SAN JUAN COUNTY COMMISSION MEETING MINUTES December 7, 1992 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk A motion to approve the minutes of the November 23, 1992 meeting as written was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. CURRENT BUSINESS Road Department South Road Foreman Lynn Laws and Office Manager Wanda Franklin met with the Commission to discuss the possibility of requiring employees who are lifting heavy objects to wear a back support. Several employees have been injured and required to have surgery because of the injuries. Administrative Assistant Rick Bailey will contact the workers comp. insurance carrier to get a recommendation on supplying and requiring the use of back supports. Cal Black Memorial Airport Calvin Blake, Midway Aviation, met with the Commission to discuss items pertaining to the operation of the Cal Black Memorial Airport. Mr. Blake said he has lost business because there is no telephone service. The County is waiting for the licensing for the microwave telephone system. As soon as the licensing is approved the telephone will be installed. Administrative Assistant Rick Bailey said the County has tried to purchase frequency from GTE for the area. GTE will not sell any of their frequencies so the County must apply for their own. The merger of GTE and Contel has caused a lot of the problems because of the difference in the policies of the two companies. Mr. Bailey said he felt there would have been telephone service available at the airport if the company was still just Contel. Mr. Blake requested a subsidy of $500 per month since the time the airport was opened. Mr. Blake said he felt this was a fair price to request since he feels the business at the airport is being hurt because there is no telephone. Mr. Blake is receiving the County share of the fuel sales and tie-downs until the telephone is installed. A motion to pay Mr. Blake $2,000 for the past months and begin paying $500 per month in December until the telephone is installed was made by Commissioner Redd and seconded by Commissioner Maryboy. Money will need to be included in next years budget for this expense. Mr. Blake indicated he did not feel the $2000 was adequate to cover his expenses of having someone at the airport 24 hours per day, providing free shuttle service and providing living facilities . After a discussion on the expenses incurred by Mr. Blake Commissioner Redd made a motion to amend his previous motion to $4,000 and begin paying $500 every month beginning in December until the telephone is installed. The motion was seconded by Commissioner Maryboy. UNANIMOUS. Mr. Blake discussed a free shuttle service for the patrons using the Cal Black Memorial Airport. Mr. Blake said he would like to be able to shuttle the people to Halls Crossing and have ARA shuttle the people back to the airport. Mr Blake said he is currently shuttling people both directions. Mr. Blake said he felt a shuttle service was essential to make the airport a success. Mr. Blake requested that the Commission write a letter to ARA at Page, Arizona concerning the need to provide a free shuttle service to the airport. The airport will provide free shuttle service from the airport to the lake. Administrative Assistant Rick Bailey will write the letter to ARA. Mr. Blake said there is a need to have T-Hangers at the airport. Mr. Blake said he felt that there should be 10 hangers. Pilots have been requesting a hanger to rent to store their planes and boats. Mr. Blake said he would like the County to prepare the ground for the hangers this winter. The Commission told Mr. Blake that they would not have the funds to build the hangers in 1993 because of the solid waste costs. Mr. Blake said he would be willing to build the hangers if the County would do the ground work. The Commission asked Administrative Assistant Rick Bailey to find out what the County can legally build on the land they have acquired for the airport. Mr. Blake said he would like the County to contact the Federal Aviation Administration about the possibility of switching from the Automatic Weather Observing System to the newer Automatic Surface Observing System that is yet to be installed at the Cal Black Memorial Airport. Mr. Blake said he felt this type of system was a better system and would give a more concise weather report to the pilots. Administrative Assistant Rick Bailey will contact the Federal Aviation Administration about this matter. Mr. Blake asked if the apron around the parking area at the airport could be paved and steel pads be purchased for jet airplanes. The Commission assured Mr. Blake that these items will be taken care of in the near future. Mr. Blake advised the Commission that there is a problem with kangaroo rats getting between the stucco and the building and eating the styrofoam insulation. Mr. Blake would like to purchase some rat poison and containers to hold the poison. Mr. Bailey will get the poison for Mr. Blake. Economic Development Plan Larry and Karen Wells met with the Commission to discuss the Economic Development Plan they are doing on a contract administrated by the Forest Service. An Action Plan Committee is being established. The committee will be members of the San Juan County Economic Development Council and personnel from the Forest Service and Farmer's Home Administration. The Commission advised