SAN JUAN COUNTY COMMISSION MEETING MINUTES December 28, 1992 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk A motion to approve the minutes of the December 21, 1992 meeting as amended was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. CURRENT BUSINESS Insurance Proposal Wanda Franklin, Road Department Office Manager, and John Black, Blue Cross/Blue Shield Insurance Representative, met with the Commission to propose adding dental, vision and preventative care to the current self-insured health insurance. Mr. Black said the dental and vision care could be added to the current policy for a yearly administration fee of approximately $1,800. The plan would be a $50 deductible for all basic and prosthodontics services, three deductible maximum per family and a $1,000 calendar year maximum. All preventive and diagnostic services would be covered 100%. Basic services would be covered 80% by insurance and 20% by the insured. Prothodontics would be covered 50% by insurance and 50% by the insured. Vision care would cover one routine vision exam per calendar year for $30.00 and pay the following: frames $40.00, single lens $40.00, bifocal lens $60.00, trifocal lens $75.00 and contact lens $100.00. Glasses or contacts are provided at one pair every two years. Mr. Black said he has not received the quote on the price of adding the preventive services to the current insurance. This would add pap smears, mamograms, prostate diagnosis, physical well baby check-ups, etc to the current policy. This would increase the amount the County would be paying in insurance claims. Mrs. Franklin said she would like the Commission to consider adding these benefits to the current insurance policy. If the Commission did not feel they had enough money budgeted for this year she would like to have them consider adding the benefits next year. A discussion was held on having the deductible raised on the health insurance to help cover the costs if the dental, vision and preventative care were added to the policy. The possibility of having the employees pay some of the costs was also discussed. It was the decision of the Commission to have Administrative Assistant Rick Bailey come up with a questionnaire to be included with the payroll to get the input from the County employees. A decision on increasing the insurance benefits will be made after the survey results are reviewed. 1992 Budget Adjustments Deputy Auditor John Fellmeth presented the necessary adjustments for the 1992 budget. A motion to approve the following resolution for 1992 budget adjustments was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Procurement Bids for a notebook computer for the Assessor were presented. Accord Systems bid $2369 for a Twin Head Sumnote 4-SX/25 notebook computer with extra battery pack. Compu Add Express bid $2494 for an Express 425 CXL Notebook with auto adapter. A motion to approve the bid from Accord Systems was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Bids for two marker boards for elections were presented. Quill Corporation bid $289.76 plus shipping for two 48"x96" boards. Viking Office Products bid $286.98 for two 48"x72" boards. This is the largest size that Viking carries. A motion to approve the bid from Quill because f the larger size was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Beer License A Beer License renewal was presented for Faye Belle's Dairy Cafe in Bluff. A motion to approve the renewal was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. San Juan Health Care Services District Board Members The following names were presented for possible appointment to the San Juan County Health Care Services Board: Nancy Cahoon, Ron Johnson, Sue Morrell, Bruce Shumway, Clancy Schmidt, James G. Norman, Ann E. Miller, Raymond T. Carney, Kevin Roberts, Nicola Ashton and Paul Westbrook. After a discussion it was the decision of the Commission to table the appointment until the Commission has talked with some of the applicants from the Monument Valley area. Zoning Hearing A public hearing was held to take public comments on a request to change the zoning in La Sal from Rural Residential (RR-22) to Agricultural (A-10). Protests to the change were heard from Steve Kosanke, Shannon Krist, Steve Deeter, Maxine Deeter, Horace Beeman and Bill Pierce. No comments were made in favor of the change. Due to the recognized economic need and the comments made by the neighbors in the area a motion to deny the change was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. A letter will be sent to Lee Cox advising that his request for a zoning change has been denied. Building Permit A building permit was presented for Lee Cox for a shop. A motion to approve the permit with the stipulation that the shop can only be used for residential purposes was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. State Centennial Committee An application for appointment as San Juan County's representative to the State Centennial Committee was received from Stan Johnson of Bluff. This matter was tabled until the next weeks meeting so that this matter could be researched further. Utah State Tax Commission Ross Barthlomew and Cal Rogers, State Tax Commission, met with the Commission and Assessor Bruce Bunker to discuss a Factor Order Stipulation. The factor order stipulation would approve the reappraisal of property in the La Sal area. A motion to approve the Stipulation was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Economic Development Economic Development Board Chairman Diane Nielson met with the Commission to discuss the economic development in the County. