SAN JUAN COUNTY COMMISSION MEETING MINUTES SEPTEMBER 13, 1993 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Joanie Alvarez, Deputy Clerk A motion to approve the minutes of the September 7, 1993 meeting as amended was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. CURRENT BUSINESS Bids Bids received for the snow plow were from H & K Trucking for $19,785.00, A-G Trucking for $22,225.00, Holland Equipment for $22,260.00, Tesco-Williams for $22,999 and Holland Equipment for $26,900 (second bid). Commissioner Bill Redd made a motion to accept the low bid of $19,785.00 from H & K Trucking. Commissioner Mark Maryboy seconded. UNANIMOUS. Historical Committee Corinne Rohring submitted a request to use County welder Johnny Alvarez and the County's portable welder to set up the original Bluff jail at Monticello's City Park. Commissioner Bill Redd made a motion to let her use both. Seconded by Commissioner Mark Maryboy. UNANIMOUS. Cross-Deputization Herbert Claw, Director of Public Safety, Joe Lennihan and Margaret Chase, Attorney's for the Navajo Nation met with the Commissioners to discuss Cross- Deputization and the 911 system on the Navajo Reservation. Also involved in the discussion were Claude Lacy, County Sheriff, Craig Halls, County Attorney and Notah Tahy, F.B.I. One topic of discussion was the fact that cross-deputization only gives San Juan County Deputies the authority to give traffic tickets, not the authority to arrest and take to jail anyone that violates the law. San Juan County needs the cross-deputization agreement to state that San Juan County Deputies have the authority to arrest anyone violating the law on the Reservation. The other topic of discussion was the 911 system. When the 911 system is up and running on the Reservation, officers need to respond. San Juan County needs to know whether Navajo Law Enforcement Officers are going to respond. San Juan County does not have the manpower or the funds to commit officers to the Reservation. Notah Tahy, F.B.I. discussed the lack of police protection on the reservation. Craig Halls, County Attorney, stated the liabilities of installing a 911 system on the Reservation that is answered by the San Juan County Sheriff's Office with County Deputies unable to respond because of lack of authority. Herbert Claw, Director of Public Safety, also discussed hiring more Navajo Law Enforcement Officers, housing for officers, the lack of adequate facilities for inmates, purchasing of modular facilities to house inmates, funding and the Montezuma Creek F.B.I. Office. Administrative Assistant, Rick Bailey indicated that the 911 system on the Reservation is fully functional but is not turned on as yet. To relieve some of the pressure felt by the Sheriff's Office Dispatch when the 911 system is up and running, the calls could easily be routed to Shiprock or Kayenta by the phone company thereby relieving the San Juan County Sheriff's Office Dispatch. Attorney's Joe Lennihan and Margaret Tate are going to try and come up with an agreement that is acceptable to both San Juan County and the Navajo Nation. Subdivision Richard Tangren presented his blue prints for subdivision of the Spanish Valley Airport. Mr. Tangren requested information on what needs to be done to open the old airstrip. Commissioner Ty Lewis referred Mr. Tangren to the subdivision ordinance and also requested that he do a preliminary plat and bring it back to a future Commission meeting. Mr. Richard Tangren requested a copy of the subdivision ordinance. Administrative Assistant, Rick Bailey gave him an updated copy of the subdivision ordinance with changes. BLM Kate Kitchell and Bob Turri of the Bureau of Land Management discussed the land disposal/landfill proposal and an alternate proposal with the Commissioners. Mr. Bob Turri presented an application for the Commissioners to fill out. Mr. Turri requested a mining plan, including any maps and diagrams. They discussed public access, access roads, the road that goes into Cottonwood as a public access road to dump site and asked Administrative Assistant, Rick Bailey to get with County Surveyor, Doug Pehrson and survey that road and the dump site. Ms. Kitchell also requested that Administrative Assistant, Rick Bailey take a look at the proposed action and the two alternatives and get all requested materials back to Mr. Turri as quickly as possible. Ms. Kitchell indicated that the Bureau of Land Management is involved in a co-op agreement with the County and the Forest Service on Law Enforcement and stated that within the next fiscal year she will be looking into the law enforcement agreement. Fire Control Fire Warden, Frank Morrell presented a request for a Firefighter Standby Policy. Commissioner Ty Lewis suggested that he make a draft policy and present it at the next Commission meeting. Fairgrounds County Extension Agent, Jim Keyes presented a bid to the Commissioners for the construction of a concession stand and restrooms at the County Fairgrounds. One bid was received from Bruce Bunker in the amount of $57,600.00. Commissioner Bill Redd made a motion to accept this bid and Commissioner Mark Maryboy seconded. UNANIMOUS. PROCESS FACILITATOR EDWARD TAPAHA'S REPORT Meeting Process Facilitator Edward Tapaha reported that on Wednesday, September 8, 1993 he attended a meeting in Window Rock with the Historical Preservation Committee. Mr. Tapaha met with David Tomelson on Thursday, September 9, 1993 to discuss surplus equipment. There is a Utah Navajo Commission meeting that Edward Tapaha will be attending on Wednesday, September 15, 1993 and also a Shiprock Agency meeting in Farmington he plans to attend on September 16 & 17, 1993. He states there is also a Western Navajo Agency meeting in Dennehotso he would like to attend. Mr. Tapaha also discussed cross-deputization and the 911 system on the Reservation with the Commissioners. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Subdivision Ordinance Administrative Assistant Rick Bailey presented a draft copy of the Subdivision Ordinance with proposed changes to the Commission. Commissioner Bill Redd made a motion to accept the subdivision ordinance with changes and Commissioner Mark Maryboy seconded. UNANIMOUS. Letter Mr. Bailey submitted a letter he received from the Navajo EPA regarding the asbestos problem in Halchita stating they do not provide funding for renovation or demolition of housing units containing asbestos. Commissioner Bill Redd suggested they take a copy of that letter together with their own letter, and send copies to Karen Sheppard and the State to see if there is a way either can help through Federal or State Agency's to help clear up this cancer danger. John Smith of Congressman Orton's Office volunteered to take on this task. Administrative Assistant Rick Bailey presented a letter he received from President Zah in support of the establishment of a Utah Area Agency Office. Commissioner Ty Lewis stated they needed that letter along with Resolutions from area Chapters in support of the Bureau Agency Office to take to Washington D.C. Meeting San Juan Forum Board of Directors meeting is set for October 6, 1993 at 10:00 a.m. at the Administration Building in Durango, Colorado. Travel Administrative Assistant Rick Bailey requested out-of-state-travel to Monterey, California for December to attend a Landfill Managers Certification Course. Commissioner Redd made a motion to approve out-of-state-travel for Mr. Bailey and Commissioner Mark Maryboy seconded. UNANIMOUS. COMMISSIONER MARK MARYBOY'S REPORT Utah Navajo Fair Commissioner Mark Maryboy announced that the Utah Navajo Fair has been cancelled. Possibly rescheduled to open sometime in October. Commissioner Maryboy discussed the Utah Navajo Fair, the property the Fair will be on, who owns the property (UNDC or UDIA) and Navajo Trust Money. With many questions comming up, Commissioner Maryboy requested that Larry Isaac of the Utah Department of Indian Affairs attend the next Commission meeting on September 20th, 1993. Administrative Assistant Rick Bailey will notify Mr. Isaac. Meeting Tomorrow, September 14, 1993, Commissioner Maryboy will be in Shiprock meeting with the Bureau of Indian Affairs and Wednesday, September 15th he will be attending Navajo Utah Commission meeting in Bluff. Commissioner Mary Maryboy and County Attorney Craig Halls will meet with the Mexican Hat Service District on Monday, September 20th, 1993 at 6:00 p.m. Utah State Fair On September 16th and 17th Commissioner Maryboy will be in Salt Lake City attending the Utah State Fair. Houses Commissioner Maryboy related comments back to Herbert Claw's, Director Of Navajo Public Safety, earlier message that if we can attain two BIA houses, then he could put two Navajo Law Enforcement Officers down in the southern end of the County. Administrative Assistant Rick Bailey will get with Mobile Oil to see if they will donate the houses. COMMISSIONER BILL REDD'S REPORT Meeting Commissioner Bill Redd reported that last Thursday, September 9, 1993 he attended a State Land Policy Board meeting in Salt Lake City. Commissioner Redd also states that he met with the UAC Trust concerning the second Begay case. On Friday, September 10th he met with Kate Kitchell of the Bureau of Land Management and discussed County Lands. Commissioner Redd relayed to the Commission that he would welcome an in-depth Economic Base Analysis for San Juan County. He suggested that the County also needs a good Mineral Study. Commissioner Redd met with Joe Jenkins to discuss the County's AOG being funded out of CIB and the need for a proposal if this is the Commission's desire. There will be a Library Board meeting and UAC meeting this week that Commissioner Redd will be attending. Subdivision Ordinance Commissioner Bill Redd made a motion to charge $5.00 for a copy of the Subdivision Ordinance. Commissioner Ty Lewis seconded. UNANIMOUS. COMMISSIONER TY LEWIS' REPORT State Fair Commissioner Ty Lewis reported that the San Juan County booth at the Utah State Fair didn't win any ribbons. He also states that the San Juan County Queen didn't win either. Commissioner Lewis requested a letter be sent to Lou Mueller thanking her for her efforts. He said the booth was well done, very creative and artistic. Administrative Assistant Rick Bailey will send the letter to Lou Mueller. Travel Commissioner Ty Lewis reports that he will be home this week.