Mr. and Mrs. Wells to contact Brad Barber, State Planning and Budget, Dixie Barsdale, Association of Governments and the Resource Conservation and Development for the information they need for this study. Mr. & Mrs. Wells will interview each Commissioner to determine their ideas of economic development for the areas of the County they represent. M-4 Subdivision Change Jane Sleight met with the Commission to request approval for a change in the M-4 Subdivision Addition #2. Mrs. Sleight has moved the location of lot #1 and changed the common area of the subdivision. A motion to approve the change for the Commission and the Planning Commission was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Meriloo Sanitation Lloyd and Fay Neet, Meriloo Sanitation, met with the Commission to register a complaint about the County doing business with a sanitation company from Cortez, Colorado. Mr. Neet said their business office is located in San Juan County near Moab and they are paying County taxes. Mr. Neet said they would like to have the opportunity to bid on projects. The Commission will pass this information on to the road department. The regulations in Utah for operating a sanitation company in Utah were discussed. The Commission will discuss these regulation with Sanitarian Rick Meyers. Beer Licenses Clerk-Auditor Gail Northern presented beer license renewals for 1993 for the Halls Crossing Store and Marina and the Hite Store and Marina for the approval and signature of the Commission. A motion to approve the renewal was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Procurement Bids for drapes and rods for the Mental Health offices in the Courthouse were presented. Bids were received from Custom Floor for $491.50, Draperies by Jo for $550 and Town and Country Furniture for $850. A motion to approve the bid from Custom Floors was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Mr. Hunter said the Montezuma Creek road shed is in need of a new heater. Mr. Hunter said he is waiting for two additional bid before a purchase can be made. Mr. Hunter requested permission to purchase the heater from the lowest bidder so the heater can be installed as soon a possible. A motion to allow Mr. Hunter to purchase from the low bidder was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. A letter was received from Max Ksiazkiewicz requesting permission to purchase two used trailer axles with brakes from Paul Langston. The axles are $75.00 each. Mr. Ksiazkiewicz said he has contacted Vernon Schafer and he charges $150 for used comparable axles. Henderson Wheel charges $160.40 without brakes. A motion to approve this purchase from Paul Langston was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Library Literacy Grant Library Board Chairman Joyce Martin discussed with the Commission the Library Literacy Grant that the Board is applying for. The maximum amount of the Grant is $35,000. The Grant will be used to purchase books to help adult who are learning to read. The Canyonlands Chapter of the American Literacy Group, Blue Mountain Academy and Even Start (College of Eastern Utah) will be assisting with the program. The books will be available in all areas of the County. Ms. Martin requested a letter of support for the Grant from the Commission. A motion to approve a letter of support for the Literacy Grant was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Aneth to Ismay Road A motion to approve sending the Notice of Award for the Bureau of Indian Affairs portion of the Aneth to Ismay Road project to Chuska Development Company was made by Commissioner Maryboy and seconded by Commissioner Redd. UNANIMOUS. The contract will be sent to Robert Montoya, BIA Shiprock Agency. Sheriff's Department Sheriff Claude Lacy and Jail Administrator Bill Christensen met with the Commission to discuss purchasing some bullet proof vests and a enlarging copy machine for the County Attorney with $4,250 of drug money that has bee seized by the County. A motion to approve bids for these purchases was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS Sheriff Lacy said the sheriff's department has a sno-cat that needs to have some repairs made so that it can be used for search and rescue. The repair costs may be approximately $1800. There are funds in the search and rescue budget for these repairs. The Commission gave their approval to this request but asked that a firm estimate be made before a final decision is made on the repairs. A discussion was held with Sheriff Lacy and Mr. Christensen concerning the requested computer storage cabinets for the jail. The Commission will send a letter to the School District asking if they want the cabinets to be the property of the School District or the County. If the School District wants to own the cabinets they need to help with the costs. Sheriff Lacy said the health care and inmate agreement with the Cities has expired. Sheriff Lacy said the contract needs to be changed to charge the Cities for their prisoners until sentencing not by nature of offense. National Park Service Canyonlands National Park Superintendent Walt Dabney introduced Natural Bridges National Park Superintendent Steve Chaney to the Commission. Mr. Chaney started work this week and will be living in Monticello. Mr. Dabney discussed the road repairs and other projects in the Needles District