SAN JUAN COUNTY COMMISSION MEETING MINUTES February 1, 1993 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice Chairman Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk Excused: Bill Redd, Commissioner A motion to approve the minutes of the January 25, 1993 meeting as written was made by Commissioner Maryboy and seconded by Commissioner Lewis. UNANIMOUS. CURRENT BUSINESS San Juan Health Care Services District/Board Members The following people have applied for appointment for the San Juan Health Care Services District Board. Ron Johnson, Nancy Cahoon and Sue Morrell from Monticello and Bruce Shumway from Blanding. With the new alignment of the Board passed at last weeks meeting two members need to be appointed from Monticello and one member from Blanding. The additional member from the southern part of the County will have to be advertised before an appointment can be made. A motion to reappoint the three members currently serving on the Board, Ron Johnson, Nancy Cahoon and Bruce Shumway, was made by Commissioner Maryboy and seconded by Commissioner Lewis. UNANIMOUS. These members will serve four year terms that will be retroactive to January 1, 1993 and will expire on December 31, 1996. San Juan Health District/Tax Anticipation Notes San Juan Hospital Financial Officer Larry Lee met with the Commission to discuss the Tax Anticipation Notes of the San Juan Health Care Services District. The following resolution was presented for the approval and signature of the Commission: RESOLUTION NO. 1993-2 RESOLUTION AUTHORIZING THE EXECUTION OF A CERTIFICATE OF ALLOCATION TO ALLOCATE TO THE SAN JUAN HEALTH DISTRICT, SAN JUAN COUNTY, UTAH A PORTION OF THE COUNTY'S $5,000,000 SMALL ISSUE LIMITATION UNDER INTERNAL REVENUE CODE SECTION 148 (f) (4) (d) AND AUTHORIZING THE ADMINISTRATIVE CONTROL BOARD OF SAN JUAN COUNTY HEALTH DISTRICT TO ISSUE ITS TAX AND REVENUE ANTICIPATION NOTES, SERIES 1993 IN AN AMOUNT NOT TO EXCEED $425,000. WHEREAS, San Juan County Health District, San Juan County, Utah (the "District") desires to issue and sell its tax and revenue anticipation notes, Series 1993 in the aggregate principal amount of $425,000 (the "Notes"); and WHEREAS, for purposes of Section 148(f)(4)(C) of the Internal Revenue Code of 1986, as amended (the "Code"), the District is deemed to be a "subordinate entity" to san Juan County, Utah (the "County"); and WHEREAS, Code Section 148 (f)(4)(C) provides that the County, should it so elect, may allocate a portion of its $5,000,000 small issue limitation to the district so that the District's Bonds would not be subject to the provisions of Code Section 148 (F) with respect to arbitrage rebate; and WHEREAS, the members of the Board of County Commission (the "Board") have determined that it is in the best interest of the county to allocate a portion of its $5,000,000 small issue limitation to the District for the calendar year 1993; and WHEREAS, a certificate of allocation effecting such allocation (the "Certificate") has been prepared, and it is considered desirable that the Chairman of the Board be authorized to execute said Certificate on behalf of the County. NOW, THEREFORE, Be it Resolved by the Board of County Commissioners of San Juan County, Utah as follows: Section 1. In accordance with Sections 11-14-19.7 and 17A-2-1326, Utah Code Annotated 1953, as amended, the Administrative Control Board of San Juan Health District (the "District") is hereby authorized to issue its Tax Anticipation Notes, Series 1993 in an amount of not to exceed $425,000 (the "Notes"), substantially in accordance with the terms and conditions of the Note Resolution the form of which is attached hereto as Exhibit "A". Section 2. The officers of the District are hereby authorized to execute any and all documents necessary for the issuance, sale and delivery of the Notes. Section 3. The County hereby acknowledges its willingness to allocate to the District for calendar year 1993 up to $425,000 of its $5,000,000 small issue limitation in accordance with Code Section 148 (f)(4)(C). Section 4. The Certificate attached hereto as Exhibit "D" is hereby approved and the execution thereof by the Chairman on behalf of the County is hereby authorized. Section 5. Immediately after its adoption, this resolution shall be signed by the Chairman of the Board and the County Clerk. Section 6. All resolutions and parts thereof in conflict herewith are hereby repealed to the extent of such conflict. Section 7. The Board considers that this resolution is in the best interest of the County, and therefore, it shall become effective immediately upon its PASSAGE, APPROVAL AND ADOPTION. Northern Clerk (SEAL) A motion to approve the Resolution and the signing