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Subdivision Ordinance Administrative Assistant Rick Bailey discussed with the Commission the need to pass a subdivision ordinance. Mr. Bailey has received subdivision ordinances from several counties to review. Mr. Bailey said he felt the County Ordinance could be modeled after several of the best ordinances. The Commission requested that Mr. Bailey send a memo to the people who are involved in subdivisions for there input. Mr. Bailey will present a draft ordinance after he receives the input from the memo. Bureau of Indian Affairs Administrative Assistant Rick Bailey said the meeting that was scheduled with the Shiprock BIA to discuss roads was canceled because of a water leak in the Shiprock office. The meeting will be rescheduled at a later date. Solid Waste Administrative Assistant Rick Bailey reported on the Solid Waste meeting that was held on December 21, 1992. Julie Orr, Indian Health Services, met with Mr. Bailey and the Commission to discuss the solid waste responsibility that IHS has on the Utah portion of the Navajo Reservation. The only responsibility that IHS has is the construction of a solid waste landfill and transfer stations. There is no IHS budget for the operation and maintenance of the landfill or the transfer stations. IHS is currently core testing on two Reservation sites in Tuba City, Arizona and Round Rock, New Mexico. IHS is working with the Navajo Nation and the Bureau of Indian Affairs for a cooperative agreement for the construction of the landfills and transfer station. IHS will participate in the construction of landfills and transfer stations in San Juan County based upon the indian population in the areas. IHS will be working with the Utah Chapters to operate the transfer stations once they are built. The Navajo Nation is considering a landfill in the Aneth area if suitable land can be found. Indian Health Services will be meeting with the Utah Chapter officials on January 11, 1993 to do a presentation on solid waste. The Utah State Division of Solid Waste will be in attendance to answer questions about Utah regulations on solid waste. PROCESS FACILATATOR EDWARD TAPAHA'S REPORT Navajo Nation Transportation District Process Facilatator Edward Tapaha said that a meeting with the Navajo Nation Transportation District and the Commission has been scheduled for January 19, 1993. Engineering, archeology and surveying of Chapter road projects will be discussed. The Utah Chapters road committees and the Bureau of Indian Affairs will also be invited to the meeting. Surplus Equipment Process Facilatator Edward Tapaha met with Wilbert Willie to discuss getting additional surplus equipment from the Chapters. Commissioner Maryboy said that Keith Begay has the necessary applications for surplus equipment and has told Commissioner Maryboy that there are graders, dump trucks and loaders available in Tooele, Utah. Emergency Equipment Process Facilatator Edward Tapaha said he has been working with Mike Nez, Emergency Coordinator Navajo Tribe, to help with the roads and livestock feed in the Navajo Mountain area. Mr. Tapaha talked with Mr. Nez about the Chapters using the funding from the Navajo Tribe to haul coal and livestock feed. Mr. Nez said that the funding could be used for this purpose. Commissioner Maryboy said that the Navajo Tribe has purchased ten semi trucks and ten graders. The equipment is available for the Chapters to use. Commissioner Maryboy requested that Administrative Assistant Rick Bailey send a letter to Larry Isaac, Utah Navajo Trust Fund Administrator, requesting matching funding for emergency situations. COMMISSIONER BILL REDD'S REPORT Oil Taxes Commissioner Redd and Commissioner Lewis met with Arlo Fawcett, ACCA, in Salt Lake City on December 23, 1992 to discuss oil company taxes. The proposal from Mr. Fawcett addresses taxing the reserves in the ground that have not been taxed. The information will be given to County Attorney Craig Halls to review. Governor-elect Leavitt Commissioner Redd and Commissioner Lewis met with Governor-elect Leavitt on December 23, 1992. The topics of discussion were Mineral Lease Funds, Monitored Retrievable Storage Facility, State Lands Trade and Economic Affairs in San Juan County. Commissioner Redd said the media was present at the meeting and he did not feel that the County had a very favorable hearing on the MRS issue. Mr. Leavitt said he would like to talk to the other Governors that have not supported the MRS study before he makes a decision on allowing San Juan County to continue with the study. A discussion was held concerning items that the County may request the Governor help to accomplish in San Juan County if he stops the MRS study. Travel Commissioner Redd will be attending a hearing on the Kerry Shumway lawsuit in Salt Lake City on December 29, 1992 with Commissioner Lewis and County Attorney Craig Halls. COMMISSIONER MARK MARYBOY'S REPORT Navajo Nation Commissioner Maryboy traveled to Window Rock, Arizona to follow up on funding for the Utah Chapters. Commissioner Maryboy sent a memo to Navajo Division of Public Safety and Attorney General concerning the switching over of the Emergency 911 system to the Navajo Tribe. Commissioner Maryboy has received no response on the memo. Utah Association for Gifted Children Commissioner Maryboy has been chosen to receive a Community Service Award from the Utah Association of Gifted Children. The presentation will be made on January 30, 1992. Utah Navajo Trust Fund The Utah Navajo Trust Fund has awarded $500,000 to the College of Eastern Utah Scholarship Endowment Trust Fund. The agreement on the funding was modified to include the concerns of the Utah Navajos about the use of the money. Travel Commissioner Maryboy will be in Window Rock on December 29-30, 1992 to do some additional follow-up on San Juan County projects. Rural Utah Public Lands Commissioner Lewis received a proposal from Bob Weidner, Senator Garn's Office, on Rural Utah Public Lands. The proposal involves better corridination with the federal government to help rural counties on public land issues in Washington D.C. Public Lands A proposal was received from Utah Association of Counties President Tom Hatch concerning the counties funding a public lands person. Administrative Assistant Rick Bailey will write a letter to Mr. Hatch indicating the funding for this position has already been established on an Association of Counties level. Western Network The final billing in the amount of $30,266.92 was received from Lucy Moore, Western Network, for the work on the Monitored Retrievable Storage Facility study. A motion to approve the payment was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Travel Commissioner Lewis will be attending a hearing on the Kerry Shumway lawsuit in Salt Lake City on December 29, 1992 with Commissioner Redd and County Attorney Craig Halls.
