SAN JUAN COUNTY COMMISSION MEETING MINUTES NOVEMBER 1, 1993 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Joanie Alvarez, Deputy Clerk A motion to approve the minutes of the October 25, 1993 meeting as written was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. CURRENT BUSINESS Aging Director Aging Director Frank Morrell presented names of applicants for the position of Ombudsman. They were Marian Laws, Donald Laws and Rose Reilly. Commissioner Bill Redd made the motion to approve the hiring of Rose Reilly at grade 4, step 1, $5.94 per hour. Commissioner Maryboy seconded. UNANIMOUS. Frank Morrell also submitted a payroll change for Malva Jones. Commissioner Bill Redd made a motion to approve the pay change for Ms. Jones from grade 3, step 5, $5.94 per hour to grade 5, step 5, $6.44 per hour. Commissioner Maryboy seconded. UNANIMOUS. Another topic of discussion Mr. Morrell brought up was the new proposed Medicaid Lien Law. Mr. Morrell stated this law essentially gives the State permission to take a persons assets home, provided said person is not leaving the nursing home. Mr. Morrell states Legislator Howard Stevenson is purposing this bill. He states Mr. Stevenson is assuming the person will not be going home and that his assests should be signed away. Commissioner Bill Redd expressed his own feelings about being oppossed to this bill. Conrad Aitkin/Principal Mexican Hat School Conrad Aitkin principal of the Mexican Hat school started by extending a belated "thank you" to Rick Bailey and the Commissioners for their help with the projects in Monument Valley. He then met with the Commissioners to discuss the dangers facing the students in his school. Mr. Aitkin discussed the possiblity of placing speed bumps in front of the school to slow traffic down, posting 20 mph speed limit signs, placing flashing signals for a crosswalk in front of the school. Mr. Aitkin stated repeatedly that this was a very hazardous area. He also requested the County prepare a walkway for students along the main road and also a crosswalk. Commissioner Lewis stated the County would grade the walkway along the main road but couldn't place a crosswalk as the County cannot maintain a flashing crosswalk. Commissioner Mark Maryboy told Mr. Aitkin to prepare letter refering to the problems in front of the school and he would check on solutions from the Tribe and/or BIA to see if they would be willing to help. The Commissioners also suggested that Mr. Aitkin do a community survey for input on solutions. Tentative Budget County Clerk/Auditor Gail Northern and County Deputy/Auditor John Fellmeth met with Commissioners to discuss the tentative budget for the County. John Fellmeth presented October's financial statements for review. Gail Northern stated the budget hearings will be December 7, 1993. Sheriff's Department Computers Mark Ewart and Bill Christensen of the Sheriff's Office submitted bids for a computer motor to get their system up and running. Commissioner Redd made a motion to accept the bid from Maverick in the amount or $5590.00. Commissioner Maryboy seconded. UNANIMOUS. Bill Christensen then submitted a bid for twenty five electronic door locks from Jail Craft Inc. in the amount of $368.00 each for a total of $9,200.00 and twenty five door position indicators in the amount of $44.00 each for a total of $1,100.00. The subtotal indicated is $10,300.00 with a 25% discount of $2,575.00 for a total of $7,725.00 plus $200.00 freight charges for a total of $7,925.00. Commissioner Bill Redd made a motion to approve this purchase. Commissioner Maryboy seconded. UNANIMOUS. San Juan County Recorder/Request to purchase County Recorder Louise Jones submitted a bid to purchase a computer monitor from Mid West Micro in the amount of $349.99 plus shipping and from AMC Direct in the amount of $439.00 plus shipping. Commissioner Redd made a motion to approve the purchase from Mid West Micro for $349.00. Commissioner Maryboy seconded. UNANIMOUS. Wilber Capitan/Aneth Chapter Wilber Capitan came to the Commission meeting with a request from the Aneth Chapter concerning county roads that were surveyed by the County. He stated some of the roads had been left out of the survey and requested that the same type of project entered into by the two entities, the Navajo Nation and San Juan County, continue into the new year. Commissioner Lewis stated the roads needed to be prioritized. He also stated if the County applied for funding for oiling of these roads, they would need that priority list. Process Facilitator Edward Tapaha stated that power lines and all utility poles also needed to be identified as the Tribe would not build any roads until all power lines and service poles are