SAN JUAN COUNTY COMMISSION MEETING MINUTES JANUARY 10, 1994 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Chambers at Monticello, Utah. Present: Ty Lewis, Chairman Mark Maryboy, Vice-Chairman Bill Redd, Commissioner Joanie Alvarez, Deputy Clerk Excused: Rick Bailey, Administrative Assistant A motion to approve the minutes of the January 3, 1994 meeting as amended was made by Commissioner Redd and seconded by Commissioner Maryboy. UNANIMOUS. CURRENT BUSINESS Transient Room Tax Ken Sleight met with the County Commissioners to discuss his ideas on the transient room tax. He stated according to the Economic Development Board/Travel Council minutes, they have set aside $55,000.00 from the transient room tax for the Halls Crossing Airport. Out of the $200,000.00 the County is expecting to get, the County can't afford to put that much money on any one project. He also stated that according to another source, Grand County is expecting to receive approximately $500,000.00 from the transient room tax and he thinks some of that money should be diverted to uses other than tourism. He then submitted a proposal and letter to the Commissioners stating he supports that thought up to a point. One of the recommendations he feels strongly about would be to re-organize the Travel Council Board as there are no Navajo people on that board. He then discussed his proposal of having four members from the south district and four members from the north district serving on this board along with representatives from the County Commission. The professional staff should then hire two more employees of Navajo descent. He stated they could save money by doing away with travel to the Trade & Travel Shows given throughout the States and that the money could be put to better use in advertizing locally. Mr. Sleight also expressed his desire for the Travel Council to view the Chapters as communities. He then stated on a local level alot could be done and/or promoted, i.e. pow wow's, fairs, etc. Commissioner Maryboy commented that some of the Chapters are interested in accessing the transient room tax. He then discussed matching funds and stated there are a few Chapters who are already trying to work with the County in this area. Mr. Sleight stated his opinion was if they were given the "seed" money, the Chapters would develope a travel/tourist committee and locally it would be beneficial. It was noted that two Native Americans who had served on the board in the past were Manuel Morgan and Dick Neztosie. Building Permit A building permit was submitted for Southern Paving Company in Moab for an addition in section 1 T27S R22E Tax #669 40 1985. Commissioner Redd made a motion to approve the addition and Commissioner Lewis seconded. UNANIMOUS. Procurement Bill Bayles submitted a bid from Cedar Mesa Electronics for 2 Kenwood mobile dual band radios for $1524.00 each for a total of $3048.24. Commissioner Redd made a motion to approve the purchase and Commissioner Lewis seconded. UNANIMOUS. Out of State Travel Request Fire Warden Frank Morrell submitted a request for out of state travel to attend an arson investigator conference. Total cost is $332.80. Commissioner Redd made a motion to approve the out of state travel request and Commissioner Maryboy seconded. UNANIMOUS. County Vehicle Policy County Communications Specialist Bill Bayles requested to be put on the list of County employees approved to commute to and from work in County vehicles. He stated he is subject to call-outs at all times. Commissioner Lewis requested documentation supporting the necessity. Mr. Bayles stated he keeps no records other than his own time sheet. The Commissioners decision was tabled until a future date. Justice Court Judge The San Juan County Commission received the following letter of resignation from A. Paul Mantz; Dear Sir: With great regret and sadness I need to inform you that due to circumstances beyond my control I will be unable to accept the job of San Juan County Justice Court Judge. I only found out these circumstances today. I feel it a great honor that the Commission chose me for this position and wish to thank the Commission for their consideration. I hope that I have not caused you a great deal of problems because of my inability to take the job. If I have I wish to express sorrow and regret. Sincerely, A. Paul Mantz After receipt of the above letter, it was decided that Commissioner Lewis would interview the remaining candidates as he was not involved in the first interview due to conflict of interest. Only two candidates