with the Commission. The Power Voltech System at the Natural Bridges is in the process of being repaired. Once the system is operational a rededication ceremony will be held. Money will be budgeted each year for repairs. Copies of the Back County Management Plan for the National Park Service was presented to the Commission for their review. Human Services Mark Lyman and Bruce Shumway met with the Commission, Clerk-Auditor Gail Northern and Deputy Auditor John Fellmeth to discuss the requested budget from San Juan County for 1993. The State Statue requires the County to budget for 20% or more of the program costs. Human Services is requesting $45,000 this year. This is the same amount that was requested last year. Mr. Shumway and Mr. Lyman requested that the County keep the funding at the same level as they did for the previous year. Request-to-Hire A request to hire for a temporary emergency operator for La Sal road department was presented for the approval of the Commission. Kendall Fuller will be hired at Grade 13 Step 1, $8.43 per hour; effective 12-7-92. A motion to approve this hiring was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Building Permit A building permit for a shop was presented for Lee Cox. This permit was tabled until some zoning questions are answered. A building permit was presented for Richard Perkins. This permit is for an electrical inspection on an existing home. A motion to approve the permit was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Bureau of Indian Affairs/Road Agreement Administrative Assistant Rick Bailey said the road agreement with the Bureau of Indian Affairs/Shiprock Agency has been received. The Commission requested that the agreement be given to County Attorney Craig Halls for his review before the Commission signs the agreement. San Juan County Service Area No. 1 Administrative Assistant Rick Bailey said a letter has been received from Stan Johnson requesting that the Board for the San Juan County Service Area No. 1 be increased to a seven member board. A motion to increase the members of the San Juan County Service Area No. 1 from five to seven member and reserving the right to reduce the member if the need arises was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Mr. Bailey will inform Mr,. Johnson of the change in board members. Budgets Administrative Assistant Rick Bailey presented the budgets for the San Juan Water Conservancy District and the San Juan County Transportation District for the approval and signature of the Commission. A motion to approve the budgets was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Service Districts Vacancies Administrative Assistant Rick Bailey discussed with the Commission the vacancies on the Boards of the San Juan Health Care Services District and the San Juan County Transportation District. The term for the representative to the San Juan Transportation District appointed by Blanding City will expire at the end of the year. Mr. Bailey said he has informed Blanding City of the procedure that needs to be taken to fill this vacancy. Travel Administrative Assistant Rick Bailey will be in Salt Lake City on December 10- 11, 1992 to an Emergency Management Meeting. Mr. Bailey will attend the State Lands Board meeting on December 10, 1992. PROCESS FACILATATOR EDWARD TAPAHA'S REPORT Chapter Meetings Process Facilatator Edward Tapaha told the Commissioners that Navajo Mountain will hold their Chapter meeting on December 19, 1992. Jamie Holgate is the new Chapter president. The Red Mesa Chapter meeting will be held on December 14, 1992. Mexican Water Chapter meeting will be held on December 13, 1992. The Oljato Chapter meeting will be held on December 20, 1992. The Aneth Chapter meeting will be held on December 13, 1992. Utah Navajo Trust Process Facilatator Edward Tapaha said there will be a meeting of the Utah Navajo Trust on December 21, 1992 at Aneth. Because of this meeting the planned in- service training with the Chapters has been canceled. The in-service training will be rescheduled in January 1993. Navajo Transportation Process Facilatator Edward Tapaha said that Gary Moore, Navajo Transportation, will be in San Juan County in two weeks to tour the area and look at a road project that have been requested by Sue Ann Benally. Mr. Moore will attend Commission meeting while in the area. Roads Process Facilatator Edward Tapaha said he has been asked why County road #201A has not been graded. Commissioner Lewis will talk with Engineer Doug Pehrson about this matter. Mr. Tapaha said he has been asked who stripes the road from Montezuma Creek to Red Mesa. Commissioner Lewis will talk with Mr. Pehrson about this matter too. Mr. Tapaha discussed with the Commission road sign damage on the Navajo Reservation. Utah Agency Office The Commission discussed with Process Facilatator Edward Tapaha the need to have resolutions from the Chapters requesting a Utah Agency Office. This would help the Utah Navajo's get the services of the federal government. Travel Process Facilatator Edward Tapaha will be in Window Rock, Arizona with Lewis Singer, San Juan School District, on December 10, 1992 to work on the land request for School District housing in Halchita. Mr. Tapaha will also be doing an election follow-up while in Window Rock. The Commission requested that Mr. Tapaha check on the status of the