SAN JUAN COUNTY COMMISSION MEETING MINUTES March 8, 1993 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present: Ty Lewis, Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk Excused: Mark Maryboy, Vice Chairman A motion to approve the minutes of the February 22, 1993 meeting as amended was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. CURRENT BUSINESS Mobil Oil Company Jerome Walker, Loss Prevention Engineer, Ernie Thomas, Environmental Technician, Herbert Keams, Loss Prevention Technician, and Earl Ahtsosie, Aneth Plant Manager with Mobil Oil Company and Paul George, Navajo Occupational Safety and Health Act Officer, met with the Commission to discuss the emergency response provided by the County in the event of a fire at the Mobil Oil Facility. Mr. Walker reviewed what happened at the recent fire at the Mobil facility. Mr. Walker said the Mobil dispatcher contacted the Cortez dispatcher who then contacted the San Juan County dispatcher. Rick Bailey, San Juan County Emergency Management Systems Director, said that all of the fire departments for the County are volunteer. The Montezuma Creek department does not have radios and pagers to contact all of the people in the event of a fire. Mr. Bailey said the Navajo Tribe has budgeted for pagers and radios for the fire department but the County has not received the funding for the equipment. Mr. Keams said that Mobil's main concern is not having a fire department that they can depend on to respond immediately in the event of a fire. Mobil was asked if they would be willing to purchase the needed pagers and radios for the Montezuma Creek Fire Department so that the volunteers could be notified in the event of a fire. Mr. Walker said he would see if Mobil would fund these items. Mr. Bailey said that San Juan County would respond to any emergency situation that happens within the County. Mr. Bailey said that he has no jurisdiction on the Navajo Reservation but would still respond. The clean up of the area would have to be the responsibility of the Navajo Tribe. San Juan County or the State of Utah would not take this responsibility. Mr. George said that representatives from the Navajo Public Safety and Navajo Environmental Protection Agency were to be at the meeting today. Mr. George said there is no one in the offices to report problems to on the weekends. Mr. Thomas said he has been told to leave a message on the answering machine when there is a problem on the weekends. Mr. Walker said he felt Mobil Oil and the State of Utah need to have a Memorandum of Understanding for the protection of the people in the area. Mr. Bailey said that he is in the process of updating the Emergency Response and Hazardous Material Plan for the County. When the plans are ready for review a copy of the plan will be sent to Mobil Oil for their review. San Juan Historical Society Dawn Boyle, Corinne Roring and Joyce Martin, San Juan Historical Society, met with the Commission to discuss the State Historical Convention that they attended. The requirements for the Americans With Disabilities Act for historical buildings was discussed. The Historical Society would like to nominate the old part of the Courthouse for the National Register of Historic Places. The ADA guidelines that are established for historical buildings are less than for other buildings. The Commission said the bids for the ADA remodeling have been awarded and the work has been started. The Commission also said they were aware of the ADA guidelines for buildings three stories high or less. The Commission gave their approval to the request to nominate the Courthouse to the National Register of Historic Places. The Commission requested that the Historical Society find out what restrictions are placed on buildings listed in the National Register. A discussion was held on forming a County Committee for the State Centennial. The Commission said they had advertised for persons interested in serving on the State Committee as the County representative. Stan Johnson of Bluff was the only applicant. The Commission nominated Mr. Johnson as a member of the State Centennial Committee. The Commission said that Mr. Johnson expressed a desire to serve on a County State Centennial Committee. The Commission asked the Historical Society to discuss forming a County State Centennial Committee at their next Board meeting. Mrs. Martin and Peggy Humphreys, Travel Council Director, discussed the State Scenic Highways and Byways program and the Highway Enhancement program with the Commission. Both of these programs are federal funded and are administered through the Utah Travel Council and the Utah Department of Transportation. Commissioner Lewis will be attending a Joint Highway Committee meeting and will find out more information on these programs. Mrs. Martin said the interest level for both of these programs is very high. State Parks Max Jensen and Steve Olsen, State Park Service, met with the Commission to discuss Newspaper Rock State Park. Mr. Jensen said that State Parks has decided to turn the Park over to the Bureau of Land Management. The State has forty acres at Newspaper Rock and is asking the BLM to transfer this land for land at Goosenecks State Park. Mr. Jensen said that State Parks currently has ten acres at the Goosenecks and five of those acres are under the rim. State Parks does not have plans to do any expansion in the near future at Goosenecks but would like to have the land for an expansion as the area is showing 50,000 visitors per year. Mr. Jensen requested a letter of support for this trade from