SAN JUAN COUNTY COMMISSION MEETING MINUTES June 7, 1993 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Dena Hunter, Deputy Clerk Excused: Rick Bailey, Administrative Assistant A motion to approve the minutes of the May 24, 1993 meeting as amended was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. CURRENT BUSINESS Amendment #3 Aging Contract Aging Director Frank Morrell presented amendment # 3 to the Aging Contract for the approval of the Commission. This amendment will provide $5,000 additional funding to the County. A motion to approve the amendment was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Health Insurance Information Program Aging Director Frank Morrell told the Commission that $6,000 per year has been appropriated for the next three years to provide a Health Information Insurance Program for the senior citizens. Mr. Morrell said he has received proposals to provide this service from Southeastern Utah Health District and Corinne Roring. Mr. Morrell recommended accepting the proposal from Southeastern Utah Health District as they have the expertise and the current contact with the clients that would be served by this program. The Commission asked if Mrs. Roring had any certification in this field and if she could provide the necessary liability insurance. Mr. Morrell showed the Commission the proposal from Mrs. Roring. A motion to approve the Mr. Morrell recommendation was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Blanding Senior Citizens/Center Director Aging Director Frank Morrell told the Commission that he has received notice from Blanding Senior Citizens Center Director Ruby Bronson that she will be retiring effective July 1, 1993. Mr. Morrell asked for permission to advertise to fill this position. The Commission gave their approval to this request. Emergency Management/Mock Disaster Fire Warden Frank Morrell updated the Commission on the mock disaster that happened at 7:45 A.M. this morning in Salt Lake City. The mock disaster was a earthquake that hit the Wasatch Front. Mr. Morrell asked for permission to commit additional resources from the County if they are needed. The Commission gave their approval to this request and asked that Mr. Morrell coordinate this request with the road department. The Commission asked Mr. Morrell to keep them informed of any additional requests. Sheriff's Department Sheriff Claude Lacy told the Commission that a body had to be helicoptered from Cataract Canyon this past week. The cost of the helicopter will be approximately $1,000. Sheriff Lacy said he did not know if the National Park Service would participate in this cost. Sheriff Lacy said he would pursue having the Park Service and the neighboring County participate in the cost of recovering the body. Sheriff Lacy said there are two other bodies that have not been recovered from the Colorado River. There is also a drowning victim in the San Juan River near Mexican Hat that has not been found. This victim will be recovered by the Navajo Tribal Police once the body is located. Sheriff Lacy discussed with the Commission a Memorandum of Understanding with the National Park Service at Glen Canyon National Recreation Area. The Commission will asked County Attorney Craig Halls to review the MOU before it is signed. Sheriff Lacy presented Payroll Notices for Michael Bailey and Kayla Draper. Mr. Bailey will be moved from dispatch to corrections at Grade 15 Step 1, $1607 per month; effective 6-7-93. Ms. Draper will be a dispatcher at Grade 9 Step 1, $1246 per month; effective 6- 7-93. A motion to approve the change for Mr. Bailey was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Commissioner Redd said he would like to discuss the hiring roster with County Attorney Craig Halls before a decision is made on Ms. Draper. It was the decision of the Commission to table this hiring until a discussion was held with the County Attorney. County Attorney Craig Halls advised the Commission that the hiring roster must be followed in hiring for the dispatcher position. Preference cannot be given to a County resident. A motion to approve hiring Kayla Draper as a dispatcher was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Sheriff Lacy and Jail Commander Bill Christensen said that the State has cancelled the contracts with Dr. Warren and the Mental Health for the State inmates. The only contract with Mental Health is a Sex Offender contract. The County will now be billed for the other Mental Health services and the Dr.'s visits. The County will then be reimbursed by the State. This will go into effect on July 1, 1993. Bus Student Matter Sheriff Claude Lacy asked if the matter concerning the school bus and a White Mesa youth was still scheduled to be discussed at 1:00 P.M. Commissioner Maryboy said he had requested that it be put on the agenda so that the Commission could hear the White Mesa resident's side of the story. Sheriff Lacy said he had done some investigating of the incident. The Blanding City Police were asked to investigate an incident that took place at the Blanding bus garage. Blanding City felt that it should be handled by the Sheriff's Department because of a conflict of interest. The Deputy Sheriff also had a conflict of interest. Sheriff Lacy said that the matter should be turned over to the Federal Bureau of Investigation if the youth feels his civil rights were violated. The Commission said that they do not have any jurisdiction over the school bus and this matter needs to be taken