SAN JUAN COUNTY COMMISSION MEETING MINUTES August 2, 1993 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Gail Northern, Clerk A motion to approve the minutes of the July 26, 1993 meeting as amended was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. CURRENT BUSINESS Nutrition Assistants Utah State University Home Economist, Frances Price, introduced the Commission to two Nutrition Assistants whom the University has just hired. The Nutrition Assistants are Darlene Eddie and Penny Tomasyo and will be working with low income families in the County. Substance Abuse Contract Bruce Shumway from Social Services presented the Substance Abuse Contract for the current fiscal year for signature of the Commission. The amount of the contract has increased from $147,000 to $202,508. A motion to approve the signing of the current fiscal year Substance Abuse Contract was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Navajo Transport Wilford Tso, formerly with Navajo Transport, Gary Eberhard from Social Services and a group of concerned citizens discussed with the Commission some problems that have developed with a company called Navajo Transport. Navajo Transport is a subsidiary of Renal Transport and has the contract to transport patients on the Reservation in need of kidney dialysis to a medical facility in Farmington, New Mexico. Mr. Tso and the other citizens present expressed concern over what appears to them to be fraudulent acts with respect to mileage accounting and billing etc. The Commission was concerned that the individuals in need of dialysis were receiving the care needed. It appears that some of the kidney dialysis patients on the Reservation have changed to a company called Safe Ride to ensure proper transportation even though this company was not awarded the transport contract. Commissioner Maryboy will bring these concerns to the attention of the Navajo Nation Attorney General and Mr. Eberhard will investigate through Social Services. Beer License A beer license was presented for Mexican Hat Lodge operated by Robert Mueller. A motion to approve the beer license for Mexican Hat Lodge upon receipt of a copy of server training certification was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Memorandum of Agreement The Memorandum of Agreement with Mountain Gravel for Lem's Draw was presented for signature of the Commission. A motion to approve the signing of the Memorandum of Agreement with Mountain Gravel was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Subdivision Ordinance There will be a Subdivision Ordinance work session August 9 at 1:00 PM during the regularly scheduled Commission meeting. All County staff involved in subdivision work will be expected to participate. Louise Jones, County Recorder will be excused due to a prior commitment. Board of Equalization Board of Equalization dates were set for August 23 and September 7, 1993 from 1:00 to 5:00 PM. Variance Request Duane Swasey requested a variance to place a mobile home on a 1 1/2 acre lot. Mr. Swasey's purchase of this lot will depend upon a variance being granted. The Commission suggested to Mr. Swasey that the land owner must request the variance and then the procedure for obtaining a variance could begin. Mr. Swasey will take up this matter with the current land owner. NACO Award San Juan County received an achievement award from the National Association of Counties for having Utah's first Multi Agency Visitor Center. Commissioner Lewis presented this award to Ms. Diane Nielson, Chairman of the San Juan County Economic Development Board. Chip Sealing Engineer, Doug Pehrson and Road Office Manager, Wanda Franklin discussed with the Commission the need to hire 2 temporary laborers for 5 - 6 weeks to help with chip sealing. The Commission instructed Ms. Franklin to contact Job Service in Blanding to hire 2 temporary laborers. PUBLIC HEARING Zoning Variance A Public Hearing was held from 1:00 to 1:20 regarding a zoning variance requested by Shane and Jamie Narans for the purpose of construction of a green house and guest cabins. There were no public comments. A motion to approve the zoning variance with the stipulation that the property remain as a single unit and not be subdivided in the future was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. PROCESS FACILITATOR EDWARD TAPAHA'S REPORT Elections Process Facilitator, Edward Tapaha reported that the translations he has been working on with the Election Outreach Workers have been completed and are now being reviewed. After review, the committee will check with the Hinkley Institute about printing. Process Facilitator, Edward Tapaha did some election translations for Blanding City regarding the City's bond election on August 3, 1993. Travel Process Facilitator, Edward Tapaha will attend a Navajo Mountain Planning meeting Tuesday, August 3. Mr. Tapaha will attend a Shiprock Agency Road Committee meeting on August 9 and 10. Mr. Tapaha will attend Pioneer Days at Navajo Mountain August 6 and 7. