SAN JUAN COUNTY COMMISSION MEETING MINUTES AUGUST 9, 1993 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Gail Northern, Clerk A motion to approve the minutes of the August 2, 1993 meeting as amended was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. CURRENT BUSINESS State Motor Vehicle Contract Bruce Bunker, County Assessor met with the County Commission regarding recent changes made by the State Legislature with regard to funding received from the State by the County for providing motor vehicle registration services. Mr. Bunker gave the Commission a copy of the new contract which will provide the County at least double the amount that the County is currently receiving. The County Attorney has reviewed the contract and recommended no changes. A motion to approve the signing of the State Motor Vehicle Contract was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Building Permit Mr. Bunker presented a building permit for the Church of Jesus Christ of Latter Day Saints - Monticello Utah Stake to build a pavilion at their Dude Ranch property. Mr. Bunker indicated that there was no problem with the permit. A motion to approve the building permit for the Church of Jesus Christ of Latter Day Saints was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. Temporary Hiring Hire requests were presented for temporary employment for Brent Bowers and Richard Perez at $6.19 per hour, Grade 5 Step 1. They will be working for the Road Department on the oiling projects. A motion to approve the temporary hiring of Brent Bowers and Richard Perez at $6.19 per hour, Grade 5 Step 1 was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. County Fair Representative Glenice Mantz, Chairperson of the San Juan County Fair met with the County Commission to review the County Fair and present the County Commission with County Fair hats. Mrs. Mantz requested the County provide $75.00 for the State Queen Pageant. The Commission asked Mrs. Mantz to have the USU Extension Office prepare an expense voucher for Commission approval. The Commission extended its appreciation to Mrs. Mantz and the Fair Board for their work. Mrs. Mantz informed the Commission that no one responded to the ad requesting someone take responsibility for the State Fair booth next year. Mrs. Mantz and Mrs. Lou Mueller will prepare the booth for this year. Mrs. Mantz was requested to solicit someone to attend with she and Mrs. Mueller. Department of Human Services Social Services Block Grant Ms. Glenna Webb reviewed with the County Commission the new program guidelines for the Social Service Block Grant Program. The County signed the State Contract this past week and it was mailed to the State for their approval. Ms. Webb indicated that the entire SSBG funding will be administered by the County. The Department of Human Services will prepare contracts between the County and the providers. The County will have to bill the State monthly for funding to pay the providers. The funding will come to the County and the County will be required to cut a check to the individual providers. Ms. Webb will assist with the preparation of the billing forms until such time that the County feels comfortable with the system. The State should be able to reimburse the County within a ten day period of time. The County will mail a copy of the contract signed last week to Ms. Webb when it is received back from the State. Ken Sleight - Pack Creek Bridge Mr. Ken Sleight reported to the Commission that the bridge at Pack Creek had washed out during a severe rain storm sunday night. Mr. Sleight indicated that his business had sustained a tremendous financial loss due to the previous condition of the bridge and now even more with the complete wash out. He indicated that he had previously requested that the County repair the bridge and due to the lack of repairs, the existing culvert was damaged beyond repair. The irrigation users are also unable to get water due to the conditions of the area and that construction efforts in the area are behind in their schedule. Mr. Sleight requested that the County provide him an immediate response as to when the bridge will be replaced or repaired. Commissioner Redd responded that he and County Engineer Pehrson had been to the bridge and it was determined that the amount of run off in the creek at the time would hamper their repair efforts. Commissioner Redd reported that the work would be major construction and that he had discussed with Mrs. Sleight that the project schedule would be about the end of August. Mr. Sleight stated that this is his major business season and this time frame is completely unsatisfactory to him. The Commission indicated that Grand County had requested an agreement with San Juan County dealing with the roads in this area in which San Juan County transferred the B Road money to Grand County for maintenance. The Commission will review the status of this road with the County Engineer. The County Road crews are involved with oiling projects that if delayed will not be able to complete until next year. Clark Terry - Zoning Variance Request Spanish Valley Mr. Clark Terry met with the County Commission to discuss the Spanish Valley airport. He reviewed his concerns about the State Division of State Lands and their schedule to either open or not open the airstrip. His