were interviewed. On the point system Lyon Hazelton received 109 points and Chuck Kreautler received 105 points. Commissioner Redd made a motion to hire Lyon Hazelton as the Justice Court Judge at grade 21, step 1 as a transfer from the County Road Department and Commissioner Maryboy seconded. UNANIMOUS. County Promotion and Transfer Policy Commissioner Redd made a motion to approve the amendment to the County promotion and transfer policy and Commissioner Maryboy seconded. UNANIMOUS. The policy now reads: It is the policy of San Juan County to promote its own employees to positions of greater responsibility whenever possible. Announcement of position vacancies will be posted on your facility's bullentin board. If you wish to be considered for any of the vacancies you may make application with your County department head. Should you transfer to a new position you will be doing so on a ninety (90) day probationary period. All accrued benefits including vacation, sick-leave, County seniority, etc., will be transferred with you to your new position. Pay will be whatever the position pays, not what the employee is making at his previous position. San Juan County reserves the right to fill or not to fill position openings with an in-house or San Juan County employee, based upon the determined San Juan County need and/or priority at the time the position becomes open. If the promotion or transfer involves a change in the employees pay grade, the new pay step will be determined as follows: 1 - Find the current pay grade and step. 2 - Find grade the employee will be advanced to. 3 - Locate on the new grade that step which matches closest to current pay, but not less than. 4 - Add to this amount the difference between the original grade and the new grade and move to that step on the new grade which matches closest to but not less than this difference. Aging Director Aging Director Frank Morrell reported on a staff meeting he conducted dealing with budget cuts and senior buses. A discussion ensued over sharing buses, CDL drivers, the senior citizen activity calendar and Center Directors co-ordinating their activities. He then requested the possibility of the buses going home with the drivers as opposed to being parked in another designated place for fear of vandalism. The request is for three buses in Blanding and one bus/van in Bluff. Commissioner Redd made a motion to add the three buses in Blanding and the one in Bluff to the County's list of approved drivers commuting in County vehicles. Commissioner Maryboy seconded. UNANIMOUS. Fire Warden Fire Warden Frank Morrell submitted the follow-up to the fire agreement for signature. Commissioner Lewis signed. Mr. Morrell then discussed leasing fire vehicles opposed to buying them. Commissioner Lewis requested Mr. Morrell run a new spread sheet and bring it back to a future Commission meeting. Commissioner Maryboy discussed extrication equipment with the fire warden and requested he get with the Montezuma Creek firefighters and help them prepare a Proposal for the purchase of such equipment and also to help with their training. Assessor's Office County Assessor Bruce Bunker discussed what he termed "a problem in his office with the exemption process for Native Americans". He stated his office staff requests to see a persons drivers license and then takes the address off of the license for their forms. The problem being some of the Native Americans are claiming tax exemption status as they say they live on the Reservation not at the address listed on their drivers license. When one of his staff members knows of a persons current address, she then denies the exemption. Some of the Native Americans have taken their concerns to Commissioner Maryboy stating the Native American staff member is harrassing them. County Attorney Craig Halls was present and stated the County needs to have a standard by which to go by. There are different resident requirements for different entities. There is no determining factor of residency required in the Assessors office and if there is it is taken off a persons drivers license. After considerable discussion it was decided that the Assessors office should start a file to the Utah State Tax Commission in which they put all questionable applications, a copy of the persons driver's license, their signed affidavits of exemption and the Assessors reason for doubt. They will then send that file to the Tax Commission and the Tax Commission can then do an investigation of their own. Wanda Franklin/Road Dept. Ms. Franklin