SAN JUAN COUNTY COMMISSION MEETING MINUTES March 22, 1993 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present: Ty Lewis, Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk Absent: Mark Maryboy, Vice Chairman A motion to approve the minutes of the March 15, 1993 meeting as amended was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS CURRENT BUSINESS Road Department Road Department Office Manager Wanda Franklin told the Commission that Jason Pionke has a back injury and will not be able to return to work as a laborer on the patch crew. Mr. Pionke would like to return to work for the County at some other position. The Commission will discuss this matter with the County Attorney. Aging Request Aging Director Frank Morrell presented a request from the Red Mesa Chapter for $1500 for the Senior Center. A discussion was held on the need to establish a contract for the money and a system so that the funds can be utilized on an equal basis by all of the Chapters. The Commission requested that Mr. Morrell develop these guidelines. A motion to approve the requested $1500 for the Red Mesa Senior Citizens was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Fire Control Fire Warden Frank Morrell presented a request to hire for the Assistant Fire Warden for the fire season. Aaron Brewer will be hired at Grade 8 Step 1, $6.96 per hour; effective 5/1/93. A motion to approve this hiring was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Mr. Morrell told the Commission that he would like to take the less aggressive approach to fire control this fire season. Mr. Morrell said he did not feel the County needed to put a fire completely out if it is not endangering crops, buildings or people. The Commission told Mr. Morrell to use his best judgement in handling the fires this fire season. Building Permit A building permit was presented for Montella's Repair for an auto repair Shop in Blanding. A motion to approve the permit was on the stipulation that it meets zoning requirements was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Road Department Complaint Jerry Holliday asked the Commission about the bidding policies of the County. Mr. Holliday said he was interested in bidding on the asphalt for this year. Mr. Holliday said he is purchasing an asphalt plant and was waiting for the bids to be advertised before getting the plant. Administrative Assistant Rick Bailey said the County was not aware that there was someone local who could supply asphalt. The previous bidders for asphalt were contacted for bids and the bids were not advertised. Mr. Bailey said if Mr. Holliday would have contacted him about his new business the County would have known to notify him for bidding. In the future all items for bid will be advertised. Mr. Holliday lodged a complaint about County equipment being used to pull a stuck semi- truck out of the mud on the Alkali road. Mr. Holliday said he had been contacted about the problem and had sent a truck to the scene. When Mr. Holliday's truck arrived North Road Foreman Tony Brandt had used County equipment to pull the semi out of the mud. The Commission said they would investigate this matter further and would establish a policy to prevent this from happening again. Mr. Holliday discussed the County policy for selling culverts with the Commission. Mr. Holiday said he has been told that the County will no longer sell culverts. Mr. Bailey said the County policy is that the County will not sell over 100 feet of culvert to one purchaser. Board of Equalization A motion to convene into Board of Equalization was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Assessor Bruce Bunker presented the figures for the reevaluation of Parcel #36220341209A, Canyonlands 21st Century. The total back taxes owing on the property for the years 1986 to 1992 after the reevaluation is $4228.88. The total back taxes including the penalty and interest for these years is $6060.43. A motion to accept the reappraisal with the adjusted penalty and interest was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Clerk-Auditor Gail Northern told the Commission that a mining claim belonging to Energy Fuel is on the list of May Tax Sale property. The taxes are for 1989. Mrs. Northern asked for permission to strike this parcel from the sale as it is a mining claim and has no personal property or land. A motion to approve the request was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. The Commission requested that Mrs. Northern investigate the possibility of attaching the back taxes to other property owned by Energy Fuels. A motion to adjourn the Board of Equalization was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Zoning Variance Request A letter was received from Guy Saperstein, Pack Creek Subdivision, requesting a set back variance from thirty feet to five feet so that he can construct a garage on the home he is building. Mr. Saperstein said the topography of