SAN JUAN COUNTY COMMISSION MEETING MINUTES February 16, 1993 The regular meeting of the San Juan County Commission was held in the commission chambers at Monticello, Utah. Present: Ty Lewis, Chairman Bill Redd, Commissioner Dena Hunter, Deputy Clerk Excused: Mark Maryboy, Vice Chairman Rick Bailey, Administrative Assistant A motion to approve the minutes of the February 8, 1993 meeting as amended was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. CURRENT BUSINESS Sheriff's Department Sheriff Claude Lacy, Jail Commander Bill Christensen and Assistant Jail Commander Kelly Bradford met with the Commission to discuss matters in the Sheriff's Department. Sheriff Lacy said that Liz Bradford has applied for unemployment. Mrs. Bradford quit her job as a cook in the jail. An unemployment hearing has been scheduled. Sheriff Lacy said he has advertised for dealers to handle the sale of the guns that have been turned over to his department by the Federal Bureau of Investigation. The sale to the public will be held within the next three months. Sheriff Lacy, Mr. Christensen and Mr. Bradford again discussed creating the rank of a Corporal for a lead shifter position in the jail. This position would give the three persons selected a three Step increase in salary. Mr. Christensen said they would like to try this rank and position for a six month period. At the end of the six month period the Sheriff's Department would review the position and how it is working with the Commission. A motion to approve appointing three Corporals and giving them a three Step increase on the condition that an agreement is signed stating that if they are no longer holding the position they agree to return to their former pay was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. This will be for a six month trial period beginning March 1, 1993. The Sheriff's Office must review this position in September 1993. Sheriff Lacy said he discussed with Attorney Lynn Lund the possibility of making the Lieutenant position for the jail and the Road Deputy an exempt position. This would exempt those employees from overtime. Mr. Lund has indicated that this position could be exempted according to the Fair Labor and Standards Act. Sheriff Lacy asked that the Commission discuss this matter with County Attorney Craig Halls and change the policy. Sheriff Lacy said that Sherry Eldredge has been working over the hours for usual part- time help. Sheriff Lacy told the Commission that Mrs. Eldredge would be back to under thirty hours once the new road deputy is hired and the other personnel finish their schooling. A discussion was held on the cost of sending Sheriff's Department personnel to the Academy and then the employee leaving after they have been trained. The Commission will discuss with County Attorney Craig Halls the possibility of requiring the employees to pay part of the cost of the Academy or signing an agreement that they will stay with the County for a certain period of time. Sheriff Lacy said if the Cross-Deputization Agreement with the Navajo Tribe is signed he will need to have three Deputies in the Bluff area. If the Agreement is not signed Sheriff Lacy plans to move one of the Deputies to Blanding. Sheriff Lacy said he is advertising to fill the position of Deputy Sheriff. Mr. Christensen said the computer at the jail is still experiencing some dumping problems. The computer expert from Grand Junction, Colorado feels that the system was not installed correctly. The cost to do the repairs will be approximately $1000. The Commission asked Mr. Christensen to discuss this matter with Data Processing Specialist John Fellmeth before a decision is made. Sheriff Lacy said the Monticello City Council met with the Sheriff's Department concerning the sewer system at the jail. The City Council is requesting that the County install a grinder in the line leaving the jail. Sheriff Lacy and Maintenance Supervisor Dell Hunter said there have not been any problems in the sewer line from the jail to the City sewer. A representative from the Monticello City was to be at the meeting to discuss this matter. The Commission said the problem must be in the City line and that they feel it is a City problem not a County problem. Monticello Cemetery District The only application received for appointment to the Monticello Cemetery District was from Darroll Young. A motion to appoint Mr. Young to a four year term that will expire on December 31, 1996 was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Road Shop Policy The Road Shop Policy that will allow the road shop foreman the ability to schedule the work to be preformed in the road shops was presented for the approval and signature of the Commission. A motion to approve the policy and the signing was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS Transient Room Tax The Ordinance to increase the Transient Room Tax to 3% was presented for the approval of the Commission. The matter was tabled until the next meeting so that the clause earmarking 1% of the tax to be used for infrastructure could be added to the Ordinance. Road Department/Oil Bids The road department has been informed by