submitted a request for Tierre Patterson, south road foreman, to attend a refresher course for third-party testers. Tabled. Mike Pederson/Sheriff's Dept. Mike Pederson of the Sheriff's Department discussed the County's transfer policy dealing with certification. Commissioner Lewis stated that Mr. Pederson should have the administration of the Sheriff's department bring back a recommendation to the Commissioners at a future Commission meeting. Beer License County Clerk/Auditor Gail Northern submitted two beer license renewals for approval, one from the LaSal Store and one from the Mexican Hat Lodge. Commissioner Redd made a motion to approve the beer license renewals and Commissioner Lewis seconded. UNANIMOUS. Payroll Change County Clerk/Auditor Gail Northern submitted payroll changes for two San Juan County employees. One was for Lori Brandt moving her from part-time Justice Court clerk, grade 2 step 5 to full-time, grade 4 step 1, and the other was for Peggy Humphreys moving her from grade 4 step 30 to grade 8 step 14. The change for Mrs. Humphreys was not a promotion but a change because she had reached the final step on the payroll chart at her current grade. Commissioner Redd made a motion to approve the payroll changes and Commissioner Lewis seconded. UNANIMOUS. Payphone/Halls Crossing A request to install a payphone at Halls Crossing in the amount of $8,256.00 was submitted to the Commissioners. Commissioner Redd made a motion to approve the installation of the payphone and Commissioner Maryboy seconded. UNANIMOUS. Canyonlands Commissioner Redd made a motion to approve the Canyonlands Eco-system Agreement and Commissioner Maryboy seconded. UNANIMOUS. Bob Wagner Commissioner Redd made a motion to retain Bob Wagner for $4500.00. Commissioner Maryboy seconded. UNANIMOUS. PROCESS FACILITATOR EDWARD TAPAHA'S REPORT Roads Process Facilitator Edward Tapaha reported he had been tracking the South Hatch Road project dealing with historic preservation. That road number is HPD 93-381. He also stated the number of the road where the landfill will be at the bottom of White Mesa hill is 5578. Tuesday, January 11th he will go to Window Rock to check on the documents related to the South Hatch road project. Voter Registration Mr. Tapaha conducted a voter registration workshop this morning, January 10th, for the Blue Mountain Dineh Chapter. Schedule January 11th, Mr. Tapaha will be in Window Rock, January 12th, 13th and 14th he will be in Phoenix, Arizona and on January 18th he will be attending the Southeast Health District meeting. COMMISSIONER BILL REDD'S REPORT CIB Commissioner Redd reported on the CIB meeting last week stating they set up rules for what they hope to accomplish with the new landfill sites. AOC According to Commissioner Redd, the Association of Counties is creating, what they call, a Western Natural Resource Summitt and have asked Commissioner Redd to chair that meeting. He stated the caucus is going to draw, theoretically a proposed natural resource public lands bill. Meetings Tonight, January 10th Commissioner Redd will be in Price attending the Division of Wildlife meeting. Wednesday, January 12th he will be attending a Western Natural Resource meeting. Thursday, January 13th he has a Utah Rural Developement Council meeting at 5:30 p.m. Friday, January 14th Commissioner Redd will be at a Comprehensive Land Planning meeting. COMMISSIONER MARK MARYBOY'S REPORT Schedule Commissioner Maryboy will be in Salt Lake City most of next week attending various organization meetings. Bluff Library Commissioner Maryboy reported on a discussion he had with Rosalie Goldman concerning her request to get permission from the Commissioners to spend the $1500.00 she received from the Economic Developement Board on a hogan/story teller to be built in front of the Bluff Library. COMMISSIONER TY LEWIS' REPORT Meeting/DOE Commissioner Lewis will be meeting with the Department of Energy on January 11th at 12:00 noon. Justice Court Judge Interviews On Tuesday, January 4th Commissioner Lewis interviewed the two candidates for the position of Justice Court Judge. Corrections On Thursday, January 6th Commissioner Lewis met with Jail Commander Bill Christensen and discussed the floor/jailer positions. Schedule Commissioner Lewis will be meeting with Don Leske regarding the tailings clean- up on Tuesday, January 11th. He will be in Salt Lake City on Thursday, January 13th meeting with Dianne Nielson regarding the tailings clean-up. Friday the 14th Commissioner Lewis will be attending a UAC meeting.