impression was that the State Division will not allow use of the airport. Mr. Terry indicated that there is a strip of private property adjacent to the airstrip that is approved by the Federal Aviation Administration for a private airstrip. The airstrip has been there for at least twenty years and Mr. Terry questioned whether its use would be considered a "grand fathered" use. Mr. Terry indicated that he did not own the property and that he had contacted the current owner. The current owner requested that Mr. Terry come to the Commission to see what procedures would need to be followed to approve this use. The current owner of the property is also looking at a subdivision around this area. Administrative Assistant, Rick Bailey indicated that the use would probably not be allowed under the current zoning but the "grand father" use may bring to light some different issues. The County Attorney will need to be contacted to review these issues. Mr. Terry indicated that the previous use was that of a private strip and that he is interested in a type of commercial activity. Mr. Terry gave the Commission a copy of the land area. F. Bennion Redd - Blue Mountain Road F. Bennion Redd met with the County Commission to discuss the Road Agreement with Clyde Barton regarding the fence that is on the Blue Mountain Road. Mr. Redd indicated that he had discussed with Mr. Barton the use of prisoners from the County jail to repair the fence that was damaged by County Road crews as they were pushing snow. He also indicated that County Attorney Craig Halls had received a bill from Mr. Barton for labor to repair the fence, which may indicate that Mr. Barton has completed the repairs without the use of the prisoners. John Fellmeth - Procurement / Computers Data Processing Manager, John Fellmeth presented a procurement for the purchase of two computers, one for the engineers office and one for the recorders office. Two procurements were presented, one from Midwest Micro for $2005.30 and one from COMP USA Direct for $2324.00. Mr. Fellmeth recommended Midwest Micro based on best value. A motion to approve the purchase of the computers from Midwest Micro in the amount of $2005.00 each was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Independent Auditors Chief Deputy Auditor, John Fellmeth also discussed with the Commission his conversation with Mr. Danny Hendrix, Karren, Hendrix & Associates, the independent auditors regarding their interest in completing the County Audit for the next two years at the agreed upon amount. The firm indicated that they would contact Mr. Fellmeth in the upcoming two weeks. Budget Chief Deputy Auditor, John Fellmeth also discussed the upcoming spending needs of the County Commission, especially dealing with the Solid Waste Landfill Budget. Commissioner Redd questioned the spending during the current year from the Road Capital Account. Gail Northern - Request To Hire County Clerk, Gail Northern reported to the County Commission that she had reviewed the applications for the vacancy in her office. Doris J. Alvarez has applied to transfer from the San Juan County Sheriff's Office to the Clerk's Office. The Commission indicated that Mrs. Alvarez would need to sign a statement that she understands that she would accept the current rate of pay for the Clerk's position and not her current salary at the Sheriff's Office. County Attorney Craig Halls will prepare the statement. A motion to approve the transfer of Doris J. Alvarez from the Sheriff's Office to the Clerk's Office, according to County Policy, to fill the position of Deputy Clerk to the Commission at Grade 4 Step 4 with a 90 day probationary period was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT IHS-Solid Waste Meeting Administrative Assistant, Rick Bailey reported that he had met with Julie Orr and Roger Anderson of Indian Health Service and Brian Bremner, Beehive Enterprises regarding the financial projection requirements for the County's solid waste land. It was Mr. Bailey's opinion that Mr. Bremner properly defended his budget projections and that they would be able to defend the project in the IHS budget process. Julie Orr reported that IHS had been sued by DNA and other Navajo defendants over their process of dealing with solid waste. She felt that this law suit would benefit the County's application to IHS for funding. They also discussed the County's desire to build a transfer station at Mexican Hat and Bluff. She requested that a letter outlining the construction budget and service area be sent to her in regard to the transfer stations. Mr. Bailey reported that the State Division of Solid and Hazardous Waste has been on the potential site in the last two weeks and did not find any problems. The State should be preparing a Draft Permit for public comment and preparing for a public hearing at the present time. Wayne County's permit was approved this last week and San Juan County's application is the next to be handled. Mr. Bailey requested the County Commission look at the issue of having the County run the landfill or to put out a request for proposals to have an operator run the landfill on a lease or an agreement from the County. Julie Orr indicated that it would be her recommendation that those individuals who will be running the landfill and other County officials take