removed. Commissioner Lewis stated the list would be given to County Surveyor Doug Pehrson but there were other roads that had priority over theirs. Commissioner Maryboy stated once the right-of-ways were obtained then it became mandatory for BIA to pick these roads up on their system. Doug Christensen/Forest Service Doug Christensen of the Forest Service came to Commission meeting to see what San Juan County law was on grazing and fences. Is it fence in or fence out. Commissioner Lewis stated that San Juan County was "fence in". Maintenance Supervisor Maintenance supervisor Dell Hunter went before the Commissioners to request some type of clean-up policy or cleaning deposit for persons reserving the conference room or the commission room. He stated over the Halloween holiday there was a party in the conference room. The person that reserved the room did not clean up afterwards, leaving the place in shambles. It took his maintenance personell over four hours to clean that one room. Mr. Hunter requested there be a policy developed for those entities, including user fees and deposits to pay for cleaning costs. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Robert Dibblee Administrative Assistant Rick Bailey reported that Robert Dibblee of Senator Hatch's office and his Chief of Staff Wendy Higginbotham would be in San Juan County during the Veteran's Day holiday to discuss the preservation and management of heritage resources in the four corners/San Juan County area. Mr. Bailey stated Mr. Dibblee invited the Commissioners to join them for dinner and join them when they toured San Juan County. Valley of the Gods / Movie Rick Bailey stated the Commissioners received a letter from Ron Griffin of Griffin Enterprizes in Moab stating they are doing a movie shoot in the Valley of the Gods area and requested permission to make a mud bog in the middle of the road to get a vehicle stuck. The road would still be open from both ends but travel would be limited. Rick Bailey suggested they get an encroachment permit and meet County Surveyor Doug Pehrson's requirements according to the encroachment permit. Mexican Hat Service District Mr. Bailey reported that the Mexican Hat Service District requested that recreation be added to their services in that district. There has been a public hearing set up on November 29, 1993 at 6:00 p.m. at the post office building in Mexican Hat. Mr. Bailey also reported on the vacant seat on the Mexican Hat Service District Board. He stated Steve Keller said he would only be interested in serving on the board if no one else would. Based on that, there is only one candidate whose name has been submitted. Interdepartmental Breakfast Rick Bailey stated the interdepartmental breakfast would be held this Friday, November 5th at 8:00 a.m. at the MD Ranch Cookhouse in Monticello. Subdivision Mr. Bailey stated he had received two current applications for subdivision, both in the Spanish Valley area. State Surplus Dave Tomelson, Director of State Surplus equipment met with Rick Bailey and others last Wednesday, October 27th, regarding a proposal to try to involve Vo-Ed programs, federal surplus and shared equipment into the school programs. There was representatives from Monticello and Blanding, Larry Izaacs from the Navajo Trust, representatives from the school district and college. Family Medical Leave Policy Mr. Bailey reported that the Family Medical Leave Bill, which we are subject to, took effect in August of this year and the County does not have a current policy. Mr. Bailey will work up a draft of the policy and present it back to the Commissioners at a later date. UDOT Mr. Bailey passed around a letter from UDOT stating they will have a meeting at the City Park pavillion on Monday, November 22, 1993 at 6:30 p.m. to discuss highway needs for San Juan and Grand counties. As part of the package they sent along a list of priority highway needs in our area. Variance Request The Commissioners received a request for variance from a gentleman in Moab. He has owned a one acre parcel with a mobile home on it for ten years and now would like to build a log home on his land. The Commissioners stated he could build a new home without a variance because he was "grandfathered" in and the use has not changed. CDBG Proposed Projects Public Hearing Commissioner Bill Redd called the public hearing to order at 1:00 P.M. Those in attendance were Commissioner Bill Redd, Administrative Assistant Rick Bailey, County Surveyor Doug Pehrson and Deputy Clerk Joanie Alvarez. Commissioner Redd stated the public hearing had been properly advertized in the San Juan Record and the purpose of the hearing was to receive input from interested persons for proposed projects