SAN JUAN COUNTY COMMISSION MEETING MINUTES July 12, 1993 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the commission chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Dena Hunter, Deputy Clerk A motion to approve the minutes of the July 6, 1993 meeting as amended was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. CURRENT BUSINESS Library Concern Joyce Martin, Library Board Chairman, met with the Commission to discuss a concern expressed over the library having video tapes of movies to check out at the libraries. The Commission expressed their concern about the competition with the local retail business. Ms. Martin said that it is common for a library to have a large selection of video tapes. The Commission asked if the Board had set a criteria for what types of video tapes would be carried in the library. Ms. Martin said that matter had not been decided by the Board. The Commission requested that Ms. Martin contact the State Library Board and see what criteria needs to be followed in purchasing video tapes for the library system. This matter will also be discussed at the next Library Board meeting. Ms. Martin discussed the Literacy Grant the Library Board has applied for with the Commission. Ms. Martin said she has received a notice that the Library Literacy program may not be funded in the budget because of legislation that was being introduced to cut the program. Ms. Martin said she was notified today that the legislation was defeated and San Juan County has received the Literacy Grant. Ms. Martin discussed the Internet Computer System that is currently being used in some of the libraries in the State. Ms. Martin said the Library Board discussed computerizing the libraries at the last Board meeting. The Board decided to study different computer systems that are available before they make a presentation to the Commission for computerizing the libraries. Ms. Martin said she will be attending a seminar on the Winnebago Computer System on August 26, 1993. Burr Trail Joyce Martin told the Commission that she had traveled the Burr Trail on a recent trip to Cedar City, Utah. Ms. Martin said she has sent a letter to the Congressional Delegation from Utah requesting that the Burr Trail be completed. Ms. Martin said the portion of the Trail that has been improved is really nice. The portion that has not been improved is washboarded and very slow traveling. Ms. Martin said she has received a copy of the Environmental Impact Statement. Comments on the EIS will be taken until August. Zoning Shane and Jamie Narans met with the Commission to discuss zoning on a parcel of property that is owned by Karl Tangren in the Spanish Valley area of the County. Mr. Narans said part of the property is zoned commercial and part is zoned agricultural. Mr. Narans said he is currently offering horseback trail rides and would like to build some cabins for overnight rental on the land. The portion of the land that the cabins would be built on is not all in the commercial zoning. Mr Narans requested a zoning variance so that the cabins can be constructed. The Commission said they were in favor of the proposal that Mr. Narans has made. A public hearing will need to be held on the requested variance zoning. Mr. Narans will send a letter with the amount of land that he is requesting the variance on so that the hearing can be advertised. Mr. Narans said he would like to purchase some of the buildings currently being used on the movie set of Gerinomo. These buildings would be placed in the commercial zone. The Commission said they could see no problem with moving the buildings on the commercial land. The building permit process will have to be followed. Blanding Library/Sprinkler System Maintenance Supervisor Dell Hunter presented bids for a sprinkling system at the Blanding Library. Bids were received from Whipple Plumbing & Irrigation for $8246 and Redd Plumbing & Solar for $3,940. A motion to approve the bid from Redd Plumbing & Solar was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Courthouse Maintenance Supervisor Dell Hunter presented a bid from Custom Floors and Furnishings for $855 for carpeting of three rooms in the Courthouse. A motion to approve the bid was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Mr. Hunter said he has received a bid in the amount of $43,112 for a wheel chair lift for the Courthouse to comply with the American With Disabilities Act. A motion to approve installing the lift was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. County Tax Rate Clerk-Auditor Gail Northern and Deputy Auditor John Fellmeth met with the Commission to discuss the information that the Commission requested on the Library and Tort Liability Funds. Mr. Fellmeth said that the library is spending at a rate that will deplete what has been budgeted for the year. The Tort Liability will increase .0092 to .000100 the statutory maximum. The tax rate will be set at next weeks meeting. Utah Counties Finance Cooperative Clerk-Auditor Gail Northern and Deputy Auditor John Fellmeth discussed with the Commission the equipment lease bonds that San Juan County has with the Utah Counties Finance Cooperative. The rate of interest being paid on the bonds is greater than the interest the County is earning on invested funds. Mr. Fellmeth said that with thirty day notice the County can pay off the bonds. A motion to approve calling the Bonds in whole was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Building Permit A building permit for a home for Allen J. Hunt was presented. A motion to approve the permit was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Mental Health Contracts Commissioner Redd said the contracts with Mental Health in the amount of $147,500 and the contract for the funding of the Department of Human Services are in the Blanding Office of Human Services and need to be signed by the County. A motion to authorize Commissioner Redd to sign these contracts for the County was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Forest Service The Commission has been invited to a breakfast meeting with the Forest Service from Price and