the SWANA land fill operator's certification course. She felt that it would be very worth while for these people to take this course. She also indicated that they were working on the issue of the location of the transfer site at the Oljato-Monument Valley site. Administrative Assistant, Rick Bailey reported that he had sent letters to Utah Power and Light and GTE Telephone about providing services to the landfill. He also sent a letter to the Utah Department of Transportation requesting that they survey the turn off area at the proposed site. A meeting will be held on the site of the proposed landfill on Tuesday, August 17, 1993 with officials from Abajo Archaeology, Bureau of Land Management and Beehive Enterprises to review the progress and attempt to define the boundaries of the landfill. Senator Hatch Administrative Assistant, Rick Bailey reported that Robert Dibblee, staff member to Senator Hatch will meet with the County Commission next Monday before traveling throughout the County. The Commission should be ready to discuss any concerns with Mr. Dibblee at that time. BIA Road Contract Administrative Assistant, Rick Bailey reported to the County Commission that he had approved and signed the extension of the Bureau of Indian Affairs contract for the Aneth to Ismay Road. The original contract expired on June 30, 1993 and the extension will be for sixty days. Black Oil Company Monitoring Well Administrative Assistant, Rick Bailey reported that he had given approval to Black Oil Company to drill a monitoring well on the parking lot of the County Library located in Monticello. The company is required to monitor the well as part of their underground storage tank program. Cal Black Memorial Airport Administrative Assistant, Rick Bailey reported that he had met with officials of the Bureau of Land Management regarding the lawsuit on the Cal Black Memorial Airport. The BLM will prepare a draft Memorandum of Understanding between the County, the BLM and the FAA to allow the County to continue to operate the airport until the lawsuit has been settled. Mr. Bailey reported to the BLM in regard to the Memorandum. County Library Board Grant Administrative Assistant, Rick Bailey reported that the County has received notification the U.S. Department of Education has awarded the San Juan County Library Board a grant for their literacy project. The grant will be for one year beginning October 1, 1993 and ending September 30, 1994 in the amount of $34,119. Procurements Administrative Assistant, Rick Bailey presented to the Commission the following procurements: Purchase of six radios from Motorola in the amount of $3,872.00. These radios are part of a grant from the Division of State Lands and Forestry and the County will receive $3,702.00 from the State Division. Funding received previously from Mobil Oil will be used as part of the match. The funding from Mobil Oil was used to purchase pagers for the Montezuma Creek Fire Department. Purchase of a Honda 4-wheel Drive ATV for use by the County Engineer, County Weed Department, County Emergency Services and Search and Rescue. The vehicle will be scheduled by the Weed Department and the County Engineer. The purchase price is $4511.00 from Hondaland in Monticello. Purchase of a portable radio repeater system from SWS Security in the amount of $2,000.00. The other bid was from Motorola in the amount of $12,000.00. Purchase of three overhead doors for the Monticello Road Shed. The following procurements were received from Sonderegger Inc. for $2,184.65; Lowry Overhead Doors $2,040.00; HOJ for $2,044.00; Utah Overhead Doors for $3,540.00 and Crawford Doors for $2,413.00. The bid from Sonderegger was accepted. A motion to approve the procurements from Motorola in the amount of $3,872.00, Hondaland in the amount of $4,511.00, SWS Security in the amount of $2,000.00 and Sonderegger in the amount of $2,184.65 was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. Bluff Building Administrative Assistant, Rick Bailey notified the County Commission about a water line break to the air conditioner at the Bluff Community Building. There was some water damage to the walls and ceilings. A proposal was presented from Economy Cleaning and Restoration in the amount of $1,175.00 for repairs. Commissioner Redd indicated that he felt this was an emergency situation. A motion to approve the repair work by Economy Cleaning and Restoration in the amount of $1,175.00 was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. LaSal Dump Administrative Assistant, Rick Bailey reported that he and County Engineer, Doug Pehrson met with officials of the Bureau of Land Management from the Grand Resource Area and Moab District Offices regarding the closure of the LaSal dump effective September 1, 1993. After some discussion, the BLM agreed to allow the closure to be delayed until October 1, 1993, if the County would allow the Blankenagel dump garbage to be brought to the County site. This was agreed upon and the County will provide the BLM with a letter of proposed closure as soon as possible. The County has requested proposals for the placement of a dumpster in LaSal until such time that a transfer station or something else is in place. State Land Trade Bill Administrative Assistant, Rick Baileyreported that the U.S. Senate has passed the