SAN JUAN COUNTY COMMISSION MEETING MINUTES May 17, 1993 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah Present: Ty Lewis, Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk Excused: Mark Maryboy, Vice Chairman A motion to approve the minutes of the May 10, 1993 meeting as amended was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. CURRENT BUSINESS Sealed Bids/Concrete Sealed bids for the concrete retainer structure for an oil tank at the Blanding road yard were opened. Bids were received from Jeff L. Black Construction for $1875, Tri-Hurst Construction for $ 1320 and Canyonlands Concrete did not submit a bid. A motion to approve the bid from Tri-Hurst Construction was mad eby Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Sealed Bids/ Cattle Guards Sealed bids for cattle guards were opened. Montella's Repair bid $933.00 each for 8'x10', $1110.30 each for 8'x 12', $1289.09 each for 8' x 14' cattle guards with a minimum order of ten each without clean outs. End wing sets at $120 each. JM Custom Welding bid $1112.66 each for 8' x 10', $1276.30 each for 8' x 12', $1491.52 each for 8'x 14' cattle guards without clean outs. End wings sets are $122.98 each. J B Grain bid $1170 each for 8" x 10", $1350 each for 8' x 12 and $1628 each for the 8' x 14' cattle guards and $95 each for the end wing sets. Young's Machine bid $1077 each for 8" x 10' , $1242 each for 8" x 12', $1496 each for 8' x 14' cattle guards and $110 per set for the end wings. A motion to accept the bid from Montella's Repair with the stipulation that the cattle guards bid meet the specifications of the County was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Human Services Block Grant Glenna Webb, Human Services Planner, met with the Commission to present the proposals the Human Services Board is recommending for funding by the Social Services Block Grant Discretionary Funding. Mrs. Webb discussed the proposal that the Board received and the criteria necessary to receive the funding. The Board recommended the following funding: Project Goodwork $8,519, San Juan County Aging $20,000, RSI $15,000, Local Interagency Council $10,000 and CEU $15,000. The Board recommended the CEU San Juan Center be notified they should not plan on receiving funding next year due to other revenue resources which could be available. A motion to approve the recommended funding was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. National Sheriff's Association Convention Sheriff Lacy met with the Commission to discuss attending the National Sheriff's Association meeting in Salt Lake City. Sheriff Lacy said the meetings will be held at the Salt Lake Marriot Hotel. Rooms will be $105 per night plus registration fees for the convention. Sheriff Lacy asked for approval to attend the meetings. A motion to approve this request was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Wesley Hunt/Abajo Peak Communications Wesley Hunt met with the Commission to request permission to upgrade his equipment at Abajo Peak to allow a radio/telephone communication link. Mr. Hunt said this upgrade would allow him to offer a telephone link to any person using his radio system. Radios could also be contacted by telephone. Mr. Hunt said he is working with the Abajo Peak Users Association, Forest Service and the Federal Communications Commission. Communications Specialist Bill Bayles has stated that he has no objection to the upgrade. A motion to approve the upgraded contingent on the fact that the upgrade does not affect any of the existing operations at Abajo Peak and a rental agreement is signed was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. This upgrade would make the equipment user friendly and increase the rental amount that Mr. Hunt pays each month. The Commission requested that the County Attorney be asked to draft an agreement on the Abajo Peak rental with Mr. Hunt. Monticello Road Shop/Equipment Monticello Shop Supervisor Max Ksiazkiewicz said he would like to purchase a D/C welder for the Monticello Shop. The welder that is currently being used is A/C and is about twenty years old. Mr. Ksiazkiewicz said the Hobart welder he would like to purchase is a heavier machine for higher use. The Commission asked Mr. Ksiazkiewicz if he has contacted local vendors to see if they could bid on welders. Mr. Ksiazkiewicz said he has not. The Commission asked that local vendors be contacted before a decision on purchasing is made. Board of Equalization A request for tax exempt status was received from the Edge of the Seater in Blanding. After checking with the Recorders Office to see if the land was owned by Edge of the Seaters on January 1, 1993 a motion to approve the tax exempt status was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Procurement Bids for a Hard Drive for Data Processing were presented. Hard Drives America, Inc bid $299 and Turbo Computers bid $339. A motion to approve the bid from Hard Drives America, Inc. was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Bids for two Spectra A 9 mobile radios from the State Bid were presented. The radios can be purchased from Motorola for $1,399 each. A motion to approve the purchase was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Bids for a 130 megabyte hard drive for Communications were presented. Cedar Mesa bid $500 and Hard Drives America Inc. bid $299. A motion to approve the bid from Hard Drive America