was made by Commissioner Maryboy and seconded by Commissioner Lewis. UNANIMOUS Sheriff's Department Sheriff Claude Lacy, Jail Commander Bill Christensen and Deputy Jail Commander Kelly Bradford met with the Commission to discuss the position of lead shifter for the jail. A proposal has been made to create three lead shifter positions. The lead shifter would have the rank of corporal and would receive an additional $75 per month salary. The Commission requested that the Sheriff's Department bring their proposal back next week when all of the commission is present. Commissioner Lewis asked that the proposal include a Grade and Step increase instead of a monetary figure. Mr. Christensen said the cross-deputization agreement with the Navajo Nation has not been received by the Sheriff's Department. Sheriff Lacy told the Commission that he currently only has one deputy in the southern part of the County. When the cross deputization agreement is finalized there will need to be three deputies in the southern part of the County. Commissioner Maryboy said he is working with the Navajo Tribe to get a Navajo Police Officer stationed in San Juan County. Sheriff Lacy said he is in the process of advertising for a Deputy Sheriff to replace Rudy Cook. Sheriff Lacy said he will fill a roster after the testing. Sheriff Lacy said depending on how the roster goes he may hire within the department or outside of the department. Sheriff Lacy said he will be appointing a Supervisor for the Road Deputies in the near future. This appointment will be made from in the department. Sheriff Lacy said he is currently checking to see if this position could be an exempt position. Beer License/Needles Outpost An application for a beer license renewal was presented for the Needles Outpost. A motion to approve the renewal was made by Commissioner Maryboy and seconded by Commissioner Lewis. UNANIMOUS. San Juan County Transportation District/Board Members A motion to appoint Eugene Foushee and Val Dalton as members of the San Juan County Transportation Service District was made by Commissioner Maryboy and seconded by Commissioner Lewis. UNANIMOUS. These appointments are for four years and will expire on December 31, 1996. Out-of-State Travel Request An out-of-state travel request was presented for Kelly Bradford to attend training with the Federal Emergency Management Administration in Maryland on February 17-23, 1993. The costs with the exception of per diem will be reimbursed by the State CEM. A motion to approve the request was made by Commissioner Maryboy and seconded by Commissioner Lewis. UNANIMOUS. A request for out-of-state travel was presented for Peggy Humphreys to attend the Minneapolis Travel Show to be held in Minneapolis, Minnesota on February 9-15, 1993. A motion to approve the request was made by Commissioner Maryboy and seconded by Commissioner Lewis. UNANIMOUS. D Roads Cleal Bradford, San Juan Foundation, met with the Commission to discuss the mapping and documentation of D roads in the County. Mr. Bradford wanted to know if the oral histories and affidavits for roads in the wilderness study area needed to be done. Mr. Bradford said he felt that the oral histories for these areas need to be done by someone with a good background of the area so that the roads will have good documentation. The Commission will make a decision on which areas they feel need to have oral histories. Utah Navajo Development Council Cleal Bradford told the Commission that he has been working with the Utah Navajo Development Council to get their outstanding bills paid. Mr. Bradford said that some of the billings that are being charged to UNDC are not their bills. Theses billings are for items at the Health Clinics that were taken over by Indian Health Services. Mr. Bradford said that UNDC is trying to get all of the bills that they feel they owe paid off. A discussion was held concerning the Utah Navajo Fair and the outstanding bills. Commissioner Maryboy said he is concerned that the audit report received from the Fair for 1991 indicated that there were funds left to be carried over to the next year and now there are outstanding bills. Commissioner Maryboy said he would like to know what happened to all of the proceeds made at the fair. The Commission was advised that Albert Mark has resigned as Utah Navajo Fair Chairman effective January 27, 1993. No new appointment has been made. A discussion was held concerning the claims being filed for compensation for illness and death associated with uranium mining. Mr. Bradford said he had written several letters to help document times that several Native American worked at the mines in the area. Administrative Assistant Rick Bailey said that Senator