trade-out of the State Sections. The cap of the maximum earnings was increased to $50,000,000.00. The bill is different from the House and will be reviewed in a House Committee after their recess. Commissioner Redd has discussed this issue this morning with Robert Dibblee of Senator Hatch's Office. COMMISSIONER BILL REDD'S REPORT Meetings Attended Commissioner Bill Redd reported that he had attended the following meetings during the previous week: Blanding City Council, Utah Association of Counties Planning Committee and the Division of State Lands and Forestry Public Hearing on the Spanish Valley General Management Plan. Weed Board Commissioner Bill Redd indicated that he had received a list of potential members for the County Weed Board. The Commission requested that a letter be sent to these potential members to see if they would be interested in serving on the board. Administrative Assistant, Rick Bailey will follow-up with these letters. COMMISSIONER MARK MARYBOY'S REPORT Navajo-Hope Meeting Commissioner Mark Maryboy reported on a meeting held by the entire Navajo Tribal Council dealing with the Navajo-Hopi Land Division. There were discussions of grazing rights and payments. This meeting was held on site and was well attended. The feeling of the majority of those in attendance was not to approve the agreement. They wanted something concrete and permanent. The Tribal Council voted against the agreement. BIA Agency in Utah Commissioner Maryboy indicated that he had met with the Bureau of Indian Affairs. They are drafting a paper dealing with the formation of an agency office in San Juan County. Senator Hatch was instrumental in this process. Concurring Resolutions from the Navajo Tribal Council Commissioner Mark Maryboy received a resolution from the Navajo Tribal Council to place the Aneth to Ismay Road and the Red Mesa Road onto the State Road system. He also received a supporting resolution from the Tribal Council on a BIA Agency in Utah and an increase in the road maintenance funding for the Bureau of Indian Affairs. The County receives an allocation from this funding. UAC Commissioners Workshop Commissioner Mark Maryboy indicated that he wanted to attend the annual Utah Association of Counties Commissioners Workshop in September to be held at Bryce Canyon. Administrative Assistant, Rick Bailey will make the needed arrangements for him to attend. Travel Commissioner Mark Maryboy will be in Window Rock on Tuesday and will be at the County Fair on Thursday and in his office on Friday. COMMISSIONER TY LEWIS' REPORT Bluff Service District Commissioner Ty Lewis reported that the Bluff Service Area had applied to UDOT on an enhancement program. This application was not approved by the Department, however they will be able to re-apply. San Juan Forum Commissioner Ty Lewis reported that October 6, 1993 will be the next meeting of the San Juan Forum at the Fort Lewis College. Enterprise Zone Commissioner Ty Lewis reported that the County's enterprise zone category will expire on October 1, 1993. There is some paper work that has to be filled out and sent into the State. The Commission will review this information on work on the application in the near future. Solid and Hazardous Waste Commissioner Ty Lewis reported that the Utah Division of Solid and Hazardous Waste approved the Solid Waste Permitting and Management Rules, which incorporates the EPA municipal solid waste landfill criteria and set July 15, 1993 as the effective date for the rules. The Board also approved changes in some of the rules. These changes were made at the request of the Utah Attorney General's Office, at the request of the U.S. Environmental Protection Agency. There will be a comment period until August 31, 1993. Administrative Assistant, Rick Bailey will contact Brian Bremner, Beehive Enterprises to see if there are any comments that the County will need to make. Department of Energy Commissioner Ty Lewis indicated that he attended a meeting this past week with the Department of Energy regarding the Monticello Clean-Up Project. They are looking at two different alternatives, one of transporting the waste to the UMETCO property south of Blanding and another site on the property located south of the old mill site. San Juan County Fair Commissioner Lewis indicated that the San Juan County Fair will be held this week and that the Commissioners received special invitations to participate with the Fair activities. SUBDIVISION WORK SESSION County Attorney Craig Halls, County Assessor and Building Inspector, Bruce Bunker and County Road Engineer, Doug Pehrson met with the County Commission to review the proposed subdivision Ordinance. County Recorder Louise Jones was excused due to a prior commitment. Blanding City submitted written comments which were discussed by the group. Craig Halls will make the changes agreed upon by the group and provide Administrative Assistant, Rick Bailey with the changes so that he can make the changes on the computer disk. The approval of the Ordinance will be placed on the next week's agenda. INSPECTOR GENERAL GAO Commissioners Lewis and Maryboy and Administrative assistant Rick Bailey will meet with Mr. Ryba from the General Accounting Office regarding a report that he will be making to Congress dealing with Federal Grants and Loans to local governments.