for the 1994 Community Development Block Grant program. Commissioner Redd asked if there were any potential projects proposed by the public. No comment was received. Commissioner Redd stated the County had two proposals. The first was the purchase of first response fire vehicles for the communities of Monument Valley, Montezuma Creek and Cedar Point. The second would be funding repairs and remodeling of the Bluff Community building and the enclosure of the Montezuma Creek swimming pool. The Commission will take these projects under advisement and make a final selection at the next Commission meeting on November 8, 1993. Commissioner Redd then asked if there were any questions or comments. There were none. The public hearing closed at 1:15 P.M. G.I.S. Discussion John Fellmeth, Bruce Bunker, Louise Jones and Doug Pehrson met with the Commissioners to discuss the possibility of installing a new computer program in the Assessor's, Recorder's, and the Surveyor's offices. This would be a system that each could tie into and build on. They discussed budgeting for this program, services offered by this program, financial requirements, 7 and 1/2 minute topografic maps, global positioning rods and other topics. PROCESS FACILITATOR EDWARD TAPAHA'S REPORT Meeting Process Facilitator Edward Tapaha reported he attended a BIA Quarterly meeting in Cortez, Colorado on Monday and Tuesday, October 25th and 26th. Topic of discussion was road priorities for '93 and '94. Mr. Tapaha then discussed the Halchita road, Oljato Chapter's priority list on roads, BIA's jurisdiction, Aneth to Navajo Mountain road and archeological studies for roads and maintenance on these roads. The Transportation Developement Committee will hold it's meeting tomorrow, November 2nd in Window Rock. The purpose of this meeting will be to prioritize the Navajo Nation road system. Blue Mountain Dineh will also hold their meeting on November 2, 1993. Mr. Tapaha will attend the Utah Navajo Commission meeting on Thursday, November 4, 1993. He will be meeting with the Tribal Attorney General in Window Rock, Arizona. There will be two meetings on Sunday, November 7th. The Oljato Chapter planning meeting the Navajo Mountain planning meeting. On November 9th the Oljato Chapter will conduct an appreciation dinner for the land exchange. COMMISSIONER BILL REDD'S REPORT Trust Land Advisory Board On October 20, 1993 Commissioner Bill Redd testified in front of the Trust Land Advisory Board in Price. Meetings Commissioner Redd attended a Coalition 2000 meeting in Provo on October 21st in the morning and in the afternoon attended a Comprehensive Land Planning Committee meeting with the State office of Planning and Budget. October 22nd Commissioner Redd attended the ACIR meeting on behalf of the State Comprehensive Planning Committee. October 25th he attended the Uintah County Commission meeting for clarification on their land planning. Commissioner Redd attended the Fiscal Analysis Information meeting on October 29th at the OPB office and on the same afternoon attended the AOG meeting in Price. COMMISSIONER MARK MARYBOY'S REPORT Navajo Tribe Commissioner Maryboy reported the Navajo Tribe is trying to form their own oil company. The purpose behind this, is since Congress could not work with President Zah to get the Trust Funds transferred to the Navajo Nation, this is another approach, by forming the oil company he can subcontract with major oil companies and the 37 and 1/2% goes to the Navajo Nation. Meeting Commissioner Maryboy met with Indian Health Services in Window Rock and discussed the proposed clinic in Red Mesa. They also discussed the clinics in Montezuma Creek, Halchita, Monument Valley and Navajo Mountain. Commissioner Maryboy will be one of the speakers for the opening ceremonies for the Western Health Summitt held in Salt Lake City on November 14th and 16th. Commission Meeting Commissioner Mark Maryboy will be gone during the Commission meetings on November 8th and November 15th. Schedule Mr. Maryboy will be in Window Rock tomorrow November 2nd and 3rd and Thursday, November 4th at Navajo Utah Commission meeting and at his office in Aneth on Friday November 5th. COMMISSIONER TY LEWIS' REPORT Judge Muhlestein Commissioner Lewis reported he received a letter of resignation from Judge Harold Muhlestein effective February 1, 1994. Judge Muhlestein and his wife Fay will be retiring as of this date. He also requested to purchase the old selectric 3 typewriter he has used during his term as Justice Court Judge. The typewriter is the old "ball" type and is fifteen years old. Letter Commissioner Lewis stated he received a letter from the San Juan Forum requesting a copy of the County's solid waste plan.