Hatch is concerned with the process for filing for these claims and is willing to intervene in behalf of the Native Americans. Mr. Bailey will send a letter to Senator Hatch outlining some of the problems that have been encountered in filing the claims. CDL Testing Road Office Manager Wanda Franklin, Gary Phelps, Utah Valley Community College and Dennis Bradford, College of Eastern Utah-San Juan Center, met with the Commission to discuss a new CDL literacy program that has been installed at the road department by UVCC. Mr. Phelps said the computer programs have been developed to help people studying to take their CDL exams. The computer programs allow them to work at their own speed. Carl Osborn, San Juan School District, will be assisting with this program. Mr. Bradford said he CEU-San Juan Center is presently offering truck driver training in Mexican Hat. Those people who are enrolled in the course will have their CDL license after they finish the course. County Road Signs The Commission discussed with County Attorney Craig Halls the possibility of offering a reward for damage, removal or defacing of County road signs. There has been a lot of the signs removed or damaged all over the County. Mr. Halls said the Commission could authorize a reward for information leading to the arrest and conviction of any person damaging, removing or destroying county road signs. Information will have to be reported to the Sheriff's Department. Administrative Assistant Rick Bailey will work on this matter. Time Off The Commission discussed with County Attorney Craig Halls time off for County employees. The need to define time off an what constitutes sick leave, vacation and all purpose needs to be defined. THe criteria for taking time off need to be established. The Commission ask that Administrative Assistant Rick Bailey compare time off with the State policy and bring a recommendation back to the Commission. Procurement Bids for a 9000 lb. Warn Winch with a roller and combo kit were presented for Emergency Services. Hayes Brothers bid $1104.00 and Sears bid $1349.97. A motion to approve the bid from Hayes Brothers was made by Commissioner Maryboy and seconded by Commissioner Lewis. UNANIMOUS. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Right-of-Way Application/South Hatch Road Administrative Assistant Rick Bailey presented the right-of-way application for the South Hatch road for the signature and approval of the Commission. A motion to approve the application and the signing was made by Commissioner Maryboy and seconded by Commissioner Lewis. UNANIMOUS. Aneth to Ismay Road Administrative Assistant Rick Bailey said that the preconstruction hearing presented by Creamer and Noble Engineers for the Aneth to Ismay project was held last week. Both of the contractors were represented at the hearings. Engineer Doug Pehrson represented San Juan County at the hearings. Creamer and Noble Engineers interviewed twelve local people for positions on the construction. Creamer and Noble started the surveying on the project last week. State Attorney General Administrative Assistant Rick Bailey said a meeting with the State Attorney General has been set for February 5, 1993 from 2:00 P.M. to 4:00 P.M. at the State Capital. This meeting will be held to discuss jurisdictional problems with San Juan County and the Navajo Tribe. Larry Isaac, Utah Navajo Trust Fund Administrator, Will Nukemia, Utah Division of Indian Affairs, State Senator Mike Dmetrich and Representative Keele Johnson have been invited to attend the meeting. Division of Wildlife Resources/Elk Management Plan A copy of the Division of Wildlife Resources Elk Management Plan for the Abajo Mountain Unit was received. The Commission will review the plan and make comments. San Juan County Special Service District #1 Administrative Assistant Rick Bailey said a letter was received from the Mexican Hat Lodge expressing concerns over the San Juan County Special Service District #1. A request was made that a member of the Commission attend the next Board meeting. Commissioner Maryboy and Mr. Bailey will plan to attend. Solid Waste Administrative Assistant Rick Bailey said that the core drilling on the White Mesa Hill solid waste site was done last week. The cores are being tested. A billing will be coming from Brian Brimner for the drilling for about $6,000. Mr. Bailey asked for authorization to make the payment when the billing is received. A motion to approve this request was made by Commissioner Maryboy and seconded by Commissioner Lewis. UNANIMOUS. Southeastern Utah Development District Administrative Assistant Rick Bailey presented a letter of support and resolution for continuing the Southeastern Utah Development