Aneth Chapter gravel pits. COMMISSIONER BILL REDD'S REPORT Monitored Retrievable Storage Facility Commissioner Redd presented copies of Nuclear Power Plant histories to the Commission for their files. Commissioner Redd said that Roan County, Virginia had petitioned for the MRS facility and was turned down on the State or Federal level. The Oakridge people staffed the Committee and were in favor of the facility. State Lands Exchange Commissioner Redd will be attending meeting with a group of county commissioners and the State Office of Planning and Budget. The State Land exchange and the various options of the exchange will be discussed. A report will be written and sent to San Juan County. Travel Commissioner Redd will be attending the State LAnds Board meeting on December 10, 1992. Commissioner Redd will be attending a Utah Association of Counties Multi-County Appraisal Trust meeting on December 16, 1992. Commissioner Redd reported that the National Association of Counties will be holding their Legislative Conference in February 1993. COMMISSIONER MARK MARYBOY'S REPORT Drug Search Commissioner Maryboy reported that the Federal Bureau of Investigation conducted drug searches in the Montezuma Creek area on December 1, 1992. The families that were searched think that the searches were ordered by Commissioner Maryboy. Commissioner Maryboy, Sheriff Claude Lacy and FBI Agents met with the families. The families still think that Commissioner Maryboy instigated the searches. The families have started circulating a petition to have Commissioner Maryboy recalled. There is no process in Utah to have a Commissioner recalled. The families are also alleging that Commissioner Maryboy has been receiving pay from the County and the Navajo Tribe for the same trips. Washington D.C. Commissioner Maryboy traveled to Washington D.C. for a two day seminar with educators. Commissioner Maryboy met with educators from Rhode Island where a program is being used that teaches technical skills in high school. This program has bee offered for two years and the students are getting better jobs because of the training. Most of the Indian Tribes in the United States were invited to the meeting. Some of the Tribes already have the Carl Perkins Grant for job training. Commissioner Maryboy traveled to Washington D.C. with San Juan School Board member Bill Todachennie. Commissioner Maryboy will be working with San Juan School District to implement these programs in San Juan County. While in Washington D.C. Commissioner Maryboy met with Congressman Orton to discuss the State Lands Exchange, the Navajo Trust Funds and the Wilderness Bill. Congressman Orton is interested in appointing a Utah Navajo to serve a position in Washington D.C. Governor's Appointments Commissioner Maryboy said he has recommended to Governor-elect Leavitt that someone who is knowledgeable in Indian law be appointed to work with the Indian Tribes. Commissioner Maryboy said he has been contacted by Will Nekemia and told that representatives of all of the Indian Tribes in Utah will be meeting with Governor-elect Leavitt on December 8, 1992. Presidential Inauguration Commissioner Maryboy reported that he has been selected to participate in the inauguration parade for President Clinton. Commissioner Maryboy will also be giving the benediction in Navajo at the inauguration. Travel Commissioner Maryboy will be meeting with the Utah Navajo Agency people this afternoon to discuss the Aneth Chapter budget. Commissioner Maryboy will be attending a workshop on Indian Agriculture and Irrigation on December 8-11, 1992 in Las Vegas, Nevada. COMMISSIONER TY LEWIS' REPORT Conference Call Commissioner Lewis will participate in a conference call with attorneys on December 9, 1992 concerning the Norman Begay lawsuit. Bookmobile Commissioner Lewis said he received a response from Doug Abrams concerning the questions on the bookmobile funding. Commissioner Lewis said he was not pleased with the response and will analyze the information he received. Division of Wildlife Resources Commissioner Lewis said the DWR is doing an Elk Management plan for the Abajo Mountains and the area northeast of Monticello. The Commission needs to make sure the County has input into the management plan. Four Corners Regional Care Center Commissioner Lewis will attend the dedication of the new portion of the Four Corners Regional Care Center on December 11, 1992. Ty Lewis, Chairman Dena Hunter, Deputy Clerk BUDGET HEARING December 7, 1992 The Budget Hearing for the 1993 Budget was held at 6:00 P.M. in the commission chambers at Monticello, Utah. There were twenty seven citizens present at the hearing. Commissioner Ty Lewis welcomed the citizens to the Budget Hearing. Deputy Auditor John Fellmeth presented the budget and explained the revenues and expenditures. There was a lengthy discussion on the funding request for the Bluff Library. Library Board Chairman Joyce Martin explained the State requirements for becoming a part of the County Library System. Rosalie Goldman said she felt the County could fund the library from other sources besides the library system funds. A discussion on the requested funding for the Chapter road projects was held. Several comments were made about needing the funding from the County to get the matching funds from the Navajo Tribe. The hearing adjourned at 7:42 P.M.