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Federal Grant Programs Administrative Assistant, Rick Bailey reported that Mr. Stuart Ryba from the General Accounting Office is conducting a survey regarding Federal Grant Programs and their benefit to rural counties. At the conclusion of his survey he will report back to congress. Mr. Ryba will be in San Juan County Monday and Tuesday, August 9 and 10 and would like to meet with Commissioner Lewis, Commissioner Maryboy and Administrative Assistant, Rick Bailey. Commissioner Lewis and Commissioner Maryboy will meet with Mr. Ryba on Monday after Commission meeting. Administrative Assistant, Rick Bailey will meet with Mr. Ryba on Tuesday. Mr. Bailey will also invite Mr. Lynn Lee from the College of Eastern Utah, San Juan Campus to the Tuesday meeting. Portable Bridges Administrative Assistant, Rick Bailey requested approval to purchase the portable bridge decking in stock at State Surplus for approximately $500.00 with the option to purchase more if needed later. A motion to approve the purchase of portable bridge decking from State Surplus in stock at present and to purchase more later if needed was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. GTE Communication Site Administrative Assistant, Rick Bailey requested approval to send a check in the amount of $500.00 with a letter requesting GTE transfer the GTE communication site at Cedar Mesa to the County. A motion to approve sending a check to GTE in the amount of $500.00 with the request for transfer was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Bluff Dump Administrative Assistant, Rick Bailey reported on a problem with the disposal of roofing debris from the Aneth School Project at the Bluff dump. It seems that the roofing debri was disposed of at the Bluff dump and since then has been burning. A citizen felt endangered by nearby exploding material. Mr. Bailey has been in contact with the company involved in the roofing project and arranged for Crowley Construction to cover the dump today. Mr. Bailey has also ordered some "No Burning" signs to post. LaSal Dump Administrative Assistant, Rick Bailey and County Engineer Doug Pehrson will meet with BLM officials on site at the LaSal dump to discuss alternatives to the situation with regard to closure of the dump. Dinosaur Museum Administrative Assistant, Rick Bailey received an invitation to the Commission from Dale Slade to attend a fund raiser luncheon at the Lamp Light in Monticello Tuesday, August 3 from 11:00 to 1:00 to benefit the Dinosaur Museum. State Lands Administrative Assistant, Rick Bailey reminded the Commission of a Public Hearing with State Lands regarding the Spanish Valley General Management Plan. The hearing will be at 7:00 PM at the Courthouse and the Commissioners will meet with Mr. Scott Hirschi, Division Director at 6:15 PM, prior to the public hearing. County Landfill Administrative Assistant, Rick Bailey will meet with Brian Bremner, Beehive Engineering and Julie Orr, Solid Waste Representative with Indian Health Services, in Shiprock, New Mexico on Tuesday, August 3, 1993. They will discuss the financial projections for the cost of the new County landfill. Economic & Travel Board Appointment Administrative Assistant, Rick Bailey presented a membership application for the San Juan County Economic Development and Travel Board from William A. Thompson. A motion to approve the appointment of William A. Thompson to the San Juan County Economic and Travel Board was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. DHS Contract Administrative Assistant, Rick Bailey presented the Department of Human Services contract for signature of the Commission. The contract amount is $68,519. This contract is for the Social Service Block Grant Program and is for the total amount that the County will receive. This amount will be allocated based upon the recommendations of the Human Service Board. A motion to approve the signing of the DHS contract was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Bluff Water and Sewer Association Administrative Assistant, Rick Bailey presented an official proxy to vote in favor of the