District and its economic development plan and work program for the approval and signature of the Commission. A motion to approve the resolution and letter and the signing was made by Commissioner Maryboy and seconded by Commissioner Lewis. UNANIMOUS. RESOLUTION 1993-3 A RESOLUTION OF THE SAN JUAN COUNTY COMMISSION SUPPORTING CONTINUATION OF THE SOUTHEASTERN UTAH ECONOMIC DEVELOPMENT DISTRICT AND ITS OVERALL ECONOMIC DEVELOPMENT PLAN AND WORK PROGRAM. Be it resolved that the San Juan County Commission, the Chairman concurring therein: WHEREAS, The area is chronically distressed, failing to keep pace with national economic growth trends over the past five years with high unemployment and decreased per capita income; and WHEREAS, Many businesses and industries in the county have suffered economic reversals and worker dislocation has occurred; and WHEREAS, Alternatives need to be developed for the employment of these and other workers in the District and for the revitalization of its business communities; and WHEREAS, An Economic Adjustment Strategy Program proposed by the Southeastern Utah Economic Development District has been targeted for implementation in Southeastern Utah that will stimulate commercial and industrial activity and increase the employment of dislocated workers, minorities and women and provide self-employment opportunities and assistance to disadvantaged small businesses; and WHEREAS, The Southeastern Utah Economic Development District Overall Economic Development Plan and subsequent Work Program for 1993-94 proposes actions to implementation programs to reverse the adverse economic conditions of the District through relevant development strategies and appropriate projects following the strategic economic planning process; and WHEREAS, The Southeastern Utah Economic Development District has the capacity and staff expertise to administer and direct the planning activities on behalf of the communities of Southeastern Utah and the Southeastern Utah Economic Development District staff has prepared a grant application on behalf of the Economic Development District; NOW THEREFORE, BE IT RESOLVED that the San Juan County Commission, in regular meeting assembled go on record as supporting the continuation of planning activities of the Southeastern Utah Economic Development District and urge acceptance of the District's planning grant application to the U.S. Economic Development Administration. BE IT FURTHER RESOLVED that a copy of this resolution be prepared and forwarded to the U.S. Economic Development Administration. /s/ Ty Lewis 2/1/93 Chairman, San Juan County Commission Date Street Lights Administrative Assistant Rick Bailey said he has been investigating the request by a Spanish Valley resident for a street light. Mr. Bailey said Grand County does provide street lights at a main intersection with a State Road. The area that the street light has been requested in is not an intersection with the State road and is not in Grand County. Utah Power and Light does not provide street lights. San Juan County has not provided street lights. The Commission asked that Mr. Bailey inform the resident that the a street light for security reasons is the responsibility if the resident. COMMISSIONER MARK MARYBOY'S REPORT Gifted Children's Award Commissioner Maryboy said he went to Salt Lake City on January 30, 1993 to receive an award from the Gifted Children's Association. Commissioner Maryboy missed the ceremonies as they were held on January 29, 1993. Road Matter Commissioner Maryboy said that County road #212 needs to be graded. The road is in very bad condition. Commissioner Maryboy said the Stormy Redoor road near Bluff needs to be graded. The Commission will check to see if this road is on the County B road system. Travel Commissioner Maryboy will be attending the meeting with the Attorney General in Salt Lake City on February 5, 1993. Commissioner Maryboy will be attending a meeting of the Navajo Tribal Budget and Finance Committee on February 2-3, 1993. The total operational budget in the amount of $101,636,218.00 has been approved for the Navajo Nation. An additional $7,000,000.00 is expected to be received and used for supplemental funding. COMMISSIONER TY LEWIS' REPORT San Juan County Transportation Service District Commissioner Lewis attended a meeting of the San Juan County Transportation Service District on January 26, 1993. The patching of roads was discussed. Commissioner Lewis would like to discuss this issue when a full Commission is present. Travel Commissioner Lewis will be attending the Community Impact Board on February 4, 1993. Commissioner Lewis will be attending the meeting at the Attorney General's Office on February 5, 1993.
