SAN JUAN COUNTY COMMISSION MEETING MINUTES DECEMBER 20, 1993 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Chambers at Monticello, Utah. Present: Ty Lewis, Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant Joanie Alvarez, Deputy Clerk Excused: Mark Maryboy, Vice-Chairman A motion to approve the minutes of the December 13, 1993 meeting as amended was made by Commissioner Redd and seconded by Commissioner Lewis. UNANIMOUS. CURRENT BUSINESS Library Budget Joyce Martin of the Library Board met with the Commissioners to discuss the library budget and the Bluff library joining the State Library system. It was discussed that if the Bluff library join the State Library system it would be up to the Bluff library personnel to submit a formal written request to do so. Probationary Raises County Clerk/Auditor Gail Northern was at the Commission meeting to discuss papers submitted by Sheriff Claude Lacy disagreeing with probationary raises from his department which had already been approved as retro-active pay by the Commissioners. The Commissioners will review the employees in question at next weeks Commission meeting. Commissioner Lewis requested Clerk/Auditor Gail Northern write a policy stating all new hires starting January 1st, 1994 will be on a probationary period but at the end of that time will not receive a probationary increase in pay. Those already in the system will receive their retro-active pay. It was again mentioned that all pay changes will be routed through the County Clerk's Office. County Vehicles The Commission approved a list of qualified County personnel authorized to commute in County vehicles. If department heads feel others in their departments should also commute they must justify that use to the Commission. The departments have until January 1, 1994 to comply. Ms. Humphreys requested Ms. Taylor be changed from part- time, 30 hours per week to full-time, 40 hours per week. Ms. Humphreys could not find a comparable grade and step for Ms. Taylor. She is now a grade 2, step 14 at $1082.00 per month. The job change form was given to the Clerk's office to find an appropriate grade and step for Ms. Taylor. Ms. Humphreys also discussed her own grade and step with the Commissioners as the next increase she will be off the scale and needs to be adjusted accordingly. Ms. Humphreys also discussed her idea of trying to make the film developement in Grand and San Juan Counties into a private foundation. The new name is the Moab To Monument Valley Film Commission. Commissioner Lewis discussed the Travel Council's office hours with Ms. Humphrey's. Independent Auditors County Clerk/Auditor Gail Northern submitted for signature an Engagement letter for $8500.00 for the 1993 audit from Independent Auditors, Karren, Hendrix & Associates. Commissioner Redd made a motion to sign the engagement letter. Commissioner Lewis seconded. UNANIMOUS. Public Hearing Commissioner Lewis announced the Commission was open for public hearing to solicit comments on the CIB application for solid waste landfill at 1:00 p.m. Administrative Assistant Rick Bailey stated the County had properly advertized in the San Juan Record that the County would hold a public hearing for the purpose of soliciting comments concerning the proposed application from the Community Impact Board for the activities associated with solid waste landfill. Mr. Bailey then read from the Community Impact Board Policy. Commissioner Lewis stated the Commission has met all qualifications of the law and will procede to hear the public's comments. The proposal is to request the CIB to fund, as a grant, the amount of $750,000.00 for the construction of a solid waste facility. The public would be impacted by having to pay users fees based on weight of garbage delivered to the landfill or assessed amount of those entities which are picking up solid waste. The question raised was, should the County accept this as a loan. Commissioner Redd responded with "why should we in view of the fact that this is a high producing mineral lease area, the impact is in this area and that's the purpose of the money that the citizens in this area, because of their declining tax base due to lack of mineral production are entitled to have those impacts mitigated". Seeing there was no more public imput, Commissioner Redd made a motion saying in light of the fact that all of the public input was in favor of going to CIB and getting a grant for this worthy purpose, the Commission pursue that with diligence and authorized Commissioner Lewis to sign paperwork necessary for the fulfillment of that public request. Commissioner Lewis seconded. UNANIMOUS. Road Department Bids Wanda Franklin of the County Road Department opened bids for oil, grease and antifreeze. Commissioner Redd made a