Ogden on July 27, 1993. The ISTEA road program and other road matters will be discussed. Bureau of Land Management Bob Turri introduced the Commission to the new Area Manager for the BLM, Kate Kitchell. The Commission welcomed Ms. Kitchell to San Juan County. Ms. Kitchell said she was aware of the good working relationship the BLM and the County have had in the past. Ms. Kitchell said she feels a good working relationship is very important. A discussion was held on the lawsuit decision on the Halls Crossing Airport and the amount of land the County is requesting for a landfill. Solid Waste Les Baker, Baker Sanitation, and Julie Orr, Indian Health Services, met with the Commission to discuss solid waste. Ms. Orr said the information that she needs for Utah needs to come to her through the County not anyone else. Ms. Orr said that the funding that IHS has is to do solid waste planning to serve Navajo homes. Before any funding can be approved to participate in the cost of the land fill Ms. Orr will need a listing of projected expenditures. Ms. Orr said that IHS supports a uniform tippage fee for the landfill. Ms. Orr presented updated information on the extension that has been granted for small landfills. Also discussed were the transfer stations. Ms. Orr said that Utah does not require a permit for a transfer station. Ms. Orr said she has several designs of transfer stations and is willing to share the information with the county. Ms. Orr said that the Navajo Nation is currently doing an inventory of all open dump sites on the Navajo Reservation. Once the inventory is completed the Tribe will negotiate for the closing of the dumps. Ms. Orr said IHS has defined an open dump site as any site engineered or administered as a formal dump site. Ms. Orr said that a lawsuit has been filed by DNA Legal Services for the dump site conditions in Tuba City and Chinle, Arizona. The Bureau of Indian Affairs if moving fast to close all dump sites at their schools. This may have an impact on the County. Mr. Baker said he is open to bringing the County business to help pay for the costs of the landfill operation. Mr. Baker said he would like to submit a proposal on the hauling he is currently doing in the State. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Park Service Meeting Administrative Assistant Rick Bailey reminded the Commission about a meeting with the National Park Service in Page, Arizona on July 26, 1993 to discuss schools. Geo Tech Administrative Assistant Rick Bailey said the Commission needs to appoint a private citizen to the Geo Tech Board. The Commission will act on this matter next week. Continuity of Government Administrative Assistant Rick Bailey said the continuity of Government plan needs to be renewed. A motion to renew the plan was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Interagency Breakfast The Interagency Breakfast meeting will be held at the Chuckwagon on July 15, 1993 at 7:30 A.M. Contaminated Soil Administrative Assistant Rick Bailey said the contaminated soil has been tested at the Bluff fire station and passed. The testing will now be conducted every 50 feet. COMMISSIONER BILL REDD'S REPORT Utah Association of Counties Comprehensive Land Planning Commissioner Redd met with the other County Commissioners on the UAC Comprehensive Land Planning. The Commissioners decided to plan a meeting with the consultants. RS2477 Commissioner Redd attended the RS2477 meeting held by Congressman Orton. Senator Vento has asked the counties for their understanding of the 1866 law on highway construction. Community Impact Board Commissioner Redd will be attending the Community Impact Board tour of the County on July 15, 1993. San Juan Economic Development Council Commissioner Redd will attend the San Juan County Economic Development Board meeting on July 13, 1993 in La Sal. COMMISSIONER MARK MARYBOY'S REPORT Navajo Tribal Budget Commissioner Maryboy will be in Window Rock, Arizona on July 13, 1993 to review the request for supplemental funding. $11,000,000 has been received. Requests for $50,000,000 have been received just from the Judicial Branch. Utah projects are included in the requests. Dialysis Commissioner Maryboy said he has been receiving numerous complaints from Navajo residents concerning a company out of Shiprock, New Mexico called Navajo Transport Company. The Company is taking patients to Shiprock for kidney dialysis and charging Indian Health Services and Medicade for the same services. Commissioner Maryboy will be meeting today with some of the people making the complaints. Social Services has been asked to attend the meeting. Solid Waste Commissioner Maryboy will be meeting with a Solid Waste Task Force made up of the Utah Chapters at 4:00 p.m. today. Three sites for transfer stations will be identified. Travel Commissioner Maryboy will be in Window Rock on July 13-14, 1993. Commissioner Maryboy will be in Aneth on July 15-16, 1993. COMMISSIONER TY LEWIS' REPORT Interagency Meeting Commissioner Lewis will be attending the Interagency meeting on June 15, 1993. San Juan Hospital/Ground Breaking Commissioner Lewis will be attending the ground breaking ceremonies for the remodeling of the San Juan Hospital on June 15, 1993. Community Impact Board Commissioner Lewis will be attending the Community Impact Board tour of the County on July 15, 1993. 4-Wheeler Commissioner Lewis discussed the possibility of purchasing a 4-wheeler for use in the County. Commissioner Lewis said the 4-wheeler could be used for weed spraying, fire control, emergency services and etc. Noxious Weeds Commissioner Lewis discussed the possibility of passing a noxious weed control ordinance in the County. Commissioner Lewis sai y yd he has been approached by several new land owners that have purchased land and then been informed that it is their responsibility, not the previous owners, to control the noxious weeds. San Juan Health Care District Master Plan Commissioner Lewis has received a copy of the San Juan Health Care Services District's Master Plan for the commission to review. The Board would like to meet with the Commission to discuss the plan.