Inc. was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Bids were presented for a lap top computer for Communications. Accord Systems bid $2160 and Comb Company bid $1999. A motion to approve the bid from Comb Company was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Maintenance Supervisor Dell Hunter presented a bid from Asphalt Systems for 200 gallon of GSB 88 asphalt rejuvenator. The bid price is $2.20 per gallon. Mr. Hunter said this was the only company that handles the asphalt rejuvenator. A motion to approve the purchase was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Commissioner Over Roads The Commission discussed the need to designate one Commissioner over roads. This will allow the Commissioner to attempt to resolve conflicts and issues at the road department. Policy changes or direction must still be handled in road meeting. It was the decision of the Commission to have Commissioner Redd act as the Commissioner over roads. This assignment will be made each year with other Commission assignments. Administrative Assistant Rick Bailey will send a memo to the road department. If Commissioner Redd is not available another Commissioner can be contacted. PROCESS FACILATATOR EDWARD TAPAHA'S REPORT Utah Navajo Commission Process Facilatator Edward Tapaha attended a meeting of the Utah Navajo Commission on May 6, 1993. A discussion was held on Solid Waste Disposal. Marvin Smith, Navajo Environmental Protection Agency, was present at the meeting and said he has several dumpsters available for transfer stations. There are also smaller dumpsters available for use at the Chapters. A site assessment for land fills is being done by the Tuba City Office of the Navajo Environmental Protection Agency. The dumps on the Reservation will not be closed until this assessment is completed. This project should be completed by July. Julie Orr, Bureau of Indian Affairs, told the Utah Navajo Commission that there have been five sites selected for transfer stations to serve the Utah portion of the Reservation. Mr. Tapaha has been asked to serve on a subcommittee for solid waste planning by the Navajo Tribal Justice Department. Chapter Meetings Process Facilatator Edward Tapaha attended the Navajo Mountain Chapter meeting on May 15, 1993. Mr. Tapaha was asked about the surplus equipment and when it would be available for the Chapters. Mr. Tapaha told the Chapter that they could go to Salt Lake City to look at the equipment. The trade agreement with Mexico and Canada was discussed. The Navajo Mountain Chapter passed a resolution in favor of the concept of a highway through Navajo Mountain to Oljato for the transporting of goods from this trade agreement. This matter will be discussed in Window Rock on May 18, 1993. Mr. Tapaha attended the Oljato Chapter meeting on May 16, 1993. Mr. Tapaha said he answered questions concerning the recreation funding and how the Chapter can match the money from the County with money from the Tribe and the Utah Navajo Commission. The Commission asked Mr. Tapaha to inform the Navajo Mountain and Oljato Chapters that if they have needed equipment for their Senior Citizens Center they need to make requests in the budget process in October. Travel Process Facilatator Edward Tapaha will be attending a meeting of the Southeastern Utah District Health Department on May 18, 1993 in Green River, Utah. Mr. Tapaha will be meeting with election outreach workers in Gallup, New Mexico on May 20, 1993. Mr. Tapaha will be attending a meeting of the San Juan County Economic Development Board on May 21, 1993. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Correspondence A letter was received from San Juan County Resident Donna Eubanks requesting financial assistance to attend veterinary schooling at Colorado State University in Fort Collins, Colorado. Ms. Eubanks is requesting funding in the approximate amount of $18,400 per year. Ms. Eubanks said a partial scholarship would be most appreciated and helpful. The Commission requested that Administrative Assistant Rick Bailey write a letter to the San Juan Scholarship Foundation from the Commission and include a copy of the letter form Ms. Eubanks and request that scholarship money or a Grant be given to Ms. Eubanks. The Commission also requested a copy of this letter be sent to Ms. Eubanks. A letter was received from Calvin Blake, Midway Aviation, requesting several items for the Cal Black Memorial Airport. Mr. Blake is requesting a mobile home for use as a residence for the employees at the airport. Administrative Assistant Rick Bailey said that the agreement with Mr. Blake states in item #14 that the fixed base operator is responsible for the housing of the operator and his employees. After a discussion on this matter it was the decision of the Commission to offer Mr. Blake one of the County travel trailers that the construction crew uses. Mr. Blake would be notified thirty days before the construction crew would need to use the trailer. Transporting the trailer to and from the airport and the damages to the trailer would be Mr. Blake's responsibility. The commission requested that Mr. Blake have items for capital purchases ready at budget time so they could be included in the budget process. Mr. Blake requested that vending machines be purchased for the airport so that people flying into the airport could purchases soft drinks and snack items. The Commission discussed who would receive