Woody's Petroleum of a price increase over the bid price that was awarded to them for oil. The letter advising of the price increase was received three days after the bids were awarded. County Attorney Craig Halls said that he will write a letter to Woody's informing them if they do not comply with the awarded bid price the oil will be purchased from the other bidder. Blanding Senior Citizens Center A call was received from Blanding Senior Citizens Director Ruby Bronson expressing concern over some of the planned changes with the Americans With Disabilities construction. The Commission discussed these changes with Maintenance Supervisor Dell Hunter and Aging Director Frank Morrell. Mr. Hunter said the changes that Mrs. Bronson is requesting have already been made. Out-of-State Travel A request for out-of-state travel was presented for Peggy Humphreys to attend a Film Development Seminar in Los Angeles, California from February 26 to March 1, 1993. A motion to approve the request was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Executive Session A motion to convene into executive session to discuss personnel matter with South Road Foreman Lynn Laws and Office Manager Wanda Franklin was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. A motion to reconvene into regular session was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Employee Private Business The Commission requested that a memo be sent to all County employees advising that there shall be no private business conducted on County time. The use of the County name for private business purchases will not be tolerated as per the County Personnel Policy. PROCESS FACILATATOR EDWARD TAPAHA'S REPORT Navajo Nation President Process Facilatator Edward Tapaha met with Navajo Nation President Peterson Zah on February 4, 1993. Health care issues and establishing a clinic at Red Mesa were discussed. Mr. Tapaha stressed the immediate need for a clinic at Navajo Mountain. The road condition from Inscription House to Navajo Mountain prevents the Navajo Mountain residents from traveling to the clinic at Inscription House. A discussion was held on the need to establish a Utah Navajo Agency and road and air quality problems in the Aneth and Montezuma Creek area. Economic Development Process Facilatator Edward Tapaha talked with Alan Begay concerning economic development on the Utah portion of the Navajo Reservation. Mr. Begay said the Chapters must do a land track withdrawl before a business can be established. A meeting is being planned to discuss economic development with Navajo Nation Vice President Marshall Plummer. Emergency Management Plan Process Facilatator Edward Tapaha said he has been working on scheduling a meeting with the oil companies on the Utah Navajo Reservation and the Aneth, Red Mesa, Tec Nos Pos and Mexican Water Chapters to discuss the oil companies Emergency Management Plan. The meeting was planned for February 19, 1993 but will have to be rescheduled. Mr. Tapaha met with Chavez Nez, Business Compliance Officer, on February 12, 1993 to discuss the oil companies regulations and the Chapter Marketing Plans. Mr. Nez will provide Mr. Tapaha with a list of the Navajo Preference hiring by the oil companies so that Mr. Tapaha can present a copy to each Chapter. Meetings Process Facilatator Edward Tapaha will be attending a Navajo Mountain Chapter Meeting on February 20 1993. Mr. Tapaha said there will be a meeting of the Utah Navajo Trust Fund on February 22, 1993 in Salt Lake City. COMMISSIONER BILL REDD'S REPORT State Land Board Commissioner Redd attended a meeting of the State Land Board on February 11, 1993. An update was given on the State Land Trade. The legislation to purchase right-of-ways with sovereign money was also discussed. Assessing and Collecting Commissioner Redd attended a meeting of the Assessing and Collecting Legislative Committee. Three bills concerning assessing and collecting have been introduced to the State Legislature. Commissioner Redd said the Bill introduced by Representative Mel Brown will give each County their own mil levy. Commissioner Redd said he talked with Representative Brown and felt this is a good bill for the County to support. Travel Commissioner Redd will be attending a Utah Association of Counties Multi-County Appraisal Trust meeting on February 17, 1993. Commissioner Redd will attend a Utah Association of Counties Comprehensive Land Planning meeting on February 18, 1993. Commissioner Redd will attend a meeting with the Attorney General's Office on February 18, 1993 to discuss jurisdiction issues. COMMISSIONER TY LEWIS' REPORT Solid Waste Commissioner Lewis met with Julie Orr, Indian Health Services and the Chapter Officials on February 8, 1992 to discuss solid waste. Ms. Orr said that IHS will participate with solid waste in areas that deal with the Navajo Reservation. Commissioner Lewis and Administrative Assistant Rick Bailey will meet with ARA Liesure Services at Halls Crossing on February 17, 1993 to discuss closing the landfill and a shuttle service to the airport. Association of Governments Commissioner Lewis will attend an AOG meeting in Price on February 19, 1993 .
