SAN JUAN COUNTY COMMISSION MEETING MINUTES JUNE 27, 1994 The regular meeting of the San Juan County Commission was held at 10:00 A.M. in the Commission Chambers at Monticello, Utah. Present: Ty Lewis, Chairman Bill Redd, Commissioner Rick Bailey, Administrative Assistant LaVee Scherick, Deputy Clerk Excused: Mary Maryboy, Vice-Chairman A motion to approve the minutes of the June 20, 1994 meeting as amended was made by Commissioner Bill Redd and seconded by Chairman Ty Lewis. UNANIMOUS. City Manager/Dan Shoemaker - Water Supervisor Clyde Christensen Monticello City Manager Dan Shoemaker and Water Supervisor Clyde Christensen approached the County requesting that the County not use any culinary water for fire or any other purpose without their consent. The County has made an agreement with the city that allows the city to use water out of Lloyds Lake and the County would bypass the coin operated box to allow use of that system. San Juan Water Conservancy/Appointment Two candidates for the vacancy on the San Juan Water Conservancy Board were presented. They are Trent Schafer, Monticello and Lynn Adams, Monticello. Commissioner Bill Redd made a motion that Trent Schafer be appointed to the board. Chairman Ty Lewis seconded. UNANIMOUS. Building Permits Two building permits were presented. They are Spanish Travel Development L.L.C. Moab, Utah for a wellhouse with basement; Michael Redd Blanding, Utah for a summer cabin at Blue Mountain Guest Ranch. Commissioner Bill Redd made a motion to approve the permits. Chairman Ty Lewis seconded. UNANIMOUS. Road Department Wanda Franklin/Road Office Manager - Max Ksiazkiewicz/Shop Supervisor Wanda Franklin has written a letter to Jose Herrera advising him that if he does not report to work by July 5, 1994 it will be assumed that he has voluntarily resigned. She has written a letter to Schafer Tire/Big A asking confirmation on their going out of business. Schafer Tire/Big A will no longer be able to honor their bid contracts for filters and tires. Wanda Franklin and Max Ksiazkiewicz requested that the original bids for filters and tires for the road dept be looked at. The original bidders have been contacted to see if they would honor their original bid quotations. They are Caun-Co Cortez, Colorado and Napa Auto Parts Monticello for filters and Grand Tire Moab, Utah for tires. It was proposed that the Big A bids be cancelled. Commissioner Bill Redd made a motion to cancel the Big A bids for filters and tires and approve the Caun-Co bid for filters and approve the Grand Tire Co. bid for tires. Chairman Ty Lewis seconded. UNANIMOUS. She submitted an accident report which occurred on June 21, 1994 for Heavy Equipment Operator/Eddie Barry with county road vehicle #225. Karl Barton/Heavy Equipment Operator Karl Barton requested that he not work under Larry Sorrell/Heavy Equipment operator while Tony Brandt/North Road Foreman is off. The Commission will make some different arrangements and let him know today. Edward Scherick/Planner-Personnel Drug Testing Edward Scherick presented a proposal for random drug testing of county employees by Dave Bancroft of Canyon Consortium. Mr. Scherick was asked to check with other entities for cost of this type of testing. No decision was made at this time. Planning Mr. Scherick presented and updated copy of the San Juan County Master Plan for review. Included are goals, broad scope of work to be done, planning steps, GIS effort, public involvement, laws, rules, regulations and policies that will affect the plan. Deputy Bill Pierce/Procedures, Salary & Inequities Deputy Bill Pierce asked the Commission to consider his position and salary and make adjustments accordingly. Mr. Pierce was asked to meet with County Personnel Officer Edward Scherick and he would report his conclusions to the Commission. No decision was made at this time. PROCESS FACILITATOR EDWARD TAPAHA'S REPORT This past week Edward Tapaha has concentrated on the elections with training poll and election officials and delivering their supplies. He will do follow-up this afternoon. ADMINISTRATIVE ASSISTANT RICK BAILEY'S REPORT Administrative Assistant Rick Bailey reported to the Commission on the Willow Basin fire discussing percentage and payment formula for the County, State and Forest participation in the cost of the fire. The Haller fire five miles east of Monticello is continuing to burn. The State of Utah has issued a fire ban on all private, State, BLM, U.S. Forest and National Park Service lands in Utah except hose in Daggett, Duchesne & Unitah Counties effective 12:01 A.M. June 29, 1994. Mr. Bailey presented an agreement from Municipal Leasing Credit Corp. in reference to the reassignment of lease for a fuel truck at Halls Crossing airport