the Commission. Blanding City manager Norman Johnson said he would like to see the State Park Service request some land around Recapture Reservoir and develop a State Park. Ken Sleight said he would not support a land exchange for areas away from the cities and towns. Mr. Sleight said he felt that there are enough visitors centers in the County. The development needs to be made where the cities and towns can benefit from the tourism. The Commission said that they will write a letter of support for the trade but would include the Recapture project be considered as a viable alternative in the letter. A discussion was held on the Edge of the Cedars expansion. Mr. Olsen said the work is about 60 days behind schedule. There should be two exhibit halls opened by the Easter weekend. The project and parking lot should be finished by mid July. The dedication is being planned for July or August. Mr. Jensen said that the State Park Service would like to have Governor Leavitt attend the dedication. Montezuma Creek Police Station Ben Tahe, Federal Bureau of Investigation, met with the Commission to discuss water problems at the Montezuma Creek Police Station. The water line going into the building has deteriorated and needs to be replaced. The agreement with the County states that the FBI would be responsible for the maintenance and repairs to the building. Mr. Tahe said he did not feel this covered major repairs but, the FBI was willing to pay half of the cost of the repair. Bayles Plumbing has estimated the repairs will cost approximately $1500. A motion to participate in a 50/50 cost share on the repairing of the pipe was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Mr. Tahe said the FBI would bill the county for their portion of the costs when the work is completed. Blanding City Land Deed Norman Johnson, Blanding City Manager, met with the Commission to discuss a land deed to Blanding City. Mr. Johnson said the City has sent a check to the County Clerk for the back taxes owing on the parcel. The Commission said they had held up recording the deed until the proposed Dinosaur Museum developers could talk with the City. Mr. Johnson said that the City has already made the trade for the land they needed with Vance Seeley. The museum developers have already talked to Mr. Seeley about the portion of land that the City will trade to him. The Commission instructed Deputy Clerk Dena Hunter to have the deed for the land recorded and deposit the money. Mr. Johnson said he would like to schedule a meeting with the Commission, road department and the City of Blanding to discuss road projects in the City of Blanding for this year. Mr. Johnson will coordinate this meeting with Administrative Assistant Rick Bailey. La Sal Recreation Bill Pierce, La Sal Recreation Board Member, met with the Commission to advise them of the official ribbon cutting ceremonies for the La Sal Recreation Building, The ceremonies will be held on March 27, 1993. Mr. Pierce said the La Sal Recreation is planning to hold the First Annual Cinco de Mayo day this May. The celebration is planned for Saturday May 8. Mr. Pierce requested a resolution of endorsement for the celebration from the Commission. A resolution of support will be drafted and presented at a future meeting. Building Permit A building permit for a foundation and electrical inspection for Suzanne Herman for a mobile home in Bluff was presented. A motion to approve the permit with the stipulation that it have the approval of the Bluff Service Area was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. San Juan Health Care Service District/Board Member Appointed A motion to appoint Anne E. Miller to be the fifth member of the San Juan Health Care Services Board was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. The term of appointment will be discussed with County Attorney Craig Halls. Monticello City/Jail Sewer Monticello City Mayor Jack Young, City Administrator Rick Terry and Councilman Gary Dunow met with the Commission to discuss sewer problems at the jail. Mr. Terry read parts of City Ordinance 1981-1 which deals with obstruction to the flow of sewer. There have been two serious plugs in the sewer line since the Public Safety Building has been in operation. Sheriff Lacy was contacted in both instances. Mayor Young said he felt the City needs to replace some of the line that is causing a problem in the future. It was requested that the County screen the sewer leaving the Public Safety Building to prevent problems. Commissioner Lewis asked if the City was going to require that all large users such as schools, motels etc. screen their sewers also. Maintenance Supervisor Dell Hunter said he did not feel the entire problem was caused by the Public Safety Building. Other sewer users could be flushing large items down the sewer also. County Attorney Craig Halls asked how a building could be sued for violation of the Ordinance. Mr. Halls requested a copy of the sited Ordinance to review. Mayor Young said the City would do some more work on the solution to the problem and return to the Commission at a later date. Tax Exempt Request Steven and Sylvia Czerkas met with the Commission to request a tax exempt status for their property that will be used for the Dinosaur Museum. Assessor Bruce Bunker indiacted to the Commission that he has met with the Czerkas'and discussed the tax exempt request. A motion to approve this request was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Mr. & Mrs. Czerkas updated the Commission on the status of the museum. The large parcel of