up with the School District. Ken Sleight said he would like to know how much the civil rights suits against the County are costing the tax payers. The Commission said there is only one civil rights case that has been filed against the County and it had to do with an employee of the County that was dismissed. Commissioner Maryboy said he felt that the incident was unfair and needed to be on record. The people involved need to be told what recourse they have and who they need to contact to solve the problem. Extension Service Extension Agent Jim Keyes said he has advertised for bids for a scale house over the livestock scales at the fairgrounds. Mr. Keyes said the only bid that was received was from Bruce Bunker Construction for $9,896. Mr Keyes said he would like to have a completion date of August 1st on the project. Commissioner Redd said he would like a private contractor to review the bid before a decision is made on the bid. Bruce Bunker came into the meeting later and told Commissioner Redd he did not appreciate asking that his bid be reviewed by another contractor. Mr. Bunker said he bid because he was told that no other bids had been submitted. Mr. Bunker said his bid could be torn up. Jim Keyes came back to the meeting after lunch and said he was told by the other contractor that the bid was comparable. Mr. Keyes said Mr. Bunker has pulled his bid. A motion to approve the bid from Bruce Bunker Construction if Mr. Bunker decided not to pull his bid. If Mr. Bunker decided to pull his bid the Motion included readvertising for bids. The Motion was seconded by Commissioner Lewis. UNANIMOUS. Mr. Keyes told the Commission that Utah State University will be hiring two EFNET workers to teach nutrition programs in the homes for the Reservation area. These positions will be part-time and will be advertised for the next two weeks. Applicants must be bilingual. Mr. Keyes asked Commissioner Maryboy to help with the interviewing for these positions. Request to Hire/Extension Office Extension Agent Jim Keyes presented requests to hire for a 4-H Aide, Fairgrounds Worker and Weed Control. Tamara Bunker will be hired for 4-H Aide at Grade 1 Step 3, $5.39 per hour; effective 6-7-93. Brian Goodwine will be hired for Weed Control at Grade 1 Step 3, $5.39 per hour; effective 6-7-93. David Vick will be hired for Fairgrounds Worker at Grade 1 Step 1, $5.28 per hour; effective 6-7-93. A motion to approve the recommended hirings was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Mr. Keyes said there were two positions available for Weed Control. The other position will have to be readvertised. Paul Menard/Spanish Valley Airstrip Paul Menard met with the Commission to express his opposition to the opening of the Spanish Valley Airstrip. The Commission told Mr. Menard that the County will not come out in support or against the strip being opened until State Lands makes a decision on the matter. The County has no authority over what State Lands does on their land. The only way the County would have control for zoning the land would be if the land was sold. Ken Sleight said he felt the Commission should make a statement for or against the airstrip. Mr. Sleight said the residents in the area oppose the airstrip and the noise of the planes. Mr. Menard is a Grand County Councilman and said he would ask the Grand County Council to pass a Resolution in opposition to the operation of the airstrip and send it to State Lands. Mr Menard discussed with the Commission the continued growth in the Spanish Valley are of San Juan County. Mr. Menard asked if San Juan County had considered letting Grand County annex this portion of the County into Grand County. The Commission told Mr. Menard that proposal was on the ballot several years back and had been soundly defeated by the San Juan County voters. Economic Development Board Economic Development Director Peggy Humphreys met with the Commission to requested four appointments to the Economic Development Board. Mrs. Humphreys said she has advertised for candidates and has not received any applications. Mrs. Humphreys asked that Barbara Tate, Phil Mueller, Rick Terry and Neil Joslin be appointed to the Board. A motion to approve this request was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS Travel Council Travel Council Director Peggy Humphreys told the Commission that Good Morning Seoul Korea is in the County doing filming. The group will be touring the United States and chose Utah as their starting point. Mrs. Humphreys said two films will be made in San Juan County this summer. City Slickers II and Maverick. Mrs. Humphreys said she has been receiving numerous calls from newspapers and television stations concerning the Four Corners disease. Mrs. Humphreys said the reports of the disease has not effected tourism in this area. The Commission asked Mrs. Humphreys about the Visitors Center hours. Mrs. Humphreys said the Center is open from 9:00 A.M. to 6:00 P.M. Monday through Friday. On the weekends the Center is open from 10:00 A.M. to 5:00 P.M. The Center is open during the lunch hour. Mrs Humphreys said the Center will be open all summer with the exception of July 4, 1993. San Juan County Fair Fair Chairman Glenice Mantz said that the plans for this years fair are well underway. Mrs. Mantz said the goal of the fairboard this year is to get everyone in the County involved in the fair. Mrs. Mantz said she has coordinators in each community that will be handling the advertising and the pick