the revenue from the machines. Also discussed was the power supply at the airport. It was the decision of the Commission that the County would not purchase vending machines. Mr. Blake may sell candy bars and pop on his own if he so chooses. Mr. Blake requested an ice machine be purchased so that ice could be sold at the airport. The Commission felt the County should not be in the ice business when ice can be purchased at the Halls Crossing Marina. Mr. Blake requested that the County supply a vehicle for use in shuttling passengers from the airport to the marina. The Commission said they would be willing to transfer title and ownership of the old County Station wagon in lieu of one months payment due to the lack of a telephone. If Mr. Blake accepts this offer the County will assume no responsibility for the repairs, maintenance or liability coverage of the vehicle nor make any implications to the condition of the vehicle. Mr. Bailey said the ballasts in the lights at the airport have been burning out due to the fluctuation in the electricity when it changes from the solar power to the generator. Bruce Johnson, Northern Electric, has indicated that a digital type ballast would prevent this burnout. The cost of replacing the ballasts would be approximately $600. A motion to approve the ballast replacement was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Mr. Bailey said that the air compressor that was approved for purchase for the Cal Black Memorial Airport from PACE Wholesale is no longer available. Mr. Bailey said he has contacted Parley Redd Mercantile in Blanding and they can supply a four horsepower air compressor for $340. The Commission authorized Mr. Bailey to purchase this air compressor. Mr. Bailey said the equipment that was ordered for the telephone system from the original supplier has raised in price. Communications Plus had to order the equipment from a different company. The equipment will be here by the end of the month. The telephone will then be installed. Kerry Shumway Lawsuit Deposition Administrative Assistant Rick Bailey presented copies of the depositions that Commissioner Redd and Commissioner Lewis gave on the Kerry Shumway lawsuit for the commissioners to review and approve. Compactor/Construction Crew Administrative Assistant Rick Bailey presented bids for the a new compactor for the Construction Crew. Bids were received from Cate-Carbon Equipment Company for $1,800 and Atlas Sales Inc. for $2425. A motion to accept the bid from Cate- Carbon Equipment was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. State Surplus Administrative Assistant Rick Bailey said he was in Salt Lake City last week and looked at the one-ton pickups that are at State Surplus. Mr. Bailey asked if the County might be able to use one of the pick-ups for the Weed and Rodent Department. Contaminated Soil Administrative Assistant Rick Bailey said that Certified Environmental has been taking care of the under ground storage tanks and testing the soil. The soil in Bluff needs to be tested to see if it can be used as road base. Certified Environmental will do this for a amount not to exceed $3,000. The Commission asked Mr. Bailey to check with the regulations and see if the soil can be left longer before being tested. This would prevent the County from paying the costs of repeated testing. COMMISSIONER BILL REDD'S REPORT National Association of Counties Western Interstate Regional Convention Commissioner Redd attended the NACO WIR Convention on May 11-15, 1993. Commissioner Redd attended the Public Lands Steering Committee . Discussions were held concerning grazing, PILT, owls and infrastructure. The consensus of the group was that if some form of funding for infrastructure were established by the Federal Government the counties should handle the funding not the States. The Ecosystem concept of land management was also discussed. This plan covers regions not counties or states. RS 2477 roads were discussed. Brian Brimner and Barbara Yellie discussed local land planning. Travel Commissioner Redd will be attending a Utah Association of Counties planning meeting on May 18, 1993 at the State Capital. Commissioner Redd will be attending a meeting of the Southeastern Utah District Health Department on May 18, 1993 in Green River, Utah. Commissioner Redd will be attending an Association of Governments meeting on May 20, 1993. Commissioner Redd will attend a meeting in Richfield , Utah on wildlife that has been organized by Senator Hatch. COMMISSIONER TY LEWIS' REPORT Utah Association of Counties Insurance Mutual Commissioner Lewis said that he has been notified by the UAC Insurance Trust that Lynn Lund of Lynn Lund and Associates will be acting as a consultant for the Insurance Mutual. Spotlight Ordinance Commissioner Lewis said the Division of Wildlife Resources has a new law that has been passed by the legislature that will allow counties to pass an ordinance on night hunting for predators. Each County can pass their own night hunting ordinance. Any fee that is charged for night hunting must be remitted to the DWR. The Commission will ask County Attorney Craig Halls to review the law and discuss it with Sheriff Claude Lacy. Travel Commissioner Lewis will be attending an Association of Governments meeting on May 20, 1993. Commissioner Lewis will be attending a Resource Conservation and Development meeting on May 20, 1993 in Green River, Utah.