land that was previously owned by 21st Century has been deeded to the Czerkas' by Aero Industries. Clerk-Auditor Gail Northern said the parcel is up for the May Tax Sale for delinquent taxes. The Czerkas' requested that the back taxes that were assessed high for the years 1988-1990 be adjusted for the condition of the property. They would then pay the back taxes which would prevent the parcel from going to tax sale. A motion to allow the Assessor to adjust the taxes was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Mrs. Northern said there is another parcel that is owned by 21st Century that will be on the May Tax Sale. The Czerkas' said they are working on getting a corrected deed for this property with Aero Industries. Once the deed is corrected the deed will be recorded and the taxes paid. Assessor Bruce Bunker presented a tax exempt request for the Church of Jesus Christ of Latter-Day Saints. A motion to approve this request was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Oil Bid County Attorney Craig Halls said he has talked with Carl Hunt, Woody's Petroleum, about the price increase on the oil bid. Mr. Hunt said the prices were increased on some items. Not all items that he received a price increase for were on the bid list. The increase only effected one of the bid prices. With the increase the bid price was still lower than the bid received from the other vendor. The Commission requested that the oil bids be an agenda item for next weeks commission meeting. Financial Statement Clerk-Auditor Gail Northern and Deputy Auditor John Fellmeth met with the Commission to discuss the financial statement for the County. Mr. Fellmeth expressed his concern over the deteriorating financial condition of the General Fund. Mr. Fellmeth gave the commission a comparison of the General Fund using prior years expenditures. Retirement Benefits/Elected Officials Clerk-Auditor Gail Northern presented the following policy on retirement benefits for elected officials for the approval of the Commission: RETIREMENT BENEFITS (ELECTED OFFICIALS) Elected Officials of San Juan County may choose one of the following Retirement contribution options. 1. State Retirement System 2. Equitable 457 Plan 3. Payment in cash after taxes and full Social Security contribution. A motion to approve the policy was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Utah Navajo Fair Roselyn Maryboy, Leonard Lee and Rebecca Benally met with the Commission to discuss the Utah Navajo Fair. A discussion was held on the land that has been previously leased for the fair. The Utah Navajo Development Council now owns part of this land. There may be a problem moving some of the equipment from this land. The fair board is trying to move the fair to Navajo Tribal Land near Montezuma Creek. The Board only needs one signature before they request the land from Navajo Land Administration. The Fair Board will meet with the Navajo Tribe to discuss the funding from the Tribe for the fair this year. Pickup Repair South Road Foreman Lynn Laws and Office Manager Wanda Franklin presented the bids for the repairs to County Pickup #121. Sealed bids were accepted for this repair. Black's Auto Body bid $954.73 and Skyline Auto bid $923.33. A motion to approve the bid from Skyline Auto was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Asphalt Bids Engineer Doug Pehrson told the Commission he had analyzed the bids for the asphalt. Phillips Petroleum initial bid was lower than Elf Asphalt but the charge for waiting time and scheduling made the bid from Elf Asphalt the lower bid. Mr. Pehrson said he recommended the bid be awarded to Elf Asphalt because of the product, service and scheduling. A motion to award the bid to Elf Asphalt because of the service, product and scheduling was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Sheriff's Department/Corporal Position The payroll notices for the three Corporal positions approved for the jail were presented. Mark Ewart will be Grade 15 Step 10, $1758 per month; effective 3-1-93. Jaren Adams will be Grade 14 Step 6, $1689 per mont; effective 3-1-93. Troy Butler will be Grade 15 Step 11, $1776 per month; effective 3-1-93. A motion to approve the payroll changes on the condition that the agreements are signed with the stipulation that this is a temporary one year position was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. PROCESS FACILATATOR EDWARD TAPAHA'S REPORT Oil Company Training Process Facilatator Edward Tapaha said he has been trying to set up a meeting with the oil companies in the Aneth area and the Chapters to do some emergency training. Mr. Tapaha said he is having difficulty in contacting the oil companies representatives that are in charge of training. Mr. Tapaha has been in contact with Navajo Land Administration, Indian Health Services Environmental Protection Agency and Navajo Safety Office to discuss this matter. Utah Agency Office Process Facilatator Edward Tapaha said he has been working on information to establish a Utah Agency Office. Mr. Tapaha said he will need to meet with the Utah Chapter Coordinatators to discuss this matter. Utah Navajo Commission Process Facilatator Edward Tapaha said the Utah Navajo Commission met with the Utah Navajo Fair Board last week. The Fair Board presented information on their plans for the fair. The Commission was supportive of the ideas presented. Out-of-State Travel Process Facilatator Edward Tapaha said the Red Mesa Chapter would like to send him to a Proposal Writing Seminar in Denver, Colorado on March 16-20, 1993. The Chapter will