dissolution of the Bluff Water and Sewer Association. A motion to sign the official proxy in favor of the dissolution of the Bluff Water and Sewer Association was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. UDOT Administrative Assistant, Rick Bailey presented a request to UDOT to place the Hart's Draw road on a major collector classification. A motion to approve the signing of the request to UDOT to place the Hart's Draw road on a major collector classification was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. COMMISSIONER BILL REDD'S REPORT Meetings Commissioner Bill Redd reported that he attended a breakfast meeting Tuesday, July 27 with the Forest Service and discussed forest roads. Wednesday, July 28, Commissioner Redd attended a Comprehensive Land Planning Committee meeting. Thursday, July 29, Commissioner Redd attended a Multi County Appraisal Trust meeting. They discussed the State's dropped valuation on AT&T and the 5 year reappraisal plan. Current Week's Agenda Commissioner Redd has a conference call with UAC Tuesday, August 3 at 8:00 AM at the Courthouse. Tuesday, August 3 Commissioner Redd will attend a meeting at 3:00 PM at the Courthouse with the DOE. Thursday, August 5 Commissioner Redd will meet with Director Scott Hirschi, Division of State Lands at 6:15 prior to the Public Hearing regarding the Spanish Valley General Management Plan. COMMISSIONER MARK MARYBOY'S REPORT Chuska Commissioner Mark Maryboy attended a meeting at the Attorney General's office. He discussed with Paula Smith, Assistant Attorney General, the law suit with Chuska Oil Company. According to Ms. Smith, there was a decision to pay back royalties in the amount of $1 to $2 million to the Utah Navajo Trust. Ms. Smith feels that Chuska will likely appeal. Transportation Committee Commissioner Mark Maryboy attended a Transportation Committee meeting in Salt Lake City last week. The Montezuma Creek to Red Mesa road was discussed. Utah Navajo Agency Commissioner Mark Maryboy has been in contact with Robert Dibblee, Senator Hatch's office, regarding the need for support of a Utah Navajo Agency. Administrative Assistant, Rick Bailey will write a letter to Navajo Nation President, Peterson Zah in support of a Utah Navajo Agency. Utah Navajo Committee Commissioner Mark Maryboy reported that the Utah Navajo Committee passed a Resolution supporting the case to sue the State of Utah to recover some of the mismanaged funds. Travel Commissioner Maryboy reported that this week he will be in Window Rock attending meetings to discuss the Navajo - Hopi land dispute. COMMISSIONER TY LEWIS' REPORT Tailings Hearings Commissioner Ty Lewis reported the schedule for Tailings Hearings. They will be held in Monticello on Wednesday, August 4 at 7:00 PM and in Blanding on Thursday, August 5 at 7:00 PM. UAC Fall Conference Commissioner Ty Lewis reminded the Commissioners that the UAC fall conference is scheduled for September 16 and 17 at Ruby's Inn. They plan to have legal counsel at the meetings to discuss Equal Footing Doctrine. A motion to approve $500.00 as San Juan County's portion of the cost for part of the presentations at the UAC Fall Conference was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. BLM Open House Commissioner Ty Lewis received an invitation to an open house for the new Area Manager, Kate Kitchell at the BLM Office August 6 from 1:00 to 4:30. Road Department Personnel Matter Commissioner Ty Lewis requested that County Attorney, Craig Halls write a letter to Road Department employee Larry Sorrell regarding County policy on leave time and hours not worked. County Road Signs Commissioner Ty Lewis suggested that the County print some reward posters for reports leading to conviction regarding damage to County road signs. Administrative Assistant, Rick Bailey will have these printed and will give some to Process Facilitator, Edward Tapaha to post at the Chapter Houses. Meetings Commissioner Ty Lewis attended a breakfast meeting with the Forest Service to discuss forest roads. Commissioner Ty Lewis attended a meeting with the school district in Page, Arizona. A school to accommodate about 100 students will be built at Bullfrog, scheduled to be completed in May of 1995. Travel Commissioner Lewis will meet with the DOE Tuesday, August 3 at 3:00 at the Courthouse. Commissioner Lewis will meet with Scott Hirschi, State Lands, on Thursday, August 5 at 6:15 regarding the Spanish Valley General Management Plan, prior to the public hearing. Commissioner Lewis will try to attend Pioneer Days at Navajo Mountain on Saturday, August 7.