the land will not allow the garage to be set back 30 feet. The Commission said a public hearing will need to be held and the Pack Creek Subdivision zoning committee be notified of the request and the public hearing. Bluff Land Assessor Bruce Bunker said that Leonard Howe has talked with him about the taxes assessed on a parcel of land that he sold and has repossessed in Bluff. Mr. Howe would like to have the taxes reduced for 1992 as he feels they are assessed too high. The Commission said that nothing can be done for this year because no one came to equalization and the time for any changes has passed. Mr. Bunker will conduct a reappraisal on the land for 1993. Ted Wilson Ted Wilson, University of Utah Hinkley Institute, met with the Commission to inform them of a workshop that the Hinkley Institute will be offering this summer. The workshop will involve approximately twenty teachers and will deal with voting rights. Mr. Wilson said he did not want to stir up any of the problems that happened in the 1990 election. The Commissioners, County Attorney Craig Halls, Clerk-Auditor Gail Northern, Bilingual Coordinatator Edward Tapaha and former Clerk-Auditor Gail Johnson will be asked to participate in workshop. Mr. Wilson said he hoped this workshop would help the teachers understand some of the voting rights problems. The University of Utah Bennion Center will be doing a service project on the Navajo Reservation in conjunction with this summer workshop. Permanent Part-time Employees Recorder Louise Jones met with the Commission to request paid vacation leave for her permanent part-time employee. After a discussion of the number of permanent part-time employees that the County has it was the decision of the Commission not to change the current policy. Subdivision Plats Recorder Louise Jones told the Commission that the last subdivision amendment that she received from the Pack Creek Subdivision has illegible signatures and was not a good copy. All signatures on the plat must be original signatures. All subdivision changes are required to have a public hearing as stated in the Utah Code. Since the County does not have a subdivision ordinance it must follow that of the State. Mrs. Jones said she has contacted Attorney Daniel Anderson about this matter. Natural Bridges Several Complaints have been received that Edstrom Construction that is doing the road into the Natural Bridges is not hiring local people. A letter of concern will be sent to National Park Service on this matter. Gun Sale The Commission received a copy of a letter that was sent to Sheriff Claude Lacy by Monticello Chief of Police Kent Adair concerning the sale of guns that were turned over to the Sheriff by the Federal Bureau of Investigation. Chief Adair stated that his department had initiated the investigation and felt that part of the funds from the sale of the guns should go to his department. Sheriff Lacy responded by letter to Chief Adair that the assistance in the investigation was appreciated but the request for some of the funds from the sale of the guns was denied. The Commission said they felt this matter should be handled by the Sheriff as he is the elected official over the Sheriff's Department. Stranded Motorist Policy A draft copy of a Stranded Motorist Polciy was presented for the review of the Commisson. The Commisison asked that the policy be sent to all departments for review before it is adopted. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Utah Association of Counties Insurance Mutual Administrative Assistant Rick Bailey said that the UAC Insurance Mutual conducted a risk management review of the San Juan County facilities. After a discussion on the problems Mr. Bailey said he would give a copy of the review to the appropriate departments so the problems can be handled. Aneth to Ismay Road Administrative Assistant Rick Bailey presented an amendment to the contract with the Bureau of Indian Affairs on the Aneth to Ismay road. This contract amendment is in the amount of $266,028 and will cover the engineering and management costs on the BIA portion of the Aneth to Ismay Road. A motion to approve the contracts and the signing was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Frontier Theater Administrative Assistant Rick Bailey said the Commission has received a letter from the City of Blanding concerning the hazard of the Frontier Theater in Blanding. Commissioner Redd said he has observed that the owners are working on dismantling the building. Mr. Bailey said the Commission has been receiving requests to do something about this building for the past five years. Mr. Bailey said he is worried that the County may be liable if something was to happen at the building. It was decided that the Commission would talk with the owners of the property to see if they can get an estimated completion date for the dismantling of the building. Mental Health and Substance Abuse A letter was received