pay for the registration fee, hotel and per diem costs if the County will provide the transportation and pay the wages of Mr. Tapaha while he attends the Seminar. A motion to approve this request was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Travel Process Facilatator Edward Tapaha will be attending a meeting of the Southeastern Utah District Health Department on March 9, 1993 in Green River, Utah. Mr. Tapaha will be attending an Indian Education meeting on March 10, 1993. Mr. Tapaha will be attending a Voter Information meeting on March 11-12, 1993. Mr. Tapaha will be attending a Utah Navajo Commission Meeting on March 15, 1993 ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Water Situation Administrative Assistant Rick Bailey said the Hydrologist for the Forest Service has reported that then is more water at Camp Jackson than has ever been recorded. Emergency Management Plan Administrative Assistant Rick Bailey said the State and the Emergency Management Office are in the process of updating the Emergency Management Plan. Some role playing will be done before the plan is implemented. Solid Waste Administrative Assistant Rick Bailey and Commissioner Lewis met with Les Baker, Baker Sanitation, on March 1, 1993 to discuss solid waste disposal. Mr. Baker will survey a rural route for La Sal, Bluff and Mexican Hat on March 17, 1993. Bill Davis, Abajo Archeology, will be doing the archeology on the landfill site. Indian Health Services will be participating in the cost of the landfill. Bluff Underground Storage Certified Environmental Technology will be finishing the Bluff Underground Storage clean-up. Welding Classes Administrative Assistant Rick Bailey said the classes that are being offered by Four Corners Welding will cover new OSHA regulations and safety requirements on welding. A motion to approve one person from each shop to attend the classes was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Aneth to Ismay Road Administrative Assistant Rick Bailey and Engineer Doug Pehrson met with Robert Montoya, Bureau of Indian Affairs, to finalize the Grant on the Aneth to Ismay road. Mr. Montoya discussed the next county project that the BIA will be requested to participate in. They discussed improving County road #262 to Hatch Trading Post. Contingent Public Defender Administrative Assistant Rick Bailey said there were only two applications received for the Contingent Public Defender position. William L. Schultz bid $50.00 per hour, travel rate of $25.00 per hour and reimbursement for long distance calls. Sandra V. Starley bid $60.00 per hour for court time, $50.00 per hour for non-court time and a travel rate of $30.00. A motion to approve the bid from William L. Schultz was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Navajo Mountain Road Administrative Assistant Rick Bailey said he received a call from the Bureau of Indian Affairs with authorization to begin the archeology on the Navajo Mountain Road. Abajo Archeology will be doing this work. Utah Department of Transportation Administrative Assistant Rick Bailey said the Utah Department of Transportation has requested a meeting to discuss the signing at the intersection of Highway #191 and #666. COMMISSIONER BILL REDD'S REPORT National Association of Counties Commissioner Redd attended the National Association of Counties Legislative Convention from February 25 to March 3, 1993 in Washington, D.C. Commissioner Redd attended meetings on Payment In Lieu of Taxes, Public Lands Steering Committee and the National Cattleman's Association. Commissioner Redd said the Forest Service is using the Audubon Society and the Sierra Club to do contracts for the Forest Service. Commissioner Redd said a letter of protest on using special interest groups needs to be sent to the Forest Service. Travel Commissioner Redd will be attending a meeting of the Southeastern Utah District Health Department of March 9, 1993. COMMISSIONER TY LEWIS' REPORT Solid Waste Commissioner Lewis and Administrative Assistant Rick Bailey met with Les Baker, Baker Sanitation, on March 1, 1993 to discuss solid waste disposal in the County. Utah Department of Transportation Commissioner Lewis Attended a meeting with the Utah Department of Transportation in Richfield on February 23, 1993. The road project for the year and the funding was discussed. Commissioner Lewis will attend a Joint Highway Committee meeting on March 18-19, 1993 in Kanab. Commissioner Lewis has been elected Chairman of this Committee. Department of Energy Commissioner Lewis attended a meeting with the Department of Energy concerning the Monticello Clean-up on March 4, 1993. The social and economic impact the residents because of the repository was discussed. Another meeting is scheduled for March 22, 1993. Association of Local Governments Commissioner Lewis attended a meeting of the Association of Local Governments on February 26, 1993. Wes Curtis, Betty Statton, Bill Redd and Ray Loy Hat have been nominated as members of the State Economic Development Board. Mike Malrich was appointed to the Economic Development District Board. Don Snider of the Utah State University is doing a study of the impact of wilderness to counties. The AOG sent a letter requesting approval of the funding to Utah State University. Attorney General A meeting has been scheduled with the Attorney General on March 18, 1993 to discuss jurisdiction problems. Harts Draw Road The Forest Service would like to meet with the Commission to discuss the Harts Draw Road. Administrative Assistant Rick bailey will arrange this meeting.
