of at the Shiprock Agency on October 1, 1992. Decentralization of services provided at the agency level were discussed. Towac Casino Commission Maryboy attended the Grand Opening of the Towac Casino on October 2, 1992. Commissioner Maryboy said that there were Tribal leaders from all over the country in attendance. Travel Commissioner Maryboy will be meeting with the teachers and students of San Juan High School and Bluff Elementary School in Bluff on October 8, 1992. Commissioner Maryboy will be attending a meeting on Navajo Tribal Investments in Albuquerque, New Mexico on October 9, 1992. COMMISSIONER TY LEWIS' REPORT Washington D.C. Commissioner Lewis traveled to Washington D.C. last week. While in Washington D.C. Commissioner Lewis spoke with the Congressmen and Senators about the Department of Energy tailings cleanup in Monticello and Mexican Hat, State Lands exchange and the Monitored Retrievable Storage Facility.