dated March 15, 1994. Commissioner Bill Redd made a motion to accept the agreement. Chairman Ty Lewis seconded. UNANIMOUS. County Attorney/Craig Halls County Attorney Craig Halls discussed with the Commission a Community Service agreement from the Justice Court. The form needs a liability responsibility statement of person accepting the inmates for community service. Attorney Craig Halls will check to see if the work/release program has a liability responsibility clause that could attach to this agreement. Public Hearing/Variance A public hearing was held for Jerry Adams Blanding, Utah requesting a variance on property at Blue Mountain Estates. There were no comments. A building permit for Jerry Adams, Blanding, for log cabin at Blue Mountain Estates was then approved. Commissioner Bill Redd made a motion to accept the variance and building permit. Chairman Ty Lewis seconded. Commissioner Bill Redd made a motion to close the hearing. Chairman Ty Lewis seconded. UNANIMOUS. Thelma Lansing/Senior Citizen Van Thelma Lansing called concerning the Aneth Senior Citizen mini van repairs. Commissioner Bill Redd made a motion to approve the request based on Aging Director Frank Morrell's approval and that it is budgeted by the department. Chairman Ty Lewis seconded. UNANIMOUS. COMMISSIONER BILL REDD'S REPORT Last week Commissioner Redd attended the Utah Association of Counties Board meeting. He also met with Lavor Webb of the Governors office. On Thursday June 30, 1994 he will attend the Multi-County Appraisal Trust meeting. Commissioner Bill Redd made a motion to accept the contract from the Governors Office of Planning & Budget for use of $40,000 for planning. Chairman Ty Lewis seconded. UNANIMOUS. CHAIRMAN TY LEWIS' REPORT Mr. Lewis received a letter from Bob Valentine, Division of Wildlife Resources concerning the hunting regulations. He requested that a letter be written to the Division of Wildlife Resources asking 1) Is Southeastern Utah region filled? If not a representative of DWR needs to come to Bluff with licenses to sell and 2) if it is filled a representative needs to come and explain the options to the Native Americans. Commissioner Lewis will be involved in the Utah Rural Public Land Council meeting on June 28, 1994 at 1:30 P.M. Mr. Lewis has no scheduled meetings next week. Lyon Hazleton/Justice Court Judge Mr. Hazleton discussed with the Commission again the need for a new computer system. Commissioner Redd, Rick Bailey Administrative Assistant, John Fellmeth Chief Deputy Auditor/Data Processor and all County Department heads will meet next Tuesday July 5, 1994 at 2:00 P.M. in the Commission room to discuss computer needs on a countywide basis. EMERGENCY DECLARATION Upon recommendation of Administrative Assistant Rick Bailey the Commission reinstated a Declaration of Emergency due to fire condition at Cedar Point, Haller Fire and the continuation of the Willow Basin Fire. Resolution 1994-02 is as follows: WHEREAS, the fire condition within San Juan Count is extreme and indications point towards a severe fire season, WHEREAS, a Stage 1 Fire Restriction was placed into affect as of 12:01 A.M. on June 29, 1994 which covers all private, State, Bureau of Land Management, U.S. Forest Service and National Park Lands within the County; WHEREAS, the Count is currently operating under a "State of Emergency Declaration due to the fire conditions; NOW THEREFORE, the San Juan County Commission has issued in connection with the Stage 1 Fire Restriction, the following restriction effective June 29, 1994 at 12:01 A.M. 1. No open fires, except campfires in improved campgrounds, picnic areas or homes. 2. No smoking, except in vehicles, building, developed recreation areas or locations in which vegetation has been cleared. 3. No discharging of fireworks. Violation of the above prohibited acts is punishable by a fine of not more than $5,000. 00 and/or imprisonment for not more than six months and/or appropriate State laws. Individuals or parties convicted of the above prohibited acts shall be financially responsible for all costs in responding and fighting such fire and for any damages to structures, crops and other damages. After a discussion with County Attorney Craig Halls a fireworks restriction was issued: "Due to the extremely severe fire potential and the resulting fires therefrom, the San Juan County Commission has decided for the safety and welfare of property and citizens, to BAN all fireworks in non-incorporated areas of the County except within those areas governed by City Councils and Tribal Authorities. Thank you for your participation in this declaration and we appreciate the help of the citizens of this County." Commissioner Bill Redd made a motion to accept the restriction.