up of items to be entered in the fair. Mrs. Mantz discussed with the Commission some of the new activities that are planned for this years fair. The Commission is invited to a luncheon on August 12, 1993 before the opening ceremonies of the fair. Mrs. Mantz said she has had problems getting anyone to do the State Fair booth this year. She has asked all of the art departments at the high schools in the County and the College of Eastern Utah. Mrs. Mantz said that Lou Mueller VOLUNTEERED to do the booth again this year if she had two helpers. Mrs. Mantz said she would be helping Mrs. Mueller and they would like to get another person involved who would be willing to do the booth next year. The Commissioners asked that an ad be put in the paper to see if they could get any interested volunteers. Memorandum of Understanding/Highway #211 A Memorandum of Understanding between the Bureau of Land Management, National Park Service, State Parks, Utah Department of Transportation San Juan County and the Dugout Ranch was presented for their approval of the Commission. This memorandum will be to develop a management plan for the lands along Highway #211. A motion to approve the MOU was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. GIS of Utah Jim Livingston, GIS Of Utah, met with the Commission to present a proposal for the mapping of San Juan County. Mr. Livingston said that his company is a full service Geographic Information System. Mr. Livingston said that GIS uses ERDOS for their mapping systems. The Forest Service and the Bureau of Land Management use this system for their mapping. The amount for total mapping of San Juan County would be approximately $24,000 to $28,000. The Commission said they would like to talk with the County Engineer to see if the County could use this service. Human Services/Bluff Worthy Glover, Human Services, told the Commission that Human Services is in the process of moving some of the offices of Family Support and Outreach to Bluff . This will enable better service to the residents of the area. Mr. Glover said Human Services can obtain some prefabricated buildings from the American Fork Training School and move them to Bluff. Mr. Glover asked if the County would be willing to sell or lease some of the property that it has in Bluff for this purpose. The Commission said they would be willing to trade property in Bluff to the State for land that the State has by the Cal Black Memorial Airport or along Highway #211. Mr. Glover will talk with State Lands about this matter. San Juan Water Conservancy District The applications for appointment to the San Juan Water Conservancy District were discussed. The only applicant from La Sal was Jim Blankenagel. Cleal Bradford was the only applicant from Blanding. Two applications were received from Bluff Jim Hook and Bill Davis. Mr. Davis did not apply personally but was nominated for appointment by Jim Sayers. A motion to appoint Mr. Blankengael and Mr. Bradford to the Water Conservancy Board and table the appointment from Bluff was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Procurement Bids for a 300 AC-DC welder were presented for the Monticello Road Shop. Bids were received from U.S. Airweld for $1,523, Four Corners Welding for $1,819 and Young's Machine for $1,946. A motion to approve the bid from U.S. Airweld was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Bids for a Jet Direct Card for Data Processing were presented. Hewlett Packard bid $449.00 plus shipping and California Computers bid $423.00. A motion to approve the bid from California Computers was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Building Permits A building permit for the alteration of a building in Bluff for a restaurant was presented for Richard Becker. The San Juan Service Area #1 has approved the application. A motion to approve the permit was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. A building permit was presented for Michael Eldred for a home east of Monticello. A motion to approve the permit with the stipulation that the proposed septic system is approved by the Southeastern Utah District Health Department was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Hanger Space Lease/ Cal Black Memorial Airport Calvin Blake, Midway Aviation, has contacted the Commission concerning a private individual leasing space to build a airplane hanger at the Cal Black Memorial Airport. The Commission expressed the concern that leasing the area for a private hanger may affect the Grant for hangers that is being pursued by the Association of Governments. The Commission will have Administrative Assistant Rick Bailey investigate what other airports do about private hangers. Road Request A letter was received from Richard and Cherie Shanteau requesting that the Pack Creek bridge be repaired so that they can move the materials for the home they are building up to their Pack Creek Ranch property. The Commission asked that a letter be sent to the Shanteau's advising that permanent repairs will be made to the bridge but no exact completion date can be given. Lloyd's Lake A discussion was held in road meeting about the outstanding billings on the Lloyd's Lake project. The Commission will have Administrative Assistant Rick Bailey write a letter to Monticello City indicating that if the bills are not brought current the county will no longer participate with the City and the San Juan Water Conservancy District in the project. PROCESS FACILATATOR EDWARD TAPAHA'S