motion to accept the bids from Woody's Petroleum. Commissioner Lewis seconded. UNANIMOUS. Bids for batteries were also opened. Commissioner Redd made a motion to accept the bids from Grand Tire. Commissioner Lewis seconded. UNANIMOUS. Culvert bids were also opened. Commissioner Redd made a motion to accept the culvert bids from Amcor. Commissioner Lewis seconded. UNANIMOUS. Tire and Filter bids were tabled until the next Commission meeting. Justice Court Judge The Commissioners will be interviewing the top four candidates for the position of Justice Court Judge tomorrow, December 21st at 2:00 p.m. The person chosen for the position will be notified officially at the next Commission meeting on December 27th. Grievance Hearing The Commissioners heard an informal grievance today, December 20th at 2:30 p.m. Commissioner Redd made a motion to go into executive session. Commissioner Lewis seconded. Commissioner Redd made a motion to go out of executive session at 3:10 p.m. Commissioner Lewis seconded. It was determined there was sufficient evidence to proceed with the grievance. A hearing will be scheduled in the very near future. Administrative Assistant Rick Bailey was instructed to set a date and send a letter to both parties nofifying them of the decision to hear both sides of the grievance. Out-of-State Travel Peggy Humphreys submitted a request for out-of-state travel to attend the Southern California Travel Show from January 10th to the 18th. Commissioner Redd made a motion to approve the out-of-state travel request and Commissioner Lewis seconded. UNANIMOUS. PROCESS FACILITATOR EDWARD TAPAHA'S REPORT Meetings Process Facilitator Edward Tapaha reports he attended a Western Agency Road meeting in Oljato on December 13th and gave them an update on San Juan County Roads. Mr. Tapaha met with the Utah Dineh Committee on December 10th and discussed matching funds for roads, senior citizens and recreation. Mr. Tapaha also attended a District 9 Council meeting and a Shiprock Agency meeting. While in Moab, Senator Bob Bennett met with Process Facilitator Edward Tapaha. Mr. Tapaha reported on the four major topics of discussion, which were 1- Navajos in mining, 2- BIA funds and the fact that the funds go to five or six area offices which each take a cut of the funds before it ends up in Utah, 3- Open mines in Oljato and Monument Valley and 4- The road from Navajo Mountain to Oljato. Schedule Mr. Tapaha will be attending the Oljato Chapter Christmas Dinner on Thursday, December 23rd. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Resolution Conference Administrative Assistant Rick Bailey stated he received notification of a Resolution Conference for a road department employee on January 5th, 1994 at 1:00 p.m. in Price. Spanish Valley Property Mr. Bailey received a request to bid on 5.7 acres of property in Spanish Valley from Jamie Narans. It was decided the property in question needed to go out for bid. Minimum bid acceptable would be for taxes, interest and recording fees. 1993's appraised value $10,780.00. Commissioner Lewis stated he would be open to accepting the appraised value or a comprable trade of a gravel source. No decision was made at this time. Out of State Travel Mr. Bailey submitted two out-of-state travel requests for himself. One to attend a class on the 911 system in Showlow, Arizona on December 30 and 31st and the other for State Emergency Services in Emmettsburg, Virginia. Commissioner Redd made a motion to approve both out-of-state travel requests. Commissioner Lewis seconded. UNANIMOUS. Bluff Tourist & Cultural Center A request was submitted from the Bluff Tourist & Cultural Center for $1500.00 for the construction of a hogan to be used as a story center in front of the Bluff library. Peggy Humphreys from the Tourist and Promotion Board was called in and instructed in the proper procedure the Bluff Tourist & Cultural Center should follow. 1 - They should have clearance from the Bluff Service District, 2 - An O.K. from the property owners and 3 - A building permit from the Assessor's office. COMMISSIONER BILL REDD'S REPORT Meetings Commissioner Redd stated he attended the State Planning meeting on Thursday, December 16th and met with Interior Secretary Babbitt on Friday, December 17th. On Tuesday, December 21st he will be in Monticello on the interview board for the position of Justice Court Judge. COMMISSIONER TY LEWIS' REPORT Meetings Commissioner Lewis reported he met with Senator Bennett on December 15th in Moab. Some of the topics of discussion were the DOE clean-up in Halchita and Monticello, the Navajo Trust Fund lawsuit and the ownership of the Cal Black airport. Commissioner Lewis also met with John Pace, the attorney representing the Utah Navajos in their lawsuit against the State.