from the State of Utah Department of Human Services regarding House Bill 462 which was passed by the 1993 Utah Legislature. This bill will reorganize the Department of Human Services and will dismantle the Office of Social Services. The Commission has the responsibility for Mental Health and Substance Abuse Programs. Three options for handling these programs were addressed. Option three deals with a contractual agreement with the Division of Mental Health and the Division of Substance Abuse for the provision and supervision of the programs. Administrative Assistant Rick Bailey will request a meeting with the Division of Substance Abuse and the Division of Mental Health to discuss this matter. Road Department/Holiday Time Administrative Assistant Rick Bailey said he has received the questionnaire that the road department sent to their employees regarding holiday time. Since the road department works four, ten hour days there are two hour on a holiday week that need to be either vacation time or time worked. The questionnaire stated that the road department policy would be what ever the majority chooses. Commissioner Lewis said he felt the policy should be set by each of the work crew to meet the needs of their crews. This Matter will be discussed at road meeting. The policy will not allow for short pay. Either vacation time or extra work hours must be used. Road Equipment Administrative Assistant Rick Bailey said he has talked with the road foremen and prioritized their road equipment needs. The priorities are two belly dumps, one for each district, one drop neck low-boy trailer and snow plows for the trucks. Mr. Bailey said the snow plows that are currently being used on the dump trucks are old and are spending more time in the shop to be repaired than they are being used to push the snow. The need for two graders for the South district was also discussed. A motion to authorize Mr. Bailey to receive bids for the two belly dumps and the two graders was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Mr. Bailey said he has been checking on a used laydown machine. There are not any used machines available. Mr. Bailey will have Engineer Doug Pehrson decide the size and type of machine that the County would need and contact the supplier. COMMISSIONER BILL REDD'S REPORT Bureau Of Land Management Commissioner Redd attended a meeting on the BLM Grand Resource Management Plan. Coalition 2000 Commissioner Redd attended a meeting of Coalition 2000. The disparity of the wilderness issue was discussed. No decisions were made. State Planning Commissioner Redd met with Brad Barber, Office of State Planning, to discuss the fiscal plan that is being done for the County. The need to include roads and future road work was discussed. Commissioner Lewis said that the Utah Department of Transportation has the capability of planning for roads. Attorney General Commissioner Redd attended a meeting with the Utah Attorney General on March 18, 1993. Commissioner Lewis, Commissioner Maryboy, Administrative Assistant Rick Bailey and Council from the Navajo Nation met to discuss jurisdiction problems. Commissioner Redd said no questions were answered as to the responsibility of the Utah Division of Indian Affairs. Travel Commissioner Redd will be attending a meeting of the Utah Association of Counties Multi-County Appraisal Trust on March 24, 1993. Commissioner Redd will be attending a meeting of the Utah Association of Counties Comprehensive Land Planning Committee on March 25, 1993. COMMISSIONER TY LEWIS' REPORT Bureau Of Land Management Commissioner Lewis attended a meeting on the BLM Grand Resource Management Plan. The Commission will be sending written comments on this plan. Monticello City Commissioner Lewis met with Monticello City on March 15, 1993 to discuss the Department of Energy tailings cleanup in Monticello. Utah Department of Transportation Joint Highway Committee Commissioner Lewis attended a meeting of the UDOT Joint Highway Committee on March 17, 1993. The concept of a five to twenty year plan, and five year plan for the roads in the State was discussed. Roads on the five year list must be designed and ready for construction. The plan was readily accepted by the committee. Meetings Commissioner Lewis will be meeting with Monticello City on March 23, 1993 to discuss solid waste disposal. Commissioner Lewis and Administrative Assistant Rick Bailey will be in Window Rock, Arizona on March 24, 1993. Commissioner Lewis will be attending a dinner meeting with the Utah Association of Counties and County officials on March 24, 1993 at the Lamplight Restaurant in Monticello. Commissioner Lewis will be attending a meeting of the Utah Association of Counties Insurance Mutual on March 26, 1993. Commissioner Lewis will be meeting on March 23, 1993 with the San Juan County Water Conservancy District, BLM, Forest Service and Cities to discuss the runoff problem that the County will be facing .