REPORT Surplus Equipment Process Facilatator Edward Tapaha said he talked with Dave Tomelson, State Surplus, regarding the letter from Leonard Haskie, Bureau of Indian Affairs about surplus equipment. Mr. Tomelson said the letter did not give him authority to screen for the Chapters. Mr. Tapaha said he would talk to Mr. Haskie about this matter at a meeting with the BIA on June 9, 1993. Mr. Tomelson said new equipment would be released in about twenty-one days. Elections Bilingual Coordinator Edward Tapaha said he will be working the months of June and July on voter registration. Mr. Tapaha said he planned to do some road side registration during these two months. Travel Process Facilatator Edward Tapaha will be attending a meeting of the Election Outreach Workers on June 8, 1993 in Zuni, Arizona. Mr. Tapaha will be attending a BIA meeting in Shiprock on June 9, 1993. Mr. Tapaha will be attending Oljato, Red Mesa and Mexican Water Chapter meetings this week. COMMISSIONER MARK MARYBOY'S REPORT School Bus Concern Commissioner Maryboy said the meeting that was scheduled for 1:00 P.M. to hear the White Mesa Residents concerns over a youth being removed from a school bus has been canceled. The Bureau of Indian Affairs representative was unable to attend the meeting. Commissioner Maryboy said he will tell the White Mesa residents to contact the Federal Bureau of Investigations Agent stationed in Blanding about this matter. Surplus Property Commissioner Maryboy discussed the copy of the letter that was sent to Dave Tomelson, State Surplus, from Leonard Haskie, Bureau of Indian Affairs, concerning surplus equipment for the Utah Chapters. The Commission asked Process Facilatator Edward Tapaha to contact Mr. Tomelson to see if the letter was what he needed to do the screening for the Chapters. Bureau of Indian Affairs Commissioner Maryboy and Engineer Doug Pehrson will be meeting with the BIA on June 9, 1993 in Shiprock New Mexico to discuss increasing road funding and the establishment of a BIA office in Utah. Commissioner Maryboy will discuss federal surplus equipment for the Chapters with Leonard Haskie. Indian Days Committee Commissioner Maryboy said the Tribe has not received a proposal from the Indian Days Committee for the funding they were going to request. Commissioner Maryboy said this will be the final week the Committee will be able to request funding. Coalition 2000 Commissioner Maryboy said he was unable to attend the Coalition 2000 meeting last week in Moab. Commissioner Maryboy said he discussed wilderness with Congressman Orton. Commissioner Maryboy said he supported Congressman Orton's proposal for wilderness and his plans for the Cedar Mesa area. Trash Burning Commissioner Maryboy said he has been contacted by the NAvajo Mountain Chapter about the possibility of the Chapter burning some trash. Commissioner Lewis said he would investigate this matter and respond to the Chapter. Mystery Disease Commissioner Maryboy said the mystery disease that has plagued the Navajo Reservation has not affected the Utah portion of the Reservation. Solid Waste Commissioner Maryboy said he has a copy of a court decision regarding requiring more excavation and drilling on proposed land fill sites. Commissioner Maryboy will fax a copy to the Courthouse for the other Commissioners. Travel Commissioner Maryboy will be in Window Rock on June 11, 1993. Commissioner Maryboy will be meeting with the Bureau of Indian Affairs on June 9, 1993 in Shiprock, New Mexico. Commissioner Maryboy will be attending a meeting with the Utah Attorney General on June 11, 1993 in Salt Lake City. COMMISSIONER BILL REDD'S REPORT Congressman Orton Commissioner Redd attended a breakfast meeting with Congressman Orton, Commissioner Lewis and Monticello Mayor Jack Young on June 1, 1993. Community Impact Board Commissioner Redd attended the Community Impact Board with Stan Johnson, Bluff Service Area #1. The Service Area requested $57,000 for water system repairs and engineering. The funding was granted. Coalition 2000 Commissioner Redd attended a meeting of Coalition 200 concerning wilderness on June 3-4, 1993 in Moab, Utah. The Environmental Groups boycotted the meetings. Travel Commissioner Redd will be attending a Utah Association of Counties Multi-County Appraisal Trust meeting on June 10, 1993. Commissioner Redd will be attending a Utah Association of Counties Board meeting on June 10, 1993. COMMISSIONER TY LEWIS' REPORT Department of Energy Commissioner Lewis met with the Department of Energy and Monticello City on May 24, 1993 to discuss the Monticello clean-up. La Sal Community Meeting Commissioner Lewis attended a La Sal Community meeting. Solid waste and roads were discussed. Commissioner Lewis will meet with the Community group once a decision is made on how the solid waste will be handled in the La Sal area. Congressman Orton Commissioner Lewis attended a breakfast meeting with Congressman Orton, Commissioner Redd and Monticello Mayor Jack Young on June 1, 1993. A discussion was held on RS2477 roads and the new tax bill. Congressman Orton explained why he voted against this bill. San Juan Forum Commissioner Lewis attended a meeting of the San Juan Forum on June 5, 1993 in Durango, Colorado. The Forum will deal with regional issues instead of State issues. Commissioner Lewis said he thought the County should become a member of the Forum. Travel Commissioner Lewis will be attending a Rural Public Lands meeting on